tonight we're hearing from the woman known only as emily doe for the first time since brock turner was sent to jail. she is writing about the case in a national magazine which has chosen her as one of its women of the year. abc 7 news reporter chris nguyen is live at the stanford campus with the story tonight. chris? >> reporter: dan and kristen, it is quite an emotional essay published by "glamour" mag scene as you know one of the biggest magazines in the country. 15 million people read it online and 10 million people get the print edition so you can bet that this is a major platform for emily doe to use in spreading her message. inside the december issue of "glamour" magazine powerful words from a survivor of sexual assault. emily doe from palo alto shares for the first time how she felt after learning about her attacker's sentence saying, quote, when it was quickly announced he would receive six months, i was struck silent and immediately i felt embarrassed for trying and led to believe i had any influence. if this case was meant to set the bar, the bar had been set on

the floor. that reaction also came after she delivered an emotional victim's impact statement in court to brock turner, the stanford swimmer found guilty of assaulting her after a night of drinking. turner would only serve three months in jail before being released. today emily was named one of "glamour's" women of the year and in a new essay published by the magazine she opened up for the support she receivd from many people all over the world, comments online had a she took to heart writing, when we all make it a priority to avoid harming or violating another human being and when we hold accountable those who do, when the campaign to recall this judge declares that survivors deserve better, then we are going somewhere. stanford law professor michelle dawber, who is leading the -- >> treatment of serious sex crimes and cleanse against women as if they are minor misdemeanors is not acceptable. >> reporter: stanford students admire emily's strength. >> her statement did a lot to

really bring this conversation to the forefront again in a way that interest just like hasn't been in recent years. >> reporter: a resilient young woman trying to stay positive despite everything that has happened. at stanford, chris nguyen, abc news. an uber driver faces sexual battery and stalking charges for allegedly groping a female passenger. police arrested 35-year-old pedro anorve of redwood city. investigators say he kissed the woman and groped her after he went to the palo alto home to return a cell known she had left in his car. the driver returned to her home about an hour after groping her and she called police but he was gone when officers got there. one of the oakland police department's most highly decorated officers has stunning accusations tonight and says top police and city officials are retaliating against him. sergeant mike gant has worked for the department for 27 years. abc 7 news reporter vic lee is live in hockey lap.

vic, tell us more. >> reporter: well, sergeant mike gant filed this legal claim against the city of oakland as well as several members of the command staff. gant says he was retaliated against as a whistleblower. now, the city says it can't respond because this is a personnel issue as well as a legal action, and as you know a claim is a precursor to a lawsuit. >> this is the top cop award that i wanted in 2001. i'm just tired of being made out to be the bad guy. >> sergeant mike gant has won all kinds of awards in his 27 years as an oakland cop and he also says he's been targeted, harrassed, disciplined for blowing the whistle against fellow cops behaving badly. >> looking at my personnel file, for sending racist tax messages and for hostile work environment. >> reporter: in june the mayor publicly accused him of violating regulations by having his friend transcribe documents from an investigation. the d.a.'s office later cleared

him and gant was placed on leave earlier this year for a domestic dispute he had with his wife. he feels this was another excuse to further punish him. >> the thin blue line is alive and well, you know, and once you stop over that line and you become an outcast. >> reporter: but gant says the abuse started when he was reassigned from the homicide division in 2004. the reason, gant says, is that he told superiors that he thought officer brendan o'brien murdered his wife erma when her death was ruled a suicide. the sex scandal involving jasmine abubblesin, alias celeste gaup, that rocked east bay law enforcement agencies, stem from the subsequent suicide of o'brien who had a relationship with a young woman. the abc news iteam obtained this crime lab report that says both o'brian and his wife had gunshot residue on their hands, one of the things that made gant suspicious. huerta lopez's sister has always believed she was murdered by

o'brien. we spoke to her by phone today. she said the sex scandal is more important to the city and police than murder. gant says all he wants to do is clear his name and reputation. vic lee, aches 7 news. a woman walking on railroad tracks in richmond was hit and killed by an amtrak train. sky 7 was over the accident scene at cutting and carlson boulevard. the sacramento-bound capital corridor train struck the woman just before 2:00. none of the 68 people on board was injured. amtrak is warning of delays through that area because of the accident which was -- has closed the tracks between the richmond and berkeley stations. tonight we are learning more about the owner of the unfinished apartment building that burned down near oakland's lake merritt yesterday. abc 1 news reporter laura anthony is live there with the legal trouble the owner faced at one point. laura. >> reporter: hi, dap, the oakland fire department and atf really just getting into this site and starting to sift through the rubble and determine

a cause for this fire. meantime, we did talk with the owner about his loss and his past dealings in in neighborhood. the owner of this building, an unfinished apartment complex that went up in flames monday is the object of a lawsuit by several tenants who were evicted from the property two years ago to make room for this now gutted project. at the time the plaintiffs in this lawsuit lived in this home owned by ethan magganas and hillary was one of the tennants. >> just trying to force us out of our home, making up things, starting construction while we were still living here. >> reporter: last year the tennants filed a lawsuit alle alleging magganas used aggressive and illegal efforts to erect him and then starting to demolish the home while they were still in it. we spoke with ethan magganas and told us he does not think the fire has anything to do with the past or the lawsuit.

voters will be deciding on has united both the democratic and republican parties in opposition to t.proposition 60 would require condoms be used by performers in adult films. abc 7 news reporter carolyn tyler joins us live in the newsroom. carolyn, you have the performers' perspective. >> reporter: that's right. california and new hampshire are the only states that allow adult films to be made legally. now the supporters of prop 60 want tighter regulations. the opponents including those who work in adult films say the measure is misguided. aerial "x" is a performer and producer who is adamantly opposed to prop 60. it would require performers to wear condoms, producers to pay for more medical exams and allow people who watch porn to sue if they don't see condoms being used. >> this puts a bounty on our head. >> reporter: she and others say the industry already has strict measures in place to prevent the spread of sexually transmitted

disease. in fact, cal osha recently decided against implementing moe guidelines. >> this bill does nothing to advance. it's actually taking us back a couple of steps. we have great testing protocols. >> reporter: but prop 60 backers claim the industry is designed current law. >> as a result thousands of young men and women are illegally and routinely exposed to sexually transmitted diseases, including hiv. >> reporter: many medical professionals say proposition 60 is ill conceived. >> this is not a public health measure but a punitive strange law. >> reporter: hand those in the industry say lawsuits could expose their names and addresses putting them at physical risk, something backers don't buy. >> there are all sorts of laws that allow for private citizens to sue to enforce the laws. >> reporter: if prop 60 becomes the law performers say it will

drive their industry underground or out of state. carolyn tyler, abc 7 news. >> a milestone at the former oakland army base today. >> one, two, three. >> reporter: abc 7 news was there as the mayor joined city officials and developers at a ground break for the oakland global logistics center. the 750,000 square foot facility will help sort and fast track goods shipped through the port make the fifth largest port in the nation more competitive and it's already bringing in new jobs to oakland. >> since the beginning of this project in 2013, a little over 3,000 jobs have been created representing about 1,250 construction jobs and 350 have south to obtain new employment and 57% of all hours worked are by oakland residents. >> reporter: the developer is a san francisco firm pro logis. you may remember last year it

became controversial over the proposal to ship coal before the city council moved to ban that idea. >> $2 an hour parking may soon be a thing of the past in oakland. a flexible parking plan is before the council tonight and if it passes, what you'll pay to park on the city streets will be based on demand at the time. city planners think spaces will turn over more quickly in the city's busiest nafnltds the plan was tried out in montclair village with prices ranging from $1 to $2.50 an hour. >> lyft drivers and the teamsters union have demanded changes to a settlement of a class action lawsuit which would continue to classify lyft employ nez california as independent contractors. the $27 million settlement covers 150,000 drivers. they want more money and to no longer be considered independent contractors and lyft is offering its passengers a new perk. ride kers now earn jetblue

"consumer reports" compared nine sites searching for the cheapest non-stop round trip flights on five busy domestic routes. users simultaneously searched for the exact same itinerary at the same time to the same airport. they found there can be big

differences. for example, in one search for new york to miami, round trip flights, the cheapest father google flights came up with was $597 but on price line the cheapest was $459, and despite its name, cheapo air never came up with the lowest fare on any of the routes that cr checked. >> we found you increase your odds of finding the lowest fare if you search for multiple fares over multiple days with or without your search history cleared on the browser and check the airline's own site to see if you can find a lower fare. find all airlines at google.com and fares can vary considerably for flights just hours apart and at nearby airports. "consumer reports" found kayak makes it particularly easy to search for other options. with prices changing all the time "consumer reports" says it's a good idea to check the day after you book to see if you

a state of disrepair. you've been on these roads. drivers there are paying of aage average of $978 every year for the increased wear an tear on their vehicles and in san jose 59% of the roads are in bad shape and the maintenance costs to the cars are costing south bay drivers $863 a year. researchers say the poor condition of bay area roads will worsen if officials don't fix these problems. >> may have bad roads but we do have good weather. a live look at live doppler 7. good evening to you all. a few clouds on the radar and no green on the screen. did get rainfall. anywhere from .03 in san jose and .45 in san rafael with the halloween storm. where does that put us? since october 1st we're running well above average for this time of year. in the case of santa rosa, 373% of normal and 354% of average and just over 200 in san francisco and almost 300 in

in the city of norca. video released by firefighters show search-and-rescue crews using bare hands to scoop away debris in order to treat dog and once done the crews gave the dog a drink of fresh water. norca was one of the areas hardest hit by the 6.6 quake. there could be a new fight soon in the fight against terrorism. it's a spin amp that detects explosives. it wilts when exposed to explosive materials. it contains nan particles that absorb water when tainted with resid residue. it will give them a tell teal sign of something malicious and the journal is published in the journal "nature." >> ever feel like you're doing too much things at once. hands going up in the studio at home. turns out you're probably right. a ucf brain researcher is saying
