>> announcer: live from the kgo-tv broadcast center, this is abc 7 news. good afternoon, and thank you for joining us on this friday. i'm ama daetz. >> and i'm larry biel. there's a growing controversy today as public schools received a federal directive to allow transgender students access to restroom facilities matching their gender identity. now, critics are calling this blackmail. here's abc news reporter brandi hitt. >> reporter: from georgia -- >> i will stay home every day and homeschool. >> reporter: to ft. worth, texas, anger and frustration as parents pack school district meetings over whether franz gender students should be be allowed to use public school bathroom and locker rooms of the gender they identify with. >> transgender students are our neighbors, and they are all of our children. >> reporter: and for the students themselves, they say

the bullying has become outrageous. >> i was beaten up. >> i started skipping school because i didn't feel safe in school. >> reporter: now the obama administration says at the request of school districts, it's issuing what it calls a letter of guidance, detailing how schools can ensure transgender students' legal civil rights suggesting schools provide access to an alternative restroom, adding curtains could easily be put up in locker rooms. >> it's not an enforcement action. it does not add a requirement to the applicable law. >> reporter: but critics see it as an ultimatum, that if they don't comply, federal school dollars may be withheld. >> we will not yield to blackmail from the president of the united states. >> reporter: earlier this week, the federal government and north carolina sued each other over that bathroom law. now it appears texas is ready to join the fight. >> i am working with the governor of north carolina, and we are going to fight back!

>> many lgbt groups are praising the obama administration's letter of guidance, one texas school says they're throwing it straight into the shredder. brandi hitt, abc news, los angeles. >> two years ago, california became the first state to ensure rights for transgender students in schools. >> access 7 news reporter laura anthony joins us live from elsa reit toe high. >> reporter: california and the bay area are well ahead of other states when it comes to accommodating transgender students on public school campuses. in 2014, the state enacted the law the school success opportunity act requiring school districts to provide access to school programs and facilitys consistent with their gender identity. here at el sa reit toe rye school, frints, that meant there is access for transgender students for school bathrooms but that was just one step.

marcus walden is a spokesman for the west contra costa school district. >> the state of california passed ab-1266 in 2013 and the bay area and this school district have been advocates and champions for civil rights for a long time so this hasn't been much of an issue here. >> transgender people are what they want to be. like the whole point of the united states is to be free to be who you want to be, do what you want to do. >> reporter: today california superintendent of schools tom tore lick son issued a statement saying, quote, i strongly support the action by president obama to make sure all states follow the lead of california and protect the rights of each and every student. now, besides the bathrooms, california schools are required to make locker rooms and other facilities able to accommodate transgender students without harassment or discrimination. tonight on abc 7 news at 5, we'll hear from some of the students heret el sarito high about how they think the law is

working here. laura anthony, abc 7 news. >> laura, thank you. we will see you at 5. a construction worker was crushed to death while operating equipment in san francisco around 8:15 this morning. people say the man was worked inside a ramp that goes below ground e. was standing atop a cherry picker when he hit a concrete slab. no one else was injured. cal osha is investigating. there have now been 20 shootings on east bay highways since notchmevember. last night the latest. the 25-year-old driver was shot in the leg. he was treated at the hospital and reemsed. officers aren't saying whether he was targeted. they say the shootings appear to be gang related with different gangs involved. for the first time, we are hearing from the attorneys defending two alameda county sheriff's deputies accused of beating a man. several charges have been filed against luis sant maria and paul

wieber. this video shows both of them hitting stanislav petrov. >> if two police officers are assaulted with a deadly weapon and then they lead this chase and you have this guy who is a career criminal, why not file? it's your county. it's your citizens. >> the defense says the surveillance video is a key piece of evidence and will help them prove their client's innocence. we have new details regarding a south bay gym owner accused of sexually assaulting female clients. abc 7 news was in morgan hill as a sheriff's deputy handcuffed the man and led him back to jail. two more women have come forward saying he touched them bringing the total number of allegations to seven. two of the victims are teenage girls. wolfsmith runs the wolfpack gym in morgan hill. a judge raised his bail from $100,000 to $325,000 because of concerns for public safety.

let's turn to the weather and our weekend's forecast coming up. we have a live look outside from our mt. tam cam. clear a little bit hazy there. >> a little bit of haze in. spencer christian is here with what's ahead for the albuquerque r weekend. >> ama and larry, as the week winds down, our temperatures are coming down as well. here is a look at live doppler 7 hd. despite the mostly sunny skies we have now, a cooler pattern has developed. here is our 24-hour temperature change. look at the inland areas. nine degrees cooler in fair fooel and concord than at this hour yesterday. 10 degrees cooler in livermore and 15 in antioch. many locations right around the bay and near the coast are a couple of degrees milder actually, but the entire region will experience a cooldown as we get into the weekend. here is the view of the golden gate bridge under mostly sunny skies, 61 agrees in san francisco, 66 in oakland. we've got 69 in mountain view and san jose, 71 at morgan hill and fin at half moon bay. this is the view of partly cloudy skies over sfo, 68 in santa rosa, napa 77, 71

fairfield, mid to upper 60s at concord and livermore. here is a forecast animation starting 5:00. drizzle will develop overnight and there is a pretty good chance of a line of coastal drizzle approaching the bay area during the overnight hours, which may necessitate umbrellas and windshield wipers early tomorrow morning. i'll have the accuweather forecast. work to replay a breeken sewer main that caused a sinkhole in san francisco is under way. that work began this morning to replace the 140--year-old brick main. the 12 by 5 foot sinkhole appeared on mission and a car got caught in it. no one was injured but the work is expected to wrap up tomorrow. governor brown released his revised budget today, the $122 billion ldz plan is slightly less than his january proposal due to a $2 billion drop in rejected tax revenues. the governor says state leaders

need to anticipate leaner times so they won't repeat the budget mei takes of the past. >> instead of pulling back in the last two recessions, the state of california accelerated its spending and therefore made the budget cuts all the more painful. >> the governor's budget now heads to the legislature for a month of intense negotiations. by law, legislators must send the governor a final spending plan by june 15th for the fiscal year that begins july 1st. america's homeland security boss is taking action to try to shorten the wait times at airport security checkpoints. secretary jeh johnson announced today the tsa will immediately increase the use of overtime and will accelerate the hiring of 768 new transportation security officers. this move comes in response to passenger and congressional outrage over hours-long lines at checkpoints at u.s. airports in recent weeks. what was supposed to be a relaxing vacation for a fairfield couple, oh, man, turned into a dramatic ordeal.

>> that couple became involved in a rescue right before they were supposed to be heading home. chris nguyen has the story. >> reporter: for denise burnham and her fiance todd buckley, it was initially all smiefls thursday afternoon as they flew over the river in maine. but the joy and excitement quickly turned into shock. >> anyone many a situation like that is going to respond. that's just in our nature. >> reporter: speaking to us via skype, the couple who are both licensed private pilots from fairfield spotted a paddle boater in distress. >> you don't know why they sunk. you you're kind of saying, this is what it looked like, what happened. but you don't want to end up causing more people to be in danger. >> reporter: the couple enlisted help from a family who was on the other side of the river. that family agreed to take their boat out to help rescue the man, but that's when things took a turn for the worse. the family tried towing the man's paddle boat but ended up ripping out their engine. on board a husband, wife and three kids as well as the man they tried to rescue.

burnham and buckley sprang into action from their seaplane. this time buckley tried to help the people to shore. burnham stayed in the plane to help warm up the children. >> it was kind of an upsetting and frightening experience. just want to keep them calm but also take action, get everybody moving quickly. >> reporter: all of the people involved are expected to be okay. the fairfield couple say they've since loerp learned that the family that tried to help didn't have insurance because the boat was brand-new. they're hoping that people in maine will come together to help them out. >> it's kind of just a bummer, right? they go out, want to do a good deed and help a person. we encourage people to help each other. >> reporter: chris nguyen, abc 7 new. still ahead, a growing scandal in the oakland police department. at least three officers accused of misconduct. we'll tell you what they're accused of doing. and cheaters exposed. a new study finds about 25% of carpoolers aren't really carpoolers. and dubs fans come out in force to check out steph curry's

a steering problem. subaru says steering columns on the vehicles may have been manufactured improperly by a parts supplier. thousands of gm suvs won't be sold at least as of now because the gas mileage is wrong, afking all 2016 chevrolet traverse, acadia and enclave models including those that have already been sold. gm says it's printing new stickers. google is hiring drivers who will probably never even have to drive. the drivers will help pilot google self-driving cars. google wants to road-test the cars in phoenix and they need people to sit behind the steering wheel for six to eight hours a day. just sit there. my kind of job. drivers will need to be be able to take control of that car if necessary. >> apple has shelled out $1 billion to invest in the chinese ride share company dd. dd operates in 400 cities and wants to use the investment to

and let's not forget about the san jose sharks who have also made it to the western finals in the nhl. their first game against the st. louis blues. last night the sharks completely dominated nashville. they won 5-0. this will be the sharks' first western conference finals appearance since 2011. the sharks during the regular season went 2-1 against the blues this year. so encouraging and really cool to have both the warriors and the sharks going at the same time. >> oh, yeah. time to check on the weather because it is the weekend. >> yes. spencer christian is here. wre anxious to know what the forecast is. >> stay tuned. i've got it right here. let's go right to live doppler 7 hd and relieve your anxiety. we have partly sunny skies right now. clouds will increase during the evening hours and we might see some drizzle. right now drizzle free from our abc exploratorium camera.

spotty drizzle may appear overnight into the early morning hours. generally a cool and breezy and dry weekend after the morning drizzle. next week, we'll see a bit of a warm-up monday through wednesday. and on we go to overnight conditions. we'll see low clouds and clouds above mid-level as well increasing during the overnight hours, low temperatures mainly in the low to mid-50s, again the chance of spotty or patchy drizzle mainly near the coast. here is our forecast animation starting this afternoon. right now, we'll see low clouds and coastal drizzle, the possibility of it, increasing by about 11:00 p.m. if you're out driving, you may need the windshield driver wipers, may want to carry an umbrella. the chances increase overnight as the line of drizzle approaches us. it will pass through quickly. the air will be dry after that. cooler air will follow the frontal system and that will take us into a generally cool weekend. so tomorrow's highs look like this. we'll see rain from about 60 in

the coast through mid and upper 60s at the bay, maybe a couple of bay shore locations will hit 70 tomorrow. and we'll see low to mid-70s in the mildest inland locations. looking at the week ahead, though, we can expect a bit of a warm- warm-up. we'll use san jose as our indicator of what inland areas can expect over the next couple of days. temperatures just a little bit below average, low 70s in san jose over the weekend. up to 78 on monday, just above average, then tuesday and wednesday we'll see mid to upper 80s in san jose, well above average. and that is the pattern that most of our inland locations will see over the next seven days. let's go on tthak you wirth seven-day forecast. after a weekend of clouds and maybe drizzle, cooler than average temperatures and breezy conditions, we'll start to see sunnier, warmer conditions on monday. looks like the warming will peak around tuesday most inland locations, upper 80s in the warmest spots, around 80 in the bay, upper 60s on the coast.

chosen gender identity or risk losing federal funding. the goal is to remove discrimination against transgender students. the lieutenant governor in texas is telling school superintendents there to ignore the directive. for the first time, a woman will lead a u.s. military combat command. world news tonight tweeted about the historical appointment of general lori robinson. she'll need northcom and norad. a federal judge has thrown out a gun charge after surveillance video contradicted a police officer's sworn testimony in court. coming up at 5, vic lee shows us the video and what it means for the officer. in oakland, the police sex scandal tied to the suicide of an oakland police officer and his wife. a news conference will getter under way in about a half hour. right now abc 7 news reporter melanie radioed woodrow has the details on the scandal involving an escort who may have been under age. >> reporter: oakland police officer says three officers are

on paid administrative leave following an investigation into allegations of sexual misconduct. law enforcement sources say the misconduct involves the daughter of an opd dispatcher who may not have been 18 when the contact began. attorney mike raines says his office is representing the officers. charges have not been filed. >> it's tragic if the district attorneys succumb to media pressure and don't make charging decisions based on the evidence. >> reporter: sources say the investigation is connected to police officer brendan o'brien's suicide in september of last year. the coroner's report says, according to a note of intent he left at the scene, he was suicidal and a series of events regarding his wife and work prompted him to commit suicide. according to a second coroner's report, o'brien's wife committed suicide the previous year with her husband's off-duty weapon, following an argument the couple had. oakland major crimes initially treated her death as suspicious. attorney john burse is a member

the low income housing crisis in san francisco is getting a major boost from a highly respected nonprofit. >> abc 7's sheryl jennings went beyond the headlines to show you

who the tenderloin neighborhood development corporation is helping. >> reporter: these seniors range in age from their mid-60s to 100 years old and they feel very fortunate to live in a building run by the tenderloin neighborhood development corporation in san francisco. it provides quality, low income housing to 3600 residents in 33 buildings, more affordable housing is on the way. 40% of those served are seniors. these exercises are just some of the many activities seniors get to enjoy who are part of the family. and they go on outings together. this group is headed to the san francisco zoo, the low rent helps people like ms. chen to pay for food and other costs for her and her husband. >> we totally pay almost more than $4,000 in cash. just for medicine. >> reporter: the seniors live in this beautifully renovated old church in the haight district of

nobody is paying any attention to her credit report, which means they can run wild with it. we get cases like this where nobody knows about it until the kid graduates from college. then they go to buy their first car or get their first apartment in their name and all of a sudden they have ruined credit. it takes a couple of years to unwind all of this. i'm glad you care about it. check their credit report uf say they don't have one. hopefully not. but if the bad guy vz stolen their social security card, they may have set up fake credit in her name. what i want to you do is go to annual credit report.com. go there, say probably the parent will have to sign on and do it, then you can check your child's report. >> i was cleaning and found some old irs tax return checks from 2001 and 2003. are they still valid? what should i do? >> okay, checks themselves aren't officially valid after six months. you can go to the irs. they say they will help anybody that has old checks that haven't been cashed, but it's quite the process. what i want you to do first is

just try to deposit them and see if they go through your bank system and go through the irs system. if it does that, then you're done. don't go spend that right away. put it in and wait about a month to make sure everybody is cool. if everybody is cool, go ahead and spend it. if that doesn't work, i want you to contact the irs. they say they'll help anybody with an old check. they would not tell me exactly when we looked at this earlier how far back they're willing to go. there you go. >> i have a ticket to alice in wonderland that was canceled when they closed/went bankrupt. any way to get my $200 back? >> no, you can't get your $200 back. but i've got some great news. the other art agencies down in the silicon valley are honoring those tickets for their events. so the ballet is closed an symphony and opera and other organizations will accept your tickets. you're going to have to have

the story you'll see only on 7. vic? >> kristen, among prosecutors and defense lawyers, there is a term they use for this. instead of testifying they call it test i lying. that's apparently what happened in federal court yesterday at a hearing. then came a video which the san francisco public defender's office gave to the suspect's federal lawyers. federal prosecutors had no idea that lawyers for brandon simpson, the suspect arrested with a loaded gun, had the security video, evidence that would result in a dismissal of the case. officer nicholas buckley had signed this sworn declaration detailing the arrest last december in the tenderloin. he was testifying yesterday in federal court before judge charles breyer. he repeated what he said in his declaration, that he and his partner had just broken up a dice game on eddie and taylor streets, that he engaged simpson who looked suspiciously at him, ignored his commands, acted aggressively, and tried to

sprint away up the hill. buckley and other officers took him down and arrested him. that's when they found a gun. public defender jeff adachi has a different account. >> they went into court and just told bold-faced lies to the judge and to the u.s. attorney. >> reporter: after buckley testified, simpson's lawyers showed the court a security video from an apartment building near the intersection. it shows officer buckley and his partner arriving first and breaking up the dice game. they interact with simpson. there's no evidence he acted aggressively nor did he try to escape by sprinting up a hill. they grab him quickly and take him down. other cops arrive and help as they struggle with simpson on the ground. >> they went up to this man and basically grabbed him for no reason. >> reporter: after viewing the video, prosecutors asked judge breyer to drop the charges. the judge said the officer purr jurored himself and it was an affront to all of
