look at the case over all. david? >> reporter: today was the stubblefield's opportunity to lash out at the district attorney. his attorneys upset he was not given an opportunity to surrender and was arrested in front of his children's school. the woman stubblefield says he did have sex with but about not rape is under attack. >> i am not a perfect man. however, allegations against me coming a year after consensual encounter with another woman are all totally false. >> reporter: that statement likely points to a not guilty plea. he faces five felony counts including rape, and rape of a person incapable of giving consent. arraignment is a month away. the former 49er defensive lineman is accused of forcing himself on a 31-year-old woman described as developmentally

disabled. her name not being released. >> one of my primary charities is special olympics. something that is true and dear to my heart. this is why these allegations hurt me badly. >> the accuser had gone to his home over a year ago to interview for a baby-sitter job. his attorneys aren't convinced the woman is developmentally disabled. >> she ran a business. she had a driver's license, able to communicate on the web and asked dana for money more than 20 something times. >> the woman's ability to consent to sex or not will be a major aspect in this case. >> simply having a developmental disability does not in and of itself make you unable to consent to sexual intercourse.

votes. >> on the democratic side, abc news projects bernie sanders will win indiana. testing got underway to test the voting machines that will be used in the june 7th primary. officials started putting the ballots through the machines. >> to be sure it's for the election. they're calibrated correctly and able to read ballots. >> testing will continue until may 24th. the san francisco department of elections is live streaming on its website. the deadline to register for a particular party is may 23. you can request through the end of may. california's primary is june 7th. if you ever dreamed of flying a bay area company wants to make that dream come true.

florida's governor is in the bay area, recruiting companies to relocate to his state. it's a move that led california governor jerry brown to call out florida saying the two states aren't in the same league. rick scott says efforts are working. >> california is a beautiful state and there is now a minimum wage to compete globally. >> scott said he visited california last year and lured several companies to florida. when governor brown found out, i issued a letter saying california competes with brazil and france, not florida and asked scott to get his head out of the sand on the affects of climate change. >> apple reversed a long losing streak today. the stock
