family remains hopeful. >> we have hope and faith that she's going to come home. shaes going to be safe. we're going to find her. it's heartbreaking not having her. >> pinson's neighbors told abc 7 news that the suspect fernando castro would cruise their vallejo neighborhood asking women and teenage girls including pearl for sex. the family of kate steinle filed a federal lawsuit today blaming the government for her killing last summer in san francisco. >> abc 7 news anchor kristen sze here now with details on that lawsuit. krist kristen? >> kate steinle's family says missteps by three agencies led to her death. the lawsuits is directed against the bureau of land management, immigration and customs and former san francisco sheriff. the 32-year-old san francisco woman was walking with her father at pier 14 last july when she was shot to death. an undocumented immigrant and felon is charged with pulling the trigger. juan sanchez had been previously

forted five times. the gun he ufzed was stolen out of the parked vehicle of a bureau of land management agent. >> if you are going to leave a gun, you make sure that it is in a locked and secure box. pictured just like we have one right here. and that it is out of plain view. >> xienly's family also blames the sheriff's department for releasing lopez-sanchez without notifying the feds after san francisco decided not to prosecute him on an old drug warrant. then sheriff ross milk areiny says he acted under the city's sanctuary law. despite call forz change, the board of supervisors this week upheld those protections for illegal immigrants. as for the bureau of land management, a spokesman tells us they will say that the complaint is under review and offer sympathies to the steinle family. >> kristen, thank you. turning now tore the race for the white house, hillary clinton wraip waped up her two-day campaign xwing in the bay area with the stop at xhiken

but sunshine from our east bay hills camera. santa rosa 84 napa in the low 80s. mid 80s in novato. livermore at 85 degrees. this is refreshing, the place to be the pacific ocean this weekend. if you are headed to the beaches, the next three days saturday lots of sunshine and very high uv index there. a sea breeze kicks in sunday so it drops temperatures into the upper 60s. but monday memorial day itself partly cloudy, a very nice 72 degrees although the ocean water temperature chilly at 64 degrees. away from the water it will warm up big time overthe weekend. we'll have the numbers shortly. thu, drew. there is a downside to the heat. windy and warm conditions around the state this memorial day weekend means increased fire danger. the california department of forestry and fire protection is beefing up its staff just in case of a major wildfire. 4,000 acres have burned in california just this week. a high number of people camping

this weekend could also pose a wildfire risk. the first case of the zika virus in slaun mow county has been confirmed by health official. the patient had recently traveled to central america where there's an ongoing outbreak of the virus. the county hejt department didn't release any other information on the patient but they did say at this time the virus poses no risk to solano county residents. come out the front door your hands up. >> a search is under way today for a third person in connection with a shooting and stabbing that left one student dead and another injured in novato. >> yesterday two people were arrested during raids and both are novato high school students. lyanne melendez is live in noef tau with the latest on a vemming story. >> reporter: and it has been, of course, a great concern to this community. that's why the play mayor felt compelled to hold a press conference. she read from a prepared statement and took no questions.

she said that this that's sent shock waves through novato. now, this all happened in the last 48 hours, and it has been very trying here. it tarted wednesday late afternoon when investigators say five teens met on a trail near novato high. two of the teens were shot and stabbed. one died. the other was left to die but managed to call 911. let's hear from the mayor. >> violence will not be tolerated in our city. any life lost is one life too many. not in our town. >> reporter: now, the next day a s.w.a.t. team alived at the home of one of the suspects arrested a 17-year-old male, then a few hours later made a second arls, this team a 16-year-old. now, police are looking for a third suspect but did not find him. investigators say they are close to locating that third person. now, the sheriff's department here is also looking into a

possible connection between a sexual assault which hand a week ago and these shottings. again, it is all part of this investigation. >> there are some common names, but whether there's any true nexus between that and the investigation we have right now we have not clearly defined that. we're looking into that as many other investigations. >> reporter: now, novato high school had grief counseling today for those who needed it. now, on sunday there will be a vigil in front of the library, the high school library. now, i also spoke to the mother of one of those teens arrested. she said she was so surprised. a neighbor told me the family and the young man, the teenager, are all good people. but the marin county sheriff's department is also telling us that they may be tried as adults. i'm live in novato, lyanne melendez, abc 7 news.

>> thank you. novato high school students will have a candlelight vigil to honor the life of the student who was killed, it will take tlais on the lawnout side the novato high school library, beginning 7: sunday evening. access 7 news was in san francisco's mission district at mission high school this afternoon as members of sf unified and the transgender community calls for inclusiveness in california schools in fact schools all across the country. sf unified announced today every school will have at least one gender-neutral restroom. >> san francisco is leading the way in these issues, and creating change for those that really need it. those that are most vulnerable, in particular transgender people, young transgender people of color. >> earlier this month, president obama directed school districts nationwide to allow transgender students to use the bathroom that matches their gender identity, not their birth certificate. on wednesday, though, 11 states filed a lawsuit challenging that government directive. we have new details

7 vic? >> reporter: here are the documents. we're learning tonight that keith green the murdered man's mother now has custody of his children. a judge issued the warrants telling the investigators district attorney's investigators and the mother to go to the hillsborough home and a day school to seize the children. this happened just yesterday. now today tiffany li's mother came to court here to ask the judge to reverse the judge's decision. tiffany li's mother and her lawyers came to the courthouse to fight for custody of her grandchildren. ff's our position they were kidnapped unlawfully by our government. >> reporter: jeff carr is the attorney for her daughter tiffany li. he's talking about her two children who were suddenly taken into protective custody yesterday by district attorneys' investigators. li, her current boyfriend and olivier adele la are all in custody and charged with

murdering keith green, li's ex-boyfriend and father of her 2 and 4-year-old daughters. >> they issued a twarwarrant fo seizing children, one from home, one from school. >> reporter: li's mother who resides most of the year in beijing, china, has been caring for them in the hillsborough home since her daughter was arrested last saturday during a s.w.a.t. team raid at the house. green's body was found may 11th in a field in shoem ma county. he disappeared in april when he went to the pancake house in millbrae telling his roommate he was going to meet li. green and li had an acrimonious breakup when he discovered she was having an affair with his friend. lawyers for green's mother colleen kud who lives out of state asked the court to give her custody of the children. she said li's mother should be considered a flight risk. >> and they sought to get a warrant based on a false allegation that mrs. li senior, the grandmother, was not a citizen of the united states, which she is. >> reporter: kud feared for the

safety of her granddaughters. she had reason to believe tiffany would herself harm the children or instruct others to harm them. the judge issue d warrants ordering authorities to remove them from the hillsborough home. the judge today denied the motion to reverse the protective order. a formal hearing will be held next month. vic lee, abc 7 news. there's been no letup in the severe weather in the nation's midsection. take a look at the damage people woke up to today in conroe, texas, outside of houston. strong winds uprooted trees and damaged homes. the worst may not be over. the national weather service issued a flash flood emergency in the area for only the third time. here is a look at just how hard the rain fell last night. check that out. this is a few mile as way from conroe in tom ball, texas. the storm system which is just sitting over the area has dropped more than 14 inches of rain. a french naval ship specializing in under water searches is on its way to help find the flight recorders of
