breaking news is happening in berkeley where you can see live from sky 7 what is left of a historic church building. fire destroyed the rectory forcing evacuations. this is only blocks away from the campus. good afternoon, everybody. i'm larry biel. >> and i'm kristein sze in for ama daetz. right now firefighters are still on the scene. it all started early this afternoon at the first congregational church on channing way. >> abc 7 news reporter laura anthony is there live with the very latest. laura? >> reporter: larry, hi. we showed you the dramatic pictures from sky 7. let's show you what it looks like here from the ground. i am standing at channing and dana. this is what's left of this first congregational church, an historic building here just a

few blocks from the uc berkeley campus. the fire chief here told me they will be here all night, they said, trying to make sure these flames stay doused. it started small and got very big very quickly with flames shooting through the roof of berkeley's first congressional church going to four alarms within a matter of minutes. >> when we arrived we found smoke showing from the exterior rooftop. fire crews went inside to try to make an aggressive interior attack, and we discovered that the fire was running through the attic. >> reporter: firefighters first tried to combat the flames from the inside but had to make a quick exit when it was clear the roof was about to collapse. >> we just saw, you know, little flames, but i thought it was containable and they came and put it out real quick. those flames quickly engulfed the roof and took the chimney out and spread quickly. >> reporter: once the roof went, all firefighters could do from then on was pour water on the

gutted structure from the outside. a day care center inside the church was evacated along the uc berkeley building. the home has long been a haven for the homeless offering services and shelter in the winter and has played host to many musical events. >> it's a great tragedy for everybody and a great loss to the community, and i am sure that they will rebuild. >> reporter: and this is a live look at the fire fighting activity still very much in force here. agencies from all over the east bay are here trying to help out. there were no injuries, but we understand a close call for one berkeley fire fighter who had to actually jump out of a window as the roof was about to collapse, and he realized he needed to get out. as you can see though, fire fighting efforts here will be going on for some time. obviously substantial damage to this church. live in berkeley, laura anthony, abc 7 news. >> laura, earlier in the afternoon we heard that they were doing some construction work up on the church.

that's good news. wind is relatively light at the moment out of northwest at 3 miles per hour. there have been stronger gifts. we show you the forecast gust animation going into the overnight house, and the gusts will remain pretty strong. they will diminish a bit in the late night hours and pick up again late tomorrow afternoon and as we look at the flag flapping in the breeze. these are peak wind gusts today. 35 miles per hour. oakland 31 at sfc and 22 to 26-mile-per-hour gusts. looking across the broader bay area, overnight. this is what will happen with the winds. they will begin to relax during the wee hours. morning into about 7:00 a.m., and then they will pick up again around midday tomorro into the afternoon and evening and become quite brisk and breezy once again. on top of all of the changing weather conditions with the abc 7 news a. >> spencer, thank you. a different fire to talk about, a possible shift in the santa cruz mountains is keeping fire evacuees from returning to their homes. it's become a frustrating week

for people who just want to go home. >> i really miss my home. makes me want to cry every time i think about it. >> here's the latest on the loma fire. it's burned 4,300 acres and destroyed eight homes. it's 34% contained. abc 7 news reporter david louie is live in the santa cruz mountains with the latest. david? >> kristen. i can confirm what spencer just told us. the winds are picking up a little bit here in the santa cruz mountains. our abc 7 field onmom ter is confirming that. the fire is definitely modifying its fire fighting efforts to factor this in. call fire also just announced it will be holding a second community meeting. this time tomorrow at 10:00 in morgan hill at the morgan hill community center. this is exactly what an increase in wind does. it creates spot fires where embers are carried a distance away. cal fire has been expecting gusts up to 35 miles an hour which can carry embers half a mile. however, you're not seeing a massive response to come of

these spot fires such as aerial drops or cruise moving in. that's because cal fire crews have already creed control lines or fire breaks where vegetation has been removed down to the soil. there's nothing left to burn. a major dozer line has also been cut to keep the fire from advancing. >> it allows us to get in and work on containment and work on we call it mop-up between those lines back in, so if the winds come up, there's not hot embers or anything to move past those paints. >> reporter: both cal fire and inmate crews are working in deep ravines where the steep walls can lead to injuries. evacuating those needing metrical care isn't easy. >> i would say no less than ten people to help an injured person up a hillside. they will have to set up either what we call a stokes basket, that's when you see like a litter to carry that person if their injuries were to that extent or even just aid somebody in walking up 100% slope, just to walk up there on your own is extremely difficult. >> residents have been showing their appreciation dropping off food. cal water employees have donated bottled water.

however, cal fire says it has plenty on hand. firefighters saved bill powell's house. >> they know exactly what they are doing and know how to do it and when it do it. they have the resources and the people. the best attitude in the world. just -- they are doing an incredibly good job. >> reporter: david louie, abc 7 news. novato firefighters have fully contained a vegetation fire burning near marin valley drive that started just after noon. the fire threatened several homes, but the shelter in place warning has now been lifted. expect traffic delays in the area though the next several hours as crews work to put it out. sky 7 was over stinson beach earlier today as the coast guard was searching for a possible missing kayaker, and that search is still under way. just before 9:00 this morning, an overturned kayak was found about two miles off the beach. the kayak has no gear no, markings. the coast guard is using an aircraft as well as boats just in case there happens to be a missing person out there. governor brown today signed

two bills that were introduced in response to the brock turner sexual assault case. one bill will require state prison time for somebody convicted of assaulting an unconscious victim. the other will permit sexual assault victims to say in court they were raped, even if the attack does not meet technical legal definitions. turner was sentenced to six months in county jail for sexually assaulting an unconscious woman, a sentence that many critics said was too lenient. now to the deadly train crash in new jersey. investigators questioned the engineer today and now they are trying to find clues from the train's black boxes. abc news reporter ray rim ho ndi is outside the station. >> one of the two data recorders recovered by the ntsb as they attempt to get one step closer to answering why. at the center of the investigation, 48-year-old train engineer thomas gallagher. >> we'll be checking records, maintenance records, employee records. >> reporter: investigators also want to get that second data

recorder located in the front car. two video recorders are also located there, but a destroyed canopy and mountains of debris is making it difficult for investigators to reach. that russia hour horror happening right in the heart of the morning commute. the 100 injured that one bystander on the platform who died. today we learn more about 34-year-old fabiola bittarde kroon who just dropped off her baby girl at day care minutes before she rushed to catch her train. >> she said she was in a rush. she went to the train, and, you know, in a way i behave myself because i talk a lot and could have spoke to her about other things. >> reporter: and amid the tragedy the story of a hero came to light. ramon ran in and crushed to de kroon's last moments of life. >> if you're going to die you're not going to die by yourself right now. >> reporter: tributes and prayers keep pouring in for

fabiola decroom. meantime, ntsb investigators will remain here at the crash site until next week. >> and an alamo teacher learned a tough lesson today on driving. the teacher hit the gas pedal instead of the brake and smashed through the fence at alamo county pre-school early this morning. sky 7 was over the school as police were beginning their investigation. the car ended up in the play area, but you can see it just missed the playground structure. nobody was hurt. some contra costa county workers were not at their desks today. they were out on strike. abc 7 news was in richmond where a picket line went up this morning where 1,100 county social work remembers off the job and the seiu members say they didn't have enough co-workers to claim her help. claimed 212 million in state and federal dollars have been lost because the county is not fully staffed the department. >> because we're not competeity. you know, we do have employees

that look elsewhere for employment opportunities and we're losing very good people that real care about this community. >> those workers happened the disabled, the elderly and families seeking public assistance. the county sent abc 7 news a statement saying it hopes to continue bargaining with the union and says many of the workers out picketing were already scheduled to have the day off. turning now to the race for the white house. once again donald trump's tweets are dominating the campaign headlines as the republican candidate went on a twitter tirade to bash hillary clinton and a former miss unisfleers in an election still up for grabs, hillary clinton in florida responded to supporters who feel like she should do more. >> some might say, well, hey, my gosh, you've only got 39 days to go, why aren't you just out there beating up on your opponent and doing everything to get the vote out and all the rest of it. well, i'll do that, but --

the ride sharing service wave is branching out. they are expanding its carpool program throughout the bay area. in may they invited a handful of local commuters to test the carpool option. it was initially available to some 25,000 employees at a few companies. riders only share the price of gas and now you can try it by downloading the waze or waze rider app and register with a corporate e-mail. scientists behind the rosetta space probe are celebrating after they crash landed on the edge of a distant comet. this is a mission that made a series of breakthrough discoveries. they chased a comet around the sun and put a sister probe on the surface and gathered information about its behavior and chemical composition. the european space agency led the mission and consortium which included nasa. lights off, lights on, and in reykjavik, iceland, tonight,

an update now on the breaking news at the top of the hour. four-alarm fire that's damaged an historic church on berkeley's south side. >> abc 7 news reporter wayne freedman is live at the scene. wayne? >> reporter: good afternoon, kristen. let me give you an example of what's going hon here. this fire is for the most part out but they are still pouring water out. if you look down here this is all pouring down the street from the scene of fire which is about half a block away. let me show you some videotape from earlier today on how this thing went down. the first congregational church of berkeley. >> the fire began at 12:42 this afternoon. as you said four alarms, 60

firefighters, they tried to fight it from the inside first, but that was not successful. it didn't work. one firefighter turns out it was stuck in an attic you couldn't get down and had to jump out of a window. he landed safely and he was all right. the roof of this building partially collapsed. there was nothing that firefighters could do to stop it. evacuations, many of them related to this fire. there's a nursery school in that place. that place has -- the nursery school has been evacuated. there's also a private boys school that. has been evacuated, and more importantly there's a dorm, a high rise dorm for uc berkeley, number 3. that building has been evacuated as well. it's kathy corner to the church. those students are still trying to get in. no word on when they will be able to do so. as for the church itself, as we come back live, it's very historic. it's been a part of berkeley since the late 1800s. not this particular structure. this structure came here in roughly 1925, but it's a loss of the community, not only do they allow people to worship here but it's a big homeless center for

people. it's a day care center. it's a boys school and it is a big loss. there are people who have been evacuated up the road right over here. we have the red cross and right now that's a lot more quiet than it was earlier and the water is still flowing down the street and this is going to be an active scene for quite some time. live from berkeley, wayne freed american, abc 7 news. >> wayne, thank you. an officers charged in a sex scandal involving an underage prostitute and several bay area police departments pleaded not guilty in court. vic lee is live in hayward with the details. vic? >> reporter: well, the sex scandal is widening, as you said. another arraignment of a law enforcement officer and on top of that the filing. legal claims on behalf. young victim and as you know a legal claim is usually a precursor to a lawsuit. ricardo perez resigned from his post early this summer as details of the sex scandal unfolded. he reportedly had sex with

jasmine abuslin, a 19-year-old woman who went by the moniker celeste gaup. abc 7 news is identifying her because she and her lawyers revealed her name publicly. 28-year-old perez has been accused of criminal sex charges who was a minor at the time. the judge released him on his own recook as soon as and that angered abuslin's attorney who are in court. >> there's a double standard. because he's a police officer he's being treated specially. if he were a black man charged with a felony he would certainly have to post bail. >> reporter: perez is one of the five law enforcement officers charged by alameda county prosecutors. they include oakland police officers and a livermore officer. oakland police officer brian buntin was arraigned a week ago on charges associated with the case. dozens more have been investigated from numerous police jurisdictions and some have already been disciplined and others have resigned.

after court today jasmine abuslin's lawyers say they have filed claim against six bay area cities and counties for failure to protect the young woman who was sexually exploited. >> the conduct is outrageous, and i think that it, unfortunately, reflects a climate and a culture within the oakland police department as well as the other departments that this kind of behavior is okay. >> the claim is for millions of dollars. >> i don't remember the exact amounts but it roughly breaks down to -- >> reporter: alameda county prosecutors have yet to charge an oakland officer and another who resigned in the wake. investigation. a third officer has been charged, but his case was continued today. vic lee, abc 7 news. and vic mentioned an oakland officer. today's proceeding comes exactly a week to the day after that oakland police officer brian buntin last appeared in court. buntin was the first officer charged in this scandal and he pleaded not guilty to felony obstruction of justice and a

misdemeanor charge of engaging in an act of prostitution. he turned himself in on tuesday and bailed out the same day. >> officials in el cajon have released two videos showing the fatal shooting of an unarmed black man this week. some videos or some viewers might find this viewer very graphic so we do want to warn you. police say the videos were released, quote, for the sake of the well-being of the community and to the address of misinformation. one video, take a look, shows 38-year-old alfred olango backing away from the police officer richard gonzalves. police say olango pointed a vape smoking device at him before he was tased and then fatally shot. his protest sparked days of contest. >> the oklahoma police officer accused of killing an unarmed black man pleaded not guilty today to a charge of first-degree murder manslaughter. betty shelby in the white shirt and pony tail was surrounded by

overs as she was hustled into a car outside of court. shelby claimed terence crutcher was reaching inside his vehicle when she shot him two weeks ago. video shows crutcher walking away with -- from shelby with his hands up but does not show when she fired. seismologists are warning today that a magnitude seven or larger quake has a 1 in 100 chance of hitting southern california by tuesday, yes. next tuesday. this is a frightening prognosis, and it comes after a swafrm up to 200 small quakes struck on monday morning and the area is south of where the san andreas fault ends. the chance of a large quake being triggered is small but real. >> from north carolina to michigan there's flash flood warnings. downpours are drowning the mid-atlantic and it's not over

italian police have recovered two vincent van gogh paintings stolen from an amsterdam museum in 2002. investigators found the artist's 1882 creation called "seascape" and "congregation leaving the reform church" hidden in a farmhouse near an organized crime ring known for cocaine trafficking. both paintings were without frames. >> the conditions of the paintings is overall rather good, i would say, but the seascape has -- damaged part of the paint layer has broken off so about this big, so there is a substantial damage. >> yeah. that damage is about five centimeters wide. the museum plans inspect both paintings closer to better assess the damage. roto rooter guys come to the rescue all the time but not like
