his 1-year-old daughter in a baptismal tub made his first appearance in court today. >> abc 7 news reporter wayne freedman has the story. >> reporter: when the man appeared in court this afternoon he did so in a wheelchair shackled and confined, appearing at one point to turn towards family members and ask for forgiveness. the judge's only action was to suspend criminal proceedings pending examination by a doctor. after court only one member of family spoke with the reporters with the agreement we would nod show his face. >> i can't speak for him because i wasn't in his head. i wasn't present to witness what happened. it's a tragedy. >> reporter: neither police for the family has released a story of 4-year-old maria. today flowers surround the baptismal pool in which police say her father drowned her sunday night and all in the presence of an older brother. >> essentially charges of homicide. the second charge is related to the actions resulting in a child's death and the third count is related to the infliction of emotional

distress. >> reporter: police have not made any more formal statements. they spent the day reconstructing events which appears to include ordaz walking outside the city limits. >> it's just painful. we wouldn't want to see any other family go through this. >> reporter: gerardo ordaz will return to court on november 28th. there is no bail. in healdsburg, wayne freedman, abc 7 news. >> breaking news in detroit, michigan where a police officer has just been shot in the head this. shooting happened offer the wayne straight university campus which is in the heart of the city. the officer worked for the university and has been taken to the hospital. police are actively looking for a gunman. on sunday a total of four officers were shot in texas, missouri and florida. back here, police arrested one of nine people who robbed a man early this morning. at 2:15 this morning the group of robbers approached a 31-year-old man at the popular

san francisco tourist attraction. one person pulled a gun. they robbed the victim of two cell phones. police tracked down one suspect and no one was injured. police bust what they say was a brothel operating in a quiet residential neighborhood right across the street from a high school. abc 7 news broke this story last night. if you were with us it happened in san mateo. now the house is on 20th avenue next to serra high school. here's abc 7 news reporter vic lee with the story live from the scene tonight. vic? >> reporter: dan, as you know, we have been tracking this story quietly for several weeks now, but we held the story because we were afraid that we would jeopardize the police investigation, but we can tell you now that the neighbors and serra high school right across the street there are glad, very glad, that police conducted this raid last night. >> there's no family photos or clothing belonging to anybody. just a couple of mattresses on

the ground and evidence consistent with prostitution, condoms, lubricants, lingerie, things like that >> reporter: curing the nighttime raid, two people were arrested inside the house here on the 400 block of 20th avenue. just across the street from serra high school. one charged with operating a house of ill fame, a legal term for brothel. the other for narcotics possession. no women were in the house at the time. police say their photos in the address were posted in online ads. undercover police have been sfalg the house for weeks before the raid. they had been tipped that something suspicious was happening inside. that's when abc 7 news first learned about the possibility that the rented house was a brothel and neighbors telling us as well about the suspicious activity. we saw this red light shining inside a window when there were people inside, presumably to alert johns that the house was operating. on those nights cars would bring young women inside the home hand

men would come and go throughout the evening. neighbors would say as many as 15 on any given day. neighbor sue loffler. cars would come and they would be textings and move down the street and they would be texting and move around the corner and foot traffic coming in. >> reporter: police say this is a new m.o. for brothel operators, renting places in nice neighborhoods. >> we do see a trend. a lot of the times they are within apartment complexes. we do occasionally see residential brothel. like this one, police say, which was shut down because neighbors decided not in our backyard and certainly not next to a school. vic lee, abc 7 news. >> let's turn now to the stormy weather coming our way. rain is in fact coming. let's give you a live look from the emoryville camera. wait for it, see. isn't that worth waiting for? yes, it's beautiful, nice. gorgeous painted skies, but let's talk to meteorologist sandhya patel to see what's going to be happening in the very near future. >> kristen, we're talking about

5135 sent up this photo of a dog sniffing a suitcase. southwest has not announced what the problem was. the flight to baltimore boarded but is now hitsed as delayed. the crew of a 70-foot barge is safe after it flipped and sank in the sacramento delta. the vessel went down near rio vista near decker island while carrying a matter truck. you can see a sheen on the water in the shot from sky 7. fortunately for the crew the barge sank close to shore, right in front of a coast guard station. rescue boat plucked one person out of the water. a good mayor tan picked up a second and two others swam to shore. no one was hurt. new concerns tonight over how the city of richmond may have handled the investigation of 11 police officers connected to a bay area sex scandal. jasmine abouluslinabuslin's cla the vegd. >> reporter: jasmine abuslin

gave five lengthy interactiview about her interactions with 11 police officers. it's testimony they heard about overs other than themselves that could be a problem. richard mopped police department's investigation of 11 of its police officers included 13 hours of recorded voluntary testimony by jasmine abuslin who said she had sex with more than 30 police officers around the bay area, some while she was underage. richmond's police officers are not facing criminal charges but last month richmond city manager bill lindsey recommended four of the city's officers be fired. i think the city was sloppy. >> sloppy says attorney general mike raines whose firm is representing the four richmond police officers because he says the officer's privacy rights were violated. >> any officer who is accused of misconduct should get all of the information that per tanks to his or her alleged misconduct.

>> reporter: he says when each officer received a recording of abuslin's testimony they heard more than her accusations about each of them. he says the recordings were not properly redacted. >> they got a recording where miss abuslin was talking about her interactions with officers other than the officer that were the subject of the discipline and they weren't entitled to know that under the law. >> if it happened, it would be a city of richmond mistake. >> reporter: city manager bill lindsey says the city will look into it. >> we take any assertion that we didn't follow legal process correctly very seriously. we want to be perfect. >> reporter: lindsey also says if true this will not change his disciplinary recommendations. he says the mistake is not enough to get the officers their jobs back though he'll be fighting for them. he does, however, say the mistake could result in litigation. >> reporter: they could sue for the violation of their privacy

with the 49ers over there. more live from san francisco. >> reporter: good evening, kristen. last night at a stadium audit the city of santa clara learned that 13 of 16 documents had not been handed over by the 49ers. now, the 49ers say some of the financial information in those documents of it confidential by the city says the team is required to hand the documents over. at some level we know we've handed over and have shared every single document that they have asked for. the ones in which we're not going to make public record are the non-nfl event financials that go directly to the general fund. >> 49ers president says authors have been looking at stadium's financial records all day. their visit comes hours before a santa clara city council meeting. council members are asking the 49ers stadium management to turn over documents required by their lease. the records will show how much

money is flowing into the city general fund as part of a contract agreement. but the niners stadium management says some information in the documents should be kept confidential. >> as we go out and book an event we obviously want to strike the best deal that we can for the city of santa clara and the general fund. i we want to make as much money as we possibly can for that. the event promoter who has to pay the act wants to keep that private. >> if the 49ers still refuse to hand over those documents, the city plans to inform the organization that it will be in breech of contract. >> what i will say it's unfortunate that we've gotten to this part. >> and the santa clara council says if the matter is not resolved in 30 days after the council meeting it will begin taking steps to take over stadium management. in santa clara, lonni rivera, abc 7 news. >> more on a man found dead in the evergreen area. officers found his body last thursday on thornhouse lane.
