jose police say this man is the one who has been terrorizing innocent drivers all summer long. good evening and thank you for joining us. i'm ama daetz. >> and i'm larry beil in for dan ashley. san jose police arrested the gunman opening fire at occupied vehicle. >> ama: let's get to katie who is live in san jose with the breaking details. katie? >> reporter: ama and larry, people who drive in this area on blossom hill road can maybe breathe easier tonight. since may someone has been shooting at people in cars here. it happened at least 10 times. tonight a suspect is in custody. the san jose police department's covert response unit arrested this man. 30-year-old michael lewis of san jose. he will be booked on four counts of attempted murder. police actually arrested lewis on august 14th on unrelated charges as they were investigating these shootings. as they followed up they got a warrant and searched his house. there they say they found a handgun. they sent that gun and shell casings recovered from some of

the shootings to the crime lab. there it was determined that the bullets were fired from the gun found at lewis' house in four of the incidents. the shootings happened between may 4th and august 5th on blossom hill road between poughkeepsie and monterey. police also say lewis had an outstanding felony warrant for being a felon in possession of a firearm. live in san jose, abc7 news. >> thank you,, katie. four oakland police officers are out of a job this evening for their involvement in the sex scandal involving a teenage girl. >> ama: the punishment doesn't end there. katie is live in oakland with our developing story. katie? >> reporter: the mayor announced a lit knee of offenses involving these officers and many are criminal in nature. but any criminal charges would have to come from a separate d.a. investigation that is under way. a dozen oakland police officers are implicated in a

sexual abuse scandal centered around celeste, a teen exploited said the mayor. >> we will hold our officerses to nothing but the highest standards of professionalism and integrity. >> reporter: they issued letters of discipline to 12 officers and four are being fired, but some may have already left the department. >> these findings will nonetheless be placed in their permanent personnel files. >> reporter: investigate earlies say each one committed one or more offenses. attempted sexual assault, lewd conduct, assisting in the crime of prostitution, accessing law enforcement databases for personal gain, failing to report crime and other misconduct. >> all of these discipline decisions will now be subject to due process and grievance procedures. >> reporter: seven officers are being placed on unpaid leave. one is being ordered to counseling and training. investigators interviewed them for more than 20 hours and poured over an enormous amount of digital evidence.

>> the investigative team examined approximately 80,000 pages of social media documents and 28,000 text messages. >> i am hopeful there are criminal charges because they should be prosecuted. we are talking about men who are police officers having sex with a minor. >> reporter: the president of the oakland plafers association association -- police officers association expressed frustration that they didn't get a heads up on the announcement. abc7 news of. >> celeste told her story to the eye team's dan noyes. he has been keeping in touch with her and says she has conflicting feelings about all of of these repercussions. >> i have spoken with celeste throughout the process even on her way to rehab in florida. all along she said she didn't want the cops to get into trouble. she considered them to be friend. this all blew up when one of the officers committed suicide and he named names in the suicide note. she did -- didn't want them to

get into trouble, but she said they did turn their backs on me so perhaps she changed her opinion. in addition to oakland police five richmond police officers are accused of having sex with her. we told you about the disciplinary action facing oakland police with a president bush alert from the a -- with the push alert from the news app. enable them to get breaking news updates as soon as they happen. >> ama: a frightening experience as a boy was playing in the backyard when a rattlesnake bit him. sky 7 was over the scene! they say a baby rattlesnake was bitten on the leg twice. now let's look at what a baby rattlesnake looks like. the snakes are more active in warmer weather and especially in areas of vegetation. >> ama: a car accident lead to the evacuation of a neighborhood in bay point when

it crashed and ruptured a gas line. residents within a quarter mile of the accident were told to leave their homes. the gas leak was capped and lifted a half hour later. a man is suing after a security guard pulled a gun on him. nicholas buchanan captured this video from his car. scare ruey moments there. scary moments. he said the insurance department happened when he ran over a traffic cone to go around a stalled car. video says they are threatening to break his car window. a spokesperson for westfield which owns the valley fair mall sent a statement saying, quote, thank you for the opportunity, but the company does not comment on matters under litigation. >> ama: people in the south bay had an unwelcome surprise coming out of their water. these pictures were shared from the willow glen area of san jose. the water temperature said a screen failed causing natural

clay and sand to get into the water system. the company shutdown the well to clean and flush it out. the discolored water is not harmful to drink even if it does look a little gross. >> it was yellowy and after the water ran there was dirt in the shower. >> ama: flushing will continue tomorrow. anyone should let it runs for a few minutes until it runs clear. the water is now off limits at two south bay lakes. san jose city officials say there is a toxic blue green algae at lake cunningham. both lakes are closed until the levels improve, but the levels remain open. it can cause skin irritation and stomach issues in humans and can be fatal for dogs. antioch police are searching for an arsonist who scrawled hate speech on a home and then set fire to it. they are issuing a call to community leaders to stand in support of the williams family. he will hold a press conference about it tomorrow.

williams says her daughter noticed the fire this morning and found a swastika and a racial slur on the home. the home had minor damage. >> ama: donald trump and hell reclinton shared a stage, but never came face to face-to-face. >> it was a forum with american military veterans in new york. karen travers has the story. >> hi, how are you? >> reporter: hillary clinton was the first to take the stage. they fielded questions from current and former military members about her e-mail server. >> i take it very seriously, always have, always will. >> reporter: the iran nuclear deal. >> we have made the world safer. we just have to make sure it is enforced. >> reporter: and how to defeat isis, pledging air support and training. but -- >> we are not putting ground troops into iraq ever again, and we are not putting ground troops into syria. >> reporter: both clinton and donald trump were asked to not attack each other.

clinton still landed a few jabs. >> the last thing we need to do is play into the hands of isis. going after american muslims, defaming a gold star family. >> reporter: trump came out swinging repeatedly taking aim at clinton. >> i have great faith in the military. i have great faith in certain of the commanders, certainly, but i have no faith in hillary clinton. >> reporter: speaking to a room of veterans when asked about his comment that he knew more about isis than military generals, trump said this. >> i think under the leadership of barack obama and hillary clinton the generals have been reduced to rubble. >> reporter: when asked about sexual assaults in the military trump says he stands by a tweet sent back in 2013. >> quote, 26,000 unreported sexual assaults in the military and only 238 convictions. what did these geniuses expect when they put men and women together? >> well, it is a correct tweet. part of the problem is nobody gets prosecuted.

now that labor day is behind us, home buyers are hoping for a surming in inven -- a surge in inventory. >> ama: in hotspots like silicon valley it may be wishful thinking which means real fors are pulling out all of the stops. lilian kim is live with the

story. >> reporter: menlo park is a tough market to crack which is why agents here and throughout silicon valley are getting creative. on this coveted street in west menlo park residents get letters from real fors saying my client is willing to pay cash, up to $5 million. she has lived on the block for two years. >> do you take the letters seriously? >> because we just moved in and we have plans to stay in the area, no. but it is always fun and interesting to read them. >> reporter: even in the fall when listings are morrow bust, agents aren't taking anything for granted. in addition to letters door knocks are common and so is making offers to builders of spec houses. this real -- realtor says such methods have worked for her. >> they don't want to go through the process. if somebody showed up at the door with the right price or this make mooy move price, they'll find a place to go. >> reporter: that was the case for a couple who sold their redwood city home. theyy were thinking of listing

it, but didn't have to after someone made an offer thisy were happy with. they now live on the central coast. >> you get greedy and sometimes you wind up losing. all things considered, we came out of it feeling very good about it. >> reporter: a behind the scenes deal that is becoming much more common throughout silicon valley. in menlo park, lilian kim, abc7 news. some verizon customers are having trouble making and receiving phone calls tonight. the company says it has a network issue in parts of northern california. it affects the peninsula and san francisco and areas north through sonoma county. the data network and text messaging are working. verizon engineers and technicians are working to fix the problem. >> ama: starting on friday you can buy the iphone seven. abc7 news was there for the unveiling of the new phones. the biggest change, no headphone jack. instead meet the wireless air bud headphones. not everyone is a fan.

it gave us the extra reddish brilliance. the air quality will continue to suffer because of the smoke. the next two days you are looking at moderate air quality for the entire bay area both thursday and friday. if you have respiratory issues a good idea for you to limit your outdoor time. live doppler hd has shown its fog from santa cruz up to the san francisco coastline. the visibility right now is just over a mile on live doppler 7. look out for the morning commute. it will be foggy in spots. most areas, believe it or not, are in the 90s. 82 in san francisco and well above normal. 87 in oakland and it got up to 101 in gilroy, and so it warmed up to a hot one. we will turn things down quite a bit tomorrow. a good 5 to 15 degrees cooler. from the east bay hills camera, a little shaky camera here. temperatures in the low to mid60 ises. -- dash low to mid60s. emeryville camera, giving you a nice look at the

visibility. 63 in santa rosa. mid60s in napa and still a warm summer night in the mid70s. it is beautiful in san francisco right now. and it is feeling mild as you look from our sutro tower camera. fog along the coast and below average temperatures. watch out for areas of fog and drizzle. we'll call it fair of the walking or biking it will be good. mild to comfortable for the morning commute depending on how you commute. so the temperatures are beginning in the low 50s to the mid60s. you notice the fog is in until knife:00 a.m. you may even see spotty drizzle. as we head into the latter part of the morning, the fog is pretty much locked in at the beaches and lingers at the coast. here are your afternoon highs. 81 in san jose.
