justices often serve until their deaths. >> kristen sze with what to expect. >> neil gorsuch is the youngest nominee in a quarter century. if confirmed he could shape our nation for decades to come. gorsuch has served on the 10th circuit court of appeals in denver for more than ten years, attended harvard law school with former president barack obama, in fact, before getting his ph.d. at oxford. he's had prestigious clerkships including for retired justice byron white and anthony kennedy. gorsuch is originally from colorado but spent years in washington. his mother was actually head of the epa for ronald reagan before being forced out because of a toxic waste cleanup scandal. gorsuch will replace justice antonin scalia, a man he looked up to and paid tribute to. as for how he would rule gorsuch says he takes the constitution and balance of powers seriously. >> mr. president, mr. vice

ideolog ideologue, so that is a hint of the battle to come. analysts say gorsuch is just to the right of scalia on the conservative spectrum. gorsuch will go through a tough senate judicial hearing, and that's expected to begin in a few weeks. dan and ama? >> justice antonin scalia died last february. in mid-march, as kristen mentioned, then president obama named garland as his nominee to replace scalia. republicans refused to hold confirmation hearings saying they felt the new president should be the one to nominate a new justice. now democrats may choose to take the same action. san francisco filed a lawsuit against president trump today claiming his order to cut off funding to sanctuary cities is unconstitutional. san francisco is one of several hundred local governments that limit how much it will cooperate with federal immigration agents. city attorney dennis herrera is accusing the trump a administration of cutting off federal dollars to san francisco. >> the president's executive order is not only

on the map here. san bruno authorities are looking for suspicious items inside the shops at tanforan on el camino real. the mall received a phone call just before 4:30 this afternoon. the caller warned a bomb had been placed inside the food court. security guards then evacuated that shopping center. we're going to keep following the story and bring you updates as they become available. and right now you're looking live at the view from our emeryville camera. tomorrow the rain returns and it will stay stormy for several days. abc 7 news weather anchor spencer christian explains what we can expect. spencer? >> okay, ama. there's a storm approaching, and by this time tomorrow we'll probably have wet weather. you can see clouds are increasing, and there's our storm in the center of it well offshore. clouds and moisture moving in our direction. tomorrow the storm will arrive in the evening hours. it will be ranked one on the storm impact scale bringing light showers and breezy conditions. it will intensify overnight into thursday morning, and by

apparently someone forgot to tell the owner of the raiders, mark davis, that goldman sachs and the las vegas billionaire were on the same team. i think davis has to be thinking right now how do i recover that ball? there is renewed enthusiasm and hope that the raiders will stay put in oakland. for weeks now the raiders have claimed that goldman sachs would help finance the $1.9 billion stadium deal if nevada billionaire sheldon adelson dropped out. yesterday adelson announced he could no longer support the plan. and today multiple reports say sachs was pulling the plug, too. adelson complains that he had been left out of some critical talks regarding the new stadium. >> if i was going to put $650 million in someone's pocket and knowing what i'm sure he probably did to get the deal together, to work with the local elected officials to make a deal happen and then not get a piece of the action, for lack of a better way to say it, i would

probably be upset, too. >> reporter: this was how the new stadium was going to be funded. adelson promised $650 million and had convinced the nevada senate to commit to nor $750 million by raising room tax in clark county. and the raiders and the nfl were going to be in for $500 million. now, unlike adelson, goldman wasn't expected to be an investor in the deal. only a lender. >> you can borrow the money but you have to pay it back. how do you do that? davis has said they don't have the money to build the stadium by themselves. >> reporter: with the latest development some speculate the nfl could table any vote on the raiders' move. >> i think oakland is the right place for the raiders. you have the fan base. you have a community, and, most of all, we want the raiders to stay where they belong in oakland. >> reporter: ronnie lott and his investment group say they are ready to work with davis to come up with the funds for the construction of the $1.2 billion stadium in oakland, something that up to you now davis has not

new at 6:00, a fire at the santa cruz yacht harbor damaged three boats this morning. the fire started on a power boat and jumped to two other vessels. firefighters pushed one of the motor boats away from the dock to keep the fire from spreading even further. a surfer who lived on one of the boats was displaced. the fire caused about $500,000 in damage. the cause is still being investigated. stanford university police issued a community alert after they say they arrested a man on campus for possession of weapons and peeping with binoculars. he was arrested in the searsville parking lot. they are investigating whether this is the same man could be connected to another incident just a you few miles away. the man arrested spoke exclusively with melanie woodrow in a story you'll see only on 7.

>> reporter: represelica guns, guns, knifes, metal knuckles, handcuffs and binoculars -- that's what stanford university department of public safety says it found inside a van on campus. someone contacted about a man acting suspiciously, possibly using binoculars to look into a student residence. >> suddenly police car here, another police car behind me. >> reporter: deputies arrested the man on possession of weapons and peeping charges. >> i'm absolutely not guilty. >> reporter: a department of safety spokesman said he conc t concepted to having his vehicle searched, a point he now disputes. >> they didn't ask me any permission to search. >> reporter: the man says they confiscated most of his gear but he showed us these. >> this is u.s. army -- >> reporter: he says he was u using them to read parking restriction signs not to peep on students.

near a street in hayward. shawn new was being returned on fraud and identity theft charges when he got out of the car and made a run for it. he is still on the loose tonight. a form earp uc santa cruz student a case. they agreed to pay more than a million dollars claiming the professor sexually assaulted the student in 2015. uc santa cruz faced allegations of knowing for years the unnamed professor was a sexual predator. the school hasn't commented on the case. san francisco's transgender community could have its own cultural district which would be the first of its kind in the u.s. the compton historic district has been proposed in the southeastern tenderloin and two more blocks of sixth street. abc 7 news was at city hall as jaime kim announced the legislation and seed money to open a community center and retail space. kim said it's an important time to celebrate diversity.

hours. it will be wet and windy on thursday and we'll have this rainy, unsettled pat earp right on into the weekend. overnight partly to mostly cloudy skies. low temperatures will not be quite so low as the last few nights. it will be chilly in the inland valleys in the low 40s. we're not expecting any low 30s tonight. right around the bay look for mid to upper 40s and tomorrow under increasingly cloudy skies. high temperatures in the upper 50s to about 60 degrees. maybe a little bit milder in the south bay where san jose will top out at 62 degrees. here is our storm impact scale. the storm arriving tomorrow evening ranks one on the impact scale, light intensity, light showers and some breezy conditions. that storm will intensify overnight, though, tomorrow night. the forecast animation starting at noon tomorrow. by early evening hours we'll see the arrival of the first wave of rain moving right through the central part of the bay area through san francisco, over to the inland east bay, and then right behind that a surge of steadier, heavier rainfall by about midnight tomorrow night. and by early morning thursday, the storm will have intensified to a number two ranking on the

storm impact scale, a storm of moderate intensity. brief downpours with the storm, with this invigorated, energized storm. wind gusts will be common. we may even see some thunderstorms. by 3:00 thursday morning before the morning commute even begins we'll already have widespread areas of moderate to heavy rainfall with some very vigorous downpours. 7:00 thursday morning still very wet. the morning commute is likely to be slow and hazardous and the rain will continue in pockets, periods of rain throughout the day and into the evening hours thursday and into friday actually. so we project that by friday evening rainfall will be 1.5-3 inches. and i did mention winds. they'll be gusty. a wind advisory will be in effect from 10:00 tomorrow night until 3:00 friday morning. winds will be generally out of the south at about 15 to 30 miles per hour but there will be

the dow dipped again today. the dow lost 107 points to close at 19,864 today. the nasdaq moved up one point ending at 5,614. the s&p dropped two points to finish at 2,278. for some perspective the dow is just about even with where it was on the first trading day of the year. an increase in wages leads tonight's bay area business watch. according to a new report by mill valley based glass door the immediamedian base pay this mon more than $66,000. that's up nearly 4% in the past year. it outpaces the national average, too. for this report the bay area includes the counties of

alameda, contra costa, marin, san mateo. apple released an earnings report today that beat expectations. revenue up more than investors thought it would be in the cupertino company shipped more iphones than predicted. sales had been falling for nine months straight. in the last three months they rose 5%. the latest iphone, the 7, went on sale in november. b.a.r.t. is about to pay a steep price to end an environmental controversy. the transit agency agreed to pay nearly $1.3 million to settle a civil environmental suit filed by contra costa, alameda and san mateo counties. the local prosecutors claim b.a.r.t. failed to implement hazardous business materials plans in those counties and accuse the agency of violating storage tank and hazardous waste laws. since president trump took office, we have talked a lot about sanctuary cities. many carry that title meaning, of course, they don't enforce federal immigration laws. >> soon the entire state could

jurors. sierra was 15 years old when she disappeared while walking to school, to a school bus stop, in morgan hill in 2012. abc 7 news reporter david louie was in the san jose courtroom today and find that possible contamination of dna evidence appears to be the centerpiece of the defense case. >> reporter: dna analyzed by investigators may be the crucial evidence that the jury of six women and six men will weigh in deciding whether 25-year-old antolin garcia-torres murdered sierra lamar. the prosecutor says garcia-torres' dna was found on sierra's jeans discovered dumped in a bag near her morgan hill home. but it was the defense team's turn today and attorney al lopez said dna protocol was not followed and the bag was contaminated. >> i think the defense did a good job in establishing that the protocols of the dna evidence collection were not followed and the prosecution will now have to shore that up through their own experts.

>> reporter: defense attorneys also tore apart the district attorney's assertion that garcia-torres tried to kidnap three women separately in the parking lots of two safeway stores in morgan hill in 2009, three years before sierra lamar disappeared. not one of the three victims could pick out garcia-torres in a photo lineup. garcia-torres continued to look composed as he listened to attorneys talk about him and the evidence that may or may not lead to his conviction. he could face the death penalty. he looked cooperative in a video played in court when questioned by police. one of the volunteers search organizers thinks the jury has a lot to consider after hearing the opening statements from both sides. >> i think the jurors are going to have their work cut out for them. i know that mr. boyd was very thorough yesterday and again this morning. >> reporter: in san jose, david louie, abc 7 news. a former associate of chinatown gangster raymond boyd chow faces life in prison for a murder that happened 11 years

ago. 50-year-old pled not guilty to killing allen liyung head of a chinatown society at the time. chow took over after the murder. he was convicted of the same murder last year. there is a bomb scare in west sacramento this afternoon. the tower bridge and surrounding streets were closed after a woman in a car said she had a bomb. police say there was suspicious wiring hanging from the car. she surrendered to police following a standoff that lasted about an hour and a half. police then detonate add suspicious device. san francisco city workers are turning up the pressure on the mayor to rebuild the hall of justice. abc 7 news obtained this letter signed by several unions including attorneys and police officers. associations. it calls for immediate action to fix the building that houses criminal courts and the district attorney's office. the building has been declared seismically unsafe since 1992.

testing self-driving cars in san francisco after a night with the city and state over permits. uber recently brought the cars back but only from mapping streets not for carrying passengers. there is a driver behind the wheel and the self-driving function is disabled. freeways without futures. that's how sections of two key bay area interstates are described in a new report that recommends tearing them down. the congress for the new urbanism put 280 between 16th and mission bay in san francisco and 980 in oakland on its list. the report argues if you take down these freeways communities will see less blight and there will be more space to build affordable housing and public transportation. one example is the embarcadero in san francisco. the old freeway was torn down after the 1989 earthquake. >> could you have imagined people wanting to tear that thing down? probably not the in those days, but if you saw it today could you imagine putting a freeway there? probably not.

it was dead. >> reporter: john's samsung galaxy phone was barply three months old and wouldn't turn on. >> it was pitch black. >> we had to turn our phone in to samsung repair. >> reporter: that isn't why john was so upset. it was the fact samsung refused to repair it and mailed it back saying john was to blame. >> and they said that was caused by my abuse, and i go, what do you mean my abuse? there's no way. >> reporter: the repair report from samsung said the lcd was damaged because of abuse. >> i was hot. i was hot. >> i was shocked because i know he hadn't abused it. >> reporter: john had protected the phone with a screen cover and a hard case. he says he never dropped or cracked it. it looked pristine when he showed it to us in walnut creek. >> and they say, oh, no, you did this. that's like a slap in the face. >> reporter: we contacted samsung. the company said its technicians did find damage and determined it was caused by the customer
