[ laughter ] now from abc7, live breaking news. >> good evening, i'm eric thomas. that breaking news tonight is here in san francisco where just in the past hour or so, the justice department has formally filed an appeal to reinstate the president's travel ban. the department of justice wants the ninth circuit court of appeals to lift a judge's order, blocking the ban. the justice department says the injunction immediately harms the public by thwarting enforcement of an executive order, issued by the president based on his national security judgment. abc7 reporter joins us live from outside the ninth circuit court on seventh and mission with more on this late-night filing. lisa? >> eric, this is where the doj sent this emergency motion late tonight and now court clerks are scrambling to get all the

paperwork in from all the parties involved so the judges can make a decision as soon as possible. this is the paperwork in the docket number specifically assigned to what continues to be an historic case. three ninth circuit court judges will decide if the restraining order issued by a washington state federal judge should be reversed. last week, president trump signed a travel ban, prompting protests nationwide. >> i really think it's unlikely they would reverse this order. i think it's unlikely they would vacate the stay. >> professor rory little at uc hastings said the motion argues president trump has the power to regulate immigration and protect our borders. little insists the current executive order is way too p>> we want to keep out bad guy and terrorists, okay? but you're keeping out way more than that. you're keeping out lots of people who have been already been vetted. >> reporter: ali is one of those people, the 12-year-old born in yemen to a mother who only

recently became a u.s. citizen. she's been living in yemen without her parents who settled in los ban os. she his her visa and is due to arrive at sfo tomorrow, still her attorneys are worried. >> if there were an emergency stay that were issued to stop this temporary restraining order from being applied, we would go back to having the executive order enforced and she could potentially be stranded again. >> the judges could make a decision at any time, but experts believe likely will be early next week. in san francisco, abc7 news. [ shouting ]. >> this is what democracy looks like! >> in florida, 3,000 protesters chanted against the now blocked executive order near the president's private mar-a-lago resort. president trump hosted a fund-raiser there tonight for the international red cross. the protesters set up a flag-draped coffin that they

said represented the death of democracy. president trump responded with this, the judge opens up our country to potential terrorists and others that do not have our best interests at heart. bad people are very happy. for a second weekend, protesters turned out in san francisco, against president trump's executive order. sky 7 was above this afternoon where hundreds of demonstrators say they plan on keeping up the pressure on the administration. sergio quintana was on the ground and has our story tonight. >> the people united will never be divided! >> reporter: this event, brings together a cross-section of people who share a similar concern. >> i'm here to protest what trump is doing. we're the voice that has to say something for anything to change. >> reporter: the feeling at this demonstration was notably different than the protest crowds we saw last weekend. on sunday, people flooded san francisco international airport, and many aimed to shut down security lines to get their voices heard. >> we want a leader, not a dirty

tweeter! >> reporter: this was not a rally aimed at shutting anything down, or parading through the streets. it was one of dozens across the country that were organized as a demonstration of momentum, to keep public pressure on the administration. >> reporter: this is now the second weekend of protests against president trump's executive order and speakers are encouraging people to do more than turn out a rally pch. >> organizing means talking to your members of congress, trying to get at them in all avenues. writing to them, calling them, showing up to their town hall meetings. >> reporter: it was a multi cultural, multi-national group. these two are originally from iran and came here to voice their concerns about president trump. >> the way he's acting and leading the country, it's going towards what you might see of people back home. >> this event was peaceful, there were no counter-protesters. members of the bay area's yemeni community joined that

protest at civic center plaza after they held a meeting of their own in san francisco. their message, don't keep us out. >> reporter: dozens of yemeni immigrants packed a room at the holiday inn to get the latest updates about the trump administration travel ban and to discuss why they believe it's misguided. >> we are american citizen. we protect this country, we will continue to protect this country. >> reporter: yemen is one of the seven countries included in the ban. mansour said he had been in contact with 75 americans who are trapped overseas this week. [ shouting ]. >> reporter: meantime, many of the folks at that meeting marched to the protest at civic center plaza. this man hoped his wife would get a visa to travel to the u.s. next week. but after talking to his immigration attorney, he's not so sure. >> i called her, she said, i'm sorry, everything is stopped for now, until you hear new.

i don't know when. >> reporter: this yemeni national is afraid to travel overseas. he's speaking through an interpreter. >> he's a green card holder, so with the trump right now, holding people in airports, he's worried about being one of those guys. >> none of us have ever committed crime. we are all law-abiding citizen. we pay our tax, we work hard. >> reporter: a family who visited iran for an agreement party will now be reunited after several members were delayed because of the travel ban. one family member arrived today, another arrived in the u.s. last week. the family doesn't know why he was held in custody despite holding a green card. >> they gave me the visa. all the security that they have to take, so why should he have problem when he gets here? >> despite being confused and worried, the family is happy and thankful now for all the support they received in the bay area.

to speak on wednesday, peaceful protests turned violent and his speech was canceled. turning now to the weather, in emeryville, you can see it's nice and clear, the glassy bay, but another round of rain is on the way. and drew tuma has more on that. >> after showers this morning, we were able to squeak out a nice dry evening, but that dry spell gonna be short-lived. our next storm already approaching on the horizon. live doppler 7 over us. we are dry, but the wider picture, there's our next storm, the cloud cover just off the coast. and right on the heels of that system, another storm is brewing in the pacific. so we have several systems that want to move in. in fact, chances of rain the next seven days. take a look at this. if we weren't already soaked, look at that, through tuesday, we are tracking a 100% chance of rain across the region. first take a much closer look at the rain arriving tomorrow. hour by hour on future weather and plan out the rest of your week in the full forecast.

a crowd chanted "shame" as a republican u.s. lawmaker was escorted out of a town hall meeting just outside sacramento today. during the event, tom mcclintock took questions from the crowd. they asked about climate change, the president's immigration order and the affordable care act. his answers sometimes led to loud booing. security kept attendance at 200 people. some were upset they could not get in. >> came because we're trying to educate ourselves and understand what's going on and figure out how we can get our message out and let people know we're worried. it's amazing how many people showed up. >> protesters didn't cause any

damage and no one was arrested. bay area public schoolteachers are urging senators to vote against president trump's choice for education secretary. that message was loud at clear at a california teacher's conference. betsy devos will have her hearing on monday. >> never having worked in a public school, never been to a public school. he didn't send her kids to a public school. all she's done in her entire career is use her wealth to undermine public schools. >> she has support from the national alliance for public charter schools and former florida governor jeb bush, they believe she could help reform the education system. it's a right of passage for many young biz. >> three, two, one, go! >> abc7 news was in santa clara for the cub scouts district pinewood derby. the top racers built custom cars

from just a block of wood. this was the tenth year it was held at the muslim community association. the scouts believe in respecting people of all faiths. >> we in the boy scouts, we have a code to be reverent, but we don't define what that is to people. so it's been a great partnership to help people see people who live differently and bring the whole community together. >> levi margolis had the fastest car. his secret? put a lot of graphite on the car. san francisco unveiled one of his biggest projects in city history today. abc7 news was there for the mansel street project ribbon cutting. over the last two years, crews transformed two lanes of an old roadway into a safer space for people. >> it will be a huge benefit to the community. people are now going to be able to walk on this street, ride their bike on this street. not have to worry as much about cars speeding by at 50, 60 miles

an hour, right in the middle of a park. >> the project also added raised cross walks, new lighting and landscaping. tonight dozens of people tipped their syrahs for a cause that's anything but petite. abc7 news was at san francisco's design center galleria. it's a foodies fantasy with some of the bay area's top chefs dishing up food. there's wind and other high end libations. all money from tonight goes to the make-a-wish foundation. sky 7 was in full throttle tonight above the ama super cross. this was round five in the series that wraps up in may. despite a little bit of rain this morning, the conditions were said to be great for racing. >> now your acweather forecast. >> a lull in the action overnight, and the rain returns for the second half of your sunday to round out the weekend.

live doppler 7 tracking all the wet weather. tonight with the break in action. live doppler 7 giving us the all-clear tonight. live look in san jose in the south bay now. all is quiet under partly cloudy skies. your morning is going to be just fine. it's on the dry side. really into the evening hours and pretty close to sunset, we'll start to see the first drops return to the region. look at the three-day rainfall. february certainly picking up right where january left off. we got soaked, once again, in the north bay. close to two inches in mill valley. san jose, close to a half inch of rain in the past 72 hours. san francisco just shy of an inch of rain. we are going to tack onto these numbers not only tomorrow evening, but several chances over the next seven days. out there right now, on the mild side. a lot of spots holding in the 50s. oakland at 52. 51 in san jose. 54, san francisco. napa, 48 in fairfield.

let's break down your sunday, hour by hour we go. the first thing we have in the morning, some areas of fog, could be dense. dry through noon. peeks of sunshine. by 4:00, introduce the chance of a sprinkle, mainly in the north bay. it's 7:00, later in the evening when the widespread wet weather makes a return. so the storm imt pact scale for tomorrow's system, sunday night into monday, a 1. scattered showers, a few downpours embedded in the system, but it won't be widespread heavy rain, and it will be breezy at times. hour by hour, we go, watch the time stamp in the korcorner of r screen. midday on sunday, dry across the region. 5:00 in the evening, here comes the next storm system approaching the coast and then it takes over the region. by 7:00, we're tracking some widespread wet weather. future weather picking up on the pops of yellow. those are the isolated downpours we'll be tracking as the system

moves through. it's a pretty quick mover. by 10:00 sunday evening, we're tracking what is the tail end of this front swinging through. in the wake of that front, still a little bit unsettled. 7:00 a.m., monday morning, still the chance of an isolated shower passing through the region. potential rainfall with this system, highest amounts in the north. the heart of the region through san carlos, san francisco, oakland, concord, a quarter to half inch of rain. then the rain shadow effect where the santa cruz mountains takes a lot of the rainfall. along with the rain here, more snow in the sierras. take a look at this. a winter storm watch goes into effect. one to two feet above 6,000 feet. please do not drive sunday night. heavy snow will be coming down at that time. much of the morning tomorrow is dry. the rain returns in the evening. monday, it's really on and off

call your travel agent or rocky mountaineer for special offers now. live where you live, this is abc7 news. >> good evening, i'm eric thomas. in tonight's headlines, the justice department filed an appeal of the restraining order of president trump's travel ban, from seven mostly muslim nations. a federal judge based out of seattle temporarily blocked that ban last night. the appeal says it harms the public by thwarting the enforcement of the executive order and second guesses the president's national security judgment. the appeal now goes to a three-judge panel. protesters rallied outside city hall tonight, chanting against the immigration order and the promise to build a wall. hundreds of those protesters were yemeni who gathered today to learn about their rights traveling and protesting.

they said a baby less than 2 months old was among the people trapped overseas last week. in response to the restraining order, the president took to social media and mocked the judge, tweeting, what is our country coming to when a judge can halt a homeland security travel ban, and anyone, even with bad intentions, can come into the u.s.? and the opinion of the so-called judge which essentially takes law enforcement away from our country, ridiculous and will be overturned. he held a gala at his florida estate tonight. outside the protesters chanted against and in favor of the president. the vice president believes trump is being the man he has always been, calling out a federal judge. >> this judge was confirmed 99-0. how is he a so-called judge? >> well, again, we face a dangerous enemy, inspiring people to come into this country and frankly inspiring people who

received a complaint about the hcg program, they sent an undercover investigator. >> so really, if you want to do the self-injection, we'll do once a day. >> the owner's sister offered prescription hcg injections without a doctor having seen the patient as required by law. >> an individual could be diabetic and they don't know it. who's checking? who's looking at them to see if there's more that they need. that's why it's so important. >> reporter: investigators learned that the spa's doctor lived 400 miles away in san lorenzo. dr. allen fuj moto declined to speak with me on camera. in his interview with investigators, he admitted training the owner and her sister once in 2009, and that they purchased hcg using his license. >> they dispense the medication and then i sign it later. >> fuj moto said he visited the spa every two months to review charts and that he rarely saw patients. >> i can only remember two people i've seen. one was a male.

>> the california medical board took away his license effective this past new year's eve and he pled guilty to aiding and abetting unlicensed practice of medicine. her sister also pled guilty. you would think that a criminal conviction that brings a $1,000 fine, suspended jail sentence and three years' probation, that mary yane kazzaro would be careful with how she runs her business now. i asked this woman to call for an appointment just two and a half weeks ago. >> i said, okay, the doctor will be in at 12:00. >> when taylor arrived, no doctor, it was marian kazzara who described the benefits and then a physician's assistant offered an injection right then and there. >> other than him telling me he could inject me, that was the end of our conversation. >> reporter: kazzaro said she has a new doctor. if she had decided to go through the injection, the physician's assistant would have done a more

thorough medical exam. >> if they had decided to get on the program, he would have written them a prescription and he would have filled it for them. >> for the iteam, dan nouds, abc7 news. other news now, surprising video shows a laptop computer exploding into flapelds. security cameras at a home in thousand oaks, show flames shooting out of a dell. it happened twice and then two more times after it was unplugged and taken out. >> i was just in shock, didn't really know what was happening. didn't really know what to do. >> the johnsons say the fire appears to have come from the laptop's lithium battery. dell recalled those batteries in 2006 because of the risk of fire and is promising to investigate this case. experts say never charge your laptop on a couch or bed. only on a hard surface. they also say, you shouldn't leave it plugged in overnight or when you leave for work. more tonight on an amazing

with drew tuma. >> a quiet night on the way tonight, but grab the rain gear especially tomorrow evening as our next storm moves in. we are all clear, move on to the storm impact scale. what we're seeing tomorrow evening and potentially through monday morning, a 1 on the storm impact scales. scattered showers move in, isolated downpours, it will be breezy at time, but wind is not really a huge concern with this quick-moving system. grab the umbrella if you have evening plans. by 5:00, there's the rain moving onshore. through 7:00, the yellows you see on the screen mixed in with the green, those are the heavier downpours that will be working through the evening forecast. by 10:00, we're tracking the tail end of this shield of moisture, but behind this front, it's still a little unsettled. so even monday morning, 7:00, we'll be tracking the chance of a scattered shower. here's the seven-day forecast.
