been on for just about a half an hour, car pool lanes moving along okay. everyone else, not so much but that is normally what we see this time of day. quick check of drive times, southbound 680 looking great through walnut creek. westbound 580, tracy to dublin, pretty average for you. you are in the yellow at just 46 minutes. for the second conservative morning, we have a flipped semi for pacheco pass drivers. i'll think about that coming up next. from hang ten to hang chapter 11? the organizations behind maverick surf competition filed for bankruptcy. >> we've been expecting more information this morning about what this means for this year's vaebt. abc7 news reporter amy hollyfield is live for us at half moon bay. >> reporter: hi, natasha. there's a fear here that the maverick surf competition won't happen this year. one person telling us that's like canceling the pumpkin festival here in half moon bay. it just won't be good but the management company has filed for bankruptcy. more details are expected this

some believe gorsuch will oppose women's reproductive rights. nominated by former president obama was denied a hearing by senate republicans. >> issue, i believe, was a vital issue to president trump defeating hillary clinton and now respecting the will of the people, it's incumbent on the senate to advise and consent and i believe we should confirm this very, very strong supreme court nominee. >> republicans call gorsuch a mainstream conservative judge. confirmation hearings are expected to begin in about two weeks. voting on two of president trump's cabinet nominees is indefinitely protest poned right now. democrats boycotted votes on tom price and stephen mnuchin. democrats said they needed more answers about their business dealings first. only five of the president's picks have cleared the senate so far. that is far fewer than his

predecessors at this point into their presidency. president obama had 14 confirmed, george w. bush, 15, clinton, 17, just under two weeks into their terms. the city of oakland is establishing a $300,000 legal fund to fight deportations. according to "the chronicle," the money will used over the next two years to help families who can't afford legal representation. the state is also taking action to protect undocumented immigrants. lawmakers are considering two new measures. the first would provide state funded legal representation. the second would prevent state and local agencies from sharing any information with the federal government about a person's religious belief, national origin, or ethnicity. it seems the trump presidency is pitting tesla owners against one another. company ceo elon musk is serving on the advisory council with the president so because of that connection, at least five people have reportedly taken back their deposits for new teslas. earlier this week, musk spoke to gizmodo about the president saying, simply attacking him

"the chronicle" reports a new $4.5 million computer program has some serious in the past six months, people have been arrested on warrants that don't exist, told to register as sex offenders when they have not commit any such crime, and ordered to show up to court when a hearing wasn't scheduled. also misdemeanor convictions are showing up as felonies. the superior court judge has ordered lawyers in both offices to fix that problem. new details in a years long debate over san francisco's hall of justice. this morning, the city's administrator is demanding everybody get out. here's a live look at the bay bridge toll plaza. plenty of people headed to work. we're tracking what's happening we're tracking what's happening with that storm approaching

bruin and daly city. mill valley at about 45 and oakland 49. here's a look at 101 and 880, one of the last areas to get wet this evening. caution for the evening showers. out and about, it will be dry during the day but if you try to do anything after the sunset, it will be wet. today on the water, fine. here's a look from the east bay hills. mid 50s to mid 60 degrees. so we've got a cooling trend. we've got rain on the way. guess who's going to tell you what it gets to your neighborhood? i'll do that next. here's alexis. i was going to say, not me. i just have your commute covered here this morning. taking a look at gilroy, this is where we've had a problem since about 3:00 a.m. for the second day in a row, we've got a flipped semi on pacheco pass, 152 the westbound side, all traffic being diverted to ferguson so yesterday wasn't as big of an impact. today it is ully blocking the westbound side. you can use 156 to 25 for an alternate. that is looking pretty good.

it is 6:14. a former uv santa cruz student who claims she was sexually assaulted by a professor reveals her identity. luz portillo says the professor assaulted her in 2015. two years later, the university of california regents and portillo reached a $1 million settlement. she hopes her decision to come forward will empower other survivors. >> if this helps at least one person, if this encourages one person to come forward, then putting my name out there is well worth it. >> portillo's attorney says the university knew the professor was a predator and did nothing about i. the school released a statement saying in part the allegations were investigated in confidence because our campus process respects the right and privacy of all parties. we investigated the victim's

claims as soon as she came forward. the new details coming out about the future of san francisco's hall of justice. the city administrator wants everyone out permanently by 2019. that comes after several unions, including the police officers association, signed this letter calling for immediate action to fix the building. the district attorney's office and sheriff's department also work out of the hall of justice. it's been declared seismically unsafe since 1992 and it is plagued with a whole slew of other problems. now sf gate reports administrator naomi kelly wants everyone, including 350 inmates, to move out in two years. no word yet on where those inmates may be transferred to. new details this morning in marin county's effort to regulate recreational marijuana. according to our media partner, the marin ij, the board of supervisors voted to ban nonmedical marijuana businesses in unincorporated areas of marin. it will allow them to consider the implications of granting licenses when recreational marijuana becomes legal to sell next year. the ban passed a first reading

yesterday. it's expected to pass a second reading next week. this one just coming in to our live desk. you already know fast food isn't good for you. now you might need to worry about the packaging it comes in too. a new report released just this morning says one-third of fast food packaging tested contained flor nated chemica that report released says those chemicals have been linked to kidney and testicular cancer, elevated cholesterol, thyroid problems among other things. no official response from any of the big fast food chains although it will likely not sit well with the industry already trying to change its image by adding more healthy options across the board. another food-related story, for those of us drinking coffee right now, you may want to put down your mug or cup and listen to this story. results out of the university of the illinois shows that coffee

and right now you can save on premium rooms at a disneyland resort hotel. we're back at 6:24. the university of california will terminate $475 million worth of contracts with wells fargo after repeated criticism over the bank's ties to private prisons. according to the daily californian, the bank financed two companes that own private lock-ups. a spokesperson says the university decided to sever ties with wells fargo in light of the bank's recent activities regarding unauthorized bank and credit card accounts. it is time to ask finney and this morning, barbara from walnut creek has a question about mortgages. >> "7 on your side's" michael finney has her answer. >> how do low income families get a lower interest rate on their mortgage? >> hey, barbara.

of winter because of the rain. it's coming back today. all right. let's talk about it. good morning. hi, everybody. a live doppler 7 showing some radar returns offshore, that's going to evaporate. big thing today is going to be mainly gray until we get to the evening hours. that's when you'll really start to feel the brunt of this storm. look at the golden gate bridge. bone dry right now. temperature 39 to 51 so you don't have to dress quite as warmly this morning. not as foggy either. temperatures mid to upper 50s for the better part of the afternoon hours and there you go, 7:00, the rain begins. we'll take a deeper look at this storm and our spare the air. alexis. enjoy that dry pavement for this morning's accumulatcommute. and you're not going anywhere fast through the bay bridge toll plaza. we've had those metering lights on for exactly one hour at this point. that is looking typical through the maze. westbound 580, tracy to dublin, we have a couple crashes around north flynn but not slowing you down too much. westbound 4, antioch to concord, 32 minutes in southbound 101 if you're coming from the north bay, no problems there.

you're in the green at 18 minutes. we have had a pretty big problem in gilroy all morning. i'll talk more about that coming up. right now, we are tracking a homicide investigation underway in san jose. >> one person is dead. abc7 news reporter matt keller is live on tully road. >> reporter: good morning, natasha and reggie. since i last saw you, my photographer patrick and i actually walked up into the crime scene to see if we could find anything there. the man was found with at least one gunshot wound in front of the optometrist office here but officers say a lot of people were at the nearby vietnamese restaurant just a couple of doors down and check out what we saw there. a lot of surveillance cams. now, this could be really helpful to police as they investigate the latest homicide here in san jose. a lot of vehicles were trapped inside the crime scene. once police started their investigation, the man was shot just before 10:00 last night and he died here at the scene. no arrests have been made and it does not appear that they have a suspect. victim's name has not been released. this is interesting. just a few buildings down is

another vietnamese cafe. that one was part of a huge bust in 2015 by san jose police and the fbi an illegal gambling machines were taken from there. no word on the motive from this shooting last night. reporting live in san jose, matt keller, abc7 news. this morning, republicans are applauding president trump's nomination of judge neil gorsuch for the open seat on the supreme court. there's already talk of a filibuster among the democrats. we were there as the dean of the university school of law watched yesterday's announcement. john trasvina says it's less about gorsuch and more about capitol hill infighting. >> will senate democrats because of their great trfrustration wi the president block this nomination? will they do it right from the beginning or are l they allow the process go to go forward. >> the supreme court seat has been vacant since the death of antonin scalia last february. if gorsuch fills the spot, the supreme court's balance won't change. he promises impartiality and

strength. house minority leader nancy pelosi is challenging senate democrats to scrutinize gorsuch's record. she calls the nomination a bad decision. >> it's a very hostile appointment if you breathe air, drink water, eat food, take medicine, or in any other way interact with the courts. this is a very bad decision. >> she made that comment during a cnn town hall last night. pelosi did not say if democrats will or even should filibuster gorsuch's nomination. republicans will try again today to confirm alabama senator jeff sessions for u.s. attorney general. democrats used a procedural move to delay the committee vote until today. they invoked what's known as the two hour rule. it bars senate meetings from running past 2:00 in the afternoon. senator dianne feinstein is among the democrats wreg whether sessions can act independently of president trump. the nation has a new border patrol chief this morning. he is a career official with the

department joining more than 30 years ago and serving as deputy chief during former president obama's administration. he will lead the department as president trump tries to build a wall along the mexican border and add thousands of agents to the department. closer to home t legal battle against president trump's immigration order is heating up. san francisco became the first city to file a federal lawsuit against the order yesterday and now santa clara county plans to do the same thing and it could happen as early as tomorrow. the president's order strips sanctuary cities of federal funding. both san francisco and santa clara county believe that order is unconstitutional and they stand to lose $1 billion each in funding. homeland security says 872 refugees will get waivers to enter the u.s. this week. the agency clarifies they were already cleared to enter before the president signed his immigration order on friday night. none of these poeople were detained in the airport protests that we saw at sfo and across the nation. the executive orders bar all refugees worldwide for 120 days

and nationalists from seven majority muslim countries for 90 days. santa rosa may be the bay area's next sanctuary city. the city council will take up a sanctuary declaration next week. there is growing support in the community for that move. city leaders say there are about 29,000 undocumented immigrants in sonoma county. activists say those people need to be protected from president trump's immigration policies. there's a facebook campaign to get a huge turnout for next tuesday's council meeting. take a close look at this photo coming up. the lake county sheriff's office is trying to find this man, 69-year-old lawrence clayton jelks. he is wanted because he failed to register as a sex offender. his last known address was in clear lake oaks. if you see him, do not approach him. immediately call police. into the live desk this morning, a class action lawsuit against the nfl filed by former cheerleaders and new at this hour, we have just learned what this lawsuit could be worth.

up to $300 million in damages against the league. the suit claims nfl teams conspired to keep cheerleaders' wages low and didn't pay them for rehearsal time or mandatory appearances. the lead plaintiff is a former 49ers gold rush cheerleader. she doesn't want her name used but did agree to do an interview. >> i hope that the lawsuit helps the women of the future, the women of the past. we've all put the same amount of energy, passion, training, there's so much into it that i just want them to know their worth, to not be taken for granted and to give what they're deserved. >> some cheerleaders claim they made as little as $5,000 a year. the suit says some nfl mascots made up to $65,000 a year. no comment yet from the nfl, but the story is developing. the team at gma also working it and you can catch their report coming up after 7:00. and speaking of football,

the raiders proposed move to las vegas may be coming apart at the seams. which means are renewed hope for raider nation that they'll stay in the bay. investment bank goldman sachs withdrew from the $1.9 billion stadium project yesterday, one day after billionaire shelton adelson announced that he was out. adelson was going to invest $650 million but complained that he was shut out of critical stadium talks. chris dobbins with the oakland coliseum authority says the frustration is understandable. >> if i was going to put $650 million in someone's pocket and knowing what he did to get the deal together to work with the local elected officials and to make a deal happen then to not get a piece of the action, for lack of a better way to say it, i would be upset too. >> ronnie lott's group says it is still ready to get something done in oakland and released a statement saying, bottom line, if the raiders want to stay in oakland, we're more than ready to be a partner in making that happen. the save oakland sports has lauchlked this petition drive on

change.org urging the nfl owners to reject the proposed relocation to las vegas. we have a link on our website, abc7news.com. alameda county sheriff's deputies hope you'll recognize a prisoner who is on the run. he escaped. you're looking at 27-year-old shawn new. he escaped from a car while being driven to sfo yesterday by deputies from kentucky. sky7 flew over hayward during yesterday's search for new along interstate 880 near a street. new is being returned to kentucky to return fraud charges. and today, lawyers for the wife of orlando nightclub shooter omar mateen will ask a federal judge ore lease her on bail. fbi agents arrested noor salman at her they say she helped her husband plan the attack. salman's family says she didn't know what happened after the shooting. really tough for several bay area families. they have a whole lot of questions this morning following the sudden closure of an

adoption agency. the independent adoption agency filed for bankruptcy and closed its doors for good after 34 years and it did have this branch in concord. one couple was in the middle of their adoption process and now they're wondering if it's still going to be legal or if they'll have to start over. another couple is concerned about important documents. >> part of the adoption process is they have very personal information on us, and there were no directions about how get that back. >> many of these affected families are now bonding on facebook, reaching out to one another. the independent adoption agency says it's closing permanently. hey, if you live in livermore, our reporting station there is reporting unhealthy levels of fine particulate matter or soot for those most sensitive to it. the bay area air quality management district said the north bay will have a wood burning ban. campbell is santa clara at 44,

the company has agreed to shell out more money and this time, it will pay at least $1.2 billion in buy backs and compensation to settle claims here in the u.s. involving cars with their larger 3 liter diesel engines. those are the engines that were rigged to cheat on emissions tests. the settlement was filed last night in district court in san francisco and it covers about 75,000 audi, volkswagen and porsche cars. this new amount caomes after agreed on a smaller settlement for its cars. a hummingbird egg is getting in the way of upgrades to the richmond-san rafael bridge. caltrans is spending $70 million to open a third lane on the lower deck to ease congestion but about a week ago, workers found a nest and an egg in a tree that was about to be removed for the project. that species of bird is federally protected, which means it can't be touched. as a result, some work on the bridge could be delayed until
