hit by a car and fellow officers open fire on the driver. we are learning of the wild chain of events leading to a violent con problem station. i'm dan ashley. >> i'm ama daetz. the injured officer is expected to survive. it happened around 3:30 this afternoon in the ocean view neighborhood at montana street and capital avenue. >> dan: lisa amin gulezian is live where the injured officer is recovering. lisa? >> reporter: he is here and so is the suspect. the suspect is in critical condition at this hour. police continues to gather evidence after a chp officer part of a stolen vehicle task force is hurt. >> there were some abrasions as well as minor head injury. >> reporter: we were at san francisco general when the injured officer arrived. he was allegedly hit by the suspect's gold honda accord which also smashed into the

this as they happen. >> ama: san jose police rammed a car. the suv was stolen and the driver put it in reverse and was about to ram the police car again when two other officers began shooting. one officer was slightly injured and no one was hit by gunfire. >> ama: new tonight film maker and community activist initially accused of murdering a man in san francisco no longer faces charges. he was considered a suspect in a shooting death at his glen park home. late tonight the district attorney's office says there isn't enough evidence for charges at this time. sources say the d.a. is waiting for toxicology results and a further investigation. those at the home say the shooting was in self-defense and the victim was an intruder. people who know him say violence isn't in his nature. >> i am hurt and shocked by this. this is not his character. i know kevin's character.

he is a good guy. >> he gained prominence after directing the 2003 documentary "straight out of hunter's point." >> dan: new details about a rescued 7-month-old baby kidnapped by his own mother in sonoma county. that baby boy is safe, and now we are learning about the alert police officer who spotted and saved the boy from a duffel bag. abc7 news reporter katie is live in the newsroom with the story. katie? >> reporter: dan, the officer was in downeyville when he saw the suspected it kidnapper, the baby's mother who does not have custody of her infant son. when he approached her he heard a baby crying and it was coming from inside the duffel bag. it was 3:00 in the afternoon in downeyville in sierra county when a plain clothed chp officer says he saw a woman who looked like 35-year-old hannah ashley. the mother wanted in the abduction of her 7-month-old son, henry massey. he walked up to her and identified himself as an

officer and that's when he says he heard crying from inside the bag she was carrying. he says ashley took off running. he caught up with her and they struggled. other officers arrived as back up and they were able to wrestle the bag away from her. baby henry was inside. joseph mec thy a said he was talking to ashley moments before her arrest. >> she was holding it and asked my friend with a cigarette. there was nothing. the baby was naked. i heard like seven months old. >> reporter: henry and his mother were taken to the hospital. they were both found to be if good health. police say ashley took her son from his grandmother's house on sunday morning. >> she came in through a window and got him and left through the door. i didn't even know it. >> reporter: gene ashley has custody of henry. she said hannah's visitation rights were restricted recently. >> she did threaten that a couple weeks ago that she would take him. >> reporter: hannah ashley is in police custody and baby henry in the care of state

protective services. abc7 news. >> ama: investigators believe a small plane in contra costa county may have hit power lines killing one person. sky 7 shows the charred wreckage. it burst into flames and it was destroyed after it hit the ground. they believe recent rain kept it from starting a large brushfire. >> ama: and police released this video showing a violent attempted robbery. it happened in a subway sandwich shop over the weekend. you can see a man repeatedly punching a worker. cornell bernard is live at police headquarters with the story. cornell? >> ama, police are looking for tips tonight. they hope someone knows who these two men are. meanwhile two employees are recovering. >> the video is hard to ouch what. two men walk into the subway restaurant on sunday night. one orders a sandwich. when the clerk rings it up the

other comes alongside the counter and punches the female clerk knocking her down. he jumps over the counter and brutally attacks another female worker. >> the suspect ends up punching her numerous times in the face and she ends up falling to the ground. >> police say one of the men tries to open the cash register and can't. >> they were asking for money numerous times. >> the clerk in red runs for her life, over the counter and out of the store. right behind one of the suspects . the other crook not far behind after failing to find cash. both men were empty handed. the subway store owner says his wife was the worker beaten. >> the crime has left workers at nearby businesses terrified. >> we close at 8:00. i don't want to have somebody come here and just like beat me up. >> the face of one of the suspects clearly captured by

high in california. 2015 statistics indicate cases are up nearly 12% over the previous year. experts think it may be in part to fewer people using condoms and local clinics closing. they are particularly concerned about syphillis which in rare cases can lead to miscarriages, still birth, strokes or blindness. >> now your accu-weather forecast with sandhya patel. >> sandhya: the weather qua get interesting -- the whether could get interesting. right now we are tracking weather and we are keeping an eye on your next system which is producing rain in the northwest coast of california. i want to show uh wider picture. there are a couple things going on here. subtropical moisture is moving in association of the system. if the dynamics come together we will be looking at moisture from a current major category 4. no threat to land. it is expected to weaken and left officers could be coming right in over the bay area.

sloppy one. scattered showers at 8:00, 9:00 and then winding down as we head into friday afternoon. rainfall totals will vary, but this time around it is not going to be such a wide discrepancy between north and south. north bay one to two incheses. south bay half an inch to three quarters and the central bay is half an inch to an temperature of rain -- to an inch of rain. this system is weaker and not as wet. saturday afternoon evening going into sunday looking at more shower activity and that will bring less in terms of rainfall totals. it is dry and mainly sunny. thursday into friday we have a wo on the i'm -- impact scale. the system covers saturday into sunday. it is weaker at a one and then halloween now. it is great for trick-or-treaters. there is another chance with a third system on tuesday. there is a chance of rain dan and ama.

>> good evening, everybody. larry beil and live at oracle arena. the warriors in their season opener, this is not a game we anticipated seeing at all. they were completely dominated by the san antonio spurs. there was high hopes. several players mentioned this is like getting slaps in the face. durant, 9 points in the first quarter, but the dubs hit seven of 33 from deep. taking it to the rack. 26 points. and then durant with authority and he had 27 points in his warriors debut. the warriors playing uphill all game long. it was a 12-2 run to beat the buzzer. 15 of his 20 came in the first half. the third quarter and tony parker is still spry at 34 and the warriors were out rebounded and they couldn't stop kawhi leonard who lead all scores with 30 pie.
