police are still looking for the shooter, a teenage male between the ages of 15 and 18. investigators say the victim doesn't know the gunman. >> pleasanton police are searching for leads after a woman was assaulted while walking home last night. the victim told police she was approached by a man just after midnight along main street near west angeles street. the suspect jumped out of a '90s hond, accord and grabbed the woman from behind in a bear hug. she was able to call 211 and took off. the victim wasn't hurt and police haven't revealed a description of the suspects but are reviewing surveillance cameras from several nearby businesses. >> 'tis the season for new law meaning a tightening of restrictions on cell phone use by drivers meaning not hands-free but hands off. abc 7's laura anthony is here with the change. >> reporter: it's long been illegal to hold the phone for a call and starting on sunday it will be illegal to hold it at

all. >> with new tighter cell phone restrictions looming, it seems a good time to review what people are obeying the laws already in place, like the one prohibiting hand held phone calls behind the wheel. it appears many drivers still haven't gotten the message. >> you ride with people and they are playing with cell phones and as a passenger you're very nervous. >> reporter: how will they do with a new law that bans holding a cell phone for any reason while driving a car. >> seems like a good idea but i don't know how they will enforce it. >> reporter: the new law the devices must be mounted and if a driver's hand makes contact it can only be a single touch or swipe. do you think that's practical? >> who is counting. i guess would be the question. >> reporter: appearances aside, we did find some people who are on board and fully intent on complying with the law meant to cut down on distractions and hopefully save lives. >> my wife, she was on top of

>> it's frustrating. >> reporter: if you drive in the bay area you know what this feels like, a sea of cars in front of you with lots of time and distance between you and your destination. traffic congestion is just awful sometimes. >> i can get to work without in 15 minute but takes me 45 minutes to get home. >> reporter: if it seems like it's getting worse, it is. caltranz tracked an increase of 72,000 daily hours of delay for vehicles over a decade. alameda county is at the top of the list with 35% of traffic congestion. santa clara has the number two spot at 22% and contra costa is next and san mateo county has 11% and surprisingly san francisco is at 7%. >> it's hard, but especially -- i mean, i cannot go out anywhere like except from work to home and that's it. >> reporter: and the worst days for congestion, wednesday is number one followed by thursday and then tuesday. >> i think monday is usually

out there right now along the coast where you had the fog moving in. we ear in the 50s. 54 san francisco and 54 half moon bay. away from the coast a couple of 60s. san jose is checking in at about 59 degrees so here's the camp overnight tonight we have the clouds streaming in from the coast inland so it's a mainly cloudy night and what that means most spots will be holding in the 40s overnight tonight, and those clouds will try and give way to a sprinkle early on saturday. trying to throw an isolated sprinkle on saturday and this system will kick out of here midday on monday and just in time for neweach the hour-by-hour forecast on new year's eve. show you a slight chance early on midday and it's out of here. but 4:00 diminishing clouds and clear skies through midnight so it will be dry as we welcome 2017 but it will be cool. upper 30s to mid-40s around the immediate bay waters and then we're tracking a very strong cold air mass moving in.

it's not a lot of moisture, and the bigger story will be the temperature so on the storm impact scale. this is a very light system and moving in monday and sitting over us through wednesday morning. light showers. it's going to pull in arctic air and as it does it may try and bring us a few snow flakes late tuesday night into wednesday morning so future weather of what we have here are the temperatures. >> as well as the moisture moving through. tuesday, tuesday afternoon evening, temperatures well above freezing and it will be a chilly day and well below the 40s as the rain falls tuesday evening. as that storm system begins to exit, it will try to pull in some cold air, so early wednesday morning. those numbers are going to fall through the 30s and we do have a chance of that cold air can link up with the moisture on the tail end of the system and we could see a few snow flakes tuesday evening and wednesday morning. arctic air moves in quick enough and could see flakes on the highest peaks in the oakland hills and here's the accuweather

here are the stories making headlines at 1:30. tomorrow 11 people from san francisco will fly back to russia as a result of sanctions handed down by president obama for russia's interference in the u.s. election. those leaving include four employees of the russian consul general and their families. another 31 employees of the russian embassy and their families are leaving from washington, d.c. russian president vladimir putin has condemned the sanctions but hasn't retaliated. today russian foreign minister sergei lavrov called on putin to expel 35 american diplomats from russia. abc 7 news reporter amy hollie feil was allowed inside the consulate where the consul general told her one of the employees leaving the country is the consulate chef along with three children. coming up at 5:00, abc 7 news reporter elissa harrington has a warning about this fake new year's eve party that takes advantage of people's generosity. and there will be a joint funeral for mother/daughter hollywood legends deb enreynolds and carrie fisher.

a 40-year-old mother from san antonio, texas died and her two young doubters were injured when the three fell from the lift at the granby ranch ski area. the group was halfway up the slope when they fell 20 feet. one of the daughters was released from the hospital this morning. the national ski area association says falls from lifts are extremely rare. new york city is preparing for its annual celebration to ring in the new year, of course in, times square. >> three, two, one, happy new year! >> reporter: iconic new year's eve ball completed its final test run before tomorrow night's countdown. the ball, illuminated by more than 32,000 l.e.d. lies and adorned with 2,600 waterford crystals has ascended 130 feet to the top of a pole where it will drop seconds before 2017. again. what are my rights as a consumer? >> this is a great question. if your car is still kofrld by the manufacturer's warranty, your car is probably a lemon. look, let me give you the rule of thumb here and four repair attempts and two for safety or more than 30 days in the repair shot and you have a lemon. this means the manufacturer generally is forced to buy the car back. if the car is out of warranty, now it's a whole new thing. you probably can't do much. the law doesn't really address that, so what you'll want to do is file a complaint with the dmv if you want to go that far. what i would do is call up your local bar association and ask to speak with an attorney who practices lemon law and they will give you 20 minutes for free and tell them where you're at and they will tell you where you stand. >> all right. victoria asked, great question, young victoria. i'm 10 years old. when should i be able to open a savings account? >> you're only 10 and thinking about saving money. you're a 7 on your side kind of
