>> grainy surveillance video helps break the case that one police chief is calling shocking. two people are now charged in a hate crime. good evening. i'm dan ashley. >> and i'm kristen sze. thanks for joining us. this couple in antioch have landed in jail. these two people are charged with multiple felonies for something police say could have been deadly. abc 7 news reporter laura anthony is live at the antioch police headquarters with more. laura? >> reporter: hi, kristen. well, we talked to roy sovari's parents, and he said he's driver for an on-demand ride service. now he and christine mcdaniel are each sitting in jail on $1.3 million jail. police maintain this was a hate crime, but they say it wasn't random, that it sprung from an ongoing dispute between two families. >> on september 7th of this year i came before the media to announce a hate crime that happened in our community. that literally sent shock waves

to it the city of antioch. >> surround by the mayor and city council the arrest of two suspects was announced in a hate crime caught on the victim's home surveillance cameras. >> based on the information that we gathered through the course of the investigation it's very evident that this was a hate crime directed at this family. >> the suspects are 25-year-old christine mcdaniel of brentwood and 27-year-old roy sovari of antioch. police say that sovari lighting three molotov cocktails and throwing them at the home of the williams. three adults and four children escaped the fire only to find racial slurs and swastikas painted on the house and burned into the front lawn. >> i'm very happy that they have been found and that they will be prosecuted and can i go on with my life. >> reporter: williams says she doesn't know the suspect but a relative of mcdaniels had an ongoing dispute with a member of mcdaniel's family. know sovari has been charged

with a height crime and arson. >> any time you paint racial slurs and a swastika on someone's residence and you try to set it on fire, that says there's some hate there. >> reporter: sovari's parents did not want to speak on camera but told us in this country people are innocent until proven guilty. there's probably a lot more to this story than what's been said. in antioch, laura anthony, abc news. and then there's this. people in an east san jose neighborhood are disgusted about what happened to one of their friends and neighbors. crime scene investigators dusted this home on north cragmont avenue for prints today hoping it will catch whoever robbed and brutally attacked the 88-year-old woman who lives here. deputies found florida douglas lying on the floor around 8:00 last night beaten so badly she is now in intensive care with significant head and facial trauma. neighbors are absolutely outraged. >> she would never do anything to hurt anybody at all. the sweetest lady around. >> she would drive by and give

her little wave and, you know, we see her in the grocery store. she always said hello and whether she knew you or not. she's an amazing lady, and she didn't deserve this at all. >> deputies say the attackers ransacked the home and took the jewelry douglas was wearing and stole her car. investigators will review surveillance from video cameras in the area. >> investigators are investigating the death of a 5-year-old boy trapped underneath a treadmill. it happened inside a home on buena vista avenue at fifth street. the bay area news group reported police found out about the incident just before 4:00 p.m. on sunday. circumstances surrounding the boy's death including how he ended up underneath the treadmill are not yet known. police have not said whether the boy lived in that home e the wife of a sheriff's deputy accused in a deadly dui crash had a prior du i arrest. she's now accused of causing a crash last friday in san ramon that killed 3-year-old elijah

dunn. abc 7 news reporter carolyn tyler is live at the fremont half justice where the woman appeared, carolyn, in court just a few days before the wreck. >> that's right. the woman yarenit malihan is expected back here not for the fatal crash last week but for another arrest three months ago for driving under the influence. according to court documents this accident on 680 in san ramon last friday was not the first time yarenit malihan was drunk behind the wheel, but this time the consequences were fatal. investigators say malihan's suv rear ended a camry that it pulled off the freeway after the driver ran out of gas. her 3-year-old son elijah was killed, and she's hospitalized with serious injuries. >> emotionally everybody is

numb. >> reporter: chuck mis crystal' father after learning of the suspect's prior dui arrest. this course document shows she was pulled over on june 7th with her own child in the law and pled guilty to a misdemeanor and dui and child endangerment and appeared in court august 31st just days before the deadly incident. >> i've seen people with a dui arrest and their license was suspended for a year? he believes the accident that killed his grandson and broke his daughter's ribs and back could have been prevented had malihan, the wife of an alameda county sheriff's deputy, had her license revoked back in june. >> the judicial system let her back out on the streets to drive again because of who her husband is. >> reporter: no response to that accusation from law enforcement agencies, including the alameda

county sheriff's didn't which expressed deep sadness about the fatality. but the dmv tells us if someone is working through the legal process their driver's license would not necessarily be suspended until the case is closed. now just a few minutes ago, we heard from the chp saying that the june incident that malihan was driving under the influence of drugs, although this court document clearly says driving under the influence of alcohol, putting her level at .13 when the legal level is .08 so we'll have to try to figure that out and get back to you tonight at 6:00. live in fremont, carolyn tyler, abc 7 news. >> carolyn, thank you. new details out of uc berkeley where officials are investigating reports of three women being sexually assaulted on campus saturday night. the attacks happened during a sold-out electronic dance music concert at the greek theater. abc 1 news has learned of at least five alcohol recalled

arrests that night and so many drunk transports. berkeley police took some to county jail and berkeley officials say there was not excessive drinking or drunkenness at the event and that campus police have upped security 100% over a typical event. they are asking any witnesses to come forward. >> tonight the cell phone industry is challenging a berkeley ordinance. this has to do with the safety of your smartphone. abc 7 news reporter elissa harrington was at a federal appeals court this morning where attorneys made their case to the judges. >> the cell phone industry faced off against the city of berkeley and the ninth circuit court of appeals in san francisco tuesday morning. at issue the right to know ordinance. it requires cell phone companies in berkeley to warn customers about safety risks from the effects of radiation exposure. it the warrants putting phone in a pocket or directly against the skin for long periods of time and may exceed fcc guidelines. attorney theodore olson representing the ctia, the

wireless association, argues the wording is misleading and intended to impact consumer behavior. >> the message that berkeley is conveying, it's an opinion. it is a message. it takes a point of view, and it suggests to you if you don't be careful you have an unsafe product. >> reporter: he says the fcc has found cell phones are safe, but lester lessig, the attorney for berkeley, says they have a right to let people know ways to prevent reaching high levels of exposure. >> cities like berkeley fear they are going to have a lawsuit funded by a multi-national corporation against them every time they have a safety warning. >> reporter: judge william fletcher did question how people could read that warning. >> saying ultio, i'm in trouble if i put it in my pocket when in fact i may not be in trouble at all. >> reporter: cell phone industry previously sued the city of berkeley. earlier in year, a federal judge allowed a revised version of the ordinance to stand. the appeals court is expected to rule on this latest argument at a later date. in san francisco, elissa

a security camera captured a moment a group ran into a group of phoenix police officers. >> wow. >> you can see one officers flying into the air from impact and three officers were injured and all are expected to be okay. police say it happened early this morning at a gas station and that the driver intentionally targeted the officers who were just standing in the parking lot. after the crash, the drivers accused of fighting with one of the officers who used a stun gun on the man and arrested him. >> wow. well, happening tonight. people who live on the crooked part of lombard street are getting their chance to speak out about its future. the problem, too many tourists are making life miserable for those residents. nbc 7 news reporter amy

hollyfield has a preview. >> look at all of the tourists standing in the middle of the street, oblivious to cars, all trying to get a shot of san francisco's crook street. these men went even further and climbed the stairs of a private condo building. people living here say this is just some of the behavior they can't tolerate anymore. >> people leaving their trash and people do urinate and defecate in front of our home. it's pretty bad. >> reporter: so we asked tourists who they be willing to pay a toll to drive down this street. >> depends on how much it was, but, yeah, i probably would. it's a prelt amazing street. nothing like that that i've seen anywhere. >> reporter: charging is one of several proposals on the table for managing this crowded situation. another, closing the street to cars. >> it's not going to be fair. i mean, this is like a landmarks you know, of san francisco. >> reporter: another idea is having to make a reservation for a time to drive down the street. >> we came here for vacation so we came with a schedule. we don't have too much time, you

know, to make a reservation, yeah. >> reporter: an ambassador here to educate people on how to act is also being proposed. >> people will stop us on the street and ask they can use our toilet. they will ask, you know, where can they get food. this is not fisherman he's wharf. >> reporter: residents say, yes, they knew what they were getting into when they moved here and things have gotten worse and people are coming here and behavior has gotten worse. something needs to change. there will be a meeting with proposals laid out from transportation officials who have studied this for the past year. all the information for our meeting on our website abc 7 news.com. amy hollyfield, abc news. a bay area company is making strides in measuring how much pot people smoke or consume. oakland-based hound labs says it's now the first breathalyzer for marijuana to be used in the field by law enforcement. the device measures the amount of thc in a person's breath. thc is the psychoactive ingredient in pot that makes people high.

. experts now say there's a 72% chance that an earthquake with a magnitude of 6.7 or greater will hit the san andreas fault before the year 2043. >> good evening, everyone. take a look at live doppler 7 hd. notice how much clearing we're getting. started out with the clouds and drizzle this morning and even some snow in the sierra. now that snow in the sierra is starting to wind down. live doppler 7 is tracking it, and here's a lovely picture from kirkwood. they got 3 to 4 inches of snow earlier this morning. they have seen it in previous years. the last time was about six years ago in the middle of september. here's a live look from our kgo roof cameras, and you're seeing nice just blue skies. 6 in san francisco and low 70s oak land mountain view and san jose, highs so far in the mid-60s to the mid-70s so really a nice break from the hot summer weather inland areas typically experience. from our san jose camera, seeing a few clouds and lots of sun mixing in.

spacex is anticipating a quick recovery after a launchpad explosion grounded flight two weeks ago. the private aerospace company founded by tesla's elon musk expects to resume launches as early as november, but it would do it from an alternate sight like cape canaveral or van den berg air force base. spacex has not determined what caused this explosion. it happened while the rocket was the being fueled. it comes with apple's new ios 10 operating system, the problem has been fixed tonight. >> the apple for users installing the ios during the first hour of availability.
