adam powell, a 41-year-old suisun resident appeared in the doorway and attempted to assassinate the officers with an assault weapon. a brazen attack and now we've learned new details about the man who police say tried to kill two officers. good afternoon and thank you for joining us. i'm ama daetz. >> and i'm eric thomas. larry beil has the day off. police say the suspect's gun had not jammed things could have turned out much differently for those officers. the vallejo police were ambushed by a man with an assault weapon as they took a break in a local starbucks. >> surveillance video shows what happened right after the attack. abc 7 news reporter laura anthony joins us live from the coffee shop. laura? >> reporter: north natalie there

were few people in this coffee shop behind me when a man walked in with an assault rifle capable of carrying up to 70 rounds. >> they were sitting in a coffee shop, you know, taking a small well-deserved break, and they were basically surprised by this gunman. >> reporter: two vallejo police officers were taking a break on sunday night when police say 41-year-old adam powell walked in and namaimed a assault rifle directly at them. >> his weapon malfunctioned and he was not able to get off the shot. >> reporter: powell ran away as shown in this surveillance video from the gas station next door. seconds later the officers caught up with him. >> he was attempting to clear that weapon plume presumably to use it as they were chasing him. >> reporter: powell was shot three times. police say besides the loaded assault weapon he also had a loaded handgun and was wearing body armor. the suspect is the father of 2-year-old adonis powell shown here in a family video.

the toddler was shot accidentally five hours earlier in this home in suisun city. police and family members say adam powell was there when the boy was shot but took off before police arrived. >> the initial indications that it seems to be an accidental shooting in suisun city. >> he's in stable condition. >> reporter: 19-year-old brianna bauers is the toddler sisters. adam powell is her mother's boyfriend and she does not believe he was trying to kill the officers. >> i assume maybe that he possibly thought his son was dead and just was distrout and just wanted to commit suicide a certain way, who knows. >> reporter: now, according to police adam powell has a criminal history with convictions for robbery and drug offenses. he was shot three times and remains in critical condition. his son is in stable condition, and according to family members is expected to survive. in vallejo, laura anthony, abc 7

news. >> laura, you say adam powell was there when his son was shot. is he a suspect in the shooting? >> reporter: well, eric, at the time of the boy's shooting adam powell was in the house we're told both by family members and by police. he was considered a person of interest because he left the home before police and paramedics arrived, but police maintain they believed that shooting was an accident. they do not know yet though whether one of the guns that powell had in his possession phere last night was used or wa the gun that accidentally shot the little boy in the family home in suisun city. they are still trying to figure all of that out. >> all right. laura anthony. thank you so much. if you would like to see the surveillance video again we post it had on the abc 7 news app. you can get the latest updates on this story by enabling push alerts. other news now, the wife of a warehouse worker in san leandro has just learned her husband was killed at work when he tried to stop someone from stealing a wooden palette. the driver who stole that palette ran the man down around

11:45 at the true world food's parking lot on williams near mers ed street. police say the driver had been caught stealing palettes from the back area of the business. elissa harrington will have a live report coming up at 5:00. jury selection began in the case of teen sierra lamar who disappeared in 2012. the man who is accused of murdering her antolin garcia-torres could be charged with the death penalty. he's also charged with kidnapping during a carjacking. lamar's body has never been found. many potential jurors cited hardship after the judge told them the case could last through april. >> so that fact alone is going to weed out many potential jurors so there's going to be a long proses here and this case will take a toll on everyone. >> the judge left the possibility of a change of venue on the table in case the jury pool says it can't be impartial because of the media coverage.

lamar would have been 20 years old on wednesday. it was a rough landing for the two people on board this twin turbo prop at the hay wad airport this afternoon. sky 7 was on it after it ran off the runway after landing. something went wrong with the landing gear causing the 12-seat plane to veer into the grass. it wasn't damaged, and the two people on board weren't hurt. the bay area got quite a dousing, a welcome sight for many and a concern for some in san francisco neighborhoods. tonight they will hear from city officials about the latest plans to prevent flooding. abc 7 news reporter carolyn tyler has the story. >> that much -- we had all of them in here. >> it will be two years ago this december that heavy rain created a nightmare for people in the mission terrace neighborhood. raw sewage mixed with storm water flowed down the street and into basements and garages. since then blaine bachelor and her husband have spent thousands of dollars on repairs. >> well, the work that we've

done here has come all out of pocket. had to dig very deep into savings and had to borrow from our parents. the city promised to fix everything and they haven't. >> a lot of work has been done. they might not see it >> reporter: san francisco public utilities commission acknowledges their infrastructure is old. some sewer pipes were installed during the gold rush days. they are now exploring a 20-year multi-million dollar fix. for neighborhoods throughout the city, they hope this land own by caltrans could be used for a project in mission terrace. >> there's sort of an erten bummer there at the very end that have street, and we're looking at sort of leveling that and bringing that down so that the stormwater can flow there. >> reporter: that could be another two years away and with a new babe they family feels the puc and the mayor are not moving quickly enough. they are among dozens who filed suit against the city. >> all this talk about long-term solution and -- it's just executions. >> reporter: city firms will update their plans during a

community meeting to the. in san francisco, carolyn tyler, abc 7 news. today was a big cleanup day for many storm-batter parts of the bay area. tree removal crews were called to cupertio today. in san francisco downed power lines were a big problem on geary boulevard last night. they landed on parked cars near third avenue cutting power to people who live nearby. pg&e says there are just 68 customers now without power in the bay area from outages related to the storm. well, ama says storm-battered, that's precisely what we were saturday especially with the powerful wind gusts. we're looking at the live doppler 7 and only seeing a few scattered showers. most of the bay area experiencing dry and calm weather and the four-day rainfall totals are impressive, nearly 1.5 inches near santor, roseau, over an inch in san francisco and 2 inches fell in

oakland and representedwood city over 2.25 and nearly 10 inches at ben lomond. this is the view at the golden gate where skies are mainly blue and this is a look at the percent of normal rainfall for the month of october to this point in october up to the 17th. livermore nearly 525% of average and napa nearly 500% of average. a lot of rainfall over the past couple of days. a 24-hour temperature change shows it's five degrees warmer and four degrees warmer in hayward and nine degrees warmer in fairfield. quite a warmup coming later this week and i'll show you all the numbers hand how long it will last in a few minutes. ama? >> thanks so much, spencer. the people pat squaw valley alpine meadow received up to three inches of fresh snow from the recent storms and provided this video of conditions at the resort. look at that. folks at squaw say they plan on opening early, between november 11th and 18th. and the storm left behind

some incredible wave action along the california coast. abc 7 news was at san francisco's fortt point as waves nearly 12 feet high crashed by the roadways. surfers were delighted and waited underneath the golden gate bridge and tourists were caught by surprise and left soaking wet. the high tides caused some coastal flooding from bodega bay. >> the prospect of the oakland raiders moving out of the bay area moved one step closer to reality today. >> anchor kristen sze is here with the latest on nevada's efforts to lure the football team to sin city. >> reporter: eric and ama, nevada governor brian sandoval was all smiles as he signed a bill into law that would help pay for a new stadium for the raiders in las vegas. owner mark davis was front and center as a vip who went on to say he would like to call las vegas home right now. the stadium bill was approved by both houses of the nevada legislature last week. a $1.9 billion with $7.9 million

you can see how clear it is. yet, we still have a few scattered light showers. i mean, widely scattered and light way up in the north bay. north of santa rosa and up to ukiah and all else is calm. this is looking north ward at a mainly blue sky. current temperature readings in the mid to upper 60s from san francisco to oakland and 71 degrees right now in gilroy and 63 at half moon bay. this is the view of a few puffs of cumulus from mt. tam. skies are mainly blue. temperatures are also in the mid to upper 60s at napa and fairfield. 78 in concord and 68 in livermore and a live view from our roof top camera looking out over the bay and these are the forecast features. we'll see sunny days ahead right into the middle of this week and much warmer all across the bay area by wednesday. no rain in sight for the next seven days and i'll show you what's coming on the eighth day. forecast animation for tonight. notice we'll see an increase in low clouds near the coast and locally out over the bay. they will move away by afternoon

and giving us another mainly sunny day. overnight low temperatures dropping into the mid to upper 40s up in the north bay valleys. a little chilly there and cool to mild elsewhere with lows generally in the low to mid-50s. and then tomorrow under mainly sunny skies we'll see highs up to mid-60s near the coast and upper 60s to around 70 and right around the bay at oakland, fremont, palo alto, san mateo, low to mid-70s inland and places like santa rosa, napa, concord, livermore and san jose and a look at the warming trend for the remainder of the week. wednesday, we'll see the warming trend real kicking into not high gear and medium gear. we'll see high temperatures into the low to mid-70s and upper 60s in some coastal locations and 80 inland and then it will get a little warmer, mild to warm on thursday with mid-80s inland and that range will pretty much hold through friday. next week on tuesday to be precise we'll see our next storm beginning to move in our

kit and developing an emergency plan for your family at abc7news.com under prepare norcal. fire boats played a large role in saving the marina from a fire after the quake, and today the city introduced its third boat. abc 7 news was at mccovey cove for the official commissioning ceremony for the st. francis. the boat cost nearly $12 million. most of the money came from a court security grant. fire officials showed off its impressive fire fighting cannons and apparatus. the earthquake was on dianne feinstein's mind remembering how the boat helped with fire hydrant to put out a fire. >> actually the fire hydrant to a great extent saved the day. >> "the st. francis" joins the "phoenix" and "the guardian" in the san francisco fleet. coming up at 4:00, new details about that shooting that

and here's what's making headlines at 4:30. police believe a man tried to assassinate two officers in a vallejo starbucks last night, but his gun malfunction the. the officers chased down and shot 41-year-old adam powell. he's in critical condition. investigators say the incident happened a few hours after powell's 2-year-old son accidentally shot himself at their home in suisun city. reporters said that samsung has had a team ready for customers who show up at sfo with banned galaxy 7 phones. what is done to make sure no one is forced to board a plane without a phone. donald trump has called out fellow republicans for being what he considers know eve when it comes to voter fraud. coming up at 4:45, reaction from both sides. and police have identified the man who shot a san francisco police officer as nicholas mcquitter. the gunman shot the officer

friday night before running away. officers followed him to everglade drive where they shot him. he kept going a few more blocks before being arrested at vincente and 28th. vic lee is here with more about the suspect and the officer who nearly died from his wound. vic? >> reporter: this is lake shore plaza in the sunset district where it all started friday night. the suspect acting erratically. we are learning more about him tonight. this is a security camera image of the suspect whom police identified as 26-year-old nicholas mick quit cquitter. he'sch accused of shooting police officer kevin downs. the suspect had a p.o. box in pacifica but had been living in a white ford van parked on the 1500 block of 1th avenue. neighbor jeremy bornstein. >> i noticed a white van worked

outside of my house and it was there for several days, and that was basically the only thing i noticed until saturday night when i saw lights from a police car outside. >> reporter: police towed the van that negotiate. it all started friday evening. officers responded to calls saying someone was threatening shoppers at lake shore plaza in the sunset district. after a chase, police say he shot at officers near stern grove, wounding downs. the suspect was shot after an exchange of gunfire. he died sunday at the hospital. over the weekend interim chief tony chaplin told reporters downs was recovering from his head wound and was k. earlier friday night police were investigating calls of gunfire at a nearby street. mayor ed lee since the suspect could be linked to that incident as well. >> we don't know if it's linked to this incident or not. there was a shelter in place for residents in edgewood and they

are trying to piece it all together. >> reporter: this investigation is conditioning. whether or not the suspect is the one who was shooting off thinks gun in that prior incident. vic lee. abc 7 news. >> vic, do we know if the suspect had mental health issues? >> reporter: well, police sources tell usee that he was apparently struggling with mental health issues. those same sources tell us his parents were trying to help him but they were unsuccessful in getting him treatment. back to you. >> all right. vic lee live. thank you very much,ic. >> reporter: opening statements begin this week in the retrial of the man accused of killing etan paetz, one of the first missing children ever featured on a milk carton. the 6-year-old disappeared while heading to his new york city bus stop in 1979. police received a tip in 2012 that led to pedro hernandez who confessed to kidnapping the boy and strangling him, but his lawyers say he's mentally unstable. a jury deadlocked last year in the first trial. the civil trial brought by a

former penn state football coach and whistleblower over the jerry sandusky case is now under way. mike mcqueary is suing penn state for $4 million claiming the university defamed him and refused to renew his contract in retaliation of his testimony against sandusky. mccreary said he saw sandusky sexual abuse a boy in a shower and reported the incident to legendary football coach joe paterno. the minnesota naacp is demanding a formal apology from a local police department after a heated confrontation was caught on camera. the cell phone video shows a black man stopped by a white officer and the whom who recorded the incident says the man did nothing wrong but the city has a different explanation. elizabeth hur has the details >> you can't just put your hands on me like this. >> reporter: this is the video posted on youtube having the naacp demanding that the police department apologize. the man stopped by police is

visibly upset and can be heard repeatedly asking the officer to take his hand off of him. >> i know my rights. i didn't do no, and you got your hand on me. >> reporter: at one point the woman recording the video also seems to question the officer's response. >> maybe you could just help him for where the right place to walk is. >> reporter: according to the police report, is the officer claims the man was, quote, obstructing southbound vehicular traffic, creating a risk to his safety and others. >> be careful in judging an officer's behavior or a person that he's got stopped behavior. when you only watch the middle of a movie you're really running off limited facts. >> reporter: this video does not show what led to the initial stop and in a statement the police department maintains the man was verbally warned that, quote, the man did not stop and was defiant. it was after that point that the recording began. >> i think you still have to look at were there ways to de-escalate that into something

other than what it appeared to end up. the answer may be no. >> reporter: the man was initially cited for disorderly conduct and failure to obey a traffic signal and the mayor now says that citation will be dropped and the city is reviewing the incident. elizabeth hur, abc news, new york. the president of the international association of chiefs of police apologized today for what he called the historic mistreatment of people of color in the united states. terrance cunningham says past injustices have created between communities of color and police. this halloween would you like to be a clown? no comments from you. it might be harder than you think. coming up, the new fallout from the nation's ongoing creepy clown phenomenon. i'm michael finney. this year. other retailers like target and best buy have not announced their plans just yet. the creepy clown phenomenon is now scaring target out of the clown costume business. the retail giant is removing clown masks from its stores and is scaling back its online inventory. this comes after reported sightings of scary looking clowns in 40 states. target says the decision was made out of sensitivity to the issue at hand. the clown craze fueled by social media has become big business. national costume retailer halloween express says its clown costume sales are up 239% this year. all right. we have a week of lovely weather coming our way after a rather stormy weekend. looking at live doppler 7 right now. we see mainly calm conditions but there are light scattered showered up in parts of the north bay and no significant rain is falling right now in the bay area. tomorrow we certainly won't see any significant rainfall. we will see significant sunshine tomorrow with highs ranging from

mid and upper 60s at the coast to right around 70 near the bay and low to mid-70s in our inland areas. for the week ahead we're losing livermore as indicator of the high temperature trend. the average high temperature is 76 and tomorrow a little bit below average and temperatures will bounce up above that level on wednesday and low 80s in livermore as well as many other inland locations thursday and friday and then temperatures taper off to the average range until the end. weekend. here's the accuweather seven-day forecast, and it's going to be mild and sunny dry week. we'll gain a few clouds over the weekend, but no rain expected then. however, early next week weather will start off as a little bit unsettled. we'll see uncreasing clouds and a little bit cooler and we'll have rain by next tuesday and, of course, we'll keep watching that for you. >> thanks, spencer. still ahead at 4:00, three weeks from election day but there are already long lines as people wait to cast their vote and now new accusations of voter

there's five ballot measures that deal with the homeless situation. more from live outside city hall with the details. >> reporter: hi, ama, you're right. one. measures, prop q, would ban sidewalk encampments. as you see behind me that protest this morning was short lived but the residents of the mission district told me they are desperate to find a solution to the homeless problem. just after 8:00 this morning a handful of neighbors of two san francisco communities began setting up tents on the sidewalk next to city hall. they are fed up with the amount of tents throughout the city used by homeless people. >> there's literally people living on the streets and the city is very slow to deal with it. the fact that it's gotten this bad is just unacceptable. >> reporter: statement janine jacob would like to seat city provide more housing and services for the homeless. >> i believe that the tents are frustrating and the mess is truss freighting and the crime is frustrating, and the myself

i've been victimized by the crime. >> reporter: on the november ballot is proposition q which would allow the city to ban sidewalk encampments. it would also authorize city officials to remove them 24 hours after a person has been offered shelter. sam dodge is with the department of homelessness and supportive housing. he argues that right now the city doesn't have enough shelters. >> we have 3,500 people that are unsheltered and we have 1,600 shelter beds. >> reporter: supervisor norma ye believes the city must first have a space before it can enforce mandates like prop q. an example was a 2010 law that didn't allow anyone to sit or lie on the public sidewalk from 7:00 in the morning to 10:00 at night. it was called ineffective because it doesn't solve the homeless problem. the city is expected to open a third navigation center for the homeless next year which would help ease but not solve the

crisis. in san francisco, lyanne melendez, abc 7 news. oakland will take up a proposal for a city-sanctioned tent city next week. abc 7 news has learned it will be a pilot program allowing an encampment to serve of around 4069 city's homeless. the move comes as the city is set to approve $400,000 in funding for winter shelters. city officials admit there's almost 1,400 people with no place to live in oakland and the shelter program will be able to serve of only a few hundred on any given night. well, it's a big move for china as it launched its longest ever mission to space. the rocket blasted off from the gobi desert to the dock with an experimental space station. astronauts will remain aboard for 30 days to pave the way for additional modules resulting in a fully completed spates station six years from now. that is going to do it for this edition of "abc 7 news at 4:00."

for a man who ran over and killed a warehouse worker at true world foods. the victim confronted the suspect for possibly stealing wooden palettes. nbc news 7 reporter elissa harrington is live at the scene. ely's snarks >> reporter: police are here on scene and have been here for seven hours now. police say that he did work here at true world foods that distributes seafood and other items for wholesale and investigators are following up on some strong leads. a you few employees along san leandro's williams street witnessed the horrifying crime. they told police a man in a pickup truck purposefully ran over their co-worker killing him. it happened around 11:45 this morning. lieutenant robert mcmanus says that employee might have confronted the suspect committing a crime on the property. >> we have some palettes in the parking lot. they have been moved, and we think that there may have been a palette theft in progress that very well c
