making news in america this morning, the trump administration is getting set for a day of defending some important decisions. among them, the choice of betsy devos to lead the education department. this as senate democrats have been up all night arguing against her nomination. terror and travel. the president ramping up his fight with the media making accusations about underreporting the threat of terrorism. that's just as his controversial travel ban is considered by a federal appeals court today. we're live in washington. happening now a new round of winter storms for the west coast. another storm is bringing plenty of rain and snow, but this one has sidewalks on fire. and super bowl champs, their fans ready to party in boston today. everyone has tom brady's permission. what more do you need to attend the festivities.

if tom brady says so, do we get the day off in new york as well? >> oh, absolutely, i think so. not so much in atlanta. good tuesday morning to you all. we're going to start with two major events being watched very closely today by the white house. >> well, first up that marathon overnighter still playing out on the floor of the senate right now of capitol hill. democrats mounting a 24-hour talk-a-thon in an effort to get at least one more republican to cross the aisle and vote against betsy devos, president trump's pick for secretary of education. >> and this comes as a decision on the legality of the president's travel ban could come as early as this evening. abc's maggie rulli joins us from washington now with the latest. a lot to keep track of this morning, maggie. >> reporter: it's a lot to keep track of practically every morning, kendis and diane. today is no different. as you mentioned, the trump administration comes out fighting defending their travel ban in court and over in the senate their nomination for

secretary of education. >> we had a wonderful election, didn't w >> reporter: president trump reminding america about his big win as he gears up for a big day today defending some of his first major decisions as president. on his executive action on immigration, the travel ban on refugees and citizens of seven muslim majority countries. >> we need strong programs so that people that love us and want to love our country and will end up loving our country are allowed in. not people that want to destroy us and destroy our country. >> reporter: that ban now put on temporary hold by a federal judge in washington state with attorneys general from 15 other states and the district of columbia now joining in the opposition. but the trump administration has appealed the ruling to the ninth circuit court of appeals which will hear oral arguments today. with the ban in legal limbo travelers from those seven countries are now rushing to the

u.s. reuniting husbands and wives. >> i'm overwhelmed. i can't even explain it. >> reporter: and entire families. >> i am so grateful to everyone that helped in this. >> reporter: as the administration waits for the courts to decide the fate of the travel ban, they're also waiting on the senate to confirm their pick for secretary of education, betsy devos. overnight democrats staging a talk-a-thon against the republican megadonor and school activist from michigan. at least two republicans have pledged to jump party lines and vote against devos. democrats are now trying to convince one more. if that vote in the senate goes as predicted, it'll be a dead heat at 50-50, and vice president mike pence will be the tiebreaking vote assuring her confirmation. kendis and diane, it sounds like another day filled with drama on capitol hill. >> keeping you busy, maggie. better than bored. abc's maggie rulli in washington for us. maggie, thanks. during that first address to troops in florida, the president took aim at one of his favorite

targets, the news media. >> so, the president asserted that the terror threat overseas is growing, and he accused the media of trying to cover up terror attacks. >> you've seen what happened in paris and nice. all over europe it's happening. it's gotten to a point where it's not even being reported and in many cases the very, very dishonest press doesn't want to report it. they have their reasons, and you understand then. >> when pressed for examples, the white house later released a list of 78 terror attacks over the past two years that it says were not adequately covered, however, the list included some extensively covered attacks like the truck attack in nice, france, the san bernardino attack and the orlando nightclub massacre that most networks covered for days, if not weeks. the list also included quite a few attacks that had very deaths or none at all. another one of president trump's cabinet picks now coming

under fresh scrutiny this morning. labor secretary nominee andrew pozner admitted he and his wife employed an undocumented housekeeper for several years. he says when they learned of her status, they immediately ended her employment and offered her assistance in getting legal status. and president trump is facing fresh criticism from britain. the speaker of the house of commons says the president should not be allowed to address parliament despite a petition signed by nearly 2 million britons. prime minister theresa may is defending the decision to invite president trump for a state visit in june. extreme weather on the move this morning. the storm that left seattle and much of washington state covered in snow is on the way out. >> that's good news for the pacific northwest. the bad news is as we take a look at the radar, that snow is being replaced by rain and in some cases high winds, as well. and this was the unusual scene outside of tacoma. that's the pavement on fire. >> yeah, damaged power lines heated up the road surface and it burst into flames. >> but some residents tried to make the best of all the

weather. here's a guy going through the streets of seattle just like any other day only this time on skis. >> probably the quickest way to get through the streets of seattle. >> accuweather's cam tran joins us now with a look at the weather picture. cam. >> good morning, diane and kendis. it will be a very stormy weather pattern out in the west this week. another impulse will be moving through today that will bring some heavy rainfall across central and northern california and we're looking at feet of snow above 8,000 feet in the sierras. now, off to the east a separate storm system will bring some strong thunderstorms from the ohio valley all the way into the deep south and we are looking at the possibility of flash flooding, strong winds as well as some hail and speaking of the deep south and southeast for that matter we're looking at above average temperatures for today. back to you, diane and kendis. >> and, cam, thank you. and boston is expecting temperatures in the upper 30s today as it celebrates the patriots super bowl victory. >> so the team returned from houston taking buses to the home stadium. there they met with some fans and, of course, showed off the lombardi trophy.

the weather forecast for this morning's parade, though, brings rain in addition to the cold that kendis mentioned. the players will be riding on the city's famous amphibious duck boat so they'll be prepared even if there's a lot of rain. >> exactly. the parade starts near the boston marathon finish line which was just repainted for the occasion. officials say the weather may hold down the attendance but the dramatic comeback may actually boost it. >> bostonians are very determined fans, i will say that. >> and they're used to worse weather, so i think it'll be fine. >> the bostonians will come out. still ahead, the tv company accused of spying on your viewing habits. plus, david beckham finds himself involved in a case of blackmail. we have details about his hacked e-mails and demands for hush money. and caught on camera, police officers make a split-second decision to end a standoff with a suspect thought to be armed.

a texas police department is using this video as a way to handle confrontations between police and suspects without gunfire. the suspect appears to be pointing a gun at the officers who had been chasing him, but instead of opening fire, you see there, the officers had a police dog take him down. turns out the suspect was holding a pocket knife and a flashlight. a decision on whether the dakota access pipeline will be completed could come this week. the project has sparked protests across the country. several native american groups and environmental groups say the $3.8 billion pipeline could damage the water supply and sacred lands, but supporters say it's needed to transport oil safely and would create jobs. and we now have confirmation that david beckham was the victim of a blackmail plot.

his public relations agency confirms a hacker obtained e-mails between him and his publicity agent and demanded more than a million dollars to keep them secret. the e-mails suggested he was using his charity work as part of a campaign for knighthood but the agency's affiliate in portugal refused to pay and the messages were published. it is believed the person comes from eastern europe. vizio is paying $2.2 million to settle charges of spying on customers' viewing habits. regulators say the company collected the data without concept and then sold it third parties specializing in targeting advertising. as part of the settlement, vizio neither confirmed nor denied any wrongdoing. the company must also delete all of the data that it collected. uber is taking another step to helping passengers literally fly to their destinations. it has hired a nasa engineer who published a proposal on flying cars. the company hopes to one day

it changes to snow, and there's a huge band of flooding from louisiana up to wisconsin and all the way east. if you're flying expect some airport delays in san francisco, memphis, minneapolis, chicago, detroit and boston. a lot of delays today. >> just take the train or drive apparently. now though to the desperate hunt for two suspects in a deadly multistate crime spree and police say the pair is armed and considered dangerous. >> investigators are also warning that the public should watch out because, quote, a killer is in our midst. authorities in florida are escalating the search for a murder suspect william boyette and mary craig rice after an alleged crime spree left three women dead and one critically injured. >> what we are experiencing is a running nightmare. >> reporter: it all started last tuesday when 30-year-old alicia greer and 39-year-old jacqueline jeanette moore were found murdered in a hotel in milton, florida. greer, a mother of three, was in an abusive relationship with boyette according to her father.

>> he choked her down to the ground, kicked her in the face. >> reporter: police say the pair struck again friday morning in lillian, alabama, where they allegedly murdered 52-year-old peggy broz in her front yard then drove off in her car. in their latest, kayla crocker from pensacola was left in critical condition. her 2-year-old left uninjured. a news conference is scheduled for later this morning. boyette has reportedly told several people that he will not be taken alive. a suspect is being held in a quadruple murder in mississippi. it happened near jackson, mississippi, authorities say 27-year-old brydell barber is suspected in five killings free on bond for a murder last march. detectives say monday's shooting took place after a nightclub argue. barber could face the death penalty in convicted. a british teen is being sentenced after admitting he killed a florida woman in london last summer and pleaded guilty to manslaughter.

prosecutors say the 19-year-old was in the midst of a schizophrenic episode when he stabbed six people in august. 64-year-old darlene horton of tallahassee was killed. a health alert this morning. adult immunizations lag far behind those for children. the reasons include confusing guidelines, a lack of emphasis and poor health coverage. now there are new guidelines from the centers for disease control for hepatitis, influenza and hpv vaccines and recommend injections for the flu vaccine, not the nasal mist. now to an unusual sight near salt lake city, utah. its state 80 shut down for about an hour late in the morning so a herd of elk could be relocated. >> now, they had taken up residence between the eastbound and westbound lanes but that posed a threat to them and to motorists. >> the median is a little sizable, and there's scrub oak and grass and felt comfortable like a sanctuary but we needed for public safety reasons we wanted them off of here. >> nine animals including a moose were herded off the median, but there may still be

we've got south central napa county under a flood warning. redwood creek out mt. vetoer road is flooding right now. southeastern sonoma county, mark west creek and coal gan creek and east central sonoma county until 6:00. so, a lot of flooding going on right now. alexis? yeah and of course that's going to translite to a pretty tough commute. we have several incidents on the boards. taking a look at the richmond-san rafael bridge on the richmond side, this is one of several bridges with a high wind advisory this morning. that along with the san mateo bridge and the bridge agolden g bridge. bay bridge has not been issued a high wind advisory but it was very gusty this morning, so basically, any bridge you're heading across, we could definitely see some gusty winds

here for the morningmute. quick check of our traffic maps. we have three crashes working right now. westbound 80 through the vacaville area, and leisuretown highway so just gives you an idea of the kind of commute that we are starting with. we'll talk about that flooding coming up. and one of the areas we are closely watching this morning, the santa cruz mountains. >> the storm has only just begun and we are already seeing dangerous conditions. abc7 news recorder matt keller is there live. kmat t? >> reporter: good morning, natasha and reggie. the rain had lightened up but the winds are gusty so that rain is going sideways. i want to show you the headlights here. you can see how that wind is pushing the rain in one direction here and we have that wind advisory, wind gusts 40 to 50 miles per hour, it's going to make it very dangerous out there on the roads. here's some advice from chp. >> keep your eyes open, go slowly, have alternate routes planned because if some of those things do happen, great potential
