>> whoa! hi! >> we've got christiane, and charity and nick. and how it wound up in a water bottle in one mind boggling trick. >> it's like if you did the same trick to a chimpanzee or something. ♪ >> this is a heart wrenching video coming from azerbaijan. you see this 10-year-old girl. she's holding on to her aunt. her mother died of cancer a few years ago. after a long custody battle, it was determined by the courts that the little girl needed to go with her biological father, whom she's not had a relationship with since she was a few months old and this is the moment that this little girl is supposed to go with her dad but in doing so will be leaving her aunt whom she calls mom behind.

the dad, even though he wanted to start court proceedings to gain custody of his daughter, decided he didn't want to put the family through that. he wanted to give them time to deal with the grieving before he initiated the legal proceedings. it's now been years. the court finally ruled that he did have the right to have his daughter, but you see as they are trying to get her to go with her dad, but the thing is -- >> this is all way too much for the kid to comprehend. any one of us i think could have arranged a much better transition than going to a stark office with authority figures and carrying this girl away from her mother figure. >> that is one of the reasons this video is getting so much attention. according to some reports that we've read, it sounds like the daughter is now back with the aunt as this case continues to be investigated and possibly the ruling even reversed. >> i'm sure everybody involves really love the child's and she needs her dad because she's already fostered this

relationship with her aunt as a mother figure, she also needs her as well. they have got to figure out a way to put their pride and egoes aside and figure out what's best for this little girl. >> to me, as a dad, i would want my daughter to be with me. to be seeing the anguish and despair on her face, it feels like you are making a bad situation worst. this company could find themselves in deep water. you see that whale there? that's an endangered whale. it's the pacific area in the known area where these whales west. we're about 30 miles away from some islands in russia. you see the person driving the boat start to approach the whale. >> which as far as i know you are not supposed to do, keep your distance and view. >> following with the engine running which has got a prop spinning which could injure an
