that deadly shooting in louisiana. those rallies spreading from los angeles to philadelphia. abc's senior justice correspondent pierre thomas has all the details for us in washington. good morning, pierre. >> reporter: good morning, robin. another fatal police shooting, a traffic stop turned deadly caught on tape. igniting anger and concern about police use of force. a new video emerging this morning of another police shooting last night in minnesota. >> we're waiting for -- >> keep your hands visible. >> i will, sir. no worries, i will. >> reporter: viewed more than 1 million times before being taken down on facebook. the video shows a traffic stop turned deadly. 32-year-old philando castile along with his girlfriend and her child pulled over last night the beginning of the incident not on tape but castile was shot, his arm bloodied. the woman in shock but continuing to livestream the situation on facebook. and in the video she says that castile had a license to carry a firearm. she says she warned the officer that he would be reaching to his pocket to get his i.d. the officer appears agitated. >> told him to get his hand up.

>> you told him to get his i.d., sir, his driver's license. >> reporter: she says the officer fired reportedly four times. castile transported to the hospital later died from his injuries. outraged family members and residents heading to the local hospital to protest. as hundreds gather at the governor's mansion overnight demanding answers. this, as protests in baton rouge continue overnight as a second video is released showing another angle of the deadly shooting of 37-year-old alton sterling. >> get on the ground, get on the ground! >> reporter: this new video showing one officer pinning sterling to the ground while another officer kneels on his arm outside a baton rouge convenience store. >> you [ bleep ] move, i swear to god! >> reporter: you can see one officer drawing his gun and moments later shots fired. an officer then removes something from sterling's pocket. sterling dying at the scene. >> oh, my god. >> reporter: sterling's family wants answers.

>> i want justice for alton. that's what i want. i want justice for him. >> reporter: the justice department and the fbi called in to investigate the baton rouge case. the same request likely coming for minnesota. so many not willing to take the word of police anymore. >> and speaking of the case in minnesota the woman remained very calm. she referred to the officer as sir, but is it dangerous for people to record these events even though it's very important information that we get, but is it dangerous for them to record it as the event is happening? >> reporter: every situation is different, people have to be careful not to do anything that would make police think that they're a threat but, robin, that cat is out of the bag. these days when people see anything their reflex action is to pull out the cell phone and start recording. >> all right, pierre. >> what they documented just shocking. we're going to move on now to that dangerous heat spreading across the country. 15 states from new mexico to new york under heat warnings right now as the northeast gets hits hard with the hardest hit wave of the summer. ginger outside with the details.

capitol hill to testify about that e-mail probe. clinton's campaign calling the grilling yet another taxpayer funded sham of an inquiry to try to hurt hillary clinton politically. clinton now trying to get back to business on the campaign trail taunting donald trump on his own turf. >> what he did for his businesses and his workers is nothing to brag about. in fact, it's shameful. >> reporter: showing up in atlantic city right outside his shuttered trump plaza casino. >> he got rich and got out and he thinks that's something to be proud of. >> reporter: trump firing right back. >> hillary with teleprompters every single time, donald trump is a bad person. he hurt the little people. i didn't. made a lot of money. >> reporter: and this morning, a big endorsement is in the works for hillary clinton. bernie sanders is now in talks with clinton's campaign about when and where, george, it could come as soon as next week. >> yep, she adopted his college tuition plan, okay.

better chance than the walter mondale bid did in 1984 winning the presidency, both of them were able to find vp nominees in the course of this. he will settle on somebody but it is a case of musical chairs. >> okay, matt dowd, thanks very much. george, now to the tragic death of a young navy s.e.a.l. ruled a homicide. 21-year-old james lovelace died during a training exercise in a pool. the death now raising questions about whether some training is too extreme. abc's martha raddatz has more and joins us from washington. good morning, martha. >> reporter: good morning, robin. the san diego medical examiner is now saying that the actions and inactions of the instructors and other individuals involved were excessive and directly contributed to the death of the young trainee. this morning, stunning new details in the drowning death of navy s.e.a.l. trainee james derek lovelace. the 21-year-old died in his first week of elite navy s.e.a.l. training. it is the most rigorous training in the u.s. military. but this time, according to the san diego medical examiner, the

training went too far. it is now being labeled a homicide. according to the medical examiner report, surveillance video from the combat swimming exercise shows lovelace struggling in the water. witnesses say his face was purple, his lips blue. the report says an instructor in the water approaches him and against regulations dunks lovelace, not once but at least twice, at one point someone else in the water pulls lovelace up. away from the instructor who eventually pulls him out still breathing but moments later he's unresponsive. >> if you kill somebody in training, you're doing the enemy's job for them. >> reporter: according to the navy s.e.a.l. foundation, between 2013 and 2015, eight s.e.a.l.s lost their lives in training. that's more than the number of s.e.a.l.s who died from combat or service-related wounds during that same period. and despite labeling this a

homicide which in this case means death at the hands of another, the navy says it is not inherently a crime but we are told charges are possible and that the instructor has been put on administrative duty during this active and open investigation, robin. >> investigation continues, martha. thank you. now to amy with today's other top stories starting with new concerns about the zika virus. >> that's right. authorities are now reporting a jump in the number of cases of zika virus, up to 50 pregnant women per day are becoming infected in puerto rico alone. the cdc is urging officials on the island to begin aerial spraying to kill mosquitoes. meanwhile, health officials in florida have confirmed 11 new travel-related zika infections in that state yesterday alone. well, an urgent manhunt is under way in san diego for the man responsible for a series of vicious attacks on homeless men in the street. two were killed. two others are in critical condition. police have released surveillance video of the suspect they say his motive is unclear.

sexual harassment at fox news. alleging ailes injected sexual and/or sexist comments into their conversations. even asking her to turn around so he could view her posterior. carlson alleges when she met with ailes to discuss how she was being treated, ailes told her, you and i should have had a sexual relationship a long time ago. and then you'd be good and better and i'd be good and better. carlson only naming ailes as a defendant but in her complaint, the married mother of two also claiming her former "fox & friends" co-anchor steve doocy. >> got a fox news alert. >> reporter: treated her in a sexist and condescending manner and she alleges when ailes learned of her complaints about doocy's behavior ailes responded by calling carlson a man hater and carlson was taken off the popular morning show in 2013 and given her own afternoon show but on her final "fox & friends" appearance she only had positive

things to say about ailes. >> thanks very much to roger ailes for believing in me and giving me this opportunity. >> reporter: carlson claims that move, along with a salary cut and ailes' refusal to renew her contract last month, were all in retaliation for her complaints of harassment and discrimination and because she rejected his sexual advances. the 76-year-old ailes, one of the most powerful men in cable news. >> we discovered a secret niche in broadcasting half the american people. >> reporter: tells abc news carlson's allegations are false. this is a retaliatory suit for the network's decision not to renew her contract, which was due to the fact that her disappointingly low ratings were dragging down the afternoon lineup. ailes has faced allegations of sexism in the past. this 2014 unauthorized biography claims the ceo wanted his female anchors to show off their legs. fox news fought back at the author saying he was never given direct access to ailes and the

book was never fact-checked with them. on wednesday, the former miss america tweeting out this blog she wrote last year recounting her experience with sexual harassment as a young reporter. something she's addressed on air. >> i knew over time that the newsroom would start abuzz like oh, here comes a former miss america. she must be a bimbo. >> reporter: carlson telling abc news that the lawsuit was a difficult step to take but adding, i had to stand up for myself and speak out for all women. carlson is seeking unspecified damages. ailes and fox news claiming that the lawsuit is defamatory and offensive and promising to defend it vigorously and the network's parent company 21st century fox saying while they have full confidence in ailes and doocy they take the allegations seriously and are conducting an internal review of the matter. >> let's talk about this with our legal team, dan abrams and sunny hostin. dan, let me begin with you. she's claiming sexual harassment

in the workplace but the lawsuit against ailes personally not against fox news. >> that's right, typically you would file a lawsuit against the entity the deep pockets it. it makes it feels like it's personal. against roger ailes. she's not suing fox in this context and so the question is going to become, what corroborating evidence does she have to avoid making this he said/she said, are there audiotapes? are there e-mails? are there other witnesses? are there contemporaneous notes that she took immediately after some of these comments were made? these are the sorts of questions you have to ask in any kind of lawsuit like this. >> can i add to that -- i think when you look at this you're right, dan, that people typically sue the parent company because they're going for the money. i think the fact that she made this personal and clear her grievance is only with roger ailes and not with fox news, not with its parent company, gives her more credibility because it's personal and sexual harassment generally is so the fact that she's done it this way, i think, shows she's very brave, and i think she gives fox news and its parent company a pass, so to speak. >> but she also seems to suggest

that she's not alone here suggesting that others at fox news were promoted because they didn't rebuff. >> well, saying she is alone in the sense that she rebuffed it, right? i mean, she's making a very, very salacious allegation here which is that other women at fox news effectively got promoted because they did not rebuff roger ailes' sexual advances and so one of the big questions is going to be, what other people are going to come forward in the context of this case? they're going to try to drag in all the fox news people on both sides of this. >> well, i think what's also important in this sexual harassment case, testimony of other victims becomes relevant and is relevant and is admissible. and her lawyer has already indicated that ten other women since the filing of the lawsuit have come forward. so you're right in a he said -- >> who they haven't vetted. >> but the bottom line he said/she said case kind of difficult to prove. a he/she said/she said/they said

wheel and eyes on the road but unfortunately it seems to have become more of a toy where people like to put up youtube video to say, hey, look what my car can do and sometimes there are problems. >> and, lauren, a new bombshell article in "fortune" magazine which tesla's ceo elon musk has responded to and said there was a huge stock sell-off after the first accident. what do you know about this? >> right. well, you're right, michael. this is very interesting because when the accident happened on may 8th and there was a death no one said anything. so he did -- we don't know if he disclosed but it doesn't seem like he disclosed to the potential investors who raised $1.46 billion for tesla so i would guess that elon musk would obviously try to protect himself and put out a statement saying, oh, yeah, they already knew. we don't know that and i have a feeling the s.e.c. might want to get involved because there's already a probe with the nhtsa over that and other accidents

that happened post that. >> people watching that. >> opened up a can of worms. >> even if it's autopilot, i'm going to keep my hands on the wheel. >> be a little weird to go without my hands on the wheel. all right, lauren, thank you. now to the battle over immunization. the new law in california requiring all public schoolkids to be vaccinated but now some parents are fighting back and filing a lawsuit and joining us now is dr. richard besser and, doc, what's going on in this case? >> yeah, so, we do have a battle brewing, all states require vaccinations for children entering kindergarten to protect them and other kids in the classroom but there are some outs. if a child has a medical condition that makes vaccination dangerous, they don't have to get vaccinated and then, in most states, if you have a religious reason, you can get out from a religious exemption and then there are almost 20 states that have a personal belief exemption. if you don't believe in vaccines you don't need to get your child vaccinated. well, california passed a new law that says only children who

have a medical condition have an out from vaccination, everyone else has to get vaccinated, so there is a group of parents suing saying this interferes with their personal beliefs and it interferes with their legal right to get their children an education supported by the state. >> rich, you're a daddy sitting by two daddies right here and you know how passionate some parents are about this subject matter, and when they hear something like this, is this kind of paint them in a corner? >> well, it may. we'll have to see what the judge says on this, but in california things were getting bad and had outbreaks of measles. in some schools as many as one in four children were not getting vaccinated and that's an outbreak waiting to happen so we'll have to see what the judge comes down. i'll be surprised if they throw out the vaccine law. for those parents who have a strong belief, their only option may end up being homeschooling. >> this is a conversation that is far from over. >> or you have to move. >> one or the other like that. okay, rich, thanks so much. and a shake-up in the marvel universe. tony stark is stepping out of the iron man suit.

in his place a new character, riri williams, she's a 15-year-old african-american girl, t.j., people are talking about this. >> say it with me now. iron man is now an iron black woman. and a young black woman here. let's show you the image we have here now. this is riri. now, riri will be stepping in -- the story line is that she's a 15-year-old genius at mit who designs an iron man suit herself. tony stark -- it got the attention of tony stark, he takes her under his wing and he hands her over the keys to the iron man suit so expect to see riri the new iron man this fall. >> iron woman. >> iron woman. has there been any blowback from this move? >> oh, no, people don't mind change, strahan. no, of course, you got some blowback from purists who say why do you keep messing with the characters and other people out there -- the creator said, racist, you had that diversity character. why would you need another

diversity character. because they introduced a female thor and hispanic half-black spider-man and this is part of marvel's idea to diversify and to broaden its fan base and this is just another step in that and then, you know, the purists. you can't make everybody happy. some people upset. you know what, there's a new minority character but it was written by a white guy. even that criticism is out there. >> always something to find. >> times are changing but the writer also talked about when he was at a signing and how much it meant to him when a young woman said, hey, thank you. i'm now being represented. it means a lot. >> and that broadens the base. some people never into comic book characters a little black girl never was into comics now she has a character she can look up to and a lot of people it's not surprising. this is something that strahan and i have known since the moment we were born and that is black women are superheroes. >> absolutely. >> so this is not a big thing to us. >> why, thank you. >> yes, and, mama, i agree. that is the truth. >> are we going to see riri in any movies. >> the plans aren't in place yet but you can bet they are going to be thinking about it and somewhere down the line --

about the hillary clinton private e-mail serve. house republicans want to know why comey recommended no charges against clinton even though he rebuked her from mishandling classified information. >> i see evidence of great carelessness but i don't see evidence that's sufficient to establish that secretary clinton or those whom she was corresponding both talked about classified information on e-mail and knew when they did it they were doing something that was against the wall. given that assessment of the facts, my conclusion was and remains no reasonable prosecutor would bring this case. >> comey said clinton did not lie under oath. well, donald trump is in washington this morning to meet with house and senate republicans after showing off one of his potential running mates.

we are back with that bombshell lawsuit raising big questions about sexual harassment in the workplace. former fox news host gretchen carlson getting a lot of reaction after those charges against her former boss roger ailes. abc's rebecca jarvis has more. >> reporter: she's a former miss america turned high-powered fox news anchor. >> welcome back. >> reporter: gretchen carlson who just weeks after her contract wasn't renewed now suing her former boss, roger ailes, for sexual harassment. >> and time now for my take. >> reporter: on her website carlson asking her fans to #standwithgretchen.

a hashtag that took off on certainly media. thousands weighing in with words like inexcusable and women deserve to live without harassment. carlson's allegations not unfamiliar to women. studies showing that one in four women in the u.s. face workplace harassment. one poll showing that 70% of cases go unreported. ailes denies carlson's claims calling them wholly without merit. and, rebecca is here with us along with tory johnson, "gma's" workplace contributor and we have a lot to talk about. rebecca, there's obviously a difference between playful banter among co-workers and sexual harassment. what's the distinction? >> so, the law is specific about this, amy. it specifically defines sexual harassment in the workplace as unwelcome sexual advances or conduct that interferes with job performance and creates an intimidating hostile or offensive work environment. the difficulty here is proving those things when these cases actually go to court. >> all right.

tory, if you recognize this behavior, here's the million-dollar question, what do you do about it? >> so every situation is different and you really have to analyze the environment you're in, the people that you're dealing with, but there are three specific things that you can do. first is call it out immediately. we live in a culture where people feel entitled to say and do almost anything. you just look at social media and see the way people talk without regard to whether it's appropriate or even legal. and so sometimes people cross that line. so, if it is inappropriate to you, you call somebody on it immediately. >> so you say that's offensive? that's offensive. >> this bothers me. i'm uncomfortable and you do it as clearly and confidently as possible. you also want to document the specifics. any time you're going to make some kind of claim that is as serious and as loaded as sexual harassment you better be prepared for your credibility to be questioned and for people to come after you so when you have a realtime record, you don't

leave it up to memory to chance but rather you keep a journal in a safe place not on your work computer. not on your desk at work where you can document specific dates, times, comments, what somebody was wearing, what witnesses were around. any sort of specifics like that are going to become the evidence you'll need when somebody questions this seriousness of this, and then finally report it and this is different depending on where you work, who you work with and who you are alleging this -- >> when it's the boss it's more difficult. >> it's very, very difficult so maybe you go to a trusted colleague. rebecca and i were talking about that. sometimes it's a trusted colleague that you can go to for help and reassurance about how to nip this. sometimes it's a boss, it's hr, if you don't feel like you're getting any kind of satisfaction at work you can file a claim with the eeoc, the equal employment opportunity commission, and you have 180 days to do that. you don't need a lawyer to do it. you can do it yourself and also seeking legal advice is another option. >> rebecca, in your piece we heard just a fraction of what

♪ ♪ we're back now with the new sunscreen study out of northwestern university raising big questions. researchers say four out of ten sunscreens they looked at are not doing the job they're supposed to. >> and that's kind of dangerous. so joining us now to break it down to help us understand had did dr. whitney bowe, a certified dermatologist. >> so tell us the significance of these studies. >> robin, you got to take this study with a grain of salt. you know, these researchers only looked at 65 of the most popular

sunscreens on amazon.com so they included like a hodgepodge of different products and included sunscreens for the beach but they also included moisturizers, tinted lotions, you know, products that are marketed as beauty products so what you'd expect from a beauty product they are using as part of your makeup routine in the morning is completely different from what you'd expect from a sunscreen you're using on your family for a day at the beach. if you're walking from your car to your office, it's perfectly acceptable to use a moisturizer with sunscreen than may not be water resistant, but if you're sweating and swimming, then you want to make sure those sunscreens are meeting all of the criteria. >> makes sense. >> if you're sweating and swimming, i talked about my girls, you have to reapply. >> yes, you do. so really the take-home message from this study, michael, is just thinking about how water impacts sunscreen so the number one reason the products in this study failed they weren't water resistant so you got to look for water resistant but you also have to take necessary precautions so first, you want to apply the sunscreen, 15 minutes before the skin gets wet. so you don't know how many types

i see people right by the swimming pool rubbing sunscreen and spraying down their kids and they jump right in the pool. it's like that is sliding off your skin and you have to wait 15 minutes. second, you are to reapply once an hour if your skin is wet. reapply every two hours, that's dry skin. if you're sweating, if you're getting wet you got to reapply every single hour and then last when you reapply you really want to reapply ideally to dry skin. get everybody out of the water, towel dry, then reapply, and then wait those 15 minutes again before you go back in. >> this is great information. i had not heard that what you were saying about waiting 15 minutes. there's more you can do. sunscreen is great. >> you can't rely just on sunscreen so sunglasses, broad him hats and sun protective clothing but be careful if you're near a body of water. if you're near water you're getting hit from the uv rays from above and they're also reflecting off of the water below so a double whammy. your sunscreen is doing double duty and be careful near water. >> i was at nevis this weekend
