he supports the obama administration's new sanctions. >> i ask based on your views of russian politics and your experience, is it possible for something like this involving the united states elections to have happened without vladimir putin knowing about it and authorizing it? >> reporter: i think that's a fair assumption. >> that he would have? >> yes. >> reporter: marco rubio pushed further citing russia's role in the killing of thousands of civilian in aleppo, syria. >> is vladimir putin a war criminal? >> i would not use that term. >> mr. tillerson, do you believe that vladimir putin is responsible for ordering the murder of countless journalists and political opponents? >> i do not have sufficient information to make that claim. >> none of this is classified. these people are dead. >> reporter: tillerson said they've talked broadly about

foreign policy but not about russia. >> i would thought russia would be at the top of that considering all the actions taking place. that did not happen? >> that has not occurred yet. >> pretty amazing. >> reporter: now after more than eight hours of testimony, marco rubio still is not convinced. he says the country needs moral clarity in foreign policy and he's not sure tillerson can deliver. without rubio's support, tillerson may not pass the vote and that could put his confirmation in real jeopardy. mary bruce. abc news, capitol hill. and james mattis is said to testify this morning. immediately after the committee plans to vote on a waiver that would exempt mattis from an existing law that bans former officers from become defense secretary unless they were out of uniform for at least seven years. mattis left four years ago. hours after accusing the intelligence agency of leaking information, president-elect was

on the phone with the director of the intelligence agency. james clapper says reports alleging the russians compromised trump did not originate with u.s. intelligence. and he said he didn't believe any leaks came from the intelligence community locally. abc's elizabeth hur has more on trump's combative news conference. >> reporter: the big news at his first press conference as president-elect, donald trump's major admission. >> as far as hacking, i think it was russia. >> reporter: for the first time, trump accepting the intelligence agency's conclusion that russian president vladimir putin ordered the election hacking. >> he shouldn't have done it. i don't believe he'll be doing it more now. we have to work something out. >> reporter: but trump quick to deny and dismiss the unconfirmed reports alleging russia has compromising information that could be used against him. >> it's all fake news. it's phony stuff.

soon as his nominee for secretary of health and human services is confirmed. lawmakers passed a measure clearing the way for the first step at repealing the law. and some republicans have misgivings about setting the it in motion before there's a replacement. an emotional day in court as relatives confronted a killer. >> dylann roof was formally sentenced to death yesterday for murdering nine black parishioners in 2015. 35 relatives spent five hours in court yelling at him, praying for him, and offering him forgiveness. after making their statements, they thanked the public for helping them through their pain. >> i'm proud of america for keeping this story alive, and allowing the victims to -- their voice to be heard. >> roof plans to appeal the federal death sentence.

officials for the leak. >> but the director of national intelligence says he spoke with trump last night and said he does not believe any leaks came from the intelligence community. jonathan carl has more. >> reporter: it's donald trump versus the intelligence community. in his first press conference as president-elect he accused the top intelligence officers of leaking the unconfirmed reports that russia was gathering salacious information to blackmail him. >> i think it was disgraceful that the intelligence agencies allowed any false information out. i think it's a disgrace. and i say that, and that's something that nazi germany did. i think it's a disgrace. that information that was false and fake and never happened got released. >> reporter: trump assured the american people that no amount of investigation will turn out anything. >> if they come back with any

kind of conclusion, if any of it stands up or is true, will you consider your position? >> there's nothing they can come back with. >> reporter: trump accepts the intelligence agencies conclusion it was russia that hacked the democrats during the campaign. >> as far as hacking, i think it was russia. >> reporter: although later he seemed to hedge. >> it could have been others also. >> reporter: he did not dispute the intelligence community's other explosive finding. on the intelligence report the second part of the conclusion was that vladimir putin ordered it because he aspired to help you in the election. do you accept that part? >> if putin likes donald trump, i consider that an asset, not a liability. because we have a horrible relationship with russia. now, i don't know that i'm going to get along with vladimir putin. i hope i do. but there's a good chance i won't. and if i don't, do you honestly believe that hillary would be

tougher on putin than me? does anybody in this room believe that? give me a break. >> reporter: but response to a question from abc, another first, a trump admonishment of vladimir putin. >> if you believe that russia was behind the hacking, what is your message to vladimir putin right now? >> he shouldn't be doing it. he won't be doing it. russia will have much greater respect for our country when i'm leading it than when other people have led it. >> reporter: as the press conference ended and trump moved through the crowd he was asked whether anyone on his team communicated with russia before the election. >> did you or anyone in your campaign have any contact with russia leading up to our during the campaign? nothing at all? >> reporter: no, trump said, not at all. trump also said he's ordering an investigation into hacking. not just the election hacking but all hacking by foreign governments. he'll order the investigation after he's sworn in on january 20th and he expects it

to be done within 90 days. jonathan karl, abc news, new york. >> james clapper said he also told trump that the unsubstantiated document is not a product of u.s. intelligence and said they haven't made a judgment on it as yet. we do know that the memos were put together by a former british spy hired by trump's rivals. john mccain acknowledged he received the information and turned it over to the fbi last month. an investigation revealed a number of serious flaws with the allegations. and ethics officials are slamming donald trump's plan to separate his businesses from the presidency. trump revealed he will retain ownership of the trump organization. he says that he would then put the businesses in a trust and turn the leadership over to his two oldest sons. trump plans to pursue new deals in the u.s. but promised not to

make new foreign arrangements. >> i understand. they don't want presidents tangled up. they want a president to run the country. so i could actually run my business. i could actually run my business and government at the same time. i don't like the way that looks, but i would be able to do that, if i wanted to. i would be the only one able to do that. >> in a blistering critique, the head of the office of government ethics called on trump to sever his business ties completely. he suggested the decision to continue to profit from his empire is unpatriotic. on capitol hill senate lawmakers worked on the affordable care act. the process called vote orama. it's rapid fire votes. this time on individual elements of the health care law. it was triggered by democrats trying to delay the process of repealing the affordable care act. a short time ago senators approved the resolution despite some republicans expressing

concern about acting to repeal the law before they come up with an alternative. also on capitol hill lawmakers have tough questions for controversial nominees. rex tillerson for secretary of state and jeff sessions for attorney general. we have the details. >> reporter: it was a rare rebuke. >> i know it's exceptional for a senate to testify against another senator. >> reporter: but cory booker followed his conscious in testifying against jeff sessions for attorney general. >> his record says we can't count on him to support state and national efforts toward bringing justice to the justice system. >> reporter: he was not alone. joined by congressman john lewis. >> it doesn't matter how senator sessions may smile. we need someone who is going to stand up, speak up and speak out for the people that need help.

that while the allegations about russia and donald trump are completely unsubstantiated they are the work of a former british spy hired first by republican operatives during the primary and later by democratic operatives who turned over these memos to the fbi last august. and we caught up with john mccain who confirmed he gave copies of the memos to the fbi director last night. >> i looked at it. decided this is a matter for the fbi, gave it to the fbi. >> reporter: a senior official says trump was directly told about the allegations last friday at trump tower when he received a classified briefing about russian hacking which contradicts what kellyanne conway initially said to seth meyers. >> i believe it said they briefed him on it. >> he said he's not aware of it. >> that concerns me. >> reporter: now an examination by abc news reveals serious

flaws in the information. they claim a trump lawyer was part of a secret liaison relationship with the russians and met with them in prague in august of 2016. cohen told abc news and his boss he has never been in prague. >> i said i want to see your passport. he brings his passport to my office. i said, wait a minute. he didn't leave the country. >> reporter: the report given to the fbi also claims that the father-in-law was a leading moscow property developer close to putin. but when abc news went to the home of the property developer in moscow, we found a case of mistaken identity. same name but no connection to trump's lawyer, cohen. other allegations revolve around trump's travel to moscow for a miss universe contest in 2013 and whether the russians filmed him with prostitutes to be able to blackmail him if they wished. trump strongly denied that saying he knows how to avoid russia's spy tricks. >> i told many people, be

careful because you don't want to see yourself on television. cameras all over the place. >> reporter: authorities tell us the fbi continues to investigate the allegations saying they're just too serious to ignore. brian ross, abc news, new york. and trump is facing criticism over his plan to separate his businesses from the presidency. during yesterday's news conference he announced he is turning the leadership of the trump organization over to his two oldest sons. but will retain ownership. trump said he will pursue new deals in the u.s. as well, but he promised not to make new foreign deals. the director of government ethics is calling on trump to divest completely. trump's pick for treasury plans to sell off shares. an investment banker with a net worth of more than $160 million, the value of some of his assets may have already gone up. he sparked a rally in november when he said that privatizing mortgage giants would be a priority for the trump administration.
