captured after a long police chase. the van ended up on its side. one man tried to stop it before it began. vic lee is live at the fremont police department with his story. vic? the man is being called a hero by fellow volunteers and staffers at wheels on wheels. he told us he was simply doing the right thing. >> our vehicle is only about a year old which is another unfortunate thing. >> this is how it ended. the meals on wheels van up ended at the ramp off highway 580 in castro valley. this is after a police chase from fremont. the car suspects were transported to the hospital. the events started at smart & final in fremont. a security guard thwarted attempts to steal a car. they ran to the parking lot of a

city office that houses meals on wheels. the couple jumped into the van. >> about to grab my cooler. >> this volunteer, james vargas went into action. >> i see a big red jacket. grab this person. and struggle. and trying to get inside, i point out it fell on top of her. >> it turned out to be the female suspect. her companion vargas says got out of the van and threatened him with a landscaping tool. >> i said dent take the truck. we use it for meals on wheels. because of our meals for seniors. >> car jackers didn't care, they took off. unfortunately this is a new van, all they have now is an old back up. >> we use it to deliver meals to

isolated senior that's can't get out of the home. >> meals the seniors rely on. vic lee, abc7 news. in san skroes yeah, doctors are evaluating a man that caused a 12 hour stand off on top of a vta light rail car. crisis negotiators lured him down with a bag of potato chips. doctors are checking him for mental health or drug issues. police are investigating whether the suspect behind this seven car crash is also responsible for a shooting at a mcdonalds hours earlier. a police officer was shot in the head after the crash yesterday evening. he is now out of the hospital and is expected to be okay. the speshths suspect is in custody and may be involved in a shooting at that drive through in antioch. no one was seriously hurt in

that shooting. to the south bay, a man shot and killed by san jose police was obsessed with isis. that is the conclusion of an investigation into that shooting. abc7 news is live with the latest on the story. wayne? >> this is a shooting that left the officer dead with his can i killer. the district attorney call that had shooting justified. it's no surprise here at the san jose police department. let's show you video now to remind you. it happened march 24th. police officers responded to reports of an intoxicated man with a rifle. the officer was dead after being shot and the report said wanted to take lives and the investigation reveals he had been obsessed with isis, threatening to decap tate his

wife, and had a history of spousal abuse. and he was apparently bipolar and schizophrenic. the report says shooting him, the police department did save others from harm. the san jose police department declined comment, so did the police officer association, so did the district attorney of this tragedy is now closed. live in san jose, wayne freedman, abc7 news. >> wayne, thank you very much. the twin brothers believed to be responsible for a bebe gun attack have not surrendered to police like they promised to do. they did not turn themselves in today. the brothers are accused of using a bebe gun to shoot at a

woman next month. abc7 news was in a hearing accused of brothers accused of killing their parents. 22-year-old hasib gs golamrabbi and his brother are both being tried as adults. one former router thinks monday may come too quickly for the defense. >> when you hear about writings made after the homicide and the fact they both went to an anime convention shortly after the homicide, that is very troubling behavior and the defense wants to know, how does this play out? >> the writing was found on the home. one message wrote sorry, the first was messy. >> bay area congressman is talking to abc7 news about the

cancer diagnosis after announcing that he has leukemia. >> i'm great. and have gone through chemotherapy. the cancer is no longer in my blood system. i'm up to my old level of energy. >> the 64-year-old democrat represents parts of contra costa county. he says he'll fight for more funding to battle cancer and improve accessibility of costly drugs to those that can't afford them. the california company is moving from bay area to frisco. it's nearly 2000 miles from jamba juice's current headquarters. eric thomas looks at is taking business out of the bay area. >> the company thinks it can

save opinion by leaving this emeryville office building for the lone star state and they also hope they can drum up new business as well. >> jamba juice company headquarters will say goodbye to this office building and hello to frisco, texas, 120 jobs will be affected. >> some have been offered relocation packages. we'll see where that lands. people are processing the news now. >> the company says cost cutting was one factor in deciding to move but they also hope to beef up their presence back east. >> it gives us centralized locations, easy access to our franchises nationally. >> it's cheap year with the cost of living that is 30% lower than the east bay. these customers don't like losing the jobs but they understand the move. >> it's like everything else in the bay, man, it's so expensive

here. >> they're giving more people for other people, us in the bay area end up with the short end of the stick, huh? >> part of the problem is the porching of local businesses by other states, you'll remember florida governor rick scott was in the bay area trying to lure firms to his state, so far, texas is leading the pack. a survey out of southern california fiebdz that 219 businesses have moved to texas since 2009, or built new operations there. like tech giants apple, google, drop box and oracle, worth billions. but this official says that doesn't tell the whole story. >> as soon as they vacate, there will probably be 10 companies looking for the space. electronic cigarettes will soon fall under federal oversight after the fda released new rules today. the district failed to take

action after chem tri teacher was arrested last week. alleged texting began nearly two years ago. david louie is live with the latest on the story. david? >> the heart of the lawsuit is that the school district did not act fast enough to fire the school district. the suit suggests that a good number of minor students might have been exposed to sexual harassment. >> what has been thought it would take action so they're suing for negligence after she notified them about sexually explicit text allegedly sent by the chemistry teacher started october, 2014. but the teacher kept his job. >> if the district had done what they should have, he would not

have been able to engage in inappropriate behavior who are current, and former students. in a writer statement, the school district says the behavior was unprofessional and unacceptable but there was no criminal activity and did not require dismissal. there was no further complaints. catfishing is a term used to describe an adult mail posing as a woman to engage under aged boys. >> they protected an individual who admittedly engaged in unlawful sexual misconduct. many more children were harmed. >> the lawsuit leaves open the possibility to add more victims. >> it's not up to us to discern the connotation between an authority figure and a child, especially if it is sexual at

rainfall up to about a quarter inch. there is a possibility of isolated lightning and hail. this evening, we expect to have scattered showers at that point and during overnight and late night hours we'll see more scattered showers so will probably be a wet commute around the bay area, we'll get more wide spread showers and we'll continue to see wide spread showers into late night hours into saturday, areas of rain sweeping through but beginning to wind down late saturday and into the forecast, into sunday, early sunday, mother's day, a chance of isolated showers but most of the day, sunday, appears dry. we project rainfall totals by mid day saturday will reach up

. a 1, 2, punch for the tobacco industry. the fda tightened rules for e-cigarettes nationwide after california's governor raised the legal age to buy tobacco to 21 across the state. oof abc7 will look at the impact it will have on young smokers. >> this sign outside of the magic dragon shop will soon come down. as of june 9, california will raise the legal age from 18 to 21. >> to get a little buffer so we can survive is the hardest part. >> the cigarettes are battery operated nicotine inhalers.
