in the east bay. a freeway shooting sends a driver to the hospital. it shuts down interstate 80. tonight we have learned a stray bullet hit another car. good evening and thank you for joining us. i'm ama daetz. >> i'm dan ashley. the shooting happened around 9:30 on eastbound interstate 80 before highway 4 in hercules. >> one person was injured around 9:15. two eastbound lanes are closed west of highway 4 and four lanes have been closed at pinole valley road. traffic in the area is heavy and we have a reporter on the scene and she will join us live in a few minutes. meantime authorities are on the lookout for a father and daughter from antioch. both are missing. kyler jackson and 1-year-old daughter kailey left for sacramento and never showed up. the family is worried and hopes someone spotted jackson's car on highway 160. they have been driving the route all day looking for any sign of these two. they have reached out for help on social media.

in the east bay tonight a train accident with tragic results. a mother and her toddler were killed when an amtrak train slammed into their suv. it happened on washington avenue in san leandro. and late tonight the alameda county coroner identified the mother and daughter as vanessaen recommittees and 3-year-old sadie. cornell bernard is live at the scene of this tragedy with developing details. cornell? >> reporter: dan, tonight the train tracks are reopened to traffic after two lives were lost here today. vaw net sawen -- vanessa's family told us where the busy mom was headed before the crash. >> sky 7hd was over the crash. a toyota suv hit head on by a busy amtrak train. first responders confirmed the worst. >> we have one female driver and one child approximately

three years old. >> 30-year-old vanessa enriquez was there with her 3-year-old daughter, sadie. the family is devastated. he calls vanessa a dedicated hard-working mom. he says vanessa was on her way to pick up her son who has autism, but she didn't arrive and police were called. there was traffic on washington avenue at the time of the crash. police say enriquez was trapped in the on coming train. >> it appears it was stopped in traffic right on top of the track. >> i have two kids and it is just -- it hurts my heart. >> jackie is always careful near this rail crossing. >> i stop before the track. if there are cars, i stop. >> on monday a pedestrian was struck and killed less than a mile from here. a mother and daughter now gone. a sad, sobering reminder about danger on the track.

cornell bernard, abc7 news. and now more on a christmas day shooting in san leandro. they released this video showing palo alto police officers opening fire on a mentally ill man. investigators say the shooting was justified because the man came at them with a weapon. lisa amin gulezian is live in san jose with new details on the weapon and the investigation. lisa? >> reporter: this is the d.a.'s 30-page account about what he says went down that night. in fact, it goes through eyewitness accounts, the dispatch logses and step by step details. >> reporter: it took 19teen seconds before police shot william wrath. he suffers schizophrenia and claimed a violent person was on the loose. when they arrived they found him in the street waiving this dinner knife.

facility staffers said it was a butter knife. >> just because someone is holding something that look like a knife, but when they know it is just a butter knife , that's not a situation where they get to kill the person every time. >> the d.a.'s report says, quote, the fact that the knife used was a dinner wear knife does not make the situation less threatening for the officers or their actions less justified. the knife used could be used to inflict a fatal wound or a serious injury. they concluded that he wanted to die at the hands of police. >> this person had a disability. they had to have a different response from the onset. >> social justice advocates wonder if more could have been done to de escalate things. those in the neighborhood are just glad it is over. >> it hasn't made me feel less safe or less concerned. >> next month wrath's mom will file a civil suit against the

officers. lisa amin gulezian. the sanctuary city policy will likely change. supervisors unanimously approved a measure that grants the sheriff the ability to contact ice when a defendant has prior felony convictions. it also clarifies when police can notify federal officials about a person's immigration status. the bill now needs the mayor's approval. people protesting donald trump clashed. video shows a scuffle being broken up after they set a trump flag on fire. at one point they tried to rush trump's event, but police blocked their way. they threw burning t-shirts and bottles at officers and their horses. police tried to clear the protest with smoke grenades, but the protesterses stayed on anyway. at least one person was arrested. hillary clinton won the primary in washington tonight. although the votes meant nothing they claimed 74 of the state's delegates at the caucus in march. clinton got 27.

now we are two weeks away from the california primary and hillary clinton spoke in riverside. tomorrow she will be in salinas and then atherton before a second san jose event on thursday. bill clinton spent the day stumping for hillary in fremont and san francisco. >> bernie sanderses spent the day in southern california where he told californians we will not stand up for somebody who insults america's minorities. >> the american people understand that we are great as a nation because of our diversity. >> sanders will be back in riverside county tomorrow and then in ventura on thursday. all right, let's turn now to the warriors. boy, it was a night fans would like to forget. the dubs fell again to the thunder and are one game away from elimination in the western conference finals. >> let's get to mike shumann. >> it was a tough thing to watch, back to back losses for

the phone with us tonight. the chp just asked her to move. katie? >> reporter: yeah, dan, the problem seems to be we got on the scene so quickly we got a little close. when investigators go the on the scene they determined we may be in the crime scene and we had to move immediately. that was at the top of the hour. we have moved to the westbound lanes. i am looking across all lanes of traffic back at the scene. the traffic action report is basically at a stand still. there is just one lane going past the scene. i can tell you it happened just before 9:30 that the chp got a report of a shooting. i want to roll this clip and show you what appears to be the victim. they say it was a male driver who was taken to the hospital. i don't have any information on his injuries at this point, but he was in a red car and the bullet holes are visible along the driver's side of the red car , and the chp tells me there are at least two people in the car. now there is a second car, a silver car that you are going

to see in the video here. that car appears to have been hit by a stray bullet and not an intended target. that silver car had its window shatter ited. no one -- sat -- shattered. this is the seventh car to car shooting on this stretch of highway. highway 80 and highway 4 area in the past 11 months and one eastbound lane is moving on highway 80 past the scene. both the red car in which the shooting victim was inside and the silver car that had a window shattered by a stray bullet are still on scene as chp investigators continue to look into what happened here. dan? >> thank you very much, katie. turning to other news tonight a silicon valley tech billionaire reportedly funded the lawsuit hulk hogan filed against on-line news and gossip site, gawker. he won a $140 million lawsuit against the website over the

publication of a sex tape. they say paypal co-founder funded the lawsuit. he has spoken out against gawker in the past for a story about his sexuality. a rival to tesla motors could besetting up shop close to its competition. los angeles-based faraday wants to build a factory in vallejo. this is video from the youtube channel. he is eyeing the former mayor island naval base. they say the goal is to build the next generation of electric vehicles. >> making their mark on the ballroom floor. dancing with the stars has crowned the season 22 winner. >> it came down to the final seconds. now, our sister station in los angeles has a look at the finale. >> "dancing with the stars" is clearly over for another season, but for the winner it is just beginning. he hopes his victory will make a difference for deaf america. now that he has won "dancing with the stars" the deaf model

abc7 news. >> season 2 3 already. people just love it. time to turn to our weather. >> sandhya patel is tracking some changes for us, sandhya. >> we will see the temperature sore, but not immediately. don't worry. let me show you live dopler 7hd. right now we are seeing extensive cloud cover across the bay area. look at those temperatures. they are in the 50s across the entire region. it is cooling down nicely. from our tower camera looking toward san francisco, the visibility is good. we don't have any issues there. spotty drizzle for the morning commute. below average temperatureses will continue. then a warmer pattern is setting up as we hit the holiday weekend. here is a look at what will happen overnight. the clouds will remain with us. tomorrow morning there are a few areas where it will be damp because of the fact we are expecting some mist and drizzle. temperatures will begin in the upper 40s to the mid50s. it is cool enough to where you will need to grab that extra layer when you get going in
