they said it's not only unconstitutional and un-american. mayor ed leah greed. san francisco became the first city in the united states to file suit against president trump's order against sanctuary cities and withholding federal funding. more than 400 in the u.s. city attorney herrera said san francisco gets over $1.2 billion a year in federal funding. most of which goes to hoik, nutrition and other safety net programs. for the president to deny that is wrong. we have to abide by the rule of law. we're going to make that quite

immigration-related legal services. they will considering a legal fund to support immigrants facing deportation. some bay area tech companies are joining forces to combat the executive order on refugees. san francisco-based git hub is organizing a meeting today, with google, air bnb discussing filing an amicus brief. they're discussing holding hearings to consider two bills that would make california a sanctuary state. one would prohibit police from cooperating with immigration requests to detain certain suspects, the other barring law enforcement from collecting information on a person's immigration status. it's uncertain what the actual would mean for the federal funding for the state. activists plan to pound the pavement in oakland in about an hour to protest the confirmation of ebeling education secretary betsy devoss. a senate committee approved her

confirmation. now it goes to for a vote. she wants control of schools to be shift d away from washington. it could mean cuts in federal funding. she also has financial conflicts of interest that should disqualify her. a senate judiciary committee is voting on the nomination of alabama senator jeff sessions as attorney general less than a day after sally yates was fired for directing the justice department not to defend his travel ban. earlier this morning, texas governor rick perry was confirmed as the new energy secretary and elaine chao sailed through her hearing to become transportation secretary. president trump is set to make a choice for a new supreme court justice in a few hours. it's believed to be down to judge neil gorsuch on the tenth circuit court of appeals in denver. judge thomas hardy man is on a court in philadelphia with the president's sister mary ann

p.m. you can also watch the announcement live on our abc 7 news app and streaming on abc 7 news.com. new this morning, president trump plans to continue at least one executive order signed by his predecessor. the white house says mr. trump will maintain a 2014 executive order signed by president obama protecting federal employees from anti-lgbtq discrimination. the president is determined to protect the rights of all americans, including the lgbtq community. in san francisco, supervisor jane kim will announce legislation today to create the first transgender district in the nation. it will encompass six blocks in the southeastern tenderloin crossover market street to include two blocks of 6th street. organizers hope it's a hub of services and economic opportunities for trans and agender communities. grab your umbrellas. back on storm watch tracking another storm set to hit the

showed you, they're coming up in the accuweather seven-day forecast. >> thanks, mike. a deal reached in a berkeley police brutality lawsuit. the police department was sued after this protest in december 2014. they say they were clubbed and tear gassed for no reason while marching for justice. settlement includes police policy changes and $125,000 for seven plaintiffs. the deal still has to be approved by the berkeley city council. happening now in the peninsula, the community is honoring a redwood city police officer who died of natural causes while on duty. right now a memorial service is under way for officer gerardo silva. the 57-year-old passed away a week and a half ago after fellow officers found him unconscious and not breathing inside the police station. today's service is being held at the fox theater in redwood city. the officer was an 18-year veteran of the department. friends say his dedication to law enforcement and service to

in hawaii. look at that bright red stripe in the middle of that steam. that's lava. usgs researchers are calling it a fire hose of lava. it's been wowing guests there. it's always eruptions there, but normally it's more of a trickle, not a hose like that. you can see why it's impressive. the explosion of water and steam by the way, caused when it hits the colder ocean water. quite a sight. more mother nature news. images of a landslide in southern california. take a look at this huge pileup of dirt and debris. this hillside gave way in the hollywood hills sending tons of mud tumbling into the yards of two homes. we're happy to say nobody was hurt, luckily. a huge cleanup effort is under way. they have a lot of work to do, still. the landslide happened last night, forcing five homes to evacuate as a precaution. there's some relief. crews restored power to the neighborhood but the slide buried two utility poles.
