years ago while at a child care in a health club. today he continues rehabilitation. 5-year-old roman enjoys playing with legos like so many other children. two years ago his mom dropped him off at child care. an employee found mom changing in changing in the locker room and gave her news that her son was in a terrible accident. she ran to him not knowing what to expect. >> i saw blood running all over and in his mouth and his ears. there is a lot of blood all over. >> these are pictures provided by the family taken after the accident. in the report it said roman had a head laceration, two inches and fairly deep. they say he ran into the window and fell down. an internal report indicates the care worker did not see roman hit his head on the windowsill. other kids saw it happen and

called her over. she said this is how her son consistently tells the therapist how it happened. >> she said roman what happened? he takes the toy and this is what what i see. >> reporter: he puts it simply. >> it means i fly into the window. >> reporter: they examined roman in june and says he continues to display symptoms of post traumatic stress syndrome. his memory is impaired and he displays anxiety. he has cues of his daily routine. he is seeing a speech therapist and occupational therapist, physical therapist and a fourth therapist for ptsd. roman's father has trouble putting his emotions into words.

>> perhaps surprising to many parents, the daycare at most health clubs, supermarkets and churches may not need a license. facilities are exempt from licensing if parents are at the facility while children are in daycare. linda is with the advocacy group. she says parents need to ask questions. >> i would want to know if they have basic health and safety knowledge and i want to know a little about the facility. >> they allege based 0 depositions with the employees that the daycare staff was distracted by clean up duties and untrained in child care. >> none of them have any training in childhood development. >> their attorney did not respond to our request for an interview. in papers filed in court there
