. and breaking news is happening in san francisco where police are investigating a homicide at a popular mall in the heart of the city. someone found the man's body this morning. somewhere inside of the westfield san francisco center building, which fronts market street. police tell us the victim is a man in his 30s. westfield management said they are cooperating with the investigation and the mall will remain open normally. lonnie rivera is at the scene and we'll have a live report coming up at 5:00. in the meantime follow us on twitter at abc news bay area for breaking developments. good afternoon, i'm ama daetz. >> and i'm larry beil. a break in the case involving some of the shootings in the east bay along the highway 4 corridor. part of a fugitive sweep to nab

24 suspected members of the norteno gang. leslie brinkley is live outside of the contra costa district attorney's office with the very latest. leslie. >> reporter: larry, the gang members were terrorizing the community according to chp, fbi and local law enforcement agencies. they were involved in several freeway shootings, they were involved in human trafficking and even murder plots. this is the customized beoat th d.a. said the gang members rode around in, the 14 on the front, said they bought with illegal drug profits and seized was the mercedes and the porch and the backseat filled with a stash of marijuana. ten weeks of investigation with 12 local and federal law enforcement agencies cul mainsoe ated -- culminated in many

arrests. >> we search 21 houses on the same time virtually, so it is a huge operation. >> these are bad guys and what they are doing are bad thing. >> reporter: concord police was at the center of it all as they call on a task force to investigate an uptick in wine. a marijuana grow house involved in the raid is estimated to have stolen $30,000 worth of utilities, guns and methamphetamine and heroin were also seized. the ringleaders were 31-year-old sean dunne and 28-year-old mariano coronadcoronado. >> individuals were attempting to murder multiple people. four individuals charged with conspiracy to commit murder. so the good news is we stopped them before they committed the crime. >> these are violent people and they have no regard for human life and we are working as hard as we can all of the agencies to attack that. >> reporter: chp said they believe two to three of the recent freeway shootings in the

highway 4 corridor may be tied to the gang members that were arrested. well of course there have been dozen of shootings on the freeways in recent months but solving two or three of them authorities say is a big step in the right direction. 24 arrests will put a big dent in violent crime in this area. live in martinez, i'm leslie brinkley, abc 7 news. >> what do authorities say about the number of norteno gang members operating in contra costa county? >> reporter: well, ama, the number i heard today was between richmond and brentwood, just along this highway 4 corridor, 75 to 100 norteno gang members. they arrested a few earlier this year. you add in the 24, and that means they've got about half of them now off the streets. that is a big step in the right direction as i said. the biggest factor is intimidation of witnesses. what that means is more people may feel more comfortable coming fort which could lead to solving

more crimes here. back to you. >> leslie, thank you. a pedestrian walking on railroad talks in south san jose was hit and killed by an actrack train this morning. we were over monterey road at skyway drive at 11:00 and it involved a coast star light train that originated in seattle and bound for l.a. none of the 239 passengers on board the train were hurt. a train resumed the run after a delay for the investigation. the pedestrian's identity has not been released. a single engine cessna with a student pilot at the control over shot the runway in east san jose this morning. sky 7 hd was overhead as they plowed through a airport fence and on to a busy road. pilot and instructor walked away unharmed. the road was closed as they worked to remove the plane and the downed fence from theroadway and reopened to traffic before lunchtime. a slow and bizarre chase from the peninsula to the east bay wrapped up this morning three hours after it started. >> it began in men lo park at it

2-:30 a.m. and ended in oakland hills. police tried to pull the driver over for possible dui. he backed up and instead tried to run over the officer. that officer is not hurt. take a look. at what point the driver gangled a large pair of garden sheers out of the window and spotted driving the wrong way on 880. tiffany wilson has the details. >> reporter: after hours of following this toyota avalon at speeds between 25 and 40 miles per hour, spike strips were all semblance of rubber tires. >> the wheels got lodged under the car so it couldn't drive any more and started a small five and he stopped and physically couldn't drive any further. >> reporter: and heavy smoke surrounded the car as chp officers approached. when the suspect refused to cooperate, officers fired several nonlethal bean bag rounds at the car's windows. this is some of the damage left behind. and then they brought in a contra costa canine unit.

>> once he was taken into custody, he was sweating profusely and signs and tim toms of in tox case or a mental disorder. >> reporter: the suspect agitated and practically incoherent. officers spent several minutes trying to calm him down as they waited for an ambulance to arrive. the driver was taken to a nearby hospital for treatment of the dog bite. meantime the investigation of the cause continued. officers found at least one pill bottle inside. the chp is not releasing the suspect's name at this time but they tell me they are checking with his family to see if there is a history of mental illness. in oakland, tiffany wilson, abc 7 news. prosecutors will decide if a homeowner is going to face charges stemming from last year's valley fire in lake county. that fire killed four people. cal fire revealed today faulty wiring in a heating system for a hot tub sparked this massive

inferno when flames destroyed 1900 buildings and charred more than 118 square miles and considered the third most destructive fire in california history into the soberanes fire is at 50% containment and burned more than 68,000 acres and is burning at steep inaccessibl area ---in accessible areas. they crews hope to have full containment by the end of the month. progress has been made fighting the pilot fire in san bernardino county. the u.s. forest service said the fire burned 7800 acres but is 64% contained which is up 6% from yesterday. they attribute the drastic improvement to containment lines firefighters have been building since the fire was reported around noon on sunday. well spare the air alert has been ordered for tomorrow partially because of the fires. >> drew tuma here with a look at the accuweather forecast. welcome back from vacation,

you have issues. and our temperatures will increase. and we'll look at how hot and when in the five-day forecast coming up. >> thank you, drew. the marine mammal center confirmed a dolphin found stranded and motionless in the mudflats south of sfo is dead. sky 7 hd flew over the rizzos dolphin yesterday and this morning a person from the center confirmed it died. they are trying to recover it for a possible necropsy but access is tricky because of the muddy location there. south bay police are looking for two burglary suspects that are part of a trio that broke into a apple building this morning. >> the three led them on a chase that led to san jose where one suspect was captured. matt keller with all of the details. >> reporter: the broken glass door tells the story. apple security spotted three people stealing from one of their buildings on bub road in cupertino at about 4:20 this morning. a sheriff followed the suspect's

bmw on highway 85 into the neighborhood in san jose where the car chase came to an end and a foot chase began. deputied assisted by san jose police set up a large perimeter around camden and lee avenue. they were going door-to-door looking for the suspects. >> the second deputy responded to the scene saw the suspects fleeing on foot. so they were able to see what direction they were going. >> early on they were able to spot the driver of the bmw. >> he was caught in starbucks. >> an employee said the man ran inside and tried to get in the bathroom but didn't have the code. law enforcement arrested him shortly after. >> i saw the police and ambulance were all right around here and they were loading a guy into the ambulance and he looked a little roughed up. >> reporter: the search for the other two suspects was called off at 8:00 a.m. investigators recovered stolen laptops from the suspect car and apple had no comment on the incident. in cupertino, matt keller, abc 7

the san bruno city manager said yesterday's federal jury guilty verdict against pg&e means justice was served an the utility in her words put profit over safety. >> but many residents in the neighborhood which was the epicenter of the explosion, they remain unsatisfactoried with ie unsatisfactoried with the verdict. vic lee is there. >> reporter: those who we spoke to who are disappointed with the verdict and think the fine, the $3 million is a drop in the bucket for this giant utility. but the city's position is this was never about money, this was about holding pg&e accountable for what happened here in san bruno, that this was no accident, that this was a

man-made disaster. >> these guilty verdicts finally hold pg&e fully accountable for their deliberate negligence and their wanton regard for public safety. >> connie jackson minced no words. it was almost six years since the fire took eight lives and destroyed 38 homes. the city fought tooth and nail against pg&e, fighting to bring the corporate utility giant to justice. the federal juries verdict -- guilty, to six criminal counts of violating the federal pipeline safety law including one count of obstructing the investigation. the district attorney steve waxstaff interpreted the jury's decision this way. >> you are held accountable. you are a company that is properly described as felons. >> reporter: pg&e now faces fines of up to $3 million. at the last minute, federal

prosecutors backed off asking for hundreds of millions in penalties. in the evidence, which d.a. wagstaff has seen, did not support prosecuting the company's executives. >> you know how it works. the fingers point. i was just following directions or i didn't know what was going on down there. >> somebody should be charged and held responsible for murder of everybody that died. >> reporter: tammy echoed the sentiments of many who live in this neighborhood near the epicenter. [ inaudible ] [ technical difficulties ] >> those that closed it were never held accountable so the companies was and the individuals were not. >> reporter: well pg&e has yet to directly comment on the verdict itself. but they did issue a statement -- after the verdict was red and it said in part we'll never forget the lessons of the past and making unprecedented progress since the accident and pg&e said it is

fully committed to safety. vic lee, abc 7 news. >> vic, let's talk more about the sanctions here because there is a lot of dissatisfaction with the prosecutors only asking for $3 million in penalties, hundreds of physicals would have been more of a deterrent and nobody is going to jail and those officials, they don't face any penalties or any fear of being locked up, what can the judge do in this situation? >> reporter: well, first of all, larry, there will be a sentencing phase in the next 60 to 90 days in federal court. and the judge cannot up that fine of $3 million. the judge can lower the fine. and he's expected to make his decision during that sentencing phase. but again, the city of san bruno, they are going to ask the judge to order corrective actions against pg&e. in short, they want the judge to appoint an independent monitor to oversee pg&e going forward and that is something they've always wanted.

>> vic lee reporting. thank you. hundreds of court workers in santa clara county picketed for a sixth day. the work stoppage discontinues as the union agreed to mediation over pay raises. sessions are expected to begin tomorrow. the union said workers will continue to strike during mediation. if you have court business they are recommending you still go and trying to accommodate as many people as possible. very emotional testimony today in sacramento as lawmakers consider a bill aiming to prevent the deadly berkeley balcony collapse from last year. >> one victim's life was forever changed spoke in sacramento today. kristen zse is here with more. >> reporter: the young woman who spoke emotionally today was an irish exchange student in berkeley for the summer. berry was celebrating turning 21 when tragedy struck. this was what remained of the fourth floor balcony that collapsed right off the uc campus in june of last year. six young people died.

ashley donahue of rohnert park and five irish students and their friend and survivor berry tells the appropriations committee today, due to her traumatic brain injury, she cannot go back to college. >> i had listerations to my liver, kidney and spleen and a collapsed lung and broken ribs. i can't believe why you are debating this bill. people died. you should ensure that all ball cons are ensured to make sure this doesn't happen again. >> reporter: the senate bill 465 would increase oversight of contractors following the balcony collapse officials learned the construction firm that built it had paid more than $26 million in building related settlements in recent years. now this bill is a modified version of a proposal defeated last summer and it must clear the committee by this friday in order to move forward.

>> thank you. a new study but berkeley and harvard links cancer causing drinking water to fire fighting foam. this is video of the foam being used to doubt the flames on a crash at sfo back in 2014. chemicals from the foam are contaminating drinking water supply around military bases and where it is used in fire fighting drills. >> this particular class of chemicals are uniquely problematic of chemicals because they never break down in the environment, not for a million years and the ones that we studied are toxic. >> the author of the study said the use of the chemical could be reduced by 90% and they are calling for a complete ban on the foam during fire training exercises. the deputy fire chief in oakland told abc 7 news if they are instructed to stop using the foam, they will. >> it is time to check on the weather. we have abc 7 news meteorologist

saying john had not been feeling well the past few days. he was so wonderful, so talented, and i guess the most beautiful thing about him was john saunders had zero ego. i saw him in toronto at the nba all-star game back in february, we hadn't seen each other in many, many years, he came up to me with this huge smile and he said larry, welcome to canada. he was from canada and had so much pride and was beaming over the events in toronto. and i said it is 31 below and how do you live here and how did you grow up in this and he said it is never this cold. even i'm freezing. and we laughed and spent a few minutes together and it was wonderful seeing him and when i saw the news on twitter this morning, i was just -- i was just stunning. john saunders, a great, great man, gone way too soon, at 61.

new oversight when it was discovered to be a likely indian burial site. >> reporter: the nine acre site is located along highway 87 south of capital expressway. david louie is live at the site to explain how this discovery will impact the project. david? >> reporter: well, the site looks like it is nearing completion but on the far edge of the property a major trench is being dug and that has the potential of disturbing historic artifact an remains. in fact in 1973 human remains were discovered here and that is why an archeologist and a tribal monitor will be watching the work here very closely. the county is in the process of doubling solar sites from six to 12, including this one commuters have been watching going up in blossom valley. we give you an overview. the site is capable of powering 215 homes for a year but the site shows up on historic land

as one belonging to a tribe. san jose state said it is likely a native american burial site. >> there is evidence that some of the burials date as late as around 400 years ago. there may be some other kinds of evidence that pushes it back to at least maybe 1700 years ago. >> reporter: while work started in june, the county planner was told only last friday of the significance. site was recovered by fill dirt when the highway was built so the native soil is protected except for trench work now underway. >> and we had archeologists come out and make sure we haven't disturbed anything and so far we are working in fill and we haven't disturbed anything. >> reporter: anthropologists are working in concert with the 600 members of the tribe to have an archeologist of their choice on-site along with a tribal monitor. it is believed the native soil may be exposed at the far ends

baltimore police department needs sustainable reform. >> reporter: city officials agreeing to a court order to overhaul the police department and the policies. >> much work remains to be done. and change will not happen overnight. but our efforts have started. the necessary process of change and reform in baltimore. >> reporter: this following a similar overhaul of the police department in ferguson, missouri, after the d.o.j. found some of the same discrimination practices in place there. marcy gonzalez, abc 7 news, new york. delta airlines expected to resume normal operations any time now. the airline canceled some 277 more flights today. all stemming from a power outage on monday in atlanta that grounds hundreds of thousands of passengers. in all the airline canceled 1800 flights on monday and tuesday and hundreds more delayed including several at san francisco international. the airline is offering refunds to passengers and some will receive travel vouchers for

facebook, twitter and e-mail. and the first question is from john t who said how come i'm forced to pay for flood insurance when not every house on my block is forced to pay for it. >> you are forced by the mortgage holder of your home and they have written if you live in a flood zone, you have to have flood insurance. and flood zones change. and fema puts out maps and if you fall within the map, you have to pay. and what has happened to you, is they've expanded the maps and they say now you are in a flood zone. well you can challenge that by getting an engineering report and he showing your home is not in a flood zone. so why aren't your neighbors paying this same deal, having to go to get the flood insurance? it is because they may have already filed an engineering report. no one will tell you about this. if you go up and pick up their engineering report and turn it

49ers fans today. the stadium, home to the 49ers 70 years ago hosted the team once again for a practice any way. sergio quintana joining us live with the details. >> reporter: well there are a few things that have changed since the 49ers last played here back in 1971. but of course, what has not changed is the devoted fan base. and today was a very special treat for the most devoted 49er faithful. for the 49er faithful this was more than just a chance to watch the team practice before the season starts, it was also an opportunity to reach back into the team history. >> you used to come to games here. >> yeah, me and my brother and neighbor. >> this stadium was the 49ers first home playing field when they were founded in 1946. plenty of fans have fond family stories passed down through generations. >> my grandfather would come over here from the elk's club on

good evening. i'm dan ashley. >> and i'm kristen zse. let's go right to lonnie rivera live near the mall. >> reporter: yes, it is business as usual here in the shopping area. but earlier this afternoon police had enforced this area as they blocked off as they are investigating a crime here. and now here is what we know. about 10:15 this morning police received a call from someone reporting a body of a man discovered inside of the mall. when the medical examiner came to westfield center mall the examiner ruled that it was a homicide. still a lot of questions about where and how this man was found but police would only say he is a white male in his 30s and that he was found inside the mall. homicide detectives entered through the back area of bloomingdale's but they are not saying much about where exactly inside the victim was discovered. >> we're not disclosing the exact location of where the body was found at this point to protect the integrity of the

investigation. but we are confirming it was found inside the mall. >> reporter: westfield management issued this statement saying the center is open and operating normally and we are cooperating fully with the investigation. now the mall hours are 10:00 a.m. to 8:30 p.m. on the website. so the call came in shortly after the mall opened. the investigation still very active and homicide detectives are asking anyone who might have been here and saw anything this morning, anything suspicious, to contact them. that is the very latest, reporting live here in san francisco, lonnie rivera, abc 7 news. >> thank you very much. a contra costa man accused of killing his wife was charged with murder and torture today. the murder and torture charges mean 69-year-old john tourcharia could be eligible for the death penalty. they arrested the former baseball player after finding his wife dead the night before at their home in
