phone video that she says proves she was a victim of domestic violence. >> stop! stop! >> abc7 news reporter katie marzullo with the details. >> reporter: ray mcdonald hasn't been a 49er in two years. it was his behavior off the field that led to his removal from the team in 2014. the video and photos made public today are part of a custody dispute between mcdonald and the mother of his son. >> get away from me! get away from me. what are you doing? >> reporter: ray mcdonald's ex-fiancee kendra scott recorded this video. her attorney said he let himself into scott's apartment, and he confronted her as she held her 2-month-old son. >> amary is in my arms, why are you doing this?

>> reporter: she says the woman in the video is in a state of fear. >> i hear a woman who is trying to get away from a situation. i hear someone who really is looking for a means out in that moment. >> reporter: the video ends with a commotion, mcdonald allegedly lunging at scott. >> stop! stop! >> unfortunately, it's a horrific video. i think the public can actually get a taste of what survivors are actually going through. >> scott's attorney has also released these photos, showing bruises on her client's face. she's filing an emergency request to stop mcdonald from seeing his son, now 20 months old. in addition to the accusations of domestic violence, she said mcdonald's dogs are dangerous. city records show two incidents of them biting people. an attempt to reach mcdonald at his san jose home was unsuccessful. in santa clara, katie marzullo, abc7 news. new at 11:00, police in oakland want to know who shot

and killed a woman, at 21st and market street. this is the 81st homicide. there were 89 killings last year. police and crimestoppers are offering a reward for any information leading to the killer in this case. new at 11:00, a driver died in a crash in concord tonight, around 8:00 at port chicago highway. investigators say the driver was speeding, lost control, and overturned. the driver was ejected. it clipped at least one other vehicle during the accident. things got heated in an oakland courtroom today as the wife of a man stabbed to death % in a target store came face to face with the two brothers accused of the killing. >> abc's laura anthony has the message griffin's wife has for her husband's accused killers. >> these are two families touched deeply by one tragedy.

both distraught but with different viewpoints. the wife of tyrone griffin jr had choice words for the two brothers charged with stabbing griffin to death in a hayward target on christmas eve. >> i don't know if they were high or what. like how you could do something like that? you took his life, right in front of his child. >> but the father of the two brothers claimed they acted in self-defense. >> they were attacked. they're portraying them as thugs or something going into the store, and it's not even like that. you know, they're always home with their family. >> reporter: 22-year-old franchy archuleta and his 25-year-old brother jesse were arrested friday night near the target. >> the suspects after the stabbing fled the scene, fled the store, and they ran nearby and they were hiding. >> he was trying to talk to them about the curse music they were

playing. >> reporter: tommy davis was with griffin and his two youngest children. she told us they stabbed him after he told them to turn down their music. but the archuleta sister told us, her brothers claim it was self-defense. and griffin was stabbed only after he hit one of them in the head with a bottle. >> i wish i could say sorry to them. sorry doesn't bring someone back. but it was just an altercation that went wrong. my brothers felt threatened. >> the archuleta brothers will be back in court. both are held without bail. in oakland, laura anthony, abc7 news. all right, imagine finding out you're out of a job through a text message. >> that's what happened to employees of a popular pay area restaurant chain. still ahead, the unanswered questions they have tonight. and first it was fire, now thieves. the bay area family that can't seem to catch a break this christmas season. and later, a digital delicacy. fine dining in the bay

we have breaking news. a driver hit and killed a pedestrian in san francisco tonight. the person was walking through an intersection near cesar chavez and bay shore boulevard. drivers are asked to stay away from the area because it's closed for the investigation. imagine finding out you don't have a job the day after christmas and by text message. that's what happened to employees af pasta pomo doro. >> they've shuttered all 15 of its bay area lokedzs. we're live in san bruno with the story. >> reporter: employees at this san bruno location just had a holiday party. there was secret santa, even new

hires, things that made them think the company was doing well. now they have to look for a new job. it's lights out at all pasta pomo doro bay area restaurants. two signs say it's closed, another one is an i vikz notice. >> i just wish whi was able to leave, instead of getting a text saying you don't have a job anymore. >> reporter: brandon never saw this coming. >> you just spent money on excessive presents and now you don't have a way to get more income. it's messed up. i 2350 i feel like they should have given us two weeks' notice. >> reporter: for customers, it's a huge loss. >> people were speculating about it. >> yeah, it's pretty affordable. they have specials. it's shocking that it's closed. >> reporter: some employees have blasted the restaurant on social

media for the way things were handled. but a manager said, quote, a business is a business, and sometimes they fail. but i'm not making a big deal about it and posting on twitter. i'm still waiting on a check myself. >> my friend, her mother and brother also worked there. in one day, three of the jobs in the household, gone. >> reporter: friday they were hoping to pick up their last check and they're hoping there will be no more surprises. in concord, a family lost even more than their home in a fire. the fire at the condo complex consumed nearly everything that jennifer ballard owned and gave her 5-year-old daughter smoke inhalation. while she was in the hospital with her daughter, someone broke into their storage shed taking their tools and swiped her laptop, and then accessed her bank account.

nicely. today, upper 50s to low 60s. we'll do another round of it. some of you may come up a few degrees. nothing but sunshine for your thursday afternoon. friday we start to see a little more cloud cover as the system to the southwest spins up the clouds and brings in the potential for a sprinkle or two around monterey. if you're traveling, rain showers in southern california with snow in the mountains for friday afternoon and evening. a light system for saturday and sunday. both ones, cold showers, at least a chance and snow levels 2 to 3,000 feet. one model hinting that it will drop down to a hundred feet. less than a quarter inch of rain expected. the systems are dragging down arctic air. a few showers. not a lot. 8:00 a.m., still some showers and the pink is a mix of rain and snow at 9:00 a.m. over mt.
