>> yes, jessica and natasha, the construction company responsible for building the new dorm got back do me say that this delay was all caused by a design that required additional testing to meet california building code. they have been running double shifts for the past couple of months to expedite the process. they are simply not ready for this weekend move in day. moving is never easy but san jose state did not think it would look like this, rather than welcome 820 freshmen into the brand new ten story high recognize students were notified yesterday they will have to live here in the bricks. >> i am disapound because it is a big change. >> they scrambled to get the dormitories ready for a last incoming class. >> we know it is still going to be tremendously difficult but we will do everything we can to make it work.

movers to him them take their stuff across the street. >> thank you. firefighters in southern california are making progress against the raging blue cut wildfire. new video shows the flames in san bernadino county, the fire has now burned more than 37,000 acres but containment has jumped to 26%. in lake county more progress on the nearly 4,000 acre clayton fire. there was an update released that the flames are 65% contained. full containment is expected by sunday. officials now say 190 homes were destroyed and eight commercial buildings and 100 other structures. >> some of the smoke from the soberanes and chimney fires burning to the south is filtering into the bay area. this is video from walnut creek camera this morning showing the thick haze over highway 24. this is where we are in the middle of the "spare the air"

day and meteorologist drew tuma is on the roof with a look at the conditions. how are we doing? >> even cross the bay right now there is incredible haze in the atmosphere. you cannot see across the bay into oakland. part of reason why, from the sfo camera you can see the haze as the planes were taking off with a lot of smoke in our atmosphere, several fires are just to our south. the soberanes and the chimney fire and the cedar fire is feeding in smoke to the upper summer and it is slowly filtering down to the surface. we have a spare day in affect and that is the worst of it, with the cool air and across the entire region we have moderate air quality with breathing issues take it easy. and stay indoors with the fresh air. rather than in the smocky atmosphere. we do have encouraging news for cleaner air, and cooler number on the way with a look at that in the five day trust. >> developing in marin county where the c.h.p. is

investigating a deadly crash they believe is the result of drinking and driving. this is video from the scene on northbound 101 near san antonio road where three cars collided shortly after 1:00 o'clock a.m. and the c.h.p. tells us minutes before they received calls of a wrong-way driver on freeway. one victim, a woman, died at hospital. a delivery truck driver suffered minor injuries. the suspected drunk driver survived and was arrested. the c.h.p. is working to confirm whether it was the driver going the wrong way on 101. >> v.t.a. riders expect big delays through the afternoon. the agency is repairing an overhead wire discovered damaged last night near children's discovery museum station in san jose. >> when it happens we take the fire down, and we have trains last out in the system and it is helping our morning commute this morning. >> some of the trains had to be towed and they set you bus bridges to assist passengers operating between alum rock and win comfort line. >> a bay area woman accused of

>> in the central valley, a police officer and a 29-year-old girl are both recovering after being hurt in a shootout in porterville about an hour outside of fresno. we are learning that the suspect started shooting after running from police during a traffic stop at 11:00 last night. neighbors her at least ten gunshots. the officer was shot in the leg. lee and his partner fired back hitting the suspect several times identified as rubin carol and is out of surgery right now and is expected to survive. investigators say there were a number of outstanding warrants against him.
