francisco marriott. melanie? >> reporter: this is where the fight happened around 2:35 monday morning that led to bruce miller's arrest. employees say they escorted him from a hot spot after he tried to take customers' food. in his booking photo you can see his stitches. sundays are for the day earlier at tom house on union street. miller was with friends here. the general manager says he was alone when he came in at 11:50 sunday night. >> he did wobble standing. he did lean on things to keep himself up. >> reporter: miller looking at the meat for a while. >> he really wanted a sandwich. >> the trouble was is that he didn't seem to have money. >> he gave up and sat down about 20 minutes and stood up.

and went after a guest. >> reporter: two miles away and two hours later, surveillance video with miller straggling and his forehead covered in blood caught attention at the travel lodge. >> he was intoxicated and i thought maybe he bumped his head. >> reporter: police say it was across the street that miller tried to get into someone else's room at the marriott. he is charged with assaulting a 79-year-old man and his 29-year-old son. his agent says he's trying to get to the bottom of what happened. so are police. >> the 49ers released miller from the team. he's been ordered to appear in court friday afternoon. this is not miller's first arrest. he faced charges after getting into a fight with his girlfriend

last year. david louie joins us live for that part of the story. >> bruce miller's counsellor gave him high marks about learning about abuse and how kit lead to aggressive bruce miller was ordered to take a domestic violence class that covered anger issues and alcohol use. he had been charged with disturbing the piece when he grabbed his girlfriend's cell phone and smashed it. records show miller entering a plea of no contest. his counsellor wrote he quote, struggled with setting boundaries with family, friends and victim and feels adhering will be challenging.

given the hes tensy, could anyone have predicted he might relapse? he was not on probation, not being monitored. the director of a violence agency is critical the lack of follow up only leads to offenders doing it again. >> they just go to another program. and so nobody is checking to see if the person is abiding by the rules of the program. we don't evaluate it. and that is insane. >> miller's counsellor told the court miller will continue to do therapy with the team psychologist. neither the team nor psychologist responded to confirm that that was done. and as news breaks be the first to know by down loading the abc7 news app.

now to a developing story. investigators have a new lead in the search for a missing cal poly student. kristin smart disappeared 20 years ago after leaving a party. today, investigators started to dig on a hillside near a large letter p near campus. fbi search dogs led them to the location. investigators hope to give the family closure. >> it is our hope this leads to answers we've been asking for the past 20 years. is what happened to kristin. >> investigators are looking at several areas but aren't saying where they are located. a convicted sex offender is back in custody in san jose. 56-year-old david lee russell was captured after a week long manhunt. he was wanted for assaulting and trying to kidnap two young women. he was driving near oakland road. police say tips helped lead to

his arrest. >> brock turner is on the sex offender registry in ohio. we have a closer look at the new police reports surrounding his return. >> first, let's take a look at the green county sexual offender registry here at the entry and you can see his listed address, which you can pull up on this map. let's do that for you. this is where neighbors can see where he is living and he does have to disclose that information. here is brock turner arriving with his mother. she's trying to hid him from cameras, protecting him this, is surveillance video. you can see his

he has to update his information every 90 days. he served half of a jail sentence for sexual assaulting an unconscious woman. people have been protesting outside of the home and some carrying weapons. police complaints have been filed about cars and camera crews in the neighborhood. nobody expects this to quiet down soon. the case inspired new legislation guarantee prison time for sexual assaults. current laws allow for a lesser sentence if the victim was unconscious and not forced. governor brown has until the end of the month to sign the bill into law. also a bill to erase the statute of limitations for rape and sexual assault cases. supporters rallied at the state capitol today under california

law, prosecution is subject to a 10 year limit. no one is raped by accident. rape is a conscious decision and we want to make sure the victim, survivors have every opportunity and time to come forward. >> the american civil liberties union saying the statute of rim tagss is there to stop wrongful pollution. the bill was written in light of multiple rape accusations against bill cosby. prosecutors hope to have 13 accusers testify at the trial. he is charged with drugging and molesting a woman at his home. police are looking for heeds and suspects after last night's shooting of a pregnant woman. both she, and her unborn child, died. wayne freedman has been looking for answers in this case and joins us live in san pablo.

wayne, what do we know about this situation? >> reporter: a little while ago, police gave us the name of the murdered woman. she's 18 years old, she and her unborn child died at the same time. there is a lot that police, neighbor, and friends are not telling us. how and what happened on this corner last night remains a mystery. the end result? a tragedy. >> i'm not going to get into motives or suspect information we're working viable leads and have cooperation from the public. >> police will say the 19-year-old died if gunshot wounds in an attack that also killed her unborn child. this afternoon a friend told us she was seven months pregnant and the neighborhood is dangerous. >> every time my mom, my sister

over the weekend, maybe there for a while. the spirit of sacramento cap sized in the area known as fals river. it's the latest example of a larger problem in the delta. laura anthony is live with the big picture, laura? >> reporter: sheriffs have successfully removed thousands of recreational boats over the past several years. the current law provides no funding for cleaning up commercial vessels, at least not before they sink and break apart. doug powell has been looking at commercial debris like this all over the delta for years. >> we're looking at lash lighters and crane bars and

maybe a fishing vessel. >> it's just the latest example of how difficult it is for law enforcement to clean up they can do little more than fight the owners and tell them to move along. now, there is no state funding to remove it until it breaks apart. >> we get grants through division of boarding waterways allowing us to remove recreational boats in california. we can't remove commercial boats if they're getting ready to sink. the law precludes us from doing that. >> the couple told sheriffs they bought it at auction for a thousand dollars, as it was sinking they took off in a dingy and haven't been seen since. the cost now is over $100,000

with no clear idea of who will pay for it. or even, whether it will be removed. a woman had her purse snatched off her shoulder at the parking lot of stan ferd shopping center. the thief just walked up, grabbed her purse and took off. police don't have a clear description of the suspect who have not been caught yet. in hillsborough a home surveillance video captured a mountain lion walking by parrot drive last night. police shared the image and remind people the area is a natural habitat. the best advice, they say stand still, and make yourself look as big as possible. marin humane society is

dealing with influx of new animals after someone dropped off 34 kittens yesterday. they left a note apologizing saying their friend's great grandmother let things get out of control. this is the fifth time that someone dropped off a large group of cats. they will waive fees for anyone who adopts an adult cat. hurricane newton tore up parts of cabo san lucas. winds 90 miles per hour and clean up is underway. the storm broke windows and toppled trees and caused power outages. officials say damage was not as extensive as two years ago when hurricane o deal hit land. remnants of hurricane hermine are being blamed for damage in boston.

happy birthday to the eastern span of the bay bridge. the bridge opened to traffic three years ago today. construction began in 2002. the old span found to be unsafe after the 1989 earthquake. if you drive across every day, the project was delayed several times for reasons including skyrocketing costs, material shortage and construction concerns. the span cost $6.4 billion to build. muni's busiest line as additional train service. abc7 news was in san francisco as the train started to run from

the haight to embarcadero station. the new shuttles will stop inbound once getting to the embarcadero station and back without stopping. 40,000 people ride the m line every day. rising home prices lead today's bay area business watch. prices of single family homes up by 3.5% in july compared to last year according to data analysis company clear logic. it's about half the statewide increases each is about 6%. twitter's board is scheduled to meet about possibly selling that company. reporting they might be looking to buy the social communication company. today, twitter stock gained a few cents, closing at 1993. and michael stayhahn made his

two campuses are located here in the bay area. the school is going to stay closed permanently. >> they just set the school is down and stopped me from graduating and getting my degree. >> itt tech was being investigated at state and federal levels for recruiting an accounting practices because of high tuition. the company blames the department of education, which moved to ban itt from enrolling new students who use federal financial aid. a suspicious package shut down a street near redwood city's city hall today. a worker spotted the package just before 10:00 a.m. the bomb squad came to check it out and determined there was no

danger. an overnight car crash sent three people to the hospital. this happened at intersection of 44th street and the car slammed into several parked vehicles and all three adults inside of the car were ejected and are in the hospital. the man who shot and killed a tsa agent and injured three others pleaded guilty to murder and other charges today. he faces life without possibility of parole. family members of the tsa agent hernandez were in court today for the plea. they say it was hard to see him in court. >> i felt numb. i didn't know how to react. i didn't know how to react. i had mixed emotions. >> seeing someone who wanted to
