"i'm appalled at your willingness to deprive over 38,000 students access to an education because of the actions of a few." according to data from the latest fiscal review, more than half of it is research budget was received, about $370 million

annually. uc berkeley police say those who turned violent were not cal students and the speech was canceled for safety reasons. and let's check in now with wayne freedman live at cal. >> reporter: that's right. if you talk to anyone on campus or in the community, no one is blaming uc berkeley for what p had. they were, in fact, outside agitators. take a look over my shoulder. good morning, berkeley, tough night last night? a war that began with a battle on campus that spread into a conflict and this morning anyone could see the evidence written on walls and covered up by plywood when the agitators carried into the streets of berkeley, they took dead aim at banks and corporate america.

>> they always hit the same spots every time. >> reporter: why is that? >> they don't like the big corporation. >> reporter: for mario, it was business as usual and why didn't the city of berkeley deploy its police departments to protect those targets. let's ask the mayor. >> we need to deploy our police resources effectively. we have limited resources. the focus was to monitor the crowd and make sure that there was no threat to physical safety of people in the crowd and in the community. >> reporter: what protesters may not have considered is that by moving on the big guys, they hurt a lot of little people, too. >> they are hurting the every day people, some of those people maybe work two jobs and they need that money. >> reporter: today, many of the people who would have worked in that starbucks did not work at all. if this is, in fact, a class

war, as some people around here are describing it, then the people who would have been at work at that starbucks and all of these other businesses qualify as collateral damage. dan? >> wayne, what's the mood like out there today? >> reporter: now, that depends on who you talk to. if you talk to the young republicans, we asked if he had known how the event had turned out, would they have sponsored the event at all. he said he did not know. they anticipated violence but not that much. another student, who is a freshman, said, and this is a quote, i think it's sad and misleading that the rest of the country saw what happened here that they cannot tell the difference between anarchists and uc berkeley students. there is a bit of a

misconception. wayne freedman, abc7 news. >> wayne, thank you. we'll turn now to our weather forecast. a damp and gray day across the bay area. live pictures from san francisco and the east bay hills which is all clouds and one or two rain droplets. >> spencer christian has the latest. >> it's going to get damper and grayer. i'll give you a closer look at what is going on. light rain and scattered showers over most of the bay area. let me close into the area of the most concentrated rainfall. it's in the east bay. south of fairfield to concord, san ramon, pockets of steadier rain in there. pretty widely scattered even into the south bay. it's light and scattered. this storm ranks 1 on the impact scale, the storm impact scale. it will be gusty as well. here's the forecast animation starting at 5:00 this afternoon and into the evening hours. we continue to see pockets of light rain and notice how

between 1:00 a.m. and 3:00 a.m., the rainfall becomes heavy and steady over the north bay. it produces a drenching. that heavier, steady rain shifts between 3:00 and 5:00 a.m. and then at 5:00 a.m., in the inland east bay and after 6:00 a.m. we see it tapering off to scattered showers for the remainder of the day tomorrow and tonight. it's going to be wet. if you're planning to go outside, i advice taking an umbrella or shielding yourself in some fashion. the seven-day forecast in a few minutes. ama? >> that's okay. it's me. the snowpack is at 173% of average in the sierra. that's as a result of the snow survey from the state department of water resources. this is the most snow recorded since 1995. the northern half of the state is now out of the drought. governor jerry brown expected to wait until the next snow survey in april before deciding whether to officially end the state

drought emergency. a new round of rain this week means we're keeping a close eye on our reservoirs and some of them are already spilling over, as you can see. this water is coming from the anderson reservoir and floating into morgan hill. matt keller takes a look at how much water is in bay area reservoirs right now. >> reporter: it was a dark and stormy night in the south bay. okay. it was dark but the storm wasn't like what we saw recently. light showers for the most part. when your ten reservoirs are above normal, even filled to the brim for some, you've got to prepare for the wet weather. >> with the dry weather, we've been able to release water from most of them to get them to a safer level to make room for the floodwaters that are coming in, inflowing into the reservoir. >> reporter: the reservoir in morgan hill is more than 100% at capacity. that's why we were able to capture this video. water spilling over and out and in the uvis creek.

lexington reservoir in los gatos is about 85% of capacity. the santa clara water district has done releases getting ready for more rain to fill up. anderson reservoir in morgan hill has reached its limit. releases have been taking place and mother nature has been cooperating, too. giving us a chance to dry out recently to help with the flooding. more will be coming to keep our water supply up. >> through january we're thinking, this is a great month but what if january and february is completely dry. we might find ourselves in a drought situation. it's looking like there is rain in the forecast so we're encouraged by that. the storms are spread out so we don't have a concern of flooding. >> reporter: all of this water from anderson reservoir is floating into the coyote creek and water officials don't expect to have any flooding issues this weekend. matt keller, abc7 news.

san leandro man may be charged with murder for running over his girlfriend. abc7 news was on ruth court as police investigated this deadly incident. it began last night as a couple argued in front of their house and then things turned tragic. >> several 911 calls of the male and female reported yelling at each other. one of our 911 callers then reports that the female was struck by the vehicle and stuck underneath it. >> the victim's boyfriend was behind the wheel. he's been identified as kevin valasco. he tried to lift the car but was not successful and his girlfriend died at the scene. a homeless village was taken down today. >> it sits under the 580 and 980 freeways. there were 18 health and safety violations.

leslie brinkley has a look at what happened today. leslie? >> reporter: advocates are absolutely angry saying that they tried to build something for the homeless only to have it attorney down but the city says the makeshift village had to go. they had to restore a public park. >> shame, shame, shame. those are homes. those are homes. >> reporter: two weeks ago, west oakland neighbors and activists took palettes and plywood and built a homeless village wedged under the 580 and 980 freeways. they set up a wash station and toilet and donated food and clothes. >> the city complains they don't have the money but we came together as a community to do this. people put their time, sweat, energy. >> i never felt so much love for people when i'm beside these parks. they came to me and helped me. they was calling me mama nancy. >> reporter: but today, 12

residents, like mama nancy, were back out on the street. oakland police officers watched as public works crews dismantled the so-called village because the city was leasing the land from cal trans to create a public park. >> reality is that they took over a public park without any permits, without any communication. we had a lot of complaints from the neighbors as well. >> reporter: the city posted 18 health, safety and fire code violations for the village. >> what we see here is an exhibit of municipal code taking precedent over the housing crisis and human dignity. >> reporter: angry advocates tried to salvage what they could as a few dozen marched oakland city hall to demand answers. beds were available in the city's winter shelter for those displaced. countywide, there are 4,000 homeless. the grassroots community groups that built this village say they will try to rebuild it now somewhere else. in oakland, leslie brinkley, abc7 news.

the blame is on a uc engineer professor. >> reporter: uc berkeley engineering professor testified in front of the board of supervisors. he was on the peer review board which gave the project a green light in a letter to the city in 2006. >> my role in the project was very clearly spelled out as looking at the reinforced concrete structure. that's where i focused my work. and the other things that they think i should have been looking at were not in my scope. >> the city relied on him. he's basically saying you shouldn't have relied in me. >> reporter: especially since he was the chair of the review

board for another project on tacoma. it was scrapped, considered too dangerous to build. >> he knew there were dewatering next door and didn't mention it anything in his letter. he knew that there was no geotechnical peer review but didn't mention it in his letter. you would think a professional like this would at least cover their behind a little bit. >> my biggest concern is an earthquake. >> reporter: pat dawson confronted the professor asking why her home was built on soil instead of bedrock. >> could have been much more clear about the potential problems with the building and didn't take that opportunity. >> reporter: this is being called a systemic failure by the city, the peer review board and the city as a whole. elissa harrington, abc7 news. a san francisco police officer shot in the line of duty is making a remarkable recovery. officer kevin downs was shot in the head while responding to a 911 call at a shopping mall.

comfortably again, hmm? >> the feud began a month ago when president trump tweeted the ratings are in and arnold schwarzenegger got swamped compared to the ratings machine, djt. that's donald j. trump. schwarzenegger tweeted, "i wish you the best of luck and i hope you'll for for the american people as aggressively as you worked for your ratings." and he said he thought the immigration ban was, quote, crazy, which leads us to today. lots of speculation out there that trump's comment is a publicity stunt intended to boost the ratings of a show he still co-produces. some think not. people are asking to give schwarzenegger huge ratings in the hopes of irking the president. ama, larry? >> you know, this rain is to boost my ratings. we're going to keep it going.

that overnight into tomorrow. we expect the heaviest rain to fall before 6:00 a.m. and it's gusty and breezy along with the rain that falls. let's look at where the heaviest rainfalls overnight and into the morning hours. in the north bay, it's at its heaviest, between 1:00 and 3:00 a.m. and then shifts southward just a bit. we see heavy, steady rain from parts of the east bay and later in the morning hours, around 5:00 to 7:00, the heaviest rain is in the south bay and finally starts to push out of the bay area with the heavier rain, that is, after 7:00 a.m. it's followed by, as you can see here on the timeline, pockets of light rain and scattered showers throughout the day, throughout the afternoon, into the evening hours tomorrow night. now, as we look ahead to rainfall potential from this storage, well, up in the north bay, santa rosa, topping out at .09 of an inch. most of the remainder of the bay area can expect anywhere from a tenth of an inch to .06.

well, gamers are taking the world by storm. competitive gaming has made its way to college campuses. >> and now women are starting to make an impact. here's a look at how the cultural dynamics of gaming are changing. >> reporter: when uc irvine opened its arena, the school positioned itself at the forefront of competitive gaming. the e-sports program wants to take a lead on rapidly growing area, women in gaming. >> if you're good, they are like you're only good to get attention. if you're bad, you're bad because you're a female. you can't do anything without being scrutinized. >> reporter: this is a junior majoring in political science and an avid gamer. she's dealt with harassment and criticism while playing online because she's a woman.

and here are the stories making headlines at 4:30. uc berkeley is cleaning up today, one night after demonstrators caused destruction on campus and in parts of berkele. they were protesting the planned aappearance of breitbart appearance of milo yiannopoulos. three people were arrested related to the protests last night. two for assault and one for failure to disperse. they were not uc berkeley students. >> comcast employees around the country have staged a one-hour walkout. david louie will have that story at 5:00.

the president tackled a number of topics and took diplomacy to twitter sounding off on iran and long-time ally australia. stephanie gosk has that story from washington. >> rporter: larry, president trump said today he wants to make sure that america doesn't get taken advantage of by other countries and this is happening on the same day that secretary of state is contending with some of that tough talk. after some heated exchanges with world leaders, president trump says his tough talk won't stop. >> it's time we'll be a little tough, folks. we're taking advantage of by every nation in the world, virtually. >> reporter: trump has taken on countries like mexico and now iran and australia. >> i love usaustralia as a couny but we have a problem. >> reporter: after an early morning tweet calling it a dumb

deal, the president opted for a softer tone for the cameras. >> a previous administration does something and you have to respect that but you can also say, why are we doing this? that's why we're in the jams that we're in. >> reporter: trump spoke with australian's prime minister after an executive order banning refugees indefinitely was announced. >> the trump administration has committed to progress with the arrangements to honor the deal, if you'd like, that was entered into with the obama administration and that was the assurance the president gave me when we spoke over the weekend. >> reporter: on his first day in office -- >> hi, i'm the new guy. >> reporter: secretary of state rex tillerson walked into a packed room trying to calm concerns from the new administration. >> we're on the same team. we share the same mission. we'll start by making it the basis of how we interact with each other.

>> reporter: and the treasury department is tweaking president obama's sanctions on russia, the ones in response to the russian hack. the white house says this is routine for the department to go back, take a look at the sanctions and oppose that may affect businesses here in the u.s. larry? >> stephanie, are there new iran sanctions in the works from the trump administration going forward? >> yes, there are. the white house says that they are working on -- working to impose sanctions on iran for two main reasons. the recent launch over the weekend and because iran supports the houthis, a rebel group. sean spicer says those sanctions will not come today but they are looking at all of their options and say this is coming directly from the white house and not the state department because this reflects how important this ssue is to them. larry? >> stephanie ramos live in washington. a coalition of american companies, including silicon

tech organizations is opposing trump's travel ban. the letter asks the president to repeal the ban saying it hinders businesses and the u.s. economy. microsoft and apple are signing the letter. a draft of the letter reads in part, "our ability to grow our companies and create jobs depends on the contributions of i immigrants from all backgrounds. two american professional basketball players remain in limbo because of the international fallout sparked by president trump's travel ban. they are stuck in dubai. they were in the uae to get their visas renewed when the ban was announced. tehran retaliated, blocking americans from traveling to iran, barring prince and jones from returning. >> what donald trump has done, the order he's made is hurting me. it's hurting me and j.p. it's affecting us by iran wanting to do the same thing and so it's keeping us from going back to provide for our families. >> the players are under y

contract in iran. a frightening hostage situation at a prison in delaware that is now over but not before the death of one of the guards. the siege ended early when police used a backhoe to breach the building. >> we lost one of our family members and it pains my heart. >> reporter: grief and shock as delaware authorities try to piece together the events that led to a deadly hostage situation at the james t. vaughn correction center, delaware's largest prison. we're now learning more about the one guard killed in action, sergeant steven floyd, an 18-year veteran. >> he's a champion and would fight for what was right. >> reporter: he was found unresponsive, authorities pronouncing him dead at the scene. >> we have to investigate what happened here, determine the

facts to make sure that it never happens again. >> reporter: here's what is known. at 10:32 a.m. on wednesday, a staff member radioed for assistance after a prison revolt. four correctional officers were taken hostage. >> hey, they're at my neck right now with a knife if you don't hurry up and turn these phones on now. >> the standoff lasting for hours. at 5:06 thursday morning, tactical teams used a backhoe to break into the building and moved quickly to secure the hostages. they found one female staff in two minutes. >> inmates shielded this victim. >> but for sergeant floyd, it was too late. the officer's union saying that his death could have been avoided. >> sergeant floyd didn't have to die yesterday. we've been asking for help from the previous governor and we got none. >> reporter: the union warned that inmates had been holding dry runs trying to determine areas of weakness.

we are back with our daily look inside the white house and today the president is communicating with foreign countries using a method that he's familiar with. karen travers has the latest

from the white house. >> reporter: call it twitter diplomacy. president trump making headlines and potentially shaking up relationships with key u.s. allies. it was a late night for president trump who tweeted just after 11:00 p.m. about an agreement that the obama administration made with australia to take in refugees. mr. trump calling it a dumb deal. this was significant because it followed a report in "the washington post" that the president's call on saturday with the prime minister of australia, steadfast u.s. ally, grew contentious over this very issue. then, early thursday morning, before the sun rose at the white house, the president saying with a tweet, "iran is on notice after its best of a ballistic missile." the white house rarely walks back the president's tweets. the standard response is, the tweets speak for themselves. mr. trump's spokesman did say thursday that the president's call with australia's prime minister was very cordial.

karen travers, abc7 news, the white house. the owner of a san francisco bookstore is taking a stand by featuring cookbooks by other countries. they are showcasing books from sudan, somalia, iraq and reaction to the displace has been overwhelmingly positive. photos have been shared on social media thousands of times. well, as kermit the frog used to say, it's not easy being green. >> district attorneys in 23 counties are trying to change that by pushing for environmentally labeling on your products. >> the green thumb, michael finney. >> what a segue. >> okay.

walmart has agreed to pay fines totalling $940,000 following accusations of its labeling of certain plastic products is misleading. district attorneys in 23 california counties claim the use of the term's biodegradable and compostable by walmart were inaccurate under california's standards. alameda county accuse walmart of making unsubstantiated claims saying that almost nothing breaks down in the landfill. and made in the usa when they are not, the federal trade commission filed a complaint against spring water systems of georgia claiming that the company falsely advertised its filters were built in the usa or proudly made in the usa. many of the filters were actually wholly imported. others were made mostly with materials from overseas.
