nightly rates, usually low. in one case, the scammer listed this house, 6,000 square feet for $450 per night. the real price is $2200. >> new year's eve i had lovely people here, 17 guests and 7:30 i get a call there are 20 people arrived outside, thinking they'd purchased this rental. >> the sheriffs try to track down the scammers, the best advise is stick with a legitimate company. use a credit card. what looks too good to be true probably is. in south lake tahoe, abc7 news. a 26-year-old humphrey chan was charged with felony hit and run resulting in serious injuries. police say his car struck a 65-year-old man jaywalking in millbrae. that man is still in the hospital, recovering.

uc berkeley is trying to change printers so a hacker can't make them print hate-filled flyers again. twice in a week people found flyer was racist messages. a known white supremacist says he targeted unprotected printers through the internet. cal is trying to upgrade security of the campus printers. they expect it to take several months. tonight, the san francisco police department finds itself in another racist texting controversy on the heels of a scandal. vic? >> reporter: the district attorney gave no names or stations but abc7 news learned one officer came from terra station and the d.a.'s office

dropped 13 cases from the rinl nal texting scandal. now, these new allegations. >> they occurred prior to, during, and after last year's scandal. and that involves five officers that are not connected to the original 14. >> reporter: the original 14 were caught exchanging offensive text messesages. the d.a. received 5,000 pages of evidence from the police department, stemming from a case involving officer jason lye, charged with looking into criminal offender information and found offensive messages from five officers. >> talking about african americans and using the "n" words, talking about members of the lgbt community in a

disparaging fashion. >> reporter: he says the texts are not criminal in nature but pose problems in court. >> the impact is our ability to present evidence, our ability to prosecute cases, and frankly, now, the possibility we're going to have to dismiss cases. >> the police chief says his office has known about the messages for a long time. >> it's possible the d.a. just found out his office is known about this since last year. >> suhr says there are four, not five, officers who exchanged the messages. >> four officers were suspended. since that time, two of those officers have left the department. one of the officers is jason lye, now charged as of tuesday. >> the fourth is referred for possible termination.

a bay area family is fighting for a law that could have saved his son's life. he died while getting a tooth extract extracted. the death pushed for caleb's law. >> there were probably 5 or 6 different steps along the way, having someone trained and just focused on that child would have prevented too much being administered in the first place. >> the bill goes before the assembly committee tuesday. the california dental association says it supports the review on the use of anesthesia. earlier week a 14 month old died while taken to the dentist in texas. the family of daisy torres says she was healthy when she went to

have a cavity filled. she was put under anesthesia and reportedly stopped breathing. new at 6:00 a plan to donate money to the victims of the san bernardino terrorist attack. nearly two and a half million dollars has been given to united way. the san bernardino relief fund committee decided how to divide it. here is the breakdown. 80% going to the families of the people who died. 15% to those wounded, and about 4% given to people who were present but not hurt. the plan will be finalized on monday and victims and families must file a claim to receive their share of the fund. the suspect seen in this surveillance video have been caught. they pried open a gate at the refer apartments in campbell. they broke into a storage room and stole several bikes, including one worth $3,000. police found that expensive bike and arrested brian smith and

steven fox. in oakland there is a battle over plans to build a condo the clarm yont hotel. there is a planning meeting tonight. alisa? >> reporter: the developer sent me a map, the condo would go here, where the parking lot is now. there are no plans to build anything taller than the hotel. robin can see the hotel from her back patio. the iconic building, a landmark of the east bay hills, a proposal to build on the property has neighbors worried. >> terrible. >> they're upset about a proposed 45 unit condo, how it would look, impact views and snarl traffic. >> it's difficult for people coming out of our street to even get on to tunnel road in the

morning and evening. so the idea that they build additional housing on the property would make it impossible to get it in now. >> reporter: flyers have been posted in the streets. >> it's not a very big project. plus or minus 22 acres. >> the developer will be there. he says a lot of the outrage is based on rumor. >> we want to make sure we're not detracting views and we want to make sure we're not detracting if views above us. >> the plan is to build a condo where the three-tiered parking lot is now. naomi shipp will look at any safety impacts this project could have to the more than 100 year old hotel. >> it's true the building is what is landmarked. the grounds are not. still, when there is impact that

will come into play. >> if approved it would likely not break ground for at least a few years. california is about to have the highest minimum wage in the nation. the state senate voted to raise the minimum wage to $15 an hour over six years. governor brown will sign it into law. it will increase about a dollar every hour until hitting $15 an hour in 2022. tonight we honor the life and legacy of late labor and civil rights leader cesar chavez. abc7 news was at the 261 union hall for a holiday breakfast. the supervisors, police and fire chiefs and others shared a meal as they honor the man who changed conditions for workers across the country. >> there is a community here.

intersense of center treat in moraga is deemed unusable and traffic will be diverted. repairs to the street will cost about $3.5 million and engineers can't figure out what caused this in the first place. repairs are finally complete tonight on a canalled sewer line caused by a sink hole that opened up in union city in october. crews are working to repair the street. westbound lanes between fair ranch road and freddit street remain closed. the cause is also not yet known. >> well, if you pay attention during the first game of the bay bridge series, you may notice

a virginia state trooper died after being shot during a training exercise happening a greyhound bus terminal. the troopers were questioning
