updates to your mobile device. >> law enforcement upgraded a missing child search to an amberg alert this afternoon. the concern is growing about the safety of 7-month-old henry massy believed to be with his mother hannah ashley who doesn't have custody of him. an amberley alert has been issued for california license plate 5jk 7 it 35. a woman riding her bike was hit by a driver this morning, a white acura on fremont acura at the sunnyvale intersection. sky 7 shows you the area where it happened. the car sped away. police in sunnyvale say the bicyclist went to the hospital with life-threatening injuries. there were witnesses to the accident, many of whom called 911 afterward. >> now to your voice, your vote, and campaigning that seemed to reach kind of a fevered pitch

million registered voters, about 72% of eligible adults. in september that number jumped to 18.2 million registereders outnumbing the total populations. >> with the clock tick on the deadline, phones were ringing and voters streaming into the contra costa county elections office in martinez. the county clerk says this year voter turnout in the east bay could be bigger than ever. he expects 10,000 people will register to vote today alone. >> there's a lot more this year. we're seeing higher numbers. we'll be at the heist the county has ever been, over 600,000 registered voters by the time it's all processed. >> an all-time high is also expected in san francisco, and an official estimates the city will hit 515,000 registered voters by the end of the day. in alameda county, registration is also up from 810,000 registered voters in 2012 to

race for president. why her effort focuses on donald trump's daughter ivanka. we have new details in the armed robbery of a man near san francisco's cliff house. police released this surveillance video of the robbery on october 5th. if you look at the top of the screen you can see the victim being dragged by 15 feet by a getaway car and the people were taking pictures when two men grabbed his camera. >> we're not sure if the victim wasn't able to let go or had to holds on to the straps and there isn't a lot of violence with him being in the street. >> one of the robbers got left behind by the getaway car and ran down the great highway to watch up as you can see there. the victim has road burns on his arms. police have arrested one suspect, this man, 19-year-old jacobo padula. firefighters evacuated a block in san rafael today after a gas main ruptured. pictures from san rafael fire show lincoln avenue closed to

traffic near lyndon lane about half had a mile north of downtown. gas spewed into the air and firefighters say the breeze helped thing thin it out. pg&e closed off the break and lincoln avenue reopened this afternoon. >> the valero refining company has agreed to pay nearly $250,000 for air quality violations at its refinery. the bay area management district say most of the violations occurred in 2013. the settlement covered 29 notices. violations include several minor hydrocarbon leaks from storage tanks and database omissions. the air district says the mistakes that led to the settlement have been corrected now. coming up at abc 7 "news at 4:00, fan frustration was evident at levi statement with a lot of empty seats at the niners game. we'll have a report on the economic impact. >> that's not america. that's not california. >> and he's not running for office, but he's all over your tv. who is this california

breaking news in berkly. sky 7 over college avenue where a large tree came crashing down this afternoon. it's big, as you can see. you see it on top of a building there. it's at alcatraz avenue in the elmwood district as you look live from sky 7. you can see the sidewalk has buckled as a result. first responders have closed that second of colleg avenue to remove this tree. we know it's windy in this area but it's much too early to determine what exactly brought it down. a crew is on the way and we'll bring you a live update from the ground here on abc 7 news and we're sending updates through

the nbc 7 news alert to get push alerts on your phone or tablet. there seems to be a correlation between six straight losses of the 49ers and empty seats at levi stadium. the team may be losing some of the faithful and the city of santa clara may be losing revenue because of it. david louie is live at levi stadium to explain. david? >> reporter: ama, the mayor of santa clara is very concerned about the empty seats because if the team is starting to lose money, then perhaps the city of santa clara will as well. now, one of the big earns, of course, is the fact that the city is expecting reimbursement for certain expenses such as traffic control. winning is a hoy-stake game, so is filling the seats at levi stadium. the niners said the game against the bucs was sold out and the half empty stadium said otherwise. and empty seats can mean less revenue for the city of santa clara. last season the 10% ticket surcharge generated $8.1 million for the city. the $5 parking fee per vehicle, over 425,000 and just over a quarter million dollars for a

senior and youth program for a total approaching $8.9 million, a drop in attendance comes at the same time the niners have asked for a $5 million a year rent break. >> lowering the rent over a long period of time will make sure that if the 49ers are not able to pay all of their expenses they will start digging into the city's revenue stream, amend i'm really concerned about that. >> reporter: the personal licenses and tickets have already been sold and empty seats don't translate no a direct revenue loss but it does impact how many vehicles use the lots and sales at concession stands. still, santa clara's acting city manager isn't alarmed. >> percentagewise it may be like 1% or 2% less, but that can be recovered when things are doing better, and, you know, things were not planned like it will always be fully sold out. >> reporter: niners turned down an interview request and declined to answer questions about the financial impact of empty seats. those are details, it says, it does not disclose. however a grand jury directed audit is under way to look at game revenues and how the city

has used those funds. the results are due in about two months. >> we are crying wolf right now that general fund monies may be used for the stadium. we have to clear that up first and that's what we're doing. >> reporter: in santa clara, david louie, abc 7 news. a mural of 49ers quarterback colin kaepernick taking a knee in protest has been painted over. apparently after san francisco classified it as graffiti. this is a picture of the mural posted online by our partners at hoodline earlier this month. this is what the wall on hudson avenue looks like now. the owner of the building told abc 7 news he had it painted over after getting a graffiti removal notice. the public works department says it received several complaints about it. a city spokesperson says the mural could have stayed if the owner simply sailed he sanctions it. the man who made millions as a hedge fund manager walked away from his power job to become a political activist. you may not know his name but you'll probably recognize his face. it's been on television a lot

barely making its presence known in oakland and into the south bay we go. live doppler 7, yeah. this is likely going to be picture over the next 24 hours. the south bay really anticipating very low totals, if any measurable rainfall is out of this system. current numbers out there, see where the rain is falling at this hour. look at santa rosa. 59 degrees, a rain-cooled temperature and outside of the showers everyone holding into the 60s and the storm impact scale, today, tonight and tomorrow. it's a wonderful light storm and the steadiest of that rain is likely in the north bay as it's falling right now. scattered showers elsewhere outside of the north bay and the rain falls for the longest amount of time. future weather hour by hour. watch the time stamp. 4:00 in the afternoon and rain in the north bay and by 7:00 this evening the front itself is still trying to enter santa rosa. there's the chance of a couple showers popping up ahead of the front and when we're back on air for abe 7 news at 11:00 meteorologist sandhya patel will be tracking that front right over the heart of the bay area. this is our best chance to pick

up some showers outside of the north bay later on tonight. as we go into the morning hours on tuesday, there is still a chance of a pocket of showers developing and most of the activity limited to the north bay and the system will go back up to the north tuesday evening and get out of here. what we you're pecting in terms of rainfall through tuesday mornings the highest totals in the north bay area, probably up to a quarter inch of rain and that might be optimistic and likely in the south bay less than .05 of an inch. expecting little or nothing in the south bay and scattered showers for your tuesday morning commute and then this system is out of here by tuesday afternoon. take a look at your highs for tuesday. very similar to where we were today. a lot of 60s around the immediate bay, a couple of spots inland and then the south bay we'll have highs in the lower 70s. accuweather seven-day forecast. morning showers on the way tomorrow. we get into wednesday. there's a break in the activity.

a manhunt is on in oklahoma for this murder suspect accused of killing two family members and wounding three others, including two police officers during an overnight shooting spree. investigators say michael vance shot the officers who had responded to a call of shots fired near oklahoma city. vance is accused of then shooting a woman as he hijacked her car. police say they found the bodies of vance's relatives in a home in the tune of luther hours after the initial calls of gunfire. the san francisco medical examiner's office has identified the two people who died in an apart murder-suicide in the oceanview district friday night. investigators say 68-year-old dana pierce of cleveland, ohio was murdered by 65-year-old woodly carson who was a resident of the city. police say the killings happened after a family argument. it's a good for the soul race to honor a late pleasanton native while benefiting students and challenge the athletes. downtown pleasanton will host its first ever 5 and 10k run and

walk event in honor of kate sustainly, 392-year-old killed on san francisco's pier 14. it's to benefit students rising above and the challenged athletes program. >> chp can't find any evidence that a tour bus braked before slamming no a big rig killing 13 people near palm springs. federal investigators have joined the chp now and they will stay there through the end of the week. investigators have identified most of the victims. abc's dana backes has the latest now from palm springs. >> reporter: this mangled wreckage is the scene of one of california's deadliest road accidents. more than a dozen people, including the driver, culled when a usa holiday tour bus heading back to los angeles from a casino slammed no a trulier. >> there was no appearance of braking no, skidmarks from the bus at the time of the collision. the only skidmarks were directly related to the big rig as it got pushed forward. >> reporter: 31 people were

injured and investigators are still trying to figure out what caused the crash. the bus company's records show no history of accidents or mechanical problems. the driver of the trailer saying he doesn't remember much about the accident. >> the impact, you know, hit me from behind, and -- and i just blacked out for a minute, and when i gained my conscious, undid my seat belt and looked around to try to see what happened. i felt like i got ran over by something and that's when i got out of my truck. >> reporter: back in los angeles, a memorial is growing where the bus was expected to return. those who lost loved ones still processing the tragedy. rosa was a mother and grandfather. her family told she died instantly. >> she got along with everybody, and she enjoy doing what she was doing, went to the casinos. >> reporter: officials say a possible medical condition or even fatigue may have been a reason why the driver failed to

apply the brakes. police in madeira are confident people who fired at a police cruise they are weekend will be captured soon. dashcam video shows the frantic moments when a passenger inside a car old fire at around 4:30 yesterday morning when the officer tried to pull over a car with a civilian guest inside on a ride-along. the woman began screaming when the shots were fired, and there were 12 shots in all and three hit the cruiser disabling it. as far as close calls, this is a very close situation where an officer could have been killed or the passenger. >> madera police released pictures of the patrol car. check it out, its window shattered. the woman on the ride-along suffered minor cuts from the broken glass. police found the suspect vehicle with a weapon inside but no sign of the suspects.

well, the ex-wife of former subway pitchman jarred fogle is suing subway for an unspecified amount of damages. katie mclaughlin says the restaurant train received three reports indicating fogle's sexual interest in in children but the company failed to take proper action. >> finding out that your husband and father of your children is a child predator is devastating and that subway did not follow on one complaint while continuing to utilize jarred as their spokesman and facilitate his visits to the hundreds of schools is beyond comprehension. >> reporter: the couple divorced days before he was sentenced to 15 years in federal prison for trading in fed pornography and paying for sex with underage girls. subway wrote in a statement it could not comment on pending litigation. dub nation, the warriors open the regular season in oakland tomorrow. ahead, how the team feels about its new reputation after signing kevin durant.

rate at 15%. the management consultancy survey found negative perceptions have since soared to 52%. wells fargo is at risk of losing $99 billion in deposits over the next year and half as a direct result of the scandal. just last month claims surfaced that the bank created as many as 2 million fake bank and credit card accounts between 2011 and 2015 in order to meet sales goals. all right. you may have a halloween decoration in your house right now that could be dangerous for kids. target is recalling 127,000 of these led gel window clings. the consumer product safety commission say the clings can separate and expose the battery which can choke children. they were sold nationwide from august to september for about a buck. if you bought them they can be returned to any target store for a refund. a letter to the editor of a rhode island newspaper sparked a day of action. the topic, yoga pants.

hundreds of people marched through the streets of barrington yesterday in what was dubbed the yoga pants parade and it came in response to a letter in "the barrington times" criticizing women of a certain age of wearing the form-flitting workout attire. >> it speaks to the need for us to stand up for our rights to wear what we want. >> they marched and went by the home of the person who wrote the letter. he claims his letter was only meant to be a joke and says it was stressful and intimidating. time now for "ask finney" via facebook, twitter and e-mail. >> i have an old deposit.

>> start with the bank, i assume you mean a certificate of deposit. start with the bank to see if they have any information about it and if they don't go to the state. there's an organization -- you know. what i don't want you to go to the state. got to unclaimed.org. by law anybody holding your money, if they have lost track of you, they have to turn the money over to the state. if you go to unclaimed you can find any state that could be tied to that money, if the money started out here or went there, that way you can try it out. they are snowed to hang on to the money, that's by law. they have to do it. >> all right. >> well, linda would like to know what should you do if you find something initial in your food that shouldn't be there? >> that's a great question. >> oh, yeah. >> linda, look, first off, notify the company. hopefully you'll be able to protect others so they don't have the same thing happen to them and also ask the government to investigate. go to the food and drug administration. that's a good starting point, but if you're thinking of suing i don't want you to expect a big payout. that's all an urban legend.

it all did take down a wire. now at first police thought that this might be a live power line, so they did close the road to traffic. we are along college avenue and alcatraz. they did find out this is an at&t line for television and phone, so lanes along college avenue are back open but officers are out here directing traffic and it is moving very slow. the good news is nobody was hurt. some branches did fall over on a parked car and did damage that vehicle. the department of forestry is on the way and they will determine what caused this tree to fall and the best way to clear it from the area. now, it was windy earlier today, and a spokesman for the city of berkeley did tell me that it appears wind was the cause, but, again, the department of forestry is going to come out here hand make their own determination. you can also see if you come back to us, the inside of the tree appears to be hole owed out. perhaps it was rotting or maybe it was sick. we are going to get some of those answers a little bit later on today, but if you are
