response. >> reporter: dan, actually the trump administration sent the reply down just at about 3:00. we're going to go over that more in the next hour. what we do know is trump's executive order will likely go to trial sometime in the next month to decide whether the travel ban is constitutional. in the meantime, the big question is should the immigration order be suspended or be banned at this time, and that's the question and that's what the ninth circuit court of appeals is working on right now. on friday when james robart, a federal judge in seattle, issued a broad order blocking key parts of president trump's immigration order, he set into motion a chain of judicial decisions for the ninth circuit court of appeals in san francisco. >> and right now the state of washington has made a pretty powerful showing of irreparable harm to lots of people who were affected by this decision. >> reporter: rory little, a law professor at uc hastings, said the trump administration is facing an uphill battle to convince three ninth circuit

judges that they should put a stop to judge robart's decision and allow the travel ban on seven predominantly muslim nations, to continue. on saturday the ninth circuit judges who communicate via e-mail and phone calls from san francisco, phoenix and honolulu, denied the trump administration's original request to vacate the stay. >> then on sunday at 1:00 in the morning actually, the state of washington files an opposition and says here's our reasons why you shouldn't vacate the stay. and then today at 3:00, the government gets to reply basically saying okay, you've read our arguments, you've read their arguments. here's what we have as our final sort of statement. >> reporter: and this is the 15-page reply from the trump administration. it essentially says according to a constitutional expert that we have here who you'll hear from in the next hour that the president has the authority to keep people out of this country and we should basically just trust the government. we're going to have more on

that, though, in the next hour. dan, ama, back to you. >> now that the trump administration's response has been filed, any idea how long it's going to take likely at least for the ninth circuit to make a decision? >> reporter: yeah, we do. we actually just learned that in the last 30 minutes or so. we do know that the three ninth circuit judges have been reviewing briefs from the trump administration and also of course from the judge in seattle for several days now, so they have a pretty good handle on this. we know that tomorrow afternoon around 3:00, they're going to get on a phone conference and do some oral arguments, so we hope to learn more of course by tomorrow evening about what all of this amounts to. >> okay, kate, thanks a lot. silicon valley is also taking a firm stand against the president's immigration ban. 97 companies, including some of silicon valley's biggest like apple, facebook, google and netflix, say president trump's recent executive order is bad for business. we're going to take a closer look at that and what it means coming up on abc 7 news at 5:00.

airbnb says it's taking action to support refugees and others. the san francisco-based company announced a new campaign today that it says will provide short-term housing to more than 100,000 people in need over the next five years. airbnb says the program will start with refugees, disaster relief workers and hopes to help other people over time. two drifters charged in the 2015 murders of a canadian tourist in san francisco and a hiker in fairfax pleaded guilty to first-degree murder today. moreson lamply and lila allgood were both charged in the two deaths. lampley will have 100 years to life in prison. a third defendant agreed to be a witness against the other two in exchange for immunity and a 15-year prison sentence.

a new clue released today about a deadly hit-and-run last week in novato. just a few hours ago the marin county sheriff's office released this digital sketch of the victim. they are asking for your help identifying him. he was killed thursday morning along highway 101 at the atherton on-ramp. the chp is still looking for the driver. investigators did recover the silver nissan versa linked to the collision in hayward. our media partner record they also identified a person of interest but have not made an arrest. if you want to take a closer look of the sketch, we have poiftd on our website, abc7news.com. a historic first for higher education in san francisco. >> the mayor announced the city will be the first in the nation to make college free for all students regardless of their income. >> lyanne melendez is live from city hall. you say a specific group of residents will be picking up the tab? >> reporter: that's right. those who sell their homes valued at $5 million and up will

have to pay more, but think of it this way. you sending your child to public schools and you don't pay tuiti tuition. city hall is arguing that community college students shouldn't have to either. >> city college must be free. >> reporter: months of putting pressure on city hall to commit to making higher education free finally paid off. >> to california residents who are living in san francisco, your community college is now free. >> reporter: san francisco will guarantee nearly $5.4 million a year to city college to pay for the tuition of students who reside in san francisco, regardless of their income. in order to qualify as a resident, a student must live in the city for at least a year and a day. they can either be part-time or full-time students. the money will come from an increase in the real estate transfer tax for commercial and residential properties, valued at more than $5 million. about 30,000 local students are

expected to benefit from the funds. >> making city college free will provide greater opportunities for more san franciscans to enter into the middle class and more san franciscans to stay in the middle class if they currently are. >> reporter: according to the student expense budget for city college, textbooks and supplies represent about $17,000 a year for full-time students. that's not including transportation. some of the money announced today will go to help offset those costs. full-time students who receive financial aid will receive an extra $500. >> price of books, i've got to say it's hard on my wallet, that's for sure. >> if you fund schools and you have a more educated workforce, then the country makes more money off of that. >> reporter: the new funding will go into effect next fall. in san francisco, lyanne melendez, abc 7 news. new today, an effort is under way to change state laws that criminal lies and stigmatize those living with hiv. the laws were passed in the

1980s and '90s. former san francisco supervisor and new state senator scott wehner helped introduce the legislation. opponents say the laws were enacted out of fear and weren't based on actual medical research. >> laws that criminalize as felonies simply having sex, blood and tissue donation, activities that have little or no risk of transmission. >> he says great strides have been made in reducing the hiv infection rates in california. those who have been diagnosed are living healthier and longer lives. the owners of a popular oakland restaurant are blasting a massive fine levied against them by a government agency. they are ordering scott's seafood to pay an $841,000 penalty for recent changes to an outdoor pavilion attached to its jack london square restaurant. the commission says the changes were made without a permit and blocks public access to the bay.

scott's lawyers say the fine is outrageous and claims the largest previous penalty for a nonenvironmental offense was $40,000. the two sides are expected to meet and talk about this next week. itch you used a b.a.r.t. park and ride lot today, you might have noticed a higher parking fee. a 50-cent increase for daily parking kicked in at the concord, north concarried, hayward, and coliseum lots. they are needed for station access and to pay for maengs. west oakland has the highest parking fee, $9 a day. as you know, a very big win for the patriots in the super bowl and for hometown hero, tom brady. but could this be his last super bowl? abc 7 sports anchor mike shumann is up next with the future for the the san mateo native. and remember those drones that lit up the sky? they have a bay area connection. i am going to school. i'm doing everything right but still coming up short.

super bowl will be remembered for the game. >> touchdown! >> reporter: this clutch two-point conversion changed the course of nfl history. >> this is a tie game. >> reporter: just 57 seconds left, as the patriots rallied and never let go. >> what a comeback! >> reporter: and with five super bowl wins under his belt, bill belichick is now the most successful coach in nfl history and quarterback tom brady, the only one to sport five of those super bowl rings. speaking of brady, his jersey went missing after the game. he joked today to look for it on ebay. lana zak, abc news, new york. again, tom brady's fifth super bowl win is the most all-time by a quarterback, passing 49ers great joe montana. so the question is, is brady the greatest to ever play the game? >> let's bring in abc 7 news mike shumann who played with joe on the 49ers first super bowl team. >> oh, boy, this debate will go on as long as we are on this planet, guys, joe versus tom. it's hard to compare players

from different eras. the game has changed so much to the advantage of quarterbacks. brady with his five super bowl titles and four mvps in those games statistically has to be considered one of the greatest. his will to win is surpassed by no one, and you saw just that in yesterday's win. both he and joe were so cool under pressure and the moment was never too big for them. but you give joe montana five wide receivers lining up in a shotgun formation like modern day quarterbacks, he will dissect any defense. brady didn't take the violent hits that joe did either, as the quarterback is more protected now, and tom probably would not have played as long as a result. let's just say they were both the best to play the game in their era. if i'm tom brady at 39 years old, i'd walk away on top, as no one will ever equal his five super bowl titles and four mvps. >> you know, it was just a great way to finish. to celebrate with my teammates and then to see my family, it was just a night i'll never forget. so it's just a great win for our

noted sight go ahead -- sightings in missouri, kansas, and as far as new york. on to the weather forecast, we are in for real rain this week. >> yeah, we've got some special effects coming our way. here's a look at live doppler 7. we've got rain across the bay area right now that's mainly light but there are pockets of more moderate rainfall. bottom line is it's wet and the evening commute could be a slow one but it's probably going to get worse tomorrow. for the remainder of this evening the storm that we have ranks 1 on the storm impact scale. there may be a downpour or two. best chance is between 9:00 and 11:00 p.m. and it will be breezy at times. here's a live view of the golden gate bridge where it appears to be dry right now but that may not last long. these are our forecast features. we'll see a strong storm arriving overnight. periods of rain will continue through friday. we'll have mild, dry pattern into the weekend. the next storm, the one that will develop overnight and be with us tomorrow is a strong

storm ranking 3 on the storm impact scale. highest impacts will be in the north bay and santa cruz mountains. some locations could see up to 3 inches of rainfall. rain heavy tomorrow morning, strong gusty winds likely, flooding, power outages are also likely. let's take a look at the expected impacts. the highest impacts will be across the north bay and down through the santa cruz mountains where some locations could see up to 3 inches of rain or more. we'll see winds gusting to 40 miles per hour or higher, downed trees and power lines, rock slides and mudslides are possible. for virtually that same area or those same areas, a flash flood watch is in effect from 10:00 tonight until 4:00 tomorrow afternoon. ponding on roadways, possible stream and creek flooding, debris flows over the burned areas and there's a wind advisory from 9:00 tonight until 6:00 tomorrow morning. winds generally out of the south at 30 to 60 miles per hour with downed trees and power outages possible. as we get into the late night hours we'll see the rain

intensify and become much more widespread. overnight we'll see heavy downpours across the entire region but especially in the north bay. that's where most of the heavy rain will fall prior to 5:00 a.m. as the morning commute gets under way. later we'll see it spreading to the central part and then to the south bay and santa cruz mountains. then the rain will stall down in the south bay and the santa cruz mountains into the afternoon hours, even as it starts to dry out a bit up in the north bay. so it's going to be a wet and messy day. potential rainfall with this system, 2 to 3 inches in the north bay, 2 to 3 inches in the santa cruz mountains, half an inch to an inch in the south bay. 1 to 2 inches from san francisco and the peninsula over through the east bay. really, really wet for the next couple of days. and in the sierra, a winter storm warning is in effect. that's through 10:00 p.m. tomorrow. we'll see an additional 1 to 2 feet of snow above 6,000 feet. 60 to 80-mile-per-hour wind gusts over the crest. here's the accuweather seven-day forecast.

it's a record-setting day for britain's queen elizabeth. the queen received a royal gun salute to mark her sapphire jubilee. she's now been on the throne 65 years, longer than any other british monarch. royal watchers say the 90-year-old queen is in good health and still fully capable of handling all of her responsibilities. >> we also have the looming visit of president trump and the queen will cope perfectly well with him. she's had to entertain all sorts of very disagreeable figures indeed, in some cases mass murderers, and that she certainly isn't, so she'll handle him pretty well i'm sure. >> buckingham palace kept today's milestone low key. the queen actually spent her day 110 miles from london at her estate in norfolk. >> amazing really. well, the oscars frenzy has

and here are the stories making headlines at 4:30. live doppler 7 is hard at work tracking this next storm that's arrived in the bay area. there's an even more powerful storm on the way. spencer christian will have a look coming up in a few minutes. laura anthony spoke with residents of walnut creek about the rain and she says very few want it to go away. coming up at 6:00, what contra costa county is doing after declaring a local state of today president trump spoke of strong support for nato, the same alliance he criticized during his campaign. he called on member countries to pay their fair share. the president made a visit to the u.s. central command telling u.s. troops he's entirely behind them. meanwhile today, top democrats are working to stop one of his cabinet picks. we're live in washington with

the latest. >> reporter: it was president trump's first trip to centcom as commander in chief. one lawmaker in another country spoke out against him. in his first address to troops, president trump taking on, quote, radical islamic terrorism saying his highest duty is to protect the american people. >> isis is on a campaign of genocide, committing atrocities across the world. radical islamic terrorists are determined to strike our homeland as they did on 9/11, as they did from boston to orlando to san bernardino and all across europe. so today we deliver a message in one very unified voice to these frces of death and destruction. america and its allies will defeat you. >> reporter: but for some of our closest allies, there's opposition to president trump. in the uk, the speaker of the house of commons drew cheers as

he expressed he would not invite trump to give a formal address at westminster hall. >> i feel very strongly that our opposition to racism and to sexism and our support for equality before the law and an independent judiciary are hugely important considerations in the house of commons. >> reporter: the criticism of the president isn't letting up back home. >> i have not called for the impeachment yet. he's doing it himself. >> reporter: and meanwhile, senate democrats have launched a 24-hour talk-a-thon. they're holding the senate floor for a full day all in a last-ditch effort to try to get one more republican to change their mind and vote against betsy devos for secretary of education. one democrat even urged the americans who have called and e-mails their senators asking them to vote no, telling those americans to double down on

their advocacy. live in washington, now back to you. >> all of this is happening as the president's travel ban remains in limbo? >> reporter: absolutely. over the weekend a federal judge halted the travel restriction allowing foreign nationals from those countries to enter the u.s. then an appeals court denied the administration's plea for an emergency ruling that would reinstate that travel ban. and now a panel of three judges are looking into that issue and they are set to hear oral arguments on it starting tomorrow. >> all right, thank you so much for that report. president trump doesn't like the polls he's seeing on his travel ban and is now labeling them as fake news. in a tweet around 4:00 this morning, he wrote any negative polls are fake news, just like the cnn, abc, nbc polls in the election. sorry, people want border security and extreme vetting. last week a cnn/orc poll found 53% of respondents opposed the

president's executive order. an ex-convict who confessed to setting fire to the florida mosque of orlando nightclub shooter omar mateen has been sentenced to 30 years in prison. 32-year-old joseph schneider pleaded no contest to a second-degree arson charge. he told detectives he set the fire, saying muslims were trying to infiltrate our government and believing islam should be illegal. no one was hurt in the fire. the mosque in ft. pierce was sometimes attended by mateen. a syrian refugee is suing facebook for defamation in germany, and it started with this selfie snapped with german chancellor angela merkel. the 18-year-old man says facebook did not do enough to stop fake news articles that labeled him as a terrorist. the selfie went viral and became synonymous with merkel opening the country's doors to refugees. then came the brussels terror attacks. suddenly the photo reappeared in facebook in a post falsely labeling the 18-year-old as one of the attackers.

>> translator: at first i cried as i thought this is not me. i thought immediately what does this mean? what will the future hold? this is really not a joke now. it's serious. >> very serious. he received death threats. the suit claims facebook took too long to respond to a number of requests to take down the false postings. facebook did eventually take the articles down and has apologized. germany is also now considering a law fining social media sites for each fake news report they fail to take down. missouri is about to become the 28th state to ban mandatory union fees. republican governor eric griton signed legislation that makes paying dues optional for employees who work in union represented shops. it will bring business and jobs to the state. opponents say it aims to weaken unions and could lead to lower wages. seven of the eight states that surround missouri already have similar laws. the high cost of tuition is

the high cost of college and the resulting debt is obviously well known but what you might not know is that the cost is leaving more and more students homeless and hungry. >> maggie spoke with one student getting help thanks to a new program in the csu system. >> reporter: besides worrying about grades, internships and how to find a job after college, shelby found herself worrying about where she was going to sleep at night. >> i was battling, trying to, you know, keep up with my studies here and trying to, you know, figure out what are we going to eat and how we're going to pay renting. >> reporter: when the housing crisis hit, shelby's family lost their home. her mom then got sick with a debilitating kidney disease. >> we got to a point where we were staying in the county hospital. we were like going floor to floor to try to sneak around the security. >> reporter: shelby became her mom's full-time caretaker all

while trying to work and go to college. >> i do have a job. i am going to school. i'm doing everything right but still coming up short records the cal state university system started the largest and most comprehensive study in the nation to date, looking at homelessness and its nearly 460,000 students. early findings shows one in ten of their students don't know where they'll sleep that night and nearly one in four don't know where they'll find their next meal. instead of dropping out, shelby reached out and became one of cal state long beach's first students to participate in their comprehensive student emergency intervention program. they helped find her a job and set her up with emergency meals, grants, ongoing counseling and temporary housing. >> all you've got to do is swipe your card. >> reporter: they have also launched a student-run food pantry on campus. >> any student can walk up to the office and say i need a little help. >> reporter: in addition to food donations, things like toil toiletries are also needed. more than 2,000 students have used it and the numbers keep

washington after his first weekend getaway to his florida estate, mar-a-lago, since taking office. but it was his early morning tweeting that has some people wondering whether he's taking issue with some media portrayals of his west wing. karen travers is at the white house. >> reporter: president trump made his first visit to u.s. central command, where he told military leaders that defeating isis and protecting the nation are top priorities. but earlier monday, the president raising eyebrows after lashing out on twitter. mr. trump writing, quote, i call my own shots, largely based on an accumulation of data, and everyone knows it. that sounds similar to when president george w. bush said in 2006 i'm the decider and i decide what is best. president bush was pushing back on calls from retired generals to fire then defense secretary donald rumsfeld over the war in iraq. so what prompted president trump to declare that he's in charge? maybe this "saturday night live"

skit that showed him giving control of the oval office to senior advisor steve bannon, portrayed as the grim reaper. or maybe it was this "time" magazine cover featuring ban on, and the headline "the great manipula manipulator." and president trump also going on offense writing in that same earlier tweet that the media is lying about him in order to marginalize him. karen travers, abc news, the white house. for the second year in a row you'll have three extra days to get your taxes filed. tax deadline day is usually april 15th but this year it falls on a weekend and the next day is a federal holiday, emancipation day. so tuesday, april 18th, is this year's tax day. filing taxes should be a lot like last year with slight changes, like a lower mileage rate and higher personal exemptions and earned income tax credits. if you were looking to get in-person help with an irs help center, you will need to get an appointment. >> maybe they should just
