i'm owing them $19,000, almost $20,000 for an error that they claim they made. >> a bonus backlanchlt today the pentagon is backtracking from its order for thousands of california national guard members to pay back money they were promise to stay in the service. good afternoon, everybody. i'm larry beil. >> and i'm ama daetz. >> it's been an issue for years, and after a lot of negative publicity the pentagon is suspending its effort to collect funds. >> abc news report lauren lyfter with more action that the defense department is taking. >> reporter: that's right. current and retired service members, some who served in war, have been asked to pay back thousands of dollars they were already paid.

defense secretary ashton carter calling the process unfair and saying it's drags on too long. facing national outrage -- >> i'm bitter. i'm angry. >> reporter: and finger-pointing. >> another boneheaded decision by the department of defense. >> reporter: the defense secretary now taking action in response to thousands of california national guard members being asked to pay back bonuses they were promised. >> i've ordered the suspension of all efforts to collect reimbursement from affected california guard members. >> reporter: during the height of the wars in iraq and afghanistan, the national guard used bonuses to entice soldiers to re-enlist. the problem started in 2010 when the military learned of criminal fraud. a california national guard official gave bonuses intended for highly skilled soldiers to others who did not qualify, and service members who did nothing wrong with paying for the mistake, people like susan haley asked to repay $15,000 plus interest.

>> we already have exhausted our savings. >> reporter: purple heart recipient chris van meader having to refinance his month to pay back. >> we were paying $1,300 each month. >> reporter: josh earnest says the president is pleased the pentagon is suspending the payments saying follow-through will be key. >> taking steps to ensure the men and women of the california national guard knowing that the commander in chief has their back. >> reporter: and secretary carter saying he has ordered a team to sec a better process to resolve these cases quickly and fairly by the first of the year with the goal of resolving all of them by july. live in los angeles, lauren lyfter, abc 7 news. larry, ama? >> lauren, how many guard members have been affected by this, and really what has the impact been on them? >> reporter: well, as you saw from some of the people in my piece, it can be $15,000. it can be $46,000. it can be money that they received ten years ago that they

have already used, and according to the abc reporting that we've, the latest, the suspension of collection applies to 6,500 california national guard members, and abc learning that $222 million has already been recouped so what about those that were entitled to bonus but have already repaid them? well, we learned that they are going to get their money back. this will be dealt with on a case-by-case department with the department of defense officials overseeing being instructed to lean on the side of the soldiers. larry and ama? >> all right. thank you so much, lauren. san mateo congresswoman jackie spear is urging the department of defense to put an end to the repayments. if not, she says congress will. >> ash carter as the secretary of defense has the authority by regulation to take this action, and we're evaluating now whether he's going to use it, and if he doesn't then we'll take action within congress to do so. >> the house armed services committee first learned about

this bonus issue two years ago but spiers says the national guard did not provide details on the extent of the problem. two powerful earthquakes have shaken italy. a 5.5 and a 6.1 quake shook a central italy town not far from am treechy, the same area where a massive earthquake killed 300 people and toppled buildings back in august. abc 7 news anchor kristen sze here with the latest. >> so many ancient buildings have collapsed and we got some actual footage of the actual shaking. take a look. this is powerful video just posted to facebook by the italian red cross, the mayor in the heart destruction says, quote, our town is doomed, and this is a building that collapsed in the visso region. no reports of death or injury. that's the good news, but keep in mind the quakes hit in the

middle of the night in fairly remote areas, so officials will take some time to fully assess the damage and casualties. we found some stunning pictures and videos of today's quakes on social media. here is the window of an abbey that collapsed in the town car crushed and that is chandelier, going to show that you one, i'm going to click on that so you can see. look at that. it's swaying wildly in san marino, and here is a building that collapsed on to a gas station in visso. of course, new pictures and videos are coming in. we'll continue to monitor new developments in the italy quakes and keep you posted. larry and ama? >> kristen, thank you. a chp officer is recovering and a suspect is in critical condition today after a chase ended in a shooting from san francisco's oceanview neighborhood yesterday. abc 7 news reporter elissa harrington live at san francisco general hospital where both the officer and the suspect were

taken. >> reporter: well, i just got off the phone with the chp spokesman. he tolls me that the officer is in fair condition. he has some cuts and a minor head injury. meanwhile the police department has yet to file charges against the suspect, and they have not explained why officers opened fire. broken glass marks the spot where a chaotic car chase came to an end in san francisco's oceanview neighborhood tuesday. the suspect was shot multiple times and a chp officer hurt. police say the suspect was driving a stolen car and tried to run officers over. that car crashed into other parked vehicles and into a house on montana street. >> this is sad and tragic. >> reporter: friends and neighbors say there's more to the story. monique malcolm's son is friends with a man they call notorious dickerson. they are all very upset and do not think the shooting was justified. >> he was a nice guy and he didn't deserve that and something needs happen with all

of these police killing innocent individuals and taking people's lives for nothing. >> reporter: there was no gun found on the suspect. one neighbor who did not want her face on camera wants the police to explain why they opened fire. >> i'm surprised that there were -- there was gunfire and there was no gun found on the civilian, and i wonder why there was gun fryar after the chase. >> reporter: san francisco police are leading the investigation. they have not released names in the case or said what happened right before the shooting. they are also investigating what agency fired the shots. daile daly city and chp from other areas were involved in the chase. both the officer and suspect survived and are both being treated at sfg hospital. >> we're learning the identity of the suspects involved in the brazen high-speed chase and

shooting. police have arrested 26-year-old vina aroya and 23-year-old thomas garcia in connection with the incident. garcia is accused of shooting at officers. a third suspect, james cruz, is still on the run. the men were driving a stolen car. two of the suspects are members of the fresno bulldog gang. at the time of the chase, a civilian was doing a ride-along with the officer. neither was hurt. all right. live doppler 7 shows sunny skies over the area in a calm weather day as we await the arrival our next storm dropping down from the northwest and as we await the arrival of that storm, let me pint out we have a flash flood in effect south of monterrey from thursday new york and heavy downpours are approaching and rain may fall at half an inch an hour and debris flows over the burn area. here's the enintensity of each

approaching sfrorm 1 to 5, 1 being a light storm and 5 severe. the approaching storm is a moderate storm. it will bring rain that's heavy at times totaling half an inch to an inch in most areas and a lot more than an inch in some of the wettest locations. forecast animation or hat least beginning of it. 5:00 tomorrow morning, looks like the morning commute will be unaffected by the storm, but by midday the rain will be falling over a good portion of the bay area so the evening commute will be slowed down by the rain which will intensify overnight tomorrow night into friday morning and at the beginning of friday morning's rush it's going to be a mess. i'll give you a look at how wet it's going to be and the storms to follow in just a few minutes. ama and larry? >> thank you so much. spencer. a dead whale has up on the daly city coastline. sky 7 is live over thornton state beach where the whale washed ashore a little more than an hour ago. the marine mammal center say they believe it's a male blue whale. sky 7 first spot it had a quarter mile offshore around 1:00 this afternoon. marine mammal scientists will

likely partner with the california academy of scientists to perform a new cropsy on the whale to determine why it died. massive lines at dmv offices in the bay area and all across california because of a computer system failure, and right now we're talking about 101 offices that are still impact. here's abc 7 news reporter lonnie rivera. at the crack of down standing outside this dmv office, yet another attempt to renew his license, his third try since monday. >> i wanted to make sure if they did open up i wouldn't be waiting until 12:00 or 1:00, right? early bird. >> in this case the early bird walks away without the worm. this note explains the reason along with an apology from the dmv. >> employees have all been exceptionally kind. everybody in the lines have been really cool about it. i think that's one of the things that you've got to deal, the more we put everything on computer. >> for this lady it's the same story, only this time she came

>> it was heralded as a technology breakthrough. so what happened. >> abc 7 news reporter david louie is live in san jose to explain. david? >> reporter: ama and larry, ll technology has a life cycle, and it appears that google fiber was a great idea when it was first launched five years ago, but today it may be too expensive, and it may not be in step with how we connect to the internet today. five years ago google's vision to wire up selected cities with fiber-optic for fast internet was a bold move. san jose was the biggest of five south bay cities on the list to get it, and construction was to start this summer and then google pulled the plug. >> i think they are still interested in providing that service in the future. what we don't know is what will it look like and when will it happen? they say that they are exploring new technology. >> reporter: every detail had been worked out to install fiber-optic along all 2,400 miles of street in san jose. 60% underground and 40% overhead on city-owned utility poles. google's cost was expected to

receive $1 billion just in san jose and something changed. people are no longer tethered by cables and instead they connect on wireless networks at high speeds. >> cable companies have done a much better job and wireless networks are getting better. the bottom line is consumers want access to their content their way any time they want and fiber is not necessarily the only way as it was five to ten years ago. >> so google is hitting the pause button while it studies lower cost alternatives and san jose will be considering options if other companies want to step in. one goal is to provide underserved communities with high-speed inter >> how can we as a city encourage providers whether it's at&t or comcast or google or others to make those investments to provide service to our entire community and especially those parts of our community that does not have the full access that we think everybody should have. >> reporter:? n san jose, david louie, abc 7 news. big changes are coming for people listing rentals on airbnb

in san francisco. starting tuesday anyone who has a unit for rent will only be allowed to boast listings for one address. it's the latest effort to put tighter controls on airbnb rentals in san francisco. last week two supervisors introduced legislation that would introduce a 60-night cap on short-term rentals regardless of whether the host is on site. the current limit is 90 days. former stanford swimmer brock turner has become the face of campus sexual assault, literally now. abc 7 news reporter matt keller shows why his picture is showing up on another college campus here in california. >> reporter: the letters on this sign at cal poly san luis obispo are big reading don't be that person and take a closer look and you'll see a familiar face, former stanford swimmer brock turner who sexually assaulted an unconscious woman at stanford.

the tide. larry and ama? >> kristen, thank you. california leads the way as the state with the most homes at extreme risk being consumed by wildfires. that's according to new data released by core logic. 29 million homes in 13 u.s. states have some risk wildfire danger. more than a million of them are located right here in the bay area. according to the date arkt combined reconstruction cost of those bay-area homes will be more than $463 billion. time for another look at the forecast now, and we've got another dose of rain, spencer christian, which is welcome. >> yeah. we have -- it's very welcome, you're right, but we have many rainy days ahead all beginning tomorrow. live doppler 7, it's hard to tell that had a big storm is approaching. sunny skies and mild cams, mainly blue sky. turn temperature reading at 67 degrees and 73 at mountianview and 80 at san jose and gilroy 77

and 64 at half moon bay. this is "the view" from our emoriville camera. 69 degrees up in santa rosa and low to mid-70s at novato, fairfield, concord and livermore and the view from the rooftop camera looking out over the bay shows blue skies. rainy and cool weather tomorrow and friday. periods of heavy downpours will accompany this storm and there's more rain falling over the weekend and into next week. the animation starting at 5:00. the morning commute may be unaffect and rain spreading widely across midday and evening commute will be wet and more widespread rain friday night into the morning commute and that's affected by widespread rain and heavy downpours and by 7:00 friday morning it looks like we'll get the most widespread areas of heavy rain from that storm. then it will lighten up just a little bit into midday friday and there's periods of rain following from midday friday into friday evening and laid

friday night ahead of the second storm which will arrive saturday. let's just deal with the first storm: rainfall totals, over an inch at napa and .9 or more and much of the central part of the bay area will have rainfall totals. overnight cloudier and cloudier with low temperatures mainly mid to upper 50s and tomorrow rain developing quickly in the north bay and spreading to other parts of the bay area. mid-60s and upper inland east bay. that's as mild as it will get. here's the accuweather seven-day forecast. let's go through this carefully. showers begin tomorrow and turn quickly to rain. this -- this will be periods of heavy rain accompanying it and a second storm moves in on saturday and continuing into

subaru is recalling four models of cars to fix ran air bump issue. 100,000 cars are included in the recall. they include 2007 to 2009 legacies and outbacks along with newer models imprezas and foresters. a secondary air injection pump can fail causing it to run continuously. ford is recalling more than 400,000 of its older suvs to fix fuel leaks that could cause fires. the affected models include certain 2010 to 2012 ford escapes and mercury mariners. ford says a fuel supply part can crack and leak gasoline. customers affected by the recall will be notified. well, if you think putting fake baby in your car to use the carpool lanes is a good idea think again. a driver in washington state was pulled over for an expired registration and then the officer noticed something unusual in the car, unusual to say the least. check it out. it's not a baby. although it does look like it at first glance. that's a ball with a hat meant to look like a baby so the

and here's what's making headlines at 4:30. national guard members in california won't have to return enlistment bonuses, at least for now. today defense secretary ash carter ordered the pentagon to suspend collection efforts while congress and the defense department look for a long-term solution. the effort to get back the money after audits revealed overpayments in order to hit enlistment goals. the dmv struggling with its second computer glitch in less than a week. rains 7 news reporter wayne freedman tweeted that computers are down statewide. crews are now dismantling a makeshift camp in france filled with thousands of people who have been living in squalor.

election. supporters say it's vital to the very existing of the aging b.a.r.t. system and critics say that b.a.r.t. and its board can't be trusted with more taxpayer money. laura anthony is live at the lafayette b.a.r.t. station with a closer look. laura? >> anybody who rides b.a.r.t. on a daily basis knows there have been problems, most recently mysterious electrical outages, but some folks are doubting whether the measure rr is a way to fix it. >> it's an incomplete plan with a lot of loopholes. >> reporter: with less than two weeks to go before election day state senator steve glazer is pushing back against measure rr, a bond to raise millions for b.a.r.t. infrastructure improvement. >> b.a.r.. knew about this since 1993 when the system actually reached capacity, so for the last 23 years they have sat on their hands and done five employee contracts and giving out lavish raises. >> rr is a property tax measure in contra costa, alameda and san francisco counties that would

it also says there are no regulations on organic seafood so if it's advertised that what i it could be a false claim. well, women have made major strides towards equality with men, but new research shows they are also catching up in drinking alcohol. researchers at the drug and alcohol center at the university of south wales in australia says women globally are now nearly as likely as men to drink and engage in excessive harmful drinking. they say there's no single reason why women are drinking more but it has become more socially acceptable for women to drink alcohol in recent years. a panel experts say too many women stop breastfeeding too soon. the primary care providers should discuss breastfeeding with women when they are pregnant, when they are in the hospital to give birth and after they have gone home with the newborns. however, the panel says if mothers decide breastfeeding is not for them, clinicians should respect that choice. from the nasdaq, i'm jane king. here's to your health. halloween can be kind of a scary time for kids who have

another bay area school district has committed to help send their students to college. >> oakland unified will give each kindergartner $100 to open a college fund. here's abc 7 news reporter lyanne melendez.

>> reporter: their t-shirts tell us each kindergartner in oakland is committed to getting into college. today the school district initiated a way to help pay for some of the costs. >> with this money we're setting an expectation for our kids and also making sure that there is discussion and dialogue at home about college. >> reporter: kindergarten-to-college program allows parents to contribute whatever they can beginning in kindergarten through the end of high school. that's 13 years worth of savings. >> i will say about $100 will be a good idea, saving like every month if we can. >> reporter: if she follows through with her plan her daughter will have more than $15,000 for college. >> it's not just about a t-shirt, it's not just about the $100. it's that shift in the culture and mindset that we believe in you and we know you'll if to college. >> reporter: if for any reason the family moves out of oakland they can take the savings account with them and at any time making contributions. this year only 18 schools will be enrolled in the kindergarten-to-college program,

i'm kristen sze, and i'm dan ashley the lines at some dmv offices are longer than unusual because for the third straight day if you may have discovered a computer glitch is bringing services to a halt. the problem is affecting 100 offices statewide. can you see them here on the map. this does not include locations that came back online throughout the day. at least a dozen offices in the bay area are affected including locations in oakland, mountianview and nap ark. abc 7 news reporter wayne freedman is live outside the dmv on fell street in san francisco and one of those crippled offices. wayne. >> and, dan, there are lines at some dmv offices that don't exist as all because the dmv offices aren't working and take a look at this parking lot. nobody here. when is the last time we see a parking lot like that inside a dmv. take a look at this list. this is just off the internet. this is from the dmv itself. this is a list of every dmv office in the state of california that still has not opened due to a
