that breaking news involved the arrest of this man. san francisco 49ers footballer bruce miller. miller was taken into custody by san francisco police early this morning. at this point, the circumstances are still unclear. it's not the first time the 29-year-old has been in trouble with the law. he pled no contest last year to a disturbing the peace after an argument with his fiance. he was ordered to attend a domestic violence course. test. test.

test. test. test. test. just hours ago, president obama landed in laos on the first presidential visit to that country ever. hours before that, he addressed the controversy surrounding colin kaepernick. he said he's glad he's engaged in the democratic process and protests from athletes are not new. >> my understanding at least is that he's exercising his constitutional right to make a statement. i think there's a long history of sports figures doing so. >> president obama is backing

colin kaepernick's right to protest and doing it on the world stage. he was asked about the nfl quarterback during the g-20 summit in china. an international gathering of leaders from 20 of the world's major economies. kaepernick has refused to stand for the star-spangled banner before two 49ers preseason games. >> i think he cares about some real legitimate issues that have to be talked about. and if nothing else, what he's done is he's generated more conversation. >> kaepernick says he's protesting police violence against african-americans. his protests have spurred outrage from some, especially many veterans groups. >> my suspicion is that over time, he's going to refine how he's thinking about it and maybe some of his critics will start seeing that he has a point. >> but kaepernick has gotten support from others. a handful of nfl players and also other sports stars.

most recently, megling rapinoe took a knee in their match against chicago. and rapinoe, who i mentioned, tweeted out this after taking a knee. she says it's the least i can do, keep the conversation going. in the studio, jessica castro. >> thank you. >> one east bay high school is preparing for grieving students to come back tomorrow morning. >> a terrible crash over the weekend took the lives of two teens. amy just spoke with the principal at the high school. amy. >> yeah, it's a holiday, but the principal is here right now at the high school, hard at work on a plan for tomorrow. he knows his students are grieving. look at all the candles left behind on campus from a vigil. so when students get here tomorrow, they will have mental health experts here and a space set aside for them if they aren't quite ready yet to go to class. >> it's not going to be a normal day. logan students are resilient.

>> the principal of james logan high school in union city says he will do all he can to help students deal with their grief tomorrow when they return to school. they'll be facing a day without izaiah mease and joe ioramo. the two died in a car crash earlier sunday morning. a third student was also in the car and is in the hospital. hundreds of people turned out for a candlelight vigil last night on campus. >> they were very well known on our campus. absolutely involved in every possible extracurricular and academic opportunity. >> the principal says even though this is a tough time, he encourages parents to send their kids to school tomorrow. >> i think it's important that students are with their friends and peers and especially classmates and teammates who need to see one another, who need to be with one another, even if it's just to say hi or give hugs to one another or cry with one another. >> as far as the third student

in the car, the principal tells me he's no longer in critical condition, but he is still in the hospital and he has a long road to recovery for him. he is a senior here at the school. recording live in union city, amy hollyfield. >> good of the principal to be thinking of his students. >> police in the south bay need to find a convicted sex offender fast. this is 56-year-old david russell. san jose police say he tried kidnapping at least two women just this past week. one in the willow glen neighborhood near hamilton and meridian avenue. he tried grabbing a young woman and dragging her to his car. the other incident happened four miles away. >> i have been here at night with my friends filling up my gas tank. so it could have been me. or one of my friends. >> investigators believe he's driving a newer model nissan rogue. no plates on this vehicle. if you see david russell, please

give police a call immediately. >> moving to the east bay where police are still searching for one of the two suspects they say stole a couple cars from a dealership. >> an employee wasn't about to let them drive away without a problem. matt is live in fremont. >> reggie, police have yet to speak with that employee about why he gave chase overnight. as for the suspect, police are interviewing him right now. how do you keep car thieves away? at the bay auto dealership on perreaulto and bay mont, you build a fence. they were called by the owner to measure the property line of the dealership because four vehicles have been stolen recently. they got a call late last night that a vehicle was stolen along with a bunch of keys. officers came out and took a report. then, just after 2:30 a.m., the same worker called while getting on northbound 880 at thornton and said he was following two vehicles stolen from the dealership. >> their attempt to flee and evade arrest, they ended up

causing a three-vehicle collision here, and continued fleeing this location and getting involved in another solo vehicle collision not too far north of here. >> at one point, all northbound lanes were closed down while the chp investigated the two crashes and cleaned up the scene. firefighter husband to cut one of the innocent victims out of their vehicle after it rolled over. that person was taken to the hospital to be checked out. the other person was not injured. one suspect was arrested while the other ran off. >> they weren't in pursuit by law enforcement agencies. none of us were involved yet. they may have been chased by a security guard or an employee of the car dealership. >> fremont police say they don't want people to put themselves in harm's way or mack the matters worse. as for the suspect, he could face charges of burglary, auto theft, and hit and run. matt keller. >> wild story, thank you. >> cleanup crews are working to

contain fuel leaking from this historic river boat that capsized. the spirit of sacramento floating upside down near bethel island in contra costa county. it had mechanical problems and started taking on water before sinking early sunday morning. according to the sacramento business journal, the tours ended in 2009. fish and wildlife officers are worried about 600 gallons of diesel in the boat's fuel tanks. the new owners just bought that boat at auction on saturday. >> still ahead at 11:00, we are here and working on this labor day holiday. and apparently, it's not that uncommon. >> plus, laboring for your vote on this labor day. hillary clinton gets a new ride as she and donald trump pitch to voters in a critical state. >> also -- >> can i get a radio tech? >> a sweet rescue at sea. a fishing boat crashes into rocks and started taking on water. a good samaritan who got there just in time.

san francisco right now on this labor day. for the annual race. did i say that right? i hope so. it's tour of san francisco in italian. abc 7 news went right outside our studio to find competitors racing by right outside. it's been a city staple since 1975. it's not for adult women and men athletes. kids also to get to hop on their bikes for a couple laps starting at levi plaza. >> i almost walked right into that. >> because you're used to stepping right outside. >> great to see them. >> gas prices are the lowest they have been in 12 years nationwide, and for once, we're included here in the bay area. the national average for a gallon of regular is $2.21. that's 20 cents cheaper than this time last year. the average household expected to pocket an extra $300 in savings this year. bay area prices are always higher, but right now, they're quite a bit lower compared to what we were paying the same

wave is in the offing. for today, no matter what body of water you're near, the delta, bay, or coast, it's going to get breezy. 24 to 38-mile-per-hour winds from 1:00 this afternoon to 9:00 this evening. let's see what's going on with the cloud cover. we have a little more sunshine along the coast. compared to yesterday. compared to today, but you can see it's really starting to clear out nicely. if you want to get the sun, the uv instex still very high. temperature, we started in the 40s in santa rosa. we're up to the 70s. 65 in san francisco. 66 in san jose where it's going to turn out to be almost 80. a lot of upper 70s to low 80s. in the peninsula, a lot of low to mid 70s at least on the bay side. on the coast side, half moon bay at 63. san francisco will go from say about 60 to 67 downtown. daley city, 62 degrees. warm sunshine in santa rosa, about 83 degrees. and along the east bay shore,

delightful day, oakland at 69 degrees. the only worry is the strong sunshine. ifcoliseum, 67 at first pitch. let's look at the east bay neighborhoods. this is as cool as it gets this week. mid to upper 80s. 90s, they're coming in tomorrow. here's a look at what's going to happen the rest of day. we're at 60 at 5:00 at the coast. 82 inland, and 50s, 60s, and 70s at 7:00. grab a jacket. we're going to cool to the 50s and 60s by 9:00. i want to show you the tropics because tropical storm newton is getting closer to becoming a hurricane. it could become a hurricane right as it slammed into cabo san lucas tomorrow morning. we'll keep an eye on it. at home, look at the heat that's coming in, tuesday, wednesday, thursday, friday, saturday, and our inland neighborhoods, 90s there. 80s around the bay. but it's not your classic offshore wind event, so the heat never makes it to the coast.

>> your classic offshore wind event obviously. >> classic, this time of year. >> thank you. >> you ready to see someone doing something really stupid. >> this was really shocking when i saw this for a first time. a landmark rock formation has been completely destroyed by vandals. >> the destruction of this was filmed by a man who was nearby. here it is. the video shows a group of eight men trying to topple pedestal rock in oregon's natural area. at one point, five of the men back off. the smart ones. three others keep going at it. wobbling the sandstone formation until, yep, it breaks apart and shattered. the witness confronts these vandals. listen to their infuriating excuse. >> they were standing on top of the rubble of the rock, laughing, smiling, giggle. they told me it was a safety hazard and they did like the world or oregon a favor, that they knocked it down.
