safe. however his mother is still missing. she was told the child services was taking custody of the boy and won't say why she lost custody but records show she had been in trouble at least twice in the last decade. a toddler received injuries when he fell from a foster apartment building. he was flown to the hospital for treatment. the boy was in a common area at the complex when he tried looking outside a window and the screen gave way and he fell 20 to 25 feet and they're investigating what happened. the in instructor that the skydiving accident was not certified. he lacked certification. he and an 18-year-old were killed when their parachute did

not open. the association is the only one recognized by the faa for skydiving jumps. the faa is now investigating that accident. the owner of a bankrupt wine company admitted in court he took $45 million from customers and didn't deliver. he owns premier cru and didn't deliver. he admitted to what was a wine ponzzy scheme. he was selling rare and expensive wine he knew he couldn't deliver and he paid for an expensive car and private golf club memberships and gifts to women he met online. he faces 20 years in prison. we're expecting a warm-up in the next few days. spencer christian back from vacation. about time i might add.

baseballs. he loved baseball and pitched in college and played at the high school in san mateo. meanwhile, police are still trying to track down the shooter. it has been five days since calvin riley was shot and killed at san francisco's aquatic park. still, not many answers. police have made no arrests. we don't know a motive. there are no known witnesses and know description of the shooter. what we do know is riley and a friend noticed someone lurking at the top of a hill while they played pokemon go on their ph e phones. riley ran ahead and jogged past a building alone. his friend heard gunfire. there are no security cameras that face that spot, but investigators say cameras could still be the key to cracking this case. >> if any also had a photograph for video, maybe took a selfie in the area between 9:00 and 10:00 on saturday night, you might not realize there was something in there but there could be information there in useful to the investigation. >> i think it's possible to get these answers.

>> reporter: rick smith, a former fbi agent says there's probably a lot happening police can't reveal. he says investigators need to reach out to more of riley's friends and find out who else he came into contact with and build a timeline. >> if it's a just a random victim of a gunshot that went off in aquatic park at 10:00, that is bizarre and they'll never figure that out. i don't think that's what happened here. >> reporter: police regularly patrol the park, a popular tourist spot near fisherman's wharf. meanwhile, riley's family and friends will gather at st. gregory's church in san mateo to remember the 20-year-old and say good-bye. the national park service is leading this investigation and they are asking for tips. larry. >> they are asking for tips but do they have any leads? >> reporter: they set up a tip line and received quite a few

homeowners insurance rates going forward. yesterday, california insurance commissioner, dave jones, released a statement criticizing the consumer watchdog report. jones said no final decision has been made on the state farm rate case. he asked an administrative law judge to consider more evidence before issuing a final order. delta airlines is once again flying at full-speed. a computer outage monday grounded and delayed thousands of flights. >> the ceo of the country's second largest airline talked about problems that snarled traffic across the globe. >> reporter: it was the computer meltdown felt by delta travelers around the world. >> everything is down right now. >> everything is down? >> yes. >> reporter: the ceo speaking out in a tv interview. >> we never experienced this outage before in our history. i am personally responsible for this happening and will pers personally make sure it doesn't happen again.

macy's across the country sh shuttering 100 stores a reflection of big changes in the retail industry. good evening. >> there are nearly two dozen macy's in the bay area. they have not revealed which e ones will close but we do know there will be some impact loc locally. david louie is live at the macy's in san jose. >> reporter: this is a case of macy's reinventing itself realizing online shopping is really growing. by closing 100 stores across the country will mean layoffs about 100 per store and increase profits and allow them to invest into digital. macy's isn't saying if stores will close here but they already closed one last year. sales and profits have been
