melendez is live with more on a hefty lawsuit just filed. >> reporter: well, i can confirm that her attorneys have indeed filed a $66 million civil claim against the city of oakland. in their words for failing to protect children. now, her attorneys also said or expect to file similar suits against other jurisdictions involved in this scandal. meanwhile, a complaint was filed, as you mentioned, against two officers this afternoon. the first complaint was filed against daniel black formerly from the livermore department. he's charged with two counts of engaging in lewd conduct, two counts of engaging in prostitution and one count of furnishing alcohol to a minor, all five misdemeanor charges, the second officers is leroy johnson, an oakland police officer who has retired and he faces one count of failing to report child abuse. an officer from the contra costa

sheriff's department and four others from the oakland police department are also expected to be charged in coming days. the investigation was launched last june by alameda county d.a. nancy o'malley following allegations of sexual misconduct involving a the woman was sent to a rehab facility in florida and was briefly in jail. this week she was released and returned to the bay area willing to testify against the officers. now we were expecting seven officers to be charged today but, again, only two were. you know, i can't read the mind of the district attorney here in al immediatea county, but perhaps nancy o'malley wanted to get those two misdemeanors out of the way. that's not to say that others

will be felony charges. again, this is only speculation. now, again, with regard to those two officers charged today they will appear in court on october 4th. i'm live in alameda county, lyanne melendez, abc 7 news. >> we sent out a push alert and you can download the app for free and continue to get the updates as they happen. >> an incident on highway 101 north near the willow road exit. let's get right to the scene live to tell us what happened. such a strange and tragic accident. >> reporter: we just got an update from the chp and they think they know what the projectile was that hit and killed this elderly man. the chp spokesperson describing it as a large brass bolt. he held his hands up, almost the size of a softball, but let's go back and explain to you exactly

what happened on northbound 101. this was around 1:00 just north of university. the driver, a man in his early 80s, behind the wheel of a white van so he hit the center divide and actually basically sideswiped the center divide for about 100 feet after a projectile came through his windshield and hit him in the neck. the chp says other drivers stopped and tried to help and give him aid and when first responders arrived on the scene they did have to pronounce him dead. the chp is still asking for any witnesses to come forward, again, preliminarily that the large brass bolt hit him in the neck and anyone asked to see anything is asked to come forward because they might be able to provide a better picture of where the bolt came from, debris on the highway or if it flew off another vehicle. an accident like this caused quite a bit of traffic backup. the two left-hand lanes of northbound 101 had to be closed for about two hours.

the chp reopened them at 3:00. the name of the driver has not been released but we do know he's in his early 80s and he lived in mountainview. katey mafrlzo, nbc 7 news. >> such a bizarre tragedy. thank you. the pilot of a small plane had to make an emergency landing in east palo alto this afternoon. federal investigators say the pilot reported engine failure around 2:30 today. the pilot managed to land the plane safely along a march inside the ravenswood open space preserve. two people were on board but they were not hurt. the cause of the failure is under investigation. a bicyclist is recovering from minor injuries after a driver hit him and get this stole his bike. oakland police responded to a report of an assault with a deadly weapon on 88th avenue around 2:00 p.m. yesterday. they say a suspect approached the cyclist as he was riding. the two had a brief conversation and the cyclist rode away. the driver then followed and hit him with a car.

when the victim fell, the suspect stole his bike and no other details about the suspect have been released. >> some parents in oakland got a real scare as the school year god under way. they got phone calls saying the child was injured or even kidnapped with a caller demanding ransom. abc 7 news reporter leslie brinkley is live outside a clairmont middle school with more on the threats. >> reporter: dan, imagine a feeling as a parent, you get a phone call your son or daughter has been injured at school or that they have been kidnapped and then the caller says they have got to have money right now. that's why oakland unified school district is sounding the alarm about this phone scam. it's called virtual kidnapping. reported to have happened twice in the last few weeks at the same school prompting the school district to issue a warning to parents here. the school started last month, a man called two parents saying their child was abducted and demanding a ransom. >> this family did exactly what

they were supposed to donned and calling the school and making sure their child was safe. >> reporter: and then it happened again last week with a man calling the grandparent to say their daughter suffere a broken nose urging them to pay money immediately for medical treatment. >> you're taking this seriously? >> oh, absolutely. we never want anybody feeling like there's something going on with their child if there is indeed not something going on with their child. >> makes my heart race for these poor parents that would get the kind of phone call, the last kind of phone call would you ever receive. >> reporter: virtual kidnapping attempts are happening more frequently across the country according to the fbi. >> it was very, very cruel. >> reporter: this woman who wish to remain unidentified describe being threatened that her daughter would be harmed if she didn't head to a bank within 60 seconds. the advice is to hang, check on your child's welfare directly with the school. in oakland, i'm leslie brinkley, abc 7 news. >> we have new video of a man police say set fire to some flags at a september 11th

memorial sunday. the man vandalized several small flags outside fire station 2. the flags were part of a larger september 11th memorial. it was set up by the menlo park fire protection district. the man was last seen walking southbound on running mead street. they helped lead recovery efforts back in 2001 in new york city. the familiar life an 88-year-old woman beaten during a home invasion robbery is getting ready to hold a prayer vigil in her honor. right now miss florida is in intensive care. abc 7 news reporter chris nguyen is live in the allen rock foothills where tonight's vigil will be held. chris? >> the suspect is expected to appear in court on monday, but for now the focus remains on tonight's vigil here in east san jose. it starts at 7:00 tonight, and the family is hopeful that neighbors will come out and show their support. at st. paul missionary baptist church in san jose, a number of
