developing news in san jose. a bizarre officer involved shooting. a man attacked his own mother with an ax. >> san jose police shot that man who was carrying the ax. now they tell us the mother wasn't the only target. police still have streets closed off near lansing. that's where we find abc news reporter who is gathering new information. >> reporter: you can see they are still gathering evidence right now. police tell me the victim was struck in the head with an ax.

he attacked his mother in the middle of the street and tried to come after officers with the ax. it was two officers that shot the suspect. >> i don't think there was time to do any time of negotiation. it unfolded very quickly. >> police say the son and mother was taken to the hospital. the mother was conscious and speaking at the time. police don't know the condition of either mom or son. neighbors recall the chaos this morning. >> yeah, just about ten houses down. you should have heard the

sirens. it was going crazy. >> it's right down on lansing right here on lansing avenue by my house. >> obviously, this early on in the investigation there's more questions than answers. we spoke to family friend that tells us the 26-year-old son was struggling with mental illness. none of the officers who fired their weapons in this incident were injured. reporting live in san jose, abc 7 news. a correction officers finds himself in jail accused of molesting a young girl. anthony is accused of molesting the daughter of a woman he lived with. he assaulted the girl in the spring of 2012 while off duty. neighbors were pleased to see a deputy living in the house. now they can't believe the accusations. >> that's very serious.

i hope that justice will be served. what can i say? you don't expect that to happen. >> santa clara county sheriff released the statement saying the allegations are deeply disturbing. if they are true, they did not meet the standards of our office and he must be held accountable. he's being held without bail. two sheriff deputies are expected to turn themselves in. they were caught on video beating a suspect. period of timers have filed multiple charges. the footage shows them hitting him in san francisco's mission district. deputies chased him from oakland into the city because the car he was in was reported stolen. both deputies are on paid administrative leave. another call for scrutiny in the

san francisco police department. civil rights attorney are gathered right now on the steps of the city's hall of justice. they are calling on california's attorney general to investigation. specifically, they want the to address recent trouble officers including the scandal. they have called for a splar similar investigation. this family shaken up wu find. this morning the gaping hole caused a big headache for commuters. a lot of progress to report. you can see the heavy equipment has arrived. around 8:00 they decided it was safe enough to open a lane of traffic in each direction.

they just wait for people to fall into these things. it's embarrassing. >> reporter: it does appear this was a pothole that had been savsave paved over and turned into a sink hole before they could repair it. >> we're up to 15 miles a year. it's a lot of pipes we're getting in there and replacing. >> reporter: this sewer line was really old. it's been here since 1875. they say they will be here until friday not sure when they will be able to reopen. one challenge they are facing is the power lines ahead that are live. they have to get a ten foot clearance. makes it tricky to get their equipment in and out. they say getting these things fixed is not as easy as you might think. live in san francisco, abc 7 news. >> it's loud too. thank you so much. mountain view police say a medical issue is to blame for a

driver slamming his car into a building at linkedin. the crash happened around midnight. the driver was found about 100 feet from the car. the drooiiver has minor injurie. ten people are homeless after back to back house fires. one fire started after 7:00 p.m. last night just around highway 87. a firefighter suffered minor burns. another was treated for heat exhaustion. a cat died inside the home. two hours earlier, firefighters responded to a fire at a duplex. lawmakers in north carolina are taking another shot at a controversial bill that limits lgbt rights including transgender people to use the

bathroom that matches their birth gender, not the one they identify with. we have more on the developing story. >> reporter: democrats athey announced the bill this morning. it's an attempt to override the controversial house bill 2 that was passed in march. they repealing it is a civil rights issue and a business one. since house bill 2 went into effect, this mother of a transgender child says her sons struggles has been thrust into the spotlight. >> it must be repealed. >> reporter: she's pleading with lawmakers to over turn it for her son's sake and everyone who else is transgender. it seeks to replace house bill 2 with inclusive language that allows transgender people to use the restroom of their gender identity, not their birth. >> if you're a citizen, you should be treated equally.

that is my rock bottom belief. house bill 2 has cost the state its reputation and damaged the economy. public schools and universities stand to lose funding as well. it's my hope that before my harm is done, those who supported house bill 2 with swallow their fear and pride, and look for way out of mire of the state sanctioned discriminatory bill. >> reporter: on monday the federal government filed a lawsuit against north carolina. north carolina's governor responded with lawsuit against the department of justice. while no republicans have spoken out about the new proposed bill, state democrats say there's only one way forward. >> we lost half a billion dollars in economic interest, 4.5 on the line in education funding. i believe there will be a repeal vote. the general assembly is dominated by republicans who have attended despite backlash.

four students are going without solid food to demand more resources. for the second time this week, danny glover is on campus showing his support for the protesters. they are meeting with the strikers negotiating team and the school president says he's committed to negotiating in good faith and hopes the students will end their hunger strike immediately. police are asking for help to find a protesters who shattered a window during donald trump's rally. he used a metal chair to shatter a window at the state's gop convention five people were arrested in the clash that happened outside the hotel.

one san mateo deputy was i kicked in the face while making an arrest. paul ryan says the republican party needs to unite to win the presidential election in november. >> to pretend we're unified as a party after coming to a bruising primary that ended like a week ago, to pretend we're unified without unifying then we go into the fall at half strength. this election is too important to go into an election at half strength. >> ryan is scheduled to meet with donald trump tomorrow. last week ryan said he was not ready to endorse the billionaire businessman. on the democratic side, vermont senator bernie sanders picked up a much needed victory. hillary clinton is holding onto her 800-delegate lead. sanders needs to pick up 98% of the remaining delegates to secure the nomination. sanders is gearing up for rally

in minnesota. new clues surrounding the de death investigation of prince. a minnesota doctor saw the singer twice before his death. he prescribed medicine for the singer to be filled at a walgreens. authorities are executing a search warrant on that store. no word on the exact prescription or if prince took the drugs. friends and family say it's a secret pain was taking medication for his hip problems. pittsburgh chp have not explained why this is happening. we'll bring you more information as we get it. you can follow us on twitter. the sunshine is slow to come out here in san francisco. that's going to lead to widespread today. nearly 25 degrees.

the inland east bay this you can see on our satellite, haven't seen the sunshine first along with the south bay. temperatures there are a little bit warmer than the rest of us. 77 already your way to the mid-80s. some low to mid-60s. coming out of this layer. it does look pretty grim or gray . more peaking inland tomorrow. cooling for all of us friday. it's back to seasonal temperatures. that's your spread to south bay. we'll have 80 in mountain view. most of the peninsula is in the mid to upper 70s. the exception will be at 71. we'll have upper 50s to mainly low 60s along the coast.

65 in downtown san francisco to about 68 in salsaletto. low to mid-80s there. freemont 79. as you go through that area, even warmer temperatures. have to go to the same this afternoon it will become sunny and a little breezy. could get up around 25 miles an hour. temperatures to mid to upper 60s at at&t park. if you're venturing outside, watch out for pollen. it's trending up. as far as lows, how about mid-50s with clouds coming back in the same area as we had this morning. could hit 90 tomorrow. we'll touch mid-70s around the bay. notice about 5 to 10 degrees
