sent tissue samd ams to a lab to determine the exact cause of death. pet smart has said it takes full responsibility for the pets in its care. a few pet owner hz not heard about the incident until we told them. do you have any concerns? >> now i do. maybe i'll go ask what happened. >> reporter: some are calling for legislation to require that all groomers be certified. >> i think they definite live should have background checks. yeah. that would be good, certified would probably be a step in the right direction too. >> reporter: the case has been given to the san mateo county district attorney's office and handed over to a prosecutor with vast experience in animal abuse cases. in san mateo, abc 7 news. a shooting investigation shut down part of an east bay park this morning. the news was at san pablo park in berkeley where you can see police searching for clues at the crime scene. the gunman is still on the run following the shooting. it was about 11:00 this morning. neighbors called police reporting gunshots when officers

arrived they found one man just outside the park's bathrooms badly wounded. >> the crime scene technicians are collecting evidence. officers are canvassing the neighborhood talking to any potential witnesses. >> the victim was critically hurt and is now in the hospital. today's case is the 13th shooting in berkeley this year. a former surgical technician accused of groping patients under anesthesia at stanford is taking a plea deal. he is accuses of fondling four males the youngest 16.

labels on sugary drink ads in san francisco. a federal judge today refused to block the city law that is now set to take effect july 25th. the american beverage association claims the ordinance violates soda makers' first amendment rights and the group could appeal today's decision. tonight the city of san jose is expected to take a stand against two states accused of patting discriminatory laws north carolina approved its bathroom law that can be difficult for transgender people and in mississippi anyone can deny services to members of the lgbt community if approved the resolution in san jose will ban all non-essential travel to those states and cut off ties to businesses headquartered there. san francisco already established a ban. in the marin county community of bolinas art has been a tradition for decades but now it's changing some say for the better, others say for the worse. abc 7 news reporter wayne freedman joins us live from bolinas beach where the big controversy is in a small town.

>> reporter: well, as the saying goes art is in the eye of the beholder. in bolinas traditionally this is what they call art. these murals along the beach. at ba lean noose. but these murals have been evolving and judgments about this art have been changing. it's been going on for a while and now it appears to be getting personal it's the last place you would expect to find a graffiti problem, bolinas in west marin county. if you don't know where you're going, good luck finding the place. >> every time they put a sign up, the locals tore it down. >> reporter: why? >> because they wanted to keep it quiet. they wanted to keep people out. >> reporter: about that they are unified. though lately some bolinas residents have taken sides regarding these murals along the beach. >> freedom of speech versus private property. >> reporter: the distraction about art graffiti and garbage has escalated for three years what began as rather beautiful painted murals have now shall we say evolved? >> art is definitely in a place

"consumer reports" tested dozens to find out which ones deliver on their spf promise. there are a lot of options when buying sunscreen. a survey from "consumer reports" found that even people who regularly use sunscreen don't always have a good understanding of what they're buying. >> people look at the spf or sun protection factor and that's very important. but it's only one part of protecting your skin from the sun. >> the spf is a measure of how well 8 sunscreen shields your skin from uvb rays, which penetrate the top layer of skin and are the chief cause of sunburns. uva rays penetrate deeper into the skin and can contribute to wrinkles. both uva and uvb rays can increase the risk of skin cancer. >> "consumer reports" recommends

using a broad spectrum sunscreen so you're protected against both type of rays. >> "consumer reports" test over 60 sunscreens to see whether they deliver the protection they claim. the uvb tests, technicians apply sunscreens to panelists' back and have them soak in a tub for 40or or teti minutes depending on the product's water resistance claim, then the area is exposed to uvb light. the next day the test area is examined for redness. more than 40% didn't have the spf they promised. to check uva, technicians pass uva light through sunscreen samples. again, some had problems. but "consumer reports" found some sunscreens aced the test and are a good value. among the best, pure sun defense spf 50 for about $6. equate ultra protection spf 50 for about $8. and no ad sport spf $50 for $10.

whale calf off the coast of car met. on saturday, the fishermen say it took place in water about 100 feet deep. they say the calf's mother tried to protect it but just could not. those fishermen believe this may be the whale calf that was attack. it washed ashore yesterday at salmon creek beach in smoem na county before washing back out to sea last night. the whale washed back to sea before a crew from the marine mammal center could perform a nem ropcy to determine the cause of death. votes are still coming in for kentucky's democratic presidential primary. the results are still too close to call. we'll show you the latest. bernie sanders leading hillary clinton right now by just 0.8% with 67% of the precincts reporting so two-thirds of the votes counted. and the lead has gone back and forth between the two. by the way, oregon also has republican and democratic races tonight. we'll continue to watch the results for you. in the south bay, local politics are turning ugly.

two candidates for public office say they've been bullied by a current state senator. a charge that's been strongly denied, as a political smear. abc 7 news reporter chris nguyen has the story. >> reporter: in san jose this afternoon, strong words from democratic district 27 assembly member nora calm poe. >> it takes a lot of courage and a lot of strength to be able to stand up. >> reporter: taking a stand against her opponent democratic state senator jim bell in the race for the 15th senate district which covers much of silicon valley. the assembly member says she's been the target of bull yig and intimidation from bell. today she was joined by current supervisor darcy green, herself a candidate campos' position.
