this is abc 7 news. good afternoon. thank you for joining us. i'm a.m. i daetz. i'm dan ashley. larry beil has the day off. a look at the east bay hills camera. it's cooler today. get ready. major heat is on the way. >> drew tuma is here with the forecast. >> hi, dan and ama. we had mother nature's ac cooling off thijs in the coastal communities. right now the wind, the sea breeze kpikd in. 30 mile an hour gusts. 17 and a half in half moon bay. you see the low clouds along coast. the wind has funneled in to portions of the bay and cooled us off compared to yesterday. 24-hour change. everybody is cooler.

so it feels a lot more refreshing out there than we did this time yesterday. still, a wide range in temperatures. believe it or not, 95 in brentwood. that's cooler than yesterday. we're at 85 in concord. 75 san jose. a cool 66 in oakland and san francisco, with that gusty sea breeze, a cool 59 degrees. future tracker temperatures will show you with the sea breeze, it's going to cool all communities off. we're not hanging on to the heat like previous days. do not get used to this refreshing cool weather. coming up, we have much warmer air moving in of the i'll show you when that arrives and that full accuweather forecast in a few minutes. thank you, drew. the hot weather is causing more concern about fires. brian huck tweeted this photo of a one-acre fire in livermore along 580. it began just before 1:00. it was put out quickly. if you see news where you live, send us the pictures.

because of the heat and fire concerns, a park in san jose will be restricted. no barbecues or open flames bb permitted. slightly cooler weather in southern california is helping crews battle fires in the san gabriel mountains. some evacuations have been lifted. firefighters say the calm is not expected to last. a shift in the wind turned a wildfire burning slowly in a heavily wooded area on the colorado/wyoming border into a fast moving threat. the fire is about five square miles now. state officials are keeping a close eye on the heat wave gripping california. offices are asking people to conserve energy during daylight hours to avoid rolling blackouts. they are especially worried that temperatures are not cooling off enough in night in southern california. still steamy down there. that causes added stress on the power grid as our air conditioners work nonstop. >> you can monitor the

touch and green in every sense of the word. >> i think it looks darn good. it's really going to be nice easy to take care of. >> starting july 1st, san jose will have new water conservation rules due to a revised water conservation target of 20%. the water supply has improved due to a 27% reduction by residents and businesses over the past year. city staff felt comfortable making the recommendations which will increase the allowable days for outdoor watering with a sprinkler system from two to three days per week. the city council approved the changes earlier this week. >> we'll continue to conserve water. but because of the really good work our residents and businesses have done, we're able to relax it a little bit. >> tim fullerton with 11ly greens fields calls from customers who want too reduce water bills and looking for ways to conserve during the drought. >> by reducing the amount of water using your lawn, you can use that water you're saving to

keep your plants and your teresa live. >> norton hopes the changes don't affect the progress that's already been made. >> it's not going away any time soon. it's nice. to think it's getting better, but not that much. you got to make an effort. >> reporter: officials will set new water restrictions or mandates by january 2017. in san jose, chris nguyen, abc 7 news. well, today nearly 5 dozen san francisco's dents were allowed to do something for the first time since a raging fire in the mission district. >> they were able to return to their burned out units. kristin is here with more. >> the outer mission, they were allowed to go in the building for a few minutes. today, the fire victims were let back in to really take their time and take stock of what's left. most residents found little to salvage. they left in a hurry when the five-alarm fire broke out saturday at 29th and mission streets.

two people were injured and six buildings gutted, including a low-income voucher hotel. tenants got the all clear today to re-enter after asbestos testing was completed. one man tells us that everything was burnt or water damaged. >> my baseball card collections, trinkets and gold, stuff like that. that i had hidden. cash. i had cash in a little box. >> help is available. a go fund me page to set up the displaced residents raised nearly $34,000. in fact, just topped that as you can see. the city a offering grants up to $10,000 such as a restaurant both were completely destroyed. for more information, go to abc 7 news.com. thank you, kristin. a new report shows people aren't getting the hint about distracted driving. according to a survey, nearly 13% of drivers were seen using

mobile devices behind the wheel. that's up about 9% from last year. the number of crashes involving distracted drivers is also up nearly 60% of drivers say they've been hit or nearly hit by another driver using a cell phone. happening now on capitol hill, house lawmakers are staging a sit-in to demand a vote on gun control legislation. >> congresswoman barbara lee shared video from the house floor and held up a picture of regina jeffries, the teenager shot and killed last tuesday in oakland. >> there's a lot of reaction on social media. gavin newsom said i wouldn't mess with representative john lewis. gabby giffords says speaking has been hard for me but i haven't been silenced. chris murphy who led the filibuster last week is supporting the house. he tweets they can shut off their cameras but not their voices. >> adrian bankert has the story. >> democrats have taken the hughes floor hostage.

the story says he was a friend and also that the sergeant believes he's being retaliated against for filing a complaint in 2014 in connection to racist text messages he received. inside al made a county superior court, the attorney for a dft in a 2013 homicide investigation filed several motions in an attempt to determine whether the ply mary homicide investigator, sergeant mike gantt did anything to taint the case. >> what's concerning to me is the secrecy of it. i received no information regarding allegations against sergeant gantt except for through the press. >> there's allegations that sergeant gantt had a woman he knew type up three witness statements. >> i don't know if that means transcription as in word by word of statements, if that means transcription of handwritten notes being tran skriepd. >> he's on administrative leave in connection to an argument he had with his wife. the same source says that gantt believed opd is retaliating

against him for filing an internal affairs complaint after receiving these racist text messages from lieutenant tony jones. according to the source, sergeant gantt filed the complaint against jones. then lieutenant john lois. the source says gantt filed a similar federal eeoc complaint in 2016. oakland police department has not confirmed that sergeant gantt is on administrative leave or why. in an e-mail statement a spokesperson writes the oakland police department does not discuss or provide details regarding personnel matters and active internal affairs investigations. the motions made in court including one for the personnel records will be heard in juliment. >> i would be asking for records about fabrication of reports, personal authorship of reports, acts of moral turpitude. >> in oakland, melanie woodrow, abc 7 news. coming up at 5:00, you're going to hear from former

oakland police chief howard jordan and the concerns he brought up at least two years ago about the department. newly proposed lemg lakes would require prison time for people unconscious or heavily intoxicated. the d.a. introduced the bill today. he said a conviction only requires probation. it would make the defendant ineligible for probation and require a three-year prison sentence which is the current penalty for a conscious person. it comes after brock turner received just six months in jail. coming up at 5:00, vic lee will have details of the movement to support the judge who made the controversial ruling. more americans are looking to social immediate use to find work. a pew research study found that people use facebook or twitter to find job opportunities. about a third of workers are required by employers to adhere to strict rules on how to present themselves online.

researchers say it's an indication that the line between our work and personal lives is further blurring. hundreds of people waited in line for more than an hour today just to get their hands-on coffee and doughnuts. it happened in walnut creek at the opening of dunkin' donuts. the first one in the bay area in 15 years. abc 7 news reporter amy holly field was there as people waited and waited. >> they knew a lot of people would show up for the grand opening in walnut creek. but they didn't expect this. >> we knew there was a lot of pent-up demand. a lot are transplants that grew up on this. this blew away my expectations. the first person got here at 2:00 a.m. she thought there would be a crowd but was happy to be first. >> i was excited. i'm embarrassed because i'm excited. because it's doughnuts. >> she was the smartest customer of all. as the morning went on, the line

medical attention that couldn't be provided on the remote continent. adrian bankert, abc news, new york. a massachusetts couple can thank foyer cigarette lighter for saving their lives after being stranded for 12 hours on a small ramp in the atlantic. joe and kathleen were out for a night on the water. but immediately ran into trouble. current carried them out to sea where 4 to 5-foot swells crashed around them. they had no life jackets and no cell phones. >> going to be okay. we're going to make it. don't worry. >> the waves were getting so big, we were losing sieft the shore. >> this is the raft the couple was on. better suited for river use. this is coast guard thermal imaging of them being rescued. she used her cigarette lighter to get the attention of the coast guard helicopter. the couple was in the early stages of hypothermia when they were rescued. thank goodness at least they had the lighter on them. >> definitely. you probably heard the old joke about what it takes to get

a counterfeiters are making a dirty problem even more dirty. bogus detergent is the hottest new criminal trend, believe it or not. 5-gallon buckets of tide and downey are being sold at swap meets, fundraise ersz and online. customers think they're getting a deal but they're not. >> you use the counterfeit detergent, it's not that much different than just using water by itself.
