searching for any marking on the pavement that may indicate the driver was attempting to brake. >> a few passengers managed to escape. they were what a chp officer call the walking wounded and others were trapped inside. it took first responders an hour to extract them. hampered by the pole that split the bus in half. the bus driver, the 57-year-old vasquez was unable to tell chp what had happened. >> he wasn't able to give us a statement at this time due to the except of injuries he sustained in the collision. >> the driver's family in los angeles woke up this morning knowing something bad had happened. >> i knew something was wrong when he didn't come back in the morning. he didn't wake me up. [ crying ] >> reporter: the dismantling of the sign and the crash investigation kept northbound highway 99 closed for nearly 11 hours, forcing a heavy truck and carload on to a frontage road and one lane was reopened after noon. the bus started in mexico and stopped in los angeles last

night. the next stop was actually in livingston. on the way to washington. the route also included a stop in sacramento where it is believed that the driver swap was scheduled. >> he is very responsible. when he got tired, he told the other driver, you could take over from here because he knew it was important for him to come home. >> 16 injured passengers are being treated at area hospitals. in merced county, david louie, abc 7 news. drowsy driving is the number one cause of coach bus crashes. that is according to the largest drivers union. the national transportation safety board estimates 36% of bus crash fatalities over the past decade have been due to driver fatigue. the union for drivers has been urging congress to pass the driver fatigue prevention act under the legislation, drivers would be paid time and a half for working more than 40 hours a week to make them less inclined to work other jobs. and now if you use the abc 7

news app, you've been getting alerts on the crash all day. get the news app for free in your phone app store. be sure to enable alerts you so get the updates as they come in. the napa valley wine train hit a car that ran a stop sign in st. helena this afternoon. this is surveillance video showing the collision. take a look at top of your screen. the white suv pulls on to the tracks at mills lane off of highway 128. the on coming locomotive hits the car and rotating it 90 degrees as you could see and pushing it off the road. the napa valley railroad police tell us that no one was hurt and the agency is of course investigating this crash. a child pornography investigation led to the discovery of videos of young girls undressing in a county theater. two men aaccuse -- are accused of recording the girls who worked at the vacaville performing arts center. lanny is there live with our story. >> reporter: the two men worked here for about eight years.

they are out on bail. they were fired. but instructors and management companies and the theater staff here all say they feel extremely violated. >> this vacaville community center is a place for dance performances and plays. but theater employees and staff amendment are shocked to learn about some drama happening back stage. >> i keep asking myself, how did i not see it and not know. how do you not know these things but you don't. >> the dance studio owner amy stokes learned from police that these two men, donald wade jr. and thomas mcpike are accused of secretly filming young girls undressed before the dance recital. >> we are looking at two specific videos taken in the back stage area at the theater, via cell phone. >> reporter: the men worked aztec nickal personnel and police say they recorded the girls from the rafters. we talked to judy barkette from the management group.

they hired wade and mcpike. >> and unfortunately, in this case, neither of the gentlemen had a prior criminal record. so the typical screening would not have accomplished anything. >> barkette said the company will look into the changes in policies and procedures. >> everyone in our company has frankly just been shattered by the breach of trust, the totally inappropriate behavior. >> the two suspects were arrested for possession of child pornography. that charge is from a prior investigation that turned up the video from the theater. the solano county d.a. will now consider new charges. in vaca ville, abc 7 news. a teenage lifeguard in an east bay community pool said she was sexual assaulted on the job. they were at the pool in concord where police say aman assaulted the 17-year-old lifeguard on sunday. the suspect sneaked down into the pool gate as someone left and he assaulted the lifeguard

in a shed near the pool. police don't believe he is from the neighborhood. the homeowner's association said it was letter and has a -- it was alerted and has alerted everyone by e-mail. >> we are making sure everybody is keeping their eyes open and keeping their eye out for each other and if they see folks that don't look like they belong, to question that. >> security cameras did capture video of the suspect. police are now reviewing that video very closely. a guilty verdict in pg&e explosion trial could mean utility wouldn't have to pay a half billion dollars fine. federal prosecutors will drop efforts to seek up to $562 million if they are convicted and instead the penalty would be the normal amount set by law, potentially $5.5 million. pg&e is accused of pipeline safety code violations resulting in the 2010 blast that killed eight people. the jury is deliberating the case. an unattended campfire is being blamed for a fire that has

burned 43,000 acres in monterey county. the vitors announced late -- the investigators announced someone left the fire burning in an off-trail section of a state park where fires and camping are in fact illegal and shouldn't be happening. the fire destroyed 57 homes and wiped out power to thousands of customers. help is on the way. the pg&e said crews have begun repairs on power lines and poles. we were at fire station 7 in the mission when san francisco firefighters returned from the monterey county firefighter. 22 firefighters joined the strike team. over the last week we would work 24 hour shifts fighting the fire and doing maintenance and food prep in off hours. they say it was a grind, as you could imagine. but meeting the people that they were working for made the effort well worth it. >> residents were more than appreciative, supportive, offering us the opportunity to be able to get in to use their bathroom if we needed to and bring us out snacks and coffee in the morning to warm us up.

like we were part of the community. >> firefighters say the area has not burned in a while. the fire is burning deep in an area difficult to access so it is going to be difficult to put out. police in berkeley believe the same men are responsible for firearmed robberies within a two-hour period near the campus. take a look at the map between 10:00 and 11:40 p.m. the first happened within 30 minutes on the south side. in the first two robberies they said they had a gun and in the last three they showed the gun to victims. and they made off with cell phones and other belongings. national night out parties are underway. the event brings neighbors outside in a symbolic statement against neighborhood crime. it is taking on special significance in oakland where hundreds are expected, including the mayor. abc 7 news reporter wayne freedman is live at one event being held. wayne. >> reporter: we're on 28th street right now and actually they expect them to show up here

a new forward report accused officials at the refinery of a lack of safety culture. it led to several serious incidents over a five-year period including a 2014 acid spill that left two workers injured. laura then is live at refinery

near martinez. laura. >> reporter: well not only did the report find there were some lax safety measures here at this refinery, it also found that officials tried to minimize an incident two years ago that seriously injured two workers. a federal agency now said there was a deficient safety culture that led to 15 separate acid spills at the tesoro martinez refinery over a five-year period. the most serious on february 12th, 2014. >> two workers were burned at the unit and an estimated 84,000 pounds of acid was released on to the grounds. >> the workers suffered first and second-degree burns and it happened again to two more workers a month later. >> while they appear to be isolated events, they are indicative deficiencies at the refinery. >> the report includes the

sampling system that failed. >> our report notes that the sampling systems at the refinery routinely exposed operators to avoidable risk. >> tesoro claims unspecified inaccuracies in the report but, quote, since 2014, they worked closely with multiple agencies on the investigation and we conducted an extensive review of procedures, control and trainingch one of those agencies is cal osha, which fined them $45,000. >> they've implemented a safety culture program. they have got the union involved in the safety culture program. they meet with employees on a much more frequent basis. >> tesoro officials told us they've improved the acid sampling prohe is and updated the protective equipment and practices. laura anthony, abc 7 news. the san francisco board of supervisors gave final approval to settle a civil suit filed by jill inmates who said they were

forced to participate in gladiator style fights by sheriff deputies. the payout about l be split between the four inmates. they accused four deputies of forcing them to fight each other while incarcerated in a san francisco jail. all three deputies face a criminal charge. one resigned from the department. transgender rights took center stage at the state capitol today. lawmakers make a pledge of support for what they call the civil rights issue of our generation. they will protect the right of transgender people. >> we need to work with our transgender community to make sure there is true equality and transform the hearts and minds of calans so we all stand together. >> trans gender people are more lick likely to live in poverty and they will not singing out transgender or nonconforming californians for discrimination

or disrespect. and into consumer news and that includes veggie burgers. >> and michael finney knows which are the best. >> 25% of us say we serve veggie burgers once a month and many eat them several times a week. perhaps my daughter who is a vegan and as consumer reports tell us, it has come a long way. it is very possible that the best burgers at your summer barbecue may not have a shred of meat in them. >> they think it is flavorless or rubbery but we found plenty that are delicious. >> wendys is testing a black bean burger and white castle has a veggie slider on the menu. but how do supermarket veggie burgers compare. consumer reports put them to the test with surprising findings, like the fact that they are not all low in calories. while light, light smart patties have only 100 calories, every

sunshine has 360. but many are topped for nutrition and taste. if you like your veggie burgers to mimic meat, these morning star farm's grillers original come closest to the taste of a regular burger, with 130 calories. and these boca all american flame grilled burgers do taste grilled and cheesy with 120 calories. if you prefer the taste of grains, seeds and vebmgys. these sodium burgers have just 110 and bush room and nutty flavors and they are equally tasty but have half as much sodium as the regular version. in all in all you have plenty of good choices if you are looking to say, make mine meatless. consumer reports said it didn't factor protein into the nutrition ratings buzz most americans -- because most americans get plenty. but vegetarians might be surprised they contained as little as four or five grams. now among those, consumer reports recommends both the

morning star farms grillers and the boca all american flame grilled that have 15 grams of protein each. >> thanks, michael. well californians are conserving less water. numbers show we save 21.5% this past june compared to more than 27% in june of 2015 when the state was at the height of the severe drought. the state water resources control board expected conservation to drop after they eased restrictions. the best -- the board it said may still put limits on some communities that saw significant increases in water use. >> so we still need to save as much water as we can. >> we do. okay. none is falling any time soon. >> sandhya patel is here with the accuweather forecast. >> hi there. we are still in the drought. fifth year. and there is water coming other than spotty drizzle. right now looking at sunshine behind me. a little bit of fog looking toward the north. let me show you live doppler 7

hd and your morning commute like this morning would be misty and drizzly in spots along the coastline and that is where the fog is sitting on the radar as you notice. and here is a view of the shallow marine layer from the mt. tam cam as we look toward sausalito, and richardson bay and 67 in oakland and in the 70s. morgan hill 82 degrees. our highs so far today, upper 90s. upper 50s -- excuse me to the low 90s. and we are watching the fog roll in from the sfo camera. 77 in santa rosa. 74 for napa. low 70s for fairfield and you get the breeze. and toward the bay. fog near the coast overnight and mostly sunny tomorrow afternoon. and we're looking at cooler than normal temperatures on thursday through saturday. here is a look at your morning. when you get going, you will see the fog around. temperatures in the 50s for all of you. so cool enough to where you need to add an extra layer but inland areas will start out clear.

hour-by-hour forecast will show you where the fog is sitting tomorrow morning between 5:00 and 7:00 a.m. mainly at the coast. a few parts of the bay. so not as widespread as we saw this morning. but there will still be spotty drizzle along the coast. so at 7:00 a.m., you are looking at the fog near the overnight bay shoreline and across the north bay. heading into the afternoon and most areas will enjoy the sun. we'll have the usual spots from san francisco to the san mateo coast with some fog. no fog expected in the afternoon for the sonoma count fair. in the last week. its a mild start. sunshine at 11:00 a.m. 71 degrees. and then warming up into the low 80s by afternoon. really quite comfortable. even though it is cooling down in the evening hours. so kids are out for the summer. if you are heading to the sonoma county fair, it should be a beautiful day. highs for wednesday in the south bay. with hazy skies in the south bay due to the smoke from the big sur fire, 82 in san jose. 85 in gilroy. 85 in santa clara. on the peninsula, upper 70s.

what you are watching is volunteer firefighters taking part in an unusual rescue in sonoma county. they are trying to free a family cow named tiny after it tunnelled down a hill at a ranch on mountain home drive. the rescue specialists helped with the heavy lifting.

instagram is taking a page from snap chat and in doing so also taking aim at the app. the facebook owned company is rolling out a new feature called stories. with it, you could make your instagram photos and videos disappear in 24 hours. sound familiar? stories appear in a bar at the top of your normal instagram feed. instagram said it hopes this will eliminate the worry of overposting and allowing you to post goofery and everyday content more often. you should notice the change in the next few weeks. the white house announced that google x could test the project wing drivery service in the united states. the flights will take place at one of six faa sanctioned drone test sites and none of which are in california. this is video of google of drone testing in australia. they plan to spend $35 million over the next five years on unmanned flight research. the department of interior also plans to expand its use of drone flights.
