katie has the story that is new at 11:00. katie? >> reporter: ama, dan, rite-aid and ross have serious problems. you can see them and feel them underfoot. the city of san mateo ordered the stores to make repairs, and they are. but it is rite-aid who says somebody else needs to pay. >> i have been walking with a cart and felt like i was falling off my shoes. it was because the floors were unlevel. >> reporter: cell phone video from inside the rite- aid shows several places where the floor has buckled or cracked. >> it is pretty noticible it is not flat. >> reporter: the ross dress for less is even more dramatic. the city of san mateo has received complaints and they sent inspectors. >> i definitely confirm both the stores have a bad situation. >> reporter: he said rite-aid had become structurally unstable and they have correction orders. >> we have asked them to

correct the dining -- dangerous situation so it is safe to use. >> reporter: the owner of rite-aid, thrifty, payless files a lawsuit alleging de watering at the construction site caused the damage. >> the issues were present or occurring might to the construction of this new development. i would say it is explorable and possible to look into. >> reporter: rite-aid is seeking at least $2.5 miion in damages. abc7 news. >> dan: also new, abc7 news reporter vic lee was the first to tweet that the city of san francisco is suing the developers of the mill 11 yes, ma'am tower. -- millenium tower. it shows a marble rolling across his unlevel floor. it accuses mill 11 yes, ma'am apartment of defrauding the condo buyers saying they knew it was sinking when it was finished in 2009. the class action lawsuit

some bea area beaches. even bigger than the waves we saw weeks ago. the marin county sheriff's department tweeted this morning about the surf. waves as high as 27 feet along the marin county coast. emergency officials are warning everyone to use caution. >> my advice is to stay away during this event. >> despite the warning some were getting ready for the big waves. matt trumble isn't so sure. >> i would say even swimming would be dangerous. absolutely. who knows what the tides are up to if the surf was that big. >> would you be out suring in -- surfing in that? >> i would not. >> even the surf shop owner is giving customers a friendly rn whatting. >> i wouldn't recommend that anybody goes and who is not an experienced surfer try to get in the water. that would be a bad call. >> reporter: rip tides and sneaker waves are on tap. the same unpredictable waves that killed a man who was trying to save his wife from
