good afternoon. i'm kristen sze. >> and i'm dan ashley. we'll begin with a major break in this weekend's bombings in new york and new jersey. >> the man accused in those bombings shot and injured in a dramatic shootout with police. >> now, abc 7 reporter eliz bert hur is live in linden, new jersey with the very latest. >> reporter: that shootout happened just behind me here and the suspect was taken here to the hospital injured and awake and alert. we're told two officers were also hurt, but they will be okay. the manhunt for the suspect ending in a shootout injuring 28-year-old ahmad khan rahami and two police officers. >> one of the officers was

actually sit until his police vehicle when he was shot at. i'm told the round went through the windshield and actually glanced off his forehead area. >> reporter: the takedown following a 911 call from a new jersey bar owner who told police there was a man sleeping in the hallway of his business. >> when the police officer arrived and to wake the individual and within a matter of seconds the suspect fired on him, he had his vest on, and he was hit in his vest so that -- that saved him. >> reporter: investigators now revealing they identified rahami as their suspect using a cell phone, found attached to a pressure cooker undetonated on 27th street in manhattan. >> right now we're not actively seeking anyone. >> i have no indication that there is a cell operating in the city. the investigation is ongoing. >> reporter: that's one of four bombs discovered in new york and new jersey over the weekend. the latest in elizabeth new jersey, not far from where rahami lived. >> vigilance is called for, and it's very, very important if

people see anything unusual, particularly an unattended package, that they report is immediately. >> reporter: and abc news learned today that the suspect is arrested here this morning is not cooperating. he's not giving his name or any -- answering any questions, and so investigators say they are now in the process of using dna and other forensic evidence to try to positively link him to the explosions. reporting from linden, new jersey, i'm elizabeth hur for abc news. >> elizabeth, thanks very much. we're also seeing increased police presence in san francisco including in and around oracle openworld conference that kicked off today. >> that's right. amy hollyfield has a look at safety precautions being taken now. >> bomb-sniffing dogs swept through oracle yorld this morning to prepare for the 60,000 people expected to attend this week. we also saw chp officers and private security teams guarding the perimeter, but attendees of oracle yorld tell us security is

not on their minds this week. >> it feels pretty safe here. i come last year also. it's pretty safe. >> reporter: san francisco police have added uniformed officers all over the city in response to the explosions on east coast. many told us they admire security here in the u.s. and feel very safe. >> i'm sure you've taken the necessary precautions, and we have all the confidence in the country, and we have been looking at u.s. as a role model for developing countries like us. >> i don't think you can live your life like that and be worried about it and coming from london we're fairly used to those kind of things so it's -- you just have to get on with things really. >> san francisco police say they hope people will think about security and help them look for anything unusual. >> what they are counting on is the public not being aware of what they are doing and just simply ignoring them. that's why we really emphasize if you see something, say something because we want the

public just to be a little extra vigilant. >> reporter: people here attending the conference say they are willing to say something if they see something but admit it's easier said than done. they tell us they are not really sure who or what they are looking for. in san francisco, amy halliefield, abc 7 nuts. federal investigators don't believe there are any links between the bombs in new york and a stab will rampage at a mall in minnesota. the islamic state claims 22-year-old-ir adan heeded its calls to attack countries like the u.s. be a off-duty police officer shot and killed adan after he allegedly stabbed nine people saturday night. witnesses say adan wore a security guard's uniform when he entered the mall. the somali immigrant had worked in the past as a guard for a store in the mall. we've sent important updates on the terror investigations. be sure to download our free abc 7 news app and enable push alerts to get the latest breaking news any time. now we have breaking news in the sexual scandal that involves law enforcement all over the bay

area. three more officers have been charged just moments ago. the alameda county announced a felony obstruction of justice charge for former oakland officer brian buntin. opd officer giovanni laverde and former contra costa deputy perez faced nell any oral copulation with a minor charges. that is punishable by up to three years involved. the case involves jasmine abullsin who has worked as a proust tuite since she was a minor. so far five officers have been charged. kranz believes a piece of metal from one of its trucks may have killed an elderly man friday in palo alto. the metal object about the size of a baseball shot through his window on highway 101 is with deadly results. abc 7 news reporter melanie woodrow joins us now. >> reporter: a bizarre and tragic accident according to chp and kranz and people who knew

82-year-old louis schaffer best say he was full of life. investigators with california highway patrol reveals this end cap is from a kranz water truck. it's the size of a baseball and approximately two to three pounds. it pierced the windshield of 822-year-old louis shafer's vehicle friday on northbound 101 hitting him in the neck and killed him. >> came as a total shock to him. >> reporter: kathy was married to him for seven years and remained friends with him after the death. >> he had many friends and was deeply spiritual. he was a wonderful father and family man. >> reporter: a statement offers gratitude to the drivers who pulled over, the coroner's office and chp for their compassion and professionalism. >> very unusual and trajic. >> reporter: chp investigators that realized a kranz water truck was pulled over on southbound 101 around the time

of the accident. >> we were advised that one of the tires blew out than that's why they were stepped on the side of the freeway. >> an isolated event that happened around we're working with chp to learn how that device came from the kranz truck. >> reporter: kranz offered its condolences to schaaf ear's family and friends. richmond police are searching for a gunman that shot and killed a man. officers found the victim behind the wheel of his car at carlson boulevard and south 47th street. sky 7 shows his white convertible half in the street there. he had several gunshot wounds. first responders could not save him. splice no information on a possible suspect. more tributes flowed today for san francisco political icon rose pak. pak died sunday at her home in chinatown. she spent decades advocating for the people of chinatown as serving as one of the city's most influential voices.

mayor ed lee spoke for the first time since the death of his longtime friend. >> she was one of the first people i met when i was a young attorney in chinatown and actually a law student trying to figure out how to represent people in chinatown. you can't always be 100% in agreement with rose, but you can certainly know exactly where she's coming from. >> pak's family plans to hold a wake for her on friday evening and the funeral will take place at old st. mary's cathedral on saturday. for the first time ever bay area quality officials issued a last-minute spare the air alert on the day of. that is look earlier from our camera. marin county very hazy out there. usually the alerts are called a day in advance. this is the 22nd spare the air alert for smog in 2016. well, you can pretty much see why they issued the spare

the air. look how dirty the bay area is. spare the air alert up now. moderate air quality for the rest of the bay area. take a look at the wind and the reason why they issued it day of is the sea breeze didn't come as expected to clean out our air. you can see the winds are still pretty light right now. highs so far, it is cooking again inland. mid-90s to low 100s for the hot spots along the coastline. it's warm as well. 70s and 80s around the region and many 90s showing up right around the bay. live doppler 7 hd showing you the fog is nowhere in sight but it's coming. you take a look here and it is right near monterrey and it will work its way up but until it arrives still a warm one as you look at the hourly temperatures for concord. 90 degrees and dropping down slowly by midnight and barely making it to the upper 60s. cooler weather in the forecast and i'll let you know when it will arrive and when you'll feel the difference and trust me, you will.

>> oh, we do. >> thank you very much. a wildfire keeps spreading through dry brush and debris. the fire forced the delay of last night's schedule launch of the alliance atlas 5 rocket carrying a satellite into orbit. so far the flames have burned more than 45 acres and the fire has knocked how the power to parts of the base. fire crews say the fire is zero percent contained. >> the milbury teacher charged with having an inappropriate relationship with a 15-year-old student was arraigned today on the peninsula. >> the case became even more complicated when abc 7 learned that the sheriff's office had dropped the ball in the investigation. >> abc 7 news reporter vic lee is live in the newsroom with the story. >> reporter: san mateo county district attorney steve wagstaf calls this a case where a teacher 25 years older than the student took advantage of her and what's more abc 7 news learned that sheriff's investigators in milbury knew about this relationship as far back as last fall but did

nothing about it and that's also now the subject of the sheriff's investigate. >> milledbury middle schoolteacher heather butts pled not guilt, among them committing a lewd act with a child. >> it's complicated. it's a very complicated situation and a very complicated case. >> reporter: abc 7 news is not naming the girl who has since graduated from taylor middle school where butts teaches. butts was arrested last month after police found her with a 15-year-old girl in a parked car here on santa helena avenue in san bruno. also disturbing, abc 7 news learned that a parent went to milbury police as far bar as last october and filed a police report after he heard about the illicit relationship, but sheriff's office would staff the milbury police department and apparently failed to investigate and then in february that same parent went to the high schokoc

a popular grocery store and deli in pescadero burned to the ground early sunday. it's downtown a few blocks from highway 101 and a popular spot for people visiting the state beach. the owners want to rebuild, and they are finding a lot of support in the community. abc 7 news reporter wayne

freedman is live in downtown pescadero. wayne? >> reporter: says a lot about this place as people have been coming far and wide from across the country, and this was not just a country store. this was a local landmark. spent enough time here. it might seem like if he stayed here for 100 years the whole world might pass by, and they hope the world comes by again when they rebuild it. follow these signs on the san mateo county coast today and they flo no longer lead to a local landmark. instead the charred and twisted remains of one. >> to see it burn. that would have been hard. i mean, it's hard to see it anyway. >> reporter: if you know pescadero then you know cindy simms, her husband steve and you may have pleasant memories of the goodies and the friendly atmosphere in the pescadero family store. while cindy and steve vacationed up north the place burned hot and fast. cause unknown. >> it looked like the entire town was up in flames when i first pulled in.

>> reporter: janice owns a business across the street and like many people here in pescadero she mourns the loss of an historic building and even more they will miss the atmosphere they created inside of it. >> it was a gathering place, community hall. >> it's community that makes it live. >> she hopes her heart and her doors to everyone. >> reporter: even today with insurance adjustors and fire inspectors and countless curiosity-seekers, cindy worried not so much for herself as she did for 19 employees. >> they are first on the list because they are the ones that i have a lot of employees who really can't afford to be unploild. >> reporter: that's the way they are in pescadero, a town defined by the lone stoplight on one side and a xwraf yard on the other. when tragedy hits a small town like this, it affects everyone, and everyone digs in. >> so now it's our turn to step up. >> reporter: wayne freedman, abc 7 news. members of a las vegas committee may support a plan to build a new stadium for the

raiders, but nevada voters don't like it, apparently. a rasmussen poll finds 800 likely voters found that 52% opposed raising hotel room taxes to build this $1.9 billion. 32% favor it and 14% are undecided at this point. last week the southern nevada infrastructure tourism committee sent its recommendation to the stadium for nevada's governor. he must decide whether to most issue on to the state legislature. meantime, a top nfl executive is in oakland today meeting city and county leaders about the prospects for a new stadium there. it comes a day after commissioner rogger goodell told reporters that he thinks a new home for the raiders can be built in oakland. a group led by this man, nfl hall of famer ronnie lott is working quitely behind the scenes on a stadium project for the coliseum site. we'll keep you updated, of course. >> so interesting, sandhya, how we had the last-minute somair the air but when you look

our camera, cooler temperatures and dramatic drop in temps wednesday and thursday. your hour-by-hour evening temperature, mild to hot, temperatures in the low 90s. emperatures go down but don't fall much, still a mild one and fog comes back at midnight and going into tomorro morning's commute. patchy fog and temperatures will look like this. mostly in the 509s. a few low to mid-650s so a comfortable to mild start tomorrow morning and there will be some nothing to start off your day. breezy tomorrow afternoon. it is still going to be warm inland but we're expecting those temperatures to come down. today we've had some 90s and 1 is hundreds, tomorrow, upper 80s for the warmest inland valleys. temperatures right along the coast in the 60s so today we've had the kind of heat where it's uncomfortable, especially when you don't have the ac in some of these homes here in san francisco on the peninsula, but as the wind shifts and the wind

really kicks in off the ocean you're going to start to feel the difference. wednesday afternoon in particular it gets windy near the coastline 20, 30, 35-mile-an-hour winds and 36 gusting at 6:00 p.m. wednesday evening. you'll notice that the winds are going into thursday morning will be strongest along the coast as well and into thursday afternoon. that will bring about the changes. you'll want to track those changes with our nbc 7 news app. wednesday sharply cooler and we'll see the 70s to barely making it to 80. saturday it's a warm weekend. just fast forward together weekend because we're going to skip over the cooler period now and notice that it really is warm. 90s there inland and 70s at our beaches and sunday we'll have the autumn heat. indian areas will be close 100 degrees. here's a look at the accuweather seven-day forecast. temperatures coming down tomorrow. low 60s to upper 80s. you don't like the 80s. no problem. wednesday, thursday, mid to upper 70s for our warmest spots. a good 20 to 25-degree drop from today. low 60s coast side and autumn

here's what's making headlines at 4:30. a man accused of setting off a bomb that injured 29 people in new york city over the weekend is now charged with five counts of attempted murder of law enforcement officers. ahmad rahami here is in hospital after a shootout with police. two officers were wounded. police say are a hammy is not cooperating with investigators or answering any questions. coming up at 5:00, abc 7 news will have insight from an east bay congressman who is on the house intelligence committee and put out the tweet. cell phone video put out an alert on the manhunt for the suspect. at 6:00 abc 7 reporter jonathan bloom with a look at the first emergency wireless alerts and in the race for president hillary clinton and donald trump are talking about the bombings in new jersey and new york on the campaign trail. abc news reporter stephanie

against someone we were told is okay turns out to be a terrorist who wants to destroy our country and its people. how did he get through the system? trump at a campaign event in florida had to this say. >> these attacks and many others were made possible because of our extremely open immigration system. >> reporter: it's too early to tell if the nation's concerns over terrorism will give either candidate an edge, but in a recent poll 49% say clinton would do a better job at keeping the country safe from terrorism while 47% say trump would. and just one week from today trump and clinton will get to address terrorism and many other topics in their very first much anticipated presidential debate. stephanie ramos, abc news, washington. the global refugee crisis tops the agenda at this week's annual united nations general assembly in new york. more than 140 heads of state and governments are taking part in the high-level summit to address the large movement of refugees

and migrants, especially from war-torn syria. the u.n. refugee agency reports during the last 12 months 11 men and women and children have died every day across europe, 11 a day. in the uk where london's parliament square has been turned into a graveyard of life jackets, the 2,500 life jackets belonged to refugees who died by crossing the mediterranean from turkey to the greek island. 625 belong to children. hundreds of migrants are still making tra treacherous journey trying to get to a better place. the life jackets have been placed here to keep the migrant crisis at the forefront and for governments to rethink policies for those seeking asylum. u.s. health officials have lifted their strongest warning to pregnant women to stay out of miami's wynwood arts district. no new cases of mosquito bjorn zika illness have been reported there since early suggest.

in seattle an entire high school football team followed the model of the 49ers. quarterback colin kaepernick and refused to stand during the national anthem. the coach told some of his players have encountered police brutality and racial profiling and some other players joined the protest. kaepernick started his protest in the preseason and other nfl players have now followed suit. a mom fighting cancer breaks into tears as her special needs son scores a touchdown. robbie heil, number 24, usually helps his teammates on the sidelines passing out water bottles and towels and heil's teammates helped surprise his mother who is undergoing cancer treatments and always watching from the sideline. heil scored a touchdown making his dream and his mom's come true. >> it really takes a village to raise my son and this village has really been outstanding.

kohl's plans to hire 69,000 additional workers for the upcoming holiday season to meet demand at 1,100 stores across

the country. the department stores operators say it started hiring in august for the holiday season and expects most jobs to be filled by the middle of november. they are moving quickly. several other retailers and businesses have already started ramping up hiring for the key holiday shopping season. nationwide ups will hire about 95,000 people, target about 70,000. the american academy of pediatrics is now urging doctors not to prescribe the pain medication codeine to children. the association says codeine can be ineffective, and the risk of side effects is too large. codeine is commonly used in over-the-counter cough syrups, but the problem is some people metabolize codeine too quickly, potentially resulting in breathing problems or sometimes even death. >> if your child is ever prescribed an opiod or narcotic, ask is there anything else that we can use that has the effect and if you do that you may get a drug that's safer. >> health and medical experts say codeine should not be prescribed to children who are younger than 12 years old.
