the next brock turner. he's referring to the ex-stanford swimmer convicted of sexual assault on an unconscious student. vic lee is live in san jose with the story tonight. vic? >> reporter: well, we are in santana row where an event called walk a mile in your shoes will begin shortly. it's sponsored by the ywca to help prevent sexual assault. d.a. rosen used a per emt torrey challenge to remove him from a sexual assault case. he didn't think the judge could be fair. now he's going to sacramento to push for tougher penalties in sexual assault convictions. >> our justice system must become better than this. >> the victims emotionally charged impact paper, many rea it. including her colleagues on the house floor. santa clara county district attorney jeff rosen says it started a revolution.

district. we are hearing tonight from a former chief of the oakland police department on the massive scandal rocking that department. plus, there are new questions about comments made by the man temporarily heading the department. abc 7 news reporter laura anthony is live at oakland city hall with the information. >> reporter: hi dan. the oakland police department has gone through a half dozen chiefs in as many years dating back to howard johnson. we talked with jordan who told us he hopes the actions of a few don't undermine the good work of the men and women he worked with for two decades. >> i'm deeply embarrassed and ashamed. >> former chief, howard jordan hasn't been the head of the oakland police department for three years. but still, he says the current scandals have rocked him to the core. >> it's very unsettling, it's very embarrassing to say the least for the people that still there, even the ones that are retired, like myself to have to explain the actions of a few. >> so far, five oakland officers

have been placed on leave. two resigned amid allegations of sex with an underage pros toout. racist texts and other illegal beha behavior on the part of officers. david downing has suggested water cannons could be used on protesters. a comment that was taken out of context and not racially motivated says libby schaaf. >> civil rights attorney john burris doesn't think the focus should be on downing. >> i'm much more concerned about who the next chief is going to be. i want a reform minded chief and a new command staff. >> downing said in a press release, quote, i did not intend to suggest that such a method would be appropriate in oakland or any other community as a legitimate crowd control method. in oakland, laura anthony, abc 7 news. the san francisco police commission is set to vote on new rules for when and how officers can use force.

calls came for an overhaul of the department's policy following the fatal police shooting of mario woods last december. the shooting was caught on cell phone video. officers shot the 26-year-old after they say he lunged at them with a knife. the video raises questions about what happened. they will choose between two versions of a new policy drafted by the police department. both put 'em emphasis on trying to de-escalate situations before resorting to force. how an inmate was mistakenly set free last night. eric thomas explains more about how this case of mistaken identity could happen. >> reporter: we're live outside the sheriff's department right now. 45-year-old michael willis had six hours of freedom before being recaptured by police. his release comes from a case of mistaken identity. he was one of two michael willis' held in the jay. one appeared in court yesterday and a judge ordered his release.

but it was the other one who was actually let go. the sheriff's department says they were similar descriptions. one was born in august of 1971, the other worn in juno owe born in june of 1971. >> it's human error. did somebody make a mistake, not follow the procedures in place before we release people or is there something with that procedure that needs to be improved? >> reporter: san francisco police arrested michael willis, the one supposed to be locked up, near taylor and ellis streets at about 10:15 this morning and returned him to jail. he had been wanted on charges of theft, peddling without a license and also on a felony warrant of failure to appear in court. he is once again back in jail. >>er thomas. -- eric thomas, reporting.

are set to start next month. but in terms of water use, city officials tell us they aren't too worried about residents going back to their old ways. in san jose's willow glen neighborhood, christine nor done looks on as her front yard gets a makeover. >> i think it looks darn good. it's really going to be nice and easy to take care of. >> reporter: because of the drought, she's one of many making the switch to artificial turf. he's helping with the installation. >> by reducing the amount of water on your lawn, you can use that water you're saving to keep your plants and your teresa live. >> reporter: but starting july 1st, san jose will have new water conservation rules due to a revised water conser vision target of 20%. the city's water supply has improved over the past year mainly because of a 27% reduction by residents and businesses. >> we're going to continue to conserve water, but because of the really good work that our residents have done and

businesses, we're able to relax it a little bit. >> reporter: based on recommendations of city staff, council members voted to increase the allowable days for outdoor watering with a sprinkler system from two to three days per week, while some neighbors welcome the change, others are unsure. >> i feel torn about watering our yard more. >> this willow glen resident hopes that neighbors don't go overboard with water use. >> we have eliminated part of the lawn in our backyard. we have installed plants because they require less water. >> officials will set new statewide water restrictions or mandates by january 2017. >> it's going to be a continuing ongoing lifestyle. not just a thing for this summer, it's going to be one for the rest of our lives. >> in san jose, chris nguyen, abc 7 news. the dry conditions were apparent in livermore today as a grassfire quickly burned two acres. viewer brian huck tweeted this picture to abc 7 news. it shows flames near north

livermore avenue and an enormous cloud of smoke billowing into the sky. it started at 12:30 today. firefighters had it under control in one hour. >> they're still trying to mop up flare ups. it's used for cattle. none were hurt by the fire. >> when you see news where you live, take a photo or video and share it with us using ash abc 7 now. we'll show it on air or at abc 7 news.com. the hot weather is raising concerns at parks. alum park where these pictures were taken, no open flames or barbecues are permitted. that restriction will be in effect at least through tomorrow. the heat is killing trees in the sierra nevada forests. the u.s. forest service reports an estimated 66 million trees have died since 2010. 26 million between last october and this month alone. the causes range from drought, warmer temperatures and a beetle epidemic. large areas of dead trees make

wildfires more destructive. they bought $6 million worth of chippers, sawmills and incinerators to help firefighters remove some of the dead trees. being blamed for manage willing a chp motorcycle. chp napa tweeted this photo today showing what's left behind. the officer was investigating a traffic accident nearby when someone dozed off behind the wheel and slammed into the parked motorcycle. the officer was not hurt. san francisco police busted about 2 dozen drivers in a traffic sting. in north beach, officers were on the lookout for drivers who did not yield to pedestrians in crosswalks. pedestrians have the right-of-way in the marked areas from curb to curb. there were eight officers part of the sting. each handed out three, maybe four citations. american canyon teenager is slowly recovering from being bitten by an extremely dangerous snake. 15-year-old audrey benson was in

belize when she was saah attacked by the ultimate pit viper. it's untreated bite can be fatal. doctors in florida call the recovery very uneven. she still has trouble swallowing and walking. they plan to give her a stimulant tomorrow to make her more alert and awake. president obama signed the first major overhaul of toxic chemical rules into law today. the president wrote his name on bill surrounded by a group of sponsors including san francisco representative nancy pelosi. the legislation requires the environmental protection agency to okay new chemicals before they enter the marketplace. they agreed the previous law was too weak and needed to be overhauled. a mobile advertising company agreed to pay nearly $1 million to settle charges that it was illegally tracking customers' geographic locations. >> even children's locations. michael finney is here with the story that parents could find alarming. >> this is a big no-no

especially coming to kids. in singapore, it was deceptively tracking millions of mobile app users, including children. companies used location data for targeting advertisers. they falsely claimed users agreed to the tracking apps intended for children also revealed location. that violates federal laws protecting online privacy. they have agreed to delete the data it has collected. air bnb is meeting civil rights groups to find ways to contact discrimination. we've told you about this before. the short term rental company received bias by some hosts. customers reported that some hosts are declining to rent to african-americans. transgendered people and other minority groups. air bnb says it's committed to ending discrimination. it made ban hosts who are screening out guests based on their race or sexual
