live from the kgo broadcast center, this is "abc7 news." >> good evening. thanks for joining us. we begin with a desperate rescue attempt in the waters off san francisco. a man fell off a cliff and despite a heroic effort, he was pronounced dead. sergio cantanna has our story. >> reporter: this was a swift and sizable effort to save a life. but it's a rescue that didn't end well. >> we retrieved the victim from the water, and he was transported by the coast guard to marin, a base for the coast guard. unfortunately, the adult male is deceased. >> reporter: at ft. baker, the body was driven away in a black van and officers with the national park place and ranger

service, inspected evidence. they have not released any information how the man fell off the cliff or who he is. san francisco firefighters say the area where he fell in was not easy to get to. >> trails are marked for the safety of the people. you have to be careful to stay away from the edge. >> the water is pretty rough over here. if you're from the area, you don't you don't get too close to the cliffs to go look at anything. >> reporter: kimber lou watched the rescue effort. this has been a tough year in this area. in april, five young men were sent into the water at ocean beach. two did not survive. tomorrow, a full team of federal investigators is expected to arrive at the scene of the worst hot air balloon crash in recorded u.s. history. it happened in texas about 30

miles outside of austin. 16 people were killed when the balloon hit a power line, caught fire, then fell to the ground. experts say power lines are an occupational hazard. >> you're trying to land the basket or the balloon near a road. it's often times going to require you to either skip over or land close to high tension power lines. >> skip nichols owns heart of texas air balloon lives. the experienced pilot was among those killed. new at 11:00, police arrested a man accused of a hit and run crash while driving drunk. it happened around 8:00 tonight at industrial boulevard in sleepy hollow. police say the driver of a blue pickup truck was racing another car when the truck slammed into a mercedes. three people in the truck ran away. a witness who saw the crash and went to help the victim says he couldn't believe it when he saw the driver run away.

>> you just endangered somebody's life, you caused harm to them and you don't want to help out? you don't want to take responsibility for what you've done? >> police later found the driver of the car. service is back to normal tonight after a fire on the tracks closed down walnut creek b.a.r.t. station. it happened just before 3:00 this afternoon. smoke could be seen for miles. it took firefighters 30 minutes to put it out. they think a power pickup paddle is to blame. >> if one of those paddles was stuck in an up position, and made contact with something tore than the third rail, there's a lot of energy there, which is definitely enough to set something on fire. >> by 4:30, trains were being single tracked through the station. a different issue for

b.a.r.t. tonight. cell phone video of an incident has gone viral and some witnesses say it was a case of excessive force. cornell bernard has the details. >> it was a brutal scene. my legs were shaking. >> reporter: she was riding b.a.r.t. on friday with her mom when she shot this cell phone video of b.a.r.t. police arresting a robbery suspect. dozens of witnesses watched. some say officers went too far. >> one of the policeman had his knee on the kid's back, and it looked like he was going to break it. one guy next to him yelled please just get your leg off, you're going to break it. >> reporter: it's believed the suspect was armed but a gun was not found. the man resisted arrest and may have kicked and spit the officers. >> that's excessive force. >> reporter: this activist believes the man was racially

profiled. >> everything that's coming forward about people of color being treated unfairly by the police, that b.a.r.t. police thought it was okay to behave that way. >> reporter: we showed the video to joseph marshal, who has no jurisdiction over b.a.r.t. police. >> the young man, looked like he was hit while he was on the ground and subdued and handcuffed. i don't see any reason for that. that looked to be, you know, very improper. >> reporter: b.a.r.t. said the suspect was uncooperative with officers. in san francisco, cornell bernard, "abc7 news." a wildfire in monterey county grew by three square miles today. 57 homes have been destroyed. the fire is just 15% contained and it started eight days ago. the cause, still unknown. the skies above san jose

were a little smoke wri because of a 124-acre brush fire. right now, no homes are threatened. investigators are not sure how it started. the flames are now 75% contained. 26,000 runners are hopefully sleeping right now as they prepare for some's san francisco marathon. crews put up barricades for the big crowds expected. the marathon starts at 5:30 in the morning. the race starts in front of the ferry building, winds through the city and across the golden gate bridge before finishing back at embarcadero and fulsome. road closures begin at midnight and continue tomorrow afternoon. happening now, mugles across the bay area are waiting in line for the first time in nine years. the newest chapter of "harry potter and the cursed child" goes on sale in minutes.

the city starting in front of the ferry building, going over the golden gate bridge, and back to the embarcadero. we have a map of the course on "abc7 news." also happening at midnight, "harry potter and the cursed child" goes on sell. it's the first harry potter book released in nine years. in napa county tonight, the clock continues to tick for a man who is running out of time. the state of california owes luther jones almost a million dollars for a wrongful conviction that sent him to prison for 18 years. but as wayne freedman reports, five months have passed with no check. it's a story you'll see only on "abc7 news." >> reporter: luther jones does not have much time left and he knows it. this is a 72-year-old man who redefines the phrase "victim of the system." that was luther jones last february, just out of prison, after serving 18 years for a crime he did not commit.

time for which the state of california now owes him close to $1 million in compensation. but it hasn't arrived yet. his son wonder it is luther will ever live to see it. >> my father has been given a time limit. so fast isn't fast enough. >> reporter: when the california department of corrections released luther, he was so sick that the first night he slipped into a deep coma. >> i was put outside the gate and left, and almost died. >> reporter: since then, luther has spent most of his time in the hospital, racking up bills without the money to pay them, waiting for his money from the state. this is a common story among exonerated inmates. rick walker served 12 years for a murder he didn't commit. >> they arrest you, convict you, send you to prison, but then make you wait for their mistake to be compensated.

high tension lines. now the ntsb begins its grim task. but they are already on the ground. a full team of 13 investigators from the ntsb will be here by sunday, trying to find answers for their loved ones of 16 victims of tragedy. now to north carolina and the story of a boy with autism who was turned away from a local restaurant. 6-year-old e.j. patterson was eating his favorite food, mcdonald's french fries at a golden corral with mom. they were asked to leave because the food came from outside the restaurant. when the mcdonald's owner heard, he offered them a free supply of french fries for a year. >> it's a blessing. >> she says the gift will be a big help. she says she normally spends

about $200 a month at mcdonald's. one woman celebrated her 80 birthday by something people her age are afraid to do. she went sky diving for the first time in sacramento. this is the way she wanting to celebrate her eight decades on earth. she said the butterflies went away once she stepped out of the plane. >> cold, and then it was just so peaceful, beautiful. i loved it. i had such a good time. >> her great granddaughter and grandson jumped before her. she says she wants to do it again for her 90th birthday. tonight, botanists are baffled over why so many corpse flowers are blooming at the same time. the smelly flower opened up this week at the botanical garden. typically, they take a decade to form their first bloom.
