consumers should never be taken advantage of by their bank. >> as part of the settlement, wells fargo agreed to have a third party review unsecured credit cards and some retail deposit accounts dating back to 2011. 2$2.6 million will be refunded o customers. an average refund will be about $25. internally the bank promises the termination of some managers and team members. there will be enhanced training, monitoring and controls. customers will see more documentation once credit card applications are filled out and the bank will send a confirmation e-mail to customers within one hour of opening and account. in a statement, the bank said quote at wells fargo when we make mistakes we are open about it and we take responsibility and we take action. >> this is a fundamental breach of customer trust. >> a professor of organizational misconduct and ethics.

apparently at random at a major corridor in south san jose. chris wynn is live at the jail with more. >> reporter: currently being held in the jail behind me expected to be charged with four counts of attempted murder. earlier today we spoke to neighbors in blossom hill. they remained stunned over what happened. for neighbors in south san jose an ongoing nightmare could soon be over. >> it's relief he was caught and we can take a deep breath. >> reporter: last night, police arrested michael james lewis of san jose and accused of issu issuesing at multiple evacuation on the blossom hill corridor. >> you're scared to go out that nobody will shoot you for nothing. >> reporter: police originally placed him under arrest for related charges. while out on patrol that night an officer noticed lewis' car, a

black dodge charger and felt something wasn't right. >> he see this car blacked out in the parking lot, circles around, makes a you turn, comes back, approaches the car, gets out of his car, approaches on foot. >> reporter: a chase followed with the suspect eventually surrendering to police and detectives obtained a search warrant for his residence where they say they found a handgun and casings involved in the four shootings. >> it could have been me or my kids or somebody in the family. you have no idea what it does to parents when we hear the ambulance out there. >> reporter: no one was injured in these shootings which occurred over a three months period. lewis is due in court tomorrow afternoon. ni, we're learning former 49er bruce miller may have used a cane when he assaulted an elderly man. he faces assault with a deadly weapon, battery and criminal

threats. early monday morning at the fisherman's wharf marriott he tried to enter a room with an elderly couple and the couple's son was staying in the next room and miller attacked him and his 70-year-old father after the son told miller he was in the wrong room. the 49ers released miller later that day. an apple engineer is taking on a mall owner and security firm after a man pointed a gun on him as he was leaving the parking lot. he filmed the entire incident at the mall. david is there live. >> reporter: it started out as a routine run to the mall on a saturday. then, as mr. buchanan was leaving this parking structure heading home, he ran into a stalled vehicle blocking his way. he went around it. then, watch what happened next. what would you do if you saw a gun pointed right at you? the shooter in position to fire. this is cell phone video apple

engineer took as he left westfield last december. the guard ran after him after he said he accidentally ran over a traffic cone leaving a mall parking garage. the gun was holstered when the supervisor arrived but the situation remained tense. >> why can't you talk to me right now? >> unlock your door or i will take out your window. >> why are you going to take out my window. >> stand out here and talk to me. >> two san jose police officers responded noting in their report the guard with the gun did not have on him two required perm permits, a state issued guard card and a gun permit. the guard was identified as 22-year-old francis fielding of san jose. fie fielding, along with his supervisor, the security firm and westfield are named in a lawsuit filed by buchanan for assault, false imprisonment, negligence and infliction of emotional distress. >> he was off work a matter of five months. he's been able to get back to work now. this is serious business when

stop. it was bound for las vegas and the names of the suspect have yet to be released. after mayor schaaf announces discipline aary action over a s scandal, another department announced it concluded its investigation with consequences. >> reporter: multiple law enforcement agencies say their investigation into an alleged sex scandal involving the woman who calls herself celeste guap has been fired. police chief makal harris wrote now that this matter has reached a conclusion we will move forward and continue to serve with honor and protect with purpose. the almeida county sheriff's office says it cleared four deputies of any criminal wrongdoing. >> we did an in-depth interview with her. in our interview she indicated none of our people did anything

illegal. >> reporter: the sheriff says the department's internal investigation is ongoing, one deputy cleared of wrongdoing and one deputy no longer with the department and two deputies still being looked at. oakland mayor libby schaaf said investigators interviewed gap mo -- guap for more than 20 hours and looked at text messages and oakland police announced four police officers are being fired and seven on unpaid lead and going through training. >> we will hold our officers to nothing but the highest standards of professionalism and integrity. all these disciplinary decisions will be subject to due process and grievance procedures. >> reporter: richmond said its process is still ongoing. we sent out a push alert with the resignation of this livermore officer. you can download the app for

an historic catholic school in oakland is closing because of

declining enrollment. it's in the fruitvale district where it serves a largely immigrant community. they're already planning a comeback. >> saint elizabeth high school has served the fruitvale working class community for years. some families have had a hard time affording a private school tuition. >> it's very difficult for a family making that kind of money who has maybe two children to afford catholic education. >> reporter: enrollment has been declining, happenin not only here but other catholic schools throughout the country. here's a glichls. enrollment in secondary schools reached its highest point in 1970 with more than 1 million children in the country. 2015, a little more than 583,000 students. it's the catholic elementary schools that have seen the biggest drop. in 1965, at the height of enr l enrollment, there were more than 4.5 million students in 2015,

only 1.3 million. saint elizabeth will close for only one year while it sets up a new program using a model like work and study. >> they will attend classes four days a week and work one day a week. it allows them to earn some of their tuition through this corporate position. >> reporter: students will work in a corporate environment. there are 30 of these schools throughout the country, two in the bay area. they enroll only students in underserved communities. still, it was disappointing news for some parents. >> it's almost like a family. i think for a lot of people that have had their kids here for years and years it's a pretty big deal. >> we haven't really talked about it. she will go to another school. >> reporter: those students will be absorbed by the other eight catholic high schools within the oakland diocese. in oakland, nbc7 news. new details on a vacant

school in richmond a charter school will not be able to move into and renovate the adams middle school campus. last night the school district voted not to sell the school at below market value to caliber scho schools. it was closed seven years ago after officials deemed it unsafe from an earthquake. governor jerry brown signed a climate law into effect. he used the skyline as the backdrop for signing of senate bill 32. it is based on a bill signed a decade ago giving broader authority to enact emissions limiting emissions and they will serve as an environmental leader. >> bills today they really are far reaching and they keep california on the move to clean up the environment and encourage

it's been a rough 12 months for the twitter san francisco company. shares are down on a year-to-year basis and questions of the ceo's future and possible sale of the company. twitter stock fell sharply today, closing at 18.7$18.70 a share, down 5.89%. one of the most well-known travel website, priceline has done away with its bidding tool for flights. it allowed customers to name their own prices. they said in recent years fewer customers have been using that tool and airliner mergers made it less practical. they plan to use set airfares that make it faster and easier to book and they still have name your own fares on hotels and rental cars. amazon plans to partner with 49ers fordelivery,

our beaches inland areas, antioch, the only places you actually saw some 90s today. here's the 22 degree drop in santa rosa, down 13 in san francisco, livermore, san jose, a good 17 degrees cooler compared to yesterday. from our santa cruz camera, it's really great. 62 in san francisco. 67 in oakland. a live look from san jose where it is nice and sunny, but it didn't feel as hot as it was yesterday. separates now, santa rosa, 71. low 70s, napa. if you just picked up the kid, running errands, breezy, you might want to grab your jacket. temperatures in the 50s and 60s and continues at 10:00 p.m., partly cloudy by midnight. that marine layer has deepened, about 2,000 feet. areas of fog and low clouds tonight. we are looking at below normal
