going to learn of the loved one's loss. >> reporter: as investigators work to figure out a question, questions of prevention are mounting. authorities announcing a criminal investigation team is on the case, determining if there's liability. >> the range of charges could be murder all the way to involuntary manslaughter, and until we know what the evidence shows us, there may be other charges. >> reporter: the building erupted into an inferno friday trapping party goers on the second floor when a makeshift stairway of wooden palettes was blocked. the building was a tinderbox. only two exits in all 10,000 square feet. people living in mobile homes inside the first floor. most of the victims were on the second floor for a concert. local officials say the warehouse, known as an artist collective, had numerous code violations and complaints of people living there illegally. >> you couldn't have more than two people on that staircase before it would just fall down.

topic to tackle. according to the institute of medicine, 1 in 14 high school football players will suffer at least one concussion. and that risk is 60% higher than the next sport. yet the sport remains the most popular among high school boys, with more than one million taking part in the game. in the latest issue of the medical journal of pediatrics, some leading experts are weighing in on the question of whether or not high school football should be banned. dr. lewis margolis writes that high school football should be banned until we can be assured that it does not have long-term detrimental consequences. he notes, football causes more harm to the brain than any other sport. but another expert does not think banning the sport is the right solution. having a licensed athletic trainer on site, a physician who is knowledgeable about the concussions at every football game and a clear return-to-play policy. >> i think having a discussion at the school, how are we going to approach the injury and making sure we're dealing with

it at a very appropriate level on that, we are taking the injury seriously. >> such a difficult problem. the other side of this argument, a lot of people have been talking about this, should we ban football at the lower levels? some people say, if you ban it at the lower levels, people don't learn how to tackle properly, and at the higher levels, they're more susceptible to injury. it's a tough call either way. >> i wonder if making the rules stricter on how you tackle could change it. if you dive in head first, you're banned from the game. or maybe a few going forward. >> there are penalties for those kinds of hits. >> in girls lacrosse, anyway, there are tons of rules about the technique and how you play, and they're very, very strict. big debate going on in football. not even just in high school, but in pros as well. well, when we come back, a new host at the oscars. and what divas do when they get back together. stick around. tourists. l.a. mayor said he plans to ride the red line today as a show of support. also breaking overnight, a shooting in sanford, north carolina, cutting short the town's annual christmas parade, has ended with two people in the hospital and a suspect in custody. as many as eight shots were fired at a convenience store. police say both shootings were related and not random. one person is hospitalized, in serious condition and another with non-life-threatening injuries. thousands of mourners have come together to share their sadness in the wake of the oakland warehouse fire. the display came hours after the death toll in the tragedy rose to 36. the city has released the name of ten more victims, all in their 20s and 30s and from the bay area. crews will continue searching at the site, but investigators don't believe they'll find any more bodies. prosecutors say criminal charges could be filed in this case, including murder.

and prosecutors in south carolina, say they'll retry michael slager, the former police officer accused of killing an unarmed man, walter scott. a mistrial was declared yesterday in charleston after the jury failed to reach a verdict. scott's mother said she's not sad over the outcome, because she knows that justice will be done. an atlanta man faces life in prison with no possibility of parole for the murder of his son in a hot car. justin ross harris declined to speak during his sentencing hearing, as his lawyers plan their appeal. here's abc's linsey davis. >> reporter: as justin ross harris learned his fate, he stood emotionless, sentenced by a judge who didn't mince any words. >> you callously walked away and left that child in a hot car, in june, in georgia, in the summer, to swelter and die. >> reporter: harris sentenced to life without parole, plus 32 years for the death of his 22-month-old son cooper who died after being left inside his

father's hot suv for more than seven hours, while he was sexting with other women. the prosecution argued that harris intentionally killed his son, because he wanted to live a child-free life. his ex-wife, cooper's mother, testified she believes it was an accident. >> did he love that little boy? >> yes, he did, very much. >> reporter: harris's attorneys argued after he was seen here getting breakfast with cooper at this restaurant, he forgot to drop the boy off at daycare on his way to work. the judge said she reflected that he had hoped to be an advocate, so people would never do this again to their children. >> i would say perhaps not in the way that you intended, but you have accomplished that goal. >> reporter: harris's lawyers plan to take his appeal to the georgia supreme court. linsey davis, abc news, new york. the brazilian soccer team that lost so many players in that plane crash, has been given the south american confederation's winning title. 19 members of the team died in a crash near medellin, colombia, where they were scheduled to play a match. there will be a friendly match at the end of january to help the victims of the disaster. new research this morning about the dangers of drowsy driving.

a triple-a report says missing one to two hours of sleep, doubles a driver's risk of getting into a crash. the study found in a 24-hour period, the crash risk for sleep-deprived drivers increased steadily when compared to drivers who slept the recommended seven hours or more. amazon is testing a brick and mortar store. with a twist. unlike regular stores, this one has no check-out lines. it's called amazon go. customers tap their cell phones on a turn style as they walk in, that logs them into the store's network, which senses the items they pick up, and charges them as they walk out the door. the store is being tested in seattle by amazon employees and it is set to open to the public early next year. >> i tried that at my convenience store, didn't work out so well. >> lot of beeping, but it ended differently.

police say welsh drove six hours from salisbury, north carolina, to self-investigate a conspiracy known on line as pizza gate. it's a story about child abuse, at this restaurant, mentioning jon podesta, hillary clinton, it's an egregious and deliberate lie. the owner said he and his employees have been besieged by death threats. >> what happens today is that false and reckless conspiracy theories come with consequences. >> reporter: one study found that during the election, fake news stories could out-perform real ones, with millions reading them. authorities say the suspect surrendered after he realized no children were being harmed here. but the shooting incident shows how a fake news story can lead to a real life-threatening situation. pierre thomas, abc news, washington. >> there was a lot of talk that some people on donald trump's transition team had been

something. you are the eyes and ears of law enforcement. public safety is my profession, but it's everybody's business. >> the fbi says the threat specified the city's universal red line city station. but the los angeles mayor said he's confident in law enforcement's response and he says he plans to ride the red line today as a show of support. breaking news out of sanford, north carolina, where multiple gun shots cut short the town's christmas parade last night. >> palace say that at least two people were hurt. one is now reportedly hospitalized and in serious condition. another with a non-life-threatening injury. witnesses on the scene report hearing as many as eight gun shots, but elsewhere along the parade route, the announcers of the event were unaware of the violence that was unfolding. >> they've got all kinds of internet, web design, wireless phones, tv. >> there's been a shooting.

>> oh, really? >> security systems. >> i think tim told me they maybe shut down the parade. >> oh, really? >> yeah. several people are going home. >> well, we didn't get a santa claus. >> yeah, i know and we may not. >> police say both shootings were related and not random. one suspect is in custody and the investigation continues. a night of remembrance as thousands honor the victims of friday's massive warehouse fire. mourners held candles hours after the death toll rose to 36. investigators don't believe any more bodies will be found. they can't be sure until the search efforts are complete. meantime, it's possible the tragedy could turn into a murder case. prosecutors are still determining whether any crimes were committed. the cause of the fire is still under investigation, however the building was an illegal residence. a number of the victims and those unaccounted for are students or recent grads from university of california at berkeley. three volunteered at the school radio station, three others members of the cal berkeley

community are among the dead. prosecutors in south carolina are vowing on retry a former police officer in the shooting of an unarmed man. the jury could not reach a decision and the judge declared a mistrial. the jury could not reach a decision. steve osunsami has more on the emotional day in court. >> the court therefore must declare a mistrial in this case. >> reporter: this former police officer, seen in this disturbing cell phone video shooting a black man in the back as he was running away will go home to the loving arms of his family. the mistrial means he will remain out on bond but under house arrest. >> until my family can see justice, no, there's no forgiveness. >> reporter: for the family of walter scott and for black americans who thought that video of the killing would bring justice, they feel the system has failed them again. they're already looking forward to a retrial promised by prosecutors. >> it's not over. y'all hear me? it's not over! until god say it's over.

>> reporter: at least two of the jurors, both of them white women, were in tears as the black foreman delivered the news. >> the statistics say that the next jury will look a lot like you. >> reporter: most of the nearly all white jury looked like they were in disbelief, but there was one who refused to make eye contact with the judge, the jury, or the family of walter scott. >> something got to him. i'm sure we'll quickly hear from the rest of the jurors who disagreed with him. >> a handful of people who came to watch, stormed out of the courtroom in disgust. to show many, the crime was clear. slager fired eight shots. when he fired his first bullet, scott was already 18 feet away. on the witness stand, he explained that he and scott fought before they were scene in the recording. he says at one point, scott got a hold of his taser and says in his mind at the time, scott was a threat. >> you fire until the threat was stopped. that's what i'm trained to do.

in the murder case against him. michael slager was seen in this now infamous cell phone video shooting walter scott who was not armed. jurors said yesterday they were unable to reach a verdict in the case, but scott's mother says justice will prevail. >> justice will be served because the god that i serve, he's able. he told me to wait on the lord and be of good courage. and god, he is strengthening my heart. >> the prosecutors say they will retry slager on the murder charges. he still faces a federal trial for violating walter scott's civil rights, a conviction there could mean life in prison. a shooting last night cut short a town's annual christmas parade in sanford, north carolina. two people were hurt, one hospitalized in serious condition, another with a nonlife threatening injury. both shootings were related and not random. witnesses report hearing up to eight gun shots. >> soon as i walked in, i heard

the gun shots. only thing i saw when the guy fell to the floor. got me nervous. i don't know what to do next, then the cops came, telling everybody to move. >> police say one suspect is now in custody and they are still investigating. thousands come together to remember the victims of friday's tragic warehouse fire in oakland. monday night's scene came after another emotional day. three more bodies were recovered from the rubble of the building. bringing the death toll to 36. meantime, possible criminal charges could be filed in connection with the fire. here is abc's danya bacchus. good morning, danya. >> reporter: good morning, diane and ryan. 33 of the 36 victims have been identified. authorities say they've been able to search at least 75% of the warehouse and they do not expect the number of victims to rise drastically. after days of wondering, dozens of victims identified, most were in their 20s and 30s. some were teenagers and three were international. >> today is the day that more than two dozen families are going to learn of the loved

one's loss. >> reporter: as investigators work to figure out a question, questions of prevention are mounting. authorities announcing a criminal investigation team is on the case, determining if there's liability. >> the range of charges could be murder all the way to involuntary manslaughter, and until we know what the evidence shows us, there may be other charges. >> reporter: the building erupted into an inferno friday trapping party goers on the second floor when a makeshift stairway of wooden palettes was blocked. the building was a tinderbox. only two exits in all 10,000 square feet. people living in mobile homes inside the first floor. most of the victims were on the second floor for a concert. local officials say the warehouse, known as an artist collective, had numerous code violations and complaints of people living there illegally. >> you couldn't have more than two people on that staircase before it would just fall down.

it was not only dangerous, but it was disgusting. >> reporter: the search effort will continue, this after they were stopped for hours monday because of structural dangers to investigators. >> danya, thank you. a snowstorm is being blamed for the deaths of two people whose car slid into the path of a pickup truck in michigan. it was part of a storm system that moved across almost all of michigan, causing scattered power outages, affecting several thousand customers in the western part of the state. the detroit area also experienced rain and slippery roads. a frightening scene played out for the driver of this vehicle speeding along a slick highway in new brunswick, canada. watch as he tries to pass this truck, as a giant piece of ice flying off the roof, and smashing the windshield. the driver said his wife was sitting next to him and was covered in shards of glass, but luckily, neither one of them were seriously injured. lawyers for an atlanta father convicted of murder for leave his son in a hot car are

vowing to appeal. justin harris declined to speak on his own behalf while in court. he maintained his innocence throughout the trial, but the judge gave him the maximum. >> callously walked away and left that child in a hot car in june, in georgia, in summer, to swelter and die. >> prosecutors had decided not to seek the death penalty and said the punishment that harris got was appropriate. former presidential candidate jill stein and her green party have filed a federal lawsuit seeking a recount in pennsylvania. stein was outside trump tower yesterday calling for every vote to be counted. recounts are now under way in michigan and wisconsin as well, after stein claimed initial ballots were susceptible to hacking.

high school football, a tough topic to tackle. according to the institute of medicine, 1 in 14 high school football players will suffer at least one concussion. and that risk is 60% higher than the next sport. yet the sport remains the most popular among high school boys, with more than one million taking part in the game. in the latest issue of the medical journal of pediatrics, some leading experts are weighing in on the question of whether or not high school football should be banned. dr. lewis margolis writes that high school football should be banned until we can be assured that it does not have long-term detrimental consequences. he notes, football causes more harm to the brain than any other sport. but another expert does not think banning the sport is the right solution. having a licensed athletic

trainer on site, a physician who is knowledgeable about the concussions at every football game and a clear return-to-play policy. >> i think having a discussion at the school, how are we going to approach the injury and making sure we're dealing with it at a very appropriate level on that, we are taking the injury seriously. >> such a difficult problem. the other side of this argument, a lot of people have been talking about this, should we ban football at the lower levels? some people say, if you ban it at the lower levels, people don't learn how to tackle properly, and at the higher levels, they're more susceptible to injury. it's a tough call either way. >> i wonder if making the rules stricter on how you tackle could change it. if you dive in head first, you're banned from the game. or maybe a few going forward. >> there are penalties for those kinds of hits. >> in girls lacrosse, anyway, there are tons of rules about the technique and how you play, and they're very, very strict. big debate going on in football. not even just in high school, but in pros as well. well, when we come back, a new host at the oscars. and what divas do when they get back together. stick around.
