many san francisco is expected to hear arguments in this case. as of right now, the executive order placing a travel ban has been lifted. families were reunited over the weekend as a federal judge in seattle brought an end to the executive order that banned refugees and people from seven muslim majority countries. president trump expressed his displeasure in tweets over the weekend, calling him a so-called judge and saying if something bad happens, you'll need to blame the judge. california senator feinstein was vocal on the issue. >> the president is not a dictator. the framers of our constitution wanted a strong congress for the very reason that most of these kinds of things should be done within the scope of law making. >> as of now, immigration agents are not enforcing the ban. the justice department though has appealed that decision. that's what brings us here to san francisco, where the world

will be watching. many are predicting this case won't end here. it will end up at the supreme court where, of course, one seat sits empty. reporting live in san francisco, amy hollyfield. >> thank you. nearly 100 tech companies including apple, facebook, are voicing their opposition to president trump's immigration order.der. 97 companies filed a friend of the court brief yesterday and argues the order is illegal. they said reinstating the ban would be harmful to their businesses and would make it difficult to hire great employees. the brief said it is leading to other countries retaliating and that can hinder doing business aboard. an officer-involved shooting occurred, the first of the year. what led to the shooting? >> reporter: police say an officer shot a man who died.

the initial call for some sort of disturbance. a police spokesperson says it is unclear if the officer who fired was dispatched to that initial call. >> he located one of the subjects involved, and that's when the incident occurred. >> shocking. it's a little >> reporter: candice heard gunshots. >> i didn't see anything. >> reporter: sergeant cortez said the officer involved is a patrol officer with approximately ten years with the department. he was not shot but was taken to the hospital for his injuries. >> did require medical attention, but it is not life threatening. we're thankful for that. >> reporter: sergeant cortez says the fremont police department is in the preliminary stages of body cameras. some units have them. it was unknown if this officer did. >> it is up to us to do our best. unfortunately, it doesn't always turn out that way. >> reporter: police didn't say if the suspect was armed. pelse and say there is no publi

threat. abc 7 news. two armed robbery suspects in custody following a search that forced bart to shut down train service at the montgomery service station. the men were seen running in yesterday afternoon. police arrested the suspects and the station is open. no one was hurt. san jose state university is warning students to be careful following an armed robbery just about two blocks from campus. two people held up a group of students on south 7th and east reed street friday night. one victim got hurt but will be okay. the robbers took off in a car, possibly a gray dodge charger. a homeless person is in custody, accused of setting this car on fire in oakland. chp showed the burning near fru fruitvale and 7th yesterday. the suspect is a 20-year-old. officers are trying to figure out why he did it. legislation will be introduced to amend california's

laws that criminalize hiv. the current laws were enacted in the '80s. that was during the height of the aids epidemic. this proposal protects people who have hiv from being prosecuted for intentionally transmitting the virus, even if their partner tested negative. the legislation protects hiv-positi hiv-positive sex orders. legislators will discuss the bill this morning at 10:00. the victory parade for the new england patriots is set for tomorrow morning in boston. >> being called the greatest comeback ever thanks to star quarterback and san mateo native tom brady. nail biting game. brady brought the patriots back from a 25-point deficit and forced the first overtime game in super bowl history. he became the first qb in history to win five super bowl

morning. behind me, i put the last couple hours in motion to give you an idea of how isolated and how light these showers are. you don't see any yellows or oranges. they will keep the pavement wet, like it is here in walnut creek at 680, at least during the early morning commute. the more people drive on it, the friction creates heat. the later you leave, it'll be easier. look how warm it is. temperatures are almost near the highs for today, at least average highs. 52 in san leandro. that's the cool spot. pittsburgh, 53, along with healdsbu healdsburg. the high temperatures will climb a little bit. the upper 50s to near 60 degrees. in fact, it'll hold steady. scattered, light showers in the morning commute. hydroplaning possible. this morning, showers and breezes increase. the heavier rain comes in tonight with temperatures in the 50s once again. we'll go hour by hour to see when it gets to your

inhaling liquid nitrogen. an investigation is underway right now. deputies were trying to save a woman in augusta, georgia. the sergeant was 33-year-old greg neeger. firefighters got there after the police department. they found the sergeant and the woman unconscious. we don't know her condition yet. the injured officer has been complaining of difficulty breathing. we'll keep an eye on the story for you. back to you. thank you, jessica. final nail in the coffin for maverick. t bankruptcy filings show the event and promoter more than $2.6 million in combined debt. as we reported last week, the promoter and manager filed for bankruptcy after the event's only sponsor, red bull, sued for bree breach of contract. the one-day annual contest

features two dozen world-class surfers taking on waves up to 60 feet. this was the year women were supposed to take part for the first time. 4:44 now. a man changing his flat tire in san jose is in the hospital this morning as police continue to search for the driver who hit him and just sped off. it happened on interstate 280 year mclaughlin avenue early the driver pulled his disabled van to the side of the lanes and was fixing a tire when hit. he was rushed to the hospital with major leg injuries. officers believe he was hit by a red 2006 to 2013 toyota corolla. >> units responded and found it was a motorist changing the tire on the right shoulder that was struck by a vehicle. >> officers found parts of a front bumper and fender on the road that came from the car they're looking for. it'll have damage to the bumper, fog light. terrifying moments for hikers in southern california after a fall into an icy ravine.

hikers slipped down the frozen mountain. this is video of the rescue attempt from the los angeles county sheriff's department. the hikers were apparently not prepared for the cold weather and the ice. the four hikers who survived are in the hospital this morning. watching san mateo native tom braid dody and the patriots was exciting enough for all bay area fans but not all people were talking about. eric thomas shows us the special moments and politics surrounding the big game also created quite the buzz. >> reporter: at a sports bar in san francisco, there were cheers for the big plays along with moments these fans will never forget. >> president bush, would you please toss the coin. >> reporter: fresh off a hospital stay, the coin flip from former president george h.w. bush and his wife, barbara, delighted the players and their hometown crowd. the commercials set a more serious tone than in years past.

>> announcer: abc 7 storm impact scale. today's storm is level 1. light rain. keep an umbrella handy and drive safely. track the storm on the abc 7 news app. 4:54. this is cool. a south bay school is home to a pair of bald eagles nesting in a few trees on campus. the two eagles are attracting a lot of attention from students, teachers, parents and, of course, bird watchers. one parent tells us he first saw them two weeks ago. the school says it's seen two nest s in separate trees since then. bald eagles are a protected species and attempting to move them is illegal. a federal judge is ordering google to turn over some of its user e-mails stored in servers overseas. the ruling against the company is part of a domestic fraud probe. the judge said because the

e-mails are stored outside the u.s., laws that limit law enforcement's access to them don't apply. in a similar case seven months ago, a judge in new york ruled microsoft didn't have to turn over the e-mails stored in ireland. federal investigators wanted them for a narcotics case. google plans to appeal the decision, saying the case breaks from the precedent set in the microsoft case. melatonin, warm milk, all for catching zs. now, camping. researchers out of the university of colorado say sleeping outdoor it is a great way to reset your internal clock. they believe natural light and dark cycles can quickly and effectually reverse the damage of living life in an artificially lit environment. a lack of sleep can, well, duh, affect their alertness, physical strength, mood and even increase the risk of a heart attack. mike, that's all we need. we need to sleep outside. >> i used to do that on the
