all right. you are looking live outside levi stadium in santa clara, tradition of tailgating under way as the faithful getting ready for a new season. the 49ers start this season with a lot to prove, too. this is a live look from sky 7 at levi stadium and high above it all the sun is out, and it's a good day to play some football. the nfl is back in season. good afternoon. i'm dan ashley. >> and i'm kristen sze. the 49ers have been in the headlines a lot this year. hard to believe that this is just first game of the regular season. >> that's right. the fans are ready to go certainly. they have been lined up for hours to begin. you can see the countdown clock on the screen to show exactly how much time we have left. 2:59 until the game. >> counting down the seconds. all righty. laura anthony is live at levi stadium and fans are set to focus on the football. >> reporter: fans just starting to file in behind me. this is the main gate into the parking lot here.

they are just setting up their tailgate parties, getting ready for this big game one of the season. of course, along with the festivities here on the ground, there will be a bit of a show up in the sky. a flyover by these air force jets won't be the only one over levi stadium tonight. earlier a small plane will carry banner in support of colin kaepernick. >> where the banner comes in and why it's so important is it demonstrates that regular people around the country also support this message. >> enough politics. we're ready for the season opener. >> go niners. >> reporter: these 49er fans are well aware of kaepernick's protest but want to focus on what happens on the field after the anthem. >> he's got a right to do what he wants to do, and we've got a right to do what we want to do, so some of us support him. some of us don't. >> we're here to support the team. we get here early and stay a little bit after. we're inside the game until the

clock hits 0:00:00. >> got a new head coach and new system and hopefully we can win some games. >> reporter: this couple drove down from orville to be first in lines at the gate. >> tired of hearing about kaepernick sitting down and all that. just want to watch the football games and get straight to the season. >> i do want to see this game because i'm originally from l.a., too, so we'll see the l.a. rams with, you know, the 49ers. >> but you're wearing a red hat. >> yes. >> reporter: despite being the underdogs, the 49er faithful are brimming with optimism going into game one. rams i think last time i look are favored. >> yeah, they are always favored but we're going to create a big upset today. >> how many y'all say we're going to get a win today? that's what i'm talking about, huh. huh. you know how we do it. >> reporter: this is a live look at the parking lot at levi stadium. you can see the folks are setting up for several hours of tailgating. this game set to begin at 7:20 this evening of course on abc 7

news. now, as for the aerial show, the small plane with the banner in support of kaepernick will fly above the stadium here between 5:00 and 6:00 p.m. the air force jets will do the traditional flyover at the end of the national anthem. that is about 7:15. live at levi stadium, laurie anthony, nbc 7 news. >> going to be exciting, thank you. >> let's bring in larry beil and our own super bowl champion mike shuman. >> the first penalty flag on mike shuman, 15 yards, no super bowl ring. where's the ring, just introduced at super bowl champion. >> in the safety deposit box. >> on the rich california history between the 49ers and rams will be renewed because the lambs have moved back to l.a. on the field blaine gabbert is the starting quarterback for now over colin kaepernick and the question is for how long, mr. shumann. >> i think he'll be the quarterback until further notice. he's won the job and kaepernick

wasn't at full strength with all the surgeries so he's rebuilding his strength, his size. he lost like 20 pounds so chip kell he to make a choice, and i think he knew all along it would be blaine back ge-- blaine gabbert. wanted to see what kaepernick had because he took the team to three title games and a super bowl. i think gabbert will be the guy until further notice. >> there's been some speculation that we might perhaps see kap tonight, a specia package of plays. >> right. >> to take advantage of his strength which is the read option. do you think we'll see kap or is that the next step to a prolonged quarterback controversy? >> it could be a little bit of both, that's a good point, but if you want to get kap some reps, that's what you do, have a specified package for him. get him some turns and reps in an actual game to get him comfortable in case he does have to play if blaine gabbert gets hurt. smart thing on chip kelly if he does do that, and i think we might see kap in a limited capacity that way. >> some people are thinking, you

know, given the contract situation with 14 million on the table if kap gets injured again. >> right. >> maybe you stash him aside. we'll see how it gets played out. for more on the quarterback situation we go live to levi stadium and rick joins us down on the field. >> hey, larry, hi, make. >> colin kaepernick has been getting most of the attention not to stand during the national anthem, blaine gabbert will be the starting quarterback when the 49ers open the season against the rams. that decision don't bother kaepernick. >> i have to wait my time and work. last time i was in this poigs ended up in a super bowl so i continue to work and prepare for for when that next opportunity comes. >> you work so hard all year round and such a small window to play 16, 20 games, and you've just got to take advantage and enjoy them because these opportunities don't come very often. few and far between. i know that being a starter not being a starter and now being a

starter again and you have to enjoy it and enjoy most of the opportunity. >> by coincidence both kaepernick and gabbert were drafted in the same 2011 class. jacksonville could gabbert with the first round pick while colin went in the second round so the chip kelly era begins tonight in levi stadium. this is rake guan, nbc 7 sports. >> now traffic with alexis smith. >> we've got the normal weekday commute to get through on top of the season opener for the 49ers so taking a live look from sky 7 right now. we're focusing on the parking lots which, of course, just opened up at 3:50 so everybody is getting set up and into position here. i did talk to the sky 7 crew. tasman drive is okay as is great american parkway. the surface streets are doing all right but a quick check of the traffic maps taking a look at the surrounding areas, southbound 101 congested and 280 and 85 also a little congested. some folks probably swinging a little wide tonight trying to avoid that game day traffic.

a look at mass transportation coming up in about 30 minutes. >> thank you, alexis. here's a look at the forecast for the season opener as the niners take on the rams. it's going to start out pretty mild and sunny as you take a look at graphic. it's 66 degrees. by the time the game gets under way, the breedses continue to pick up. the temperature will drop to 59, so a good idea to take a jacket or a sweatshirt with you. it will get cool later on. live doppler 7 tracking quite a bit of cloud cover, not just over the coast by over parts of the bay right now. you look at those numbers. this does not look like summer or feel like summer. temperatures in the 50s to 70s. okay. maybe at the coast it feels like it with all the cloud cover around. cooler than average by far. no doubt about it, and as you take a look at your evening planner, hour by hour forecast, breezy and cool this evening, upper 50s to mid-60s. sun goes down and temperatures will drop a few. increasing clouds by 10:00 p.m., and this is what i want to draw your attention to. at midnight we're going to start to see some drizzly areas

developing. the drizzly areas are going to continue as we head into your morning commute. i'll be back to let you know how this is going to impact you coming right up. dan and kristen. >> okay. thanks very much, sandhya. >> a south by a man is among three killed in reno. that plane was headed to the bay area. >> nbc 7 reporter david louie is here with more on the crash victims. dan? >> reporter: as you're just indicated, the three identities of the three people who perished in that plane crash last night. ed mum bey rt, a member at christian jubilee center was on board and was bringing back a fugitive, a woman named ronni hernandez, 34 years old. published reports indicate she had been arrested two years ago for possession of narcotics. the pilot was from southern california, 57-year-old robert drescher. mumbert was well liked here in the south bay. agents from the national transportation safety board are investigating why the piper

cherokee crashed right after takeoff at reno tahoe airport sunday evening with three people on boards. the aircraft smashed into the airport parking lot. among three who died was 45-year-old ed mumbert, a longtime bail bondsman based in the south bay. his death was confirmed by family pastor dick brunelle of jubilee christian center in san jose. the pastor also shared these photos. mumbert was bringing back a client he had hunted down after skipping bail >>the pilot, i don't know the pilot, but it was a colleague and a good pilot, i understand, and the -- the person apprehended. >> reporter: and it was a woman. >> yes. >> reporter: the plane had taken off from san carlos airport and was returning there when it crashed. mumbert worked by himself and once had an office in san jose and was a member of the jubilee congregation and would sometimes provide security when pastor burnell went over seas to potentially dangerous places. >> always there, generous, big

unified school district finally got back to us literally minutes ago. they do confirm that the vice principal gary jenson has been placed on temporary leave with pay while the district conducts a review of what happened last thursday at an assembly here at college park high school. they say the review may take a day or two. in the meantime, students are having their say. >> mister. >> jenson! >> reporter: the demonstration was big and noisy. students from college park high school gathering on the edge of campus during the lunch hour to protest what they believe is an injustice. the possible disciplining of a popular vice principal gary jensen. >> we want jensen back right now? into? >> he didn't do anything wrong. >> reporter: this protest after jensen told hundreds of incoming sophomores an assembly last week about what they shouldn't be wearing to school. four students felt they were the targets and complained that he had publicly shamed them,

although jensen did not use names. a school staffer who did not want to be identified told abc 7 news jensen was escorted off campus friday and that the district was investigating the incident. >> everyone got mad at him and first, and people started to realize, he was just following the rules. >> reporter: rules, the students say, are printed right here in their school planner. the dress code, jensen was talking about. a dress code that prohibits, among other attire, thin or strapless tank tops and plunging necklines. >> it's in our planner, and he shouldn't -- he shouldn't be punished for telling us what's in our planner that we can read on our own. >> i mean, he was doing his job, and he does have a point. his execution was wrong. >> reporter: many student protesters say jensen should have talked to the dress code violators privately. none of them believe he should be disciplined for what he did. vick lee vic lee, nbc 7 minutes. >> the woman at the center of a bay area sex scandal has been

offered a plea deal after she was accused of attacking a security guard in rehab. 19-year-old cleft guap is being treated for sex and drug addiction at a facility in martin county florida. investigators say she bit a security guard last month and was arevved on suspicion of felony battery. today prosecutors downgraded the charge to misdemeanor battery but did not offer further details of the plea deal. her testimony is going to be important in cases against several former bay area officers connected to this sex scandal. two robbery suspects are now in custody this. video from sky 7 shows the an armored vehicle and police officers with weapons drawn in vallejo this morning. officers say the men held up two high school students at gunpoint around 7:30 in fairfield. police chased them for a short time before ending it because of safety reasons. the suspects were later spotted in bolleo. officers took them into custody. the wife of an alameda county deputy has been arrested

with a dui crash that killed a 3-year-old boy in san ramon. the chp says the 39-year-old woman of pleasanton was driving the suv that rear ended a stolen toyota camera on interstate 680 friday night. in a statement today the sheriff's department says words cannot express how deeply sad we are of the tragic death of elijah dunn. a gofundme page has been set up. details on abc 7. colin kaepernick plans to continue his protest during the national anthem. >> carolyn tyler tweeted this picture earlier today. >> she spoke with olympic mmd jackie joyner-kersee about the issue. >> reporter: six-time olympic medalist jackie joyner-kersee brought hugs and delivered laptops at the george davis senior residences in san

francisco's baiji neighborhood helping to bridge the digital divide. >> i've been doing my community work for a long time. >> reporter: it's part of how she tackles injustice. >> i believe in fighting injustice with love it. might take a longer time but we always have to find love. >> reporter: she's been watching colin kaepernick's protest against racist and police brutality as it gains traction as fellow athletes, in some cases entire teams, join in solidarity. some players yesterday raised their fists, reminiscent of tommy smith and john carlos back in the '60s. olympic track stars like joiner-kersey. >> you see it on the field and do you stand for something. >> reporter: considered one of the greatest athletes of all time says she was discriminated against during her heyday in the '80s and '90s and fought back with a message of positivity. she respects the flag and the

team apart and could really hurt the 49ers. several other players came back and said, he will, wait a second, this actually brought us together because we had to have a dialogue about this situation. what's your take on it? >> i appreciate it, trying to right a wrong but i think you need to take the american flag out of it, but right away you have to choose sides in the locker room with a situation like that. have you 55 players from all different backgrounds and you'll have different attitudes on it. we all have thoughts about issues, socially and politically, but it takes such a singular focus in the locker room to be successful in the nfl i don't think you need these kinds of distractions, yeah, four or five players brought it together and might have opened up dialogue and you can see as a team it can be divisive and for him being a backup quarterback, too, this was, quote, a bigger name than a starter, think it has more residue, but i think in the long run this can be a distraction if this keeps going throughout the season. >> that's an interesting point, because on espn, on their

pregame show tonight, they reported that kap said whatever they do tonight will be understate the. he didn't want to detract from the opening game and get the focus on him, and it's interesting how this was playing out in different parts of the country in different ways, because i just saw a tweet that brandon marshall of the broncos is supporting kap and he just lost his second sponsorship show in denver it plays a little differently than it does in the bay area which is a little bit more of a liberal area. one thing we know for sure, whatever the reaction will be tonight, especially a day after the anniversary of 9/11, everybody will be watching kap and the other players during the national anthem. >> now your accuweather forecast with sandhya >> a little bit of cloudiness in the north bay and east bay and winds gusting out of the southwest at 32 miles per hour and breezing around parts of the

bay area and it's really cooler than it should be by a good 15 to 20 degrees. clous are all stacked up as we look towards the bay. 58 in san francisco. oakland is 63 degrees and san jose 71 and it is a cool 57 1/2 moon bay. take a look at the marine layer, deepening from the mount tam cam. mid-60s santa rosa and napa. our warmest spots, believe it or not, fairfield and livermore 70 degrees. a live look from our golden gate bridge camera and also a cloudy one. a look at the forecast. heavy drizzle for the morning commute and stays cooler tomorrow with a warmer pattern staying up. bringing in a storm impact scale and one in is a light system and five is a weak storm and it's a 1 on our impact scale and a light system which will impact the morning commute. less than a tenth of an inch expected and as i said it will impact your morning commute.

episode yesterday in new york city. she's been diagnosed with pneumonia. abc 7 news reporter lyanne melendez is live with more. >> reporter: she's definitely missing the very cold san francisco weather here on nobb hill. the show must go on without hillary clinton in person. now regard to the health controversy, some say this is the biggest mistake of her campaign. again, showing there is an honesty issue, but her supporters are spinning it differently, tweeting today that hillary attended the 9/11 event despite pneumonia. today's video showing hillary clinton stumbling while getting into a van has many wondering why her campaign waited two days to reveal she had pneumonia. >> if your challenge is transparency, that's a problem. >> reporter: ken goldstein says it hurts her campaign when

hillary becomes the story. republicans are once again questioning her honesty. >> it's standard procedure for the clintons to withhold information. i mean, they have been in this business for many years and keep a lot of secrets. >> both of these candidates have really not come forth with information about their health as much as the public deserves. >> reporter: after the episode both candidates have vowed to release their personal health information. some believe not every flushings pneumonia or cold should be reported, only serious debilitating conditions should be disclosed by a candidate. for example, john mccain had several bouts with skin cancer. during the 2008 presidential campaign he had to release his medical records. goldstein says the public should realize campaigning is grueling work. >> it is brutal, and you have to be on all the time, all the time. and it takes a toll. >> reporter: despite having to cans ale major event in san

francisco today, clinton will address supporters via teleconference. in san francisco, lyanne melendez, abc 7 news. >> we'll bring you campaign updates as they happen right to your mobile device and just download our abc 7 news app and enable push alerts. a historic game in washington as governor brown signed a bill giving overtime to farm workers. it's the first law of its kind in the nation to end the practice of applying separate labor rules to agricultural workers. it is significant change and currently farm workers get overtime if they work more than ten hours a day or 60 hours a week. that will now change to eight hours a day or 40 hours a week. the new law will be fazed in beginning in 2019. legal eagles. coming up, the police department that now plans to take on rogue aircraft with a flying squadron.

abc 7 news was in santa clara along el camino r real this morning and three abandoned carts were discovered in 15 minutes. abandoned shopping carts are just bad for the city's image >> it's a clean place, clean city. don't like to see carts around. >> the quality of life issue. we would like to remove the shopping carts as soon as we can. >> if you find an abandoned shopping cart the city of santa clara encourages to you report it to the store that it belongs to or the city streets department. meantime, a member of the san francisco board of supervisors will introduce a resolution tomorrow to protect bees and other pollinators in city. supervisor katie tang says the resolution is designed to enhance the liveability of san francisco's neighborhoods and create more sustainable habitats and keep these and other pollinators healthy. tang says at least 30 cities have already been designated bee cities. >> some bay area residents took a transformative boat ride today. abc 7 news was at san
