many of the evacuees from various towns have headed to shelters in places like colusa and chico, anywhere that's out of the way. >> my daughter wanted me to get a place to stay for maybe three to four days until they work this out to see if it's going to work. >> reporter: all of them well aware that there's another round of rain headed their way. >> i wouldn't say that everything's going to be fine. because you know, we know a storm's coming. we don't know how big it is. >> i don't think we're out of the woods for a while yet. the weather has been phenomenal. thank goodness we didn't have full reservoirs to begin with. we are getting a unique perspective now on the situation in oroville this morning. look, chp releasing this video that shows what the dam looks like at night using night vision. a flight crew says the infrared cameras help them see the dam and spillways more clearly. the agency has three helicopters and two airplanes currently

patrolling at oroville. and of course the question on so many minds this morning, how did this crisis get this bad despite the warning signs? >> jessica digging into details of a federal investigation. >> yes, everyone wondering how this crisis could have happened and that is what the review will now tackle. it is being ordered by the federal energy regulatory commission. it's the same agency that rejected the idea of reinforcing the emergency spillway back in 2005. when critics suggested it could fail. at least five experts, we'll take a look at damage, give recommendations as well, but listen to this. because of that controversial history, there will also be forensic analysis done by a third party and that generally is a branch of forensics that looks into whether any fraud was committed or manipulation of data. back to you. a closer look now at the dam

from the center of the mess. the oroville dam, 770 feet tall, beating the hoover dam by almost 50 feet. lake oroville has a capacity of more than 3.5 million acre feet. that's enough water for about 6 million california families for one year. it is the second largest reservoir in the state, shasta is the biggest. this weekend marked the first time the emergency spillway had ever been used. abc7 news was in downtown oroville last night, which for the most part looks like a ghost town. only a few businesses remain open. local police are among the few cars on the road checking to make sure that looters don't move in while thousands of residents are away. many business owners doing what they can to protect their livelihood before being evacuated. scenes like this are pretty common in oroville and many other threatened communities. you see store fronts lined with sandbags. the county has set up several sandbag locations. we are staying on top of the dam crisis and sending out updates as they happen on our abc7 news app. you can download it for free.

make sure you enable push alerts to get the updates as the they happen. president trump's new security adviser, michael flynn, is out. he resigned after growing concerns over his communication with russia and for misleading the vice president. abc news reporter stephanie ramos has the latest in this stunning shake-up. >> reporter: natasha, there is drama coming out of the white house. i one day, general michael flynn received support from the white house. then it was said that the president was evaluating his situation and then comes flynn's resignation over a possible breach of the law. general michael flynn was one of the first to endorse president donald trump. he was one of the president's first appointments after the election. but now, the national security adviser is the first to go, less than a month on the job. he faced mounting questions over a phone call he had with the russian ambassador, discussing u.s. sanctions placed on russia by the obama administration for

suspected meddling in the 2016 election. before trump even took office. flynn said he didn't. vice president mike pence then said the same. >> what i can confirm, having spoken to him about it, is that those conversations that happened to occur around the time that the united states took action to expel diplomats had nothing whatsoever to do with those sanctions. >> reporter: but multiple sources tell abc news the topic of sanctions did come up and the fbi and the department of justice acting attorney general sally yates who was fired for trying to block trump's immigration order, sents a warning to the white house, krnld that a high level official count in a public lie could be subject to blackmail. despite calls for his firing from democrats, trump's councillor, kelleyanne conway showed white house support for flynn. >> general flynn does enjoy the full confidence of the president. >> reporter: hours later, flynn was out, in his letter writing,

unfortunately, because of the fast pace of event, i inadvertently briefed the vice president elect and others with incomplete information regarding my phone calls with the russian ambassador. in that letter, flynn also says he apologized to the president and vice president. now, among those being considered to replace flynn are retired general david petraeus and also retired admiral robert harward. back to you, reggie and natasha. the president has named keith kellogg as acting national security adviser and kellogg does have ties to the bay area. he earned his bachelors at santa clara university. he worked for defense companies, including oracle. a fremont b.a.r.t. station is not even open yet, no trains, no passengers, but it has plenty of staff. >> we're talking about full-tie staffers. several employees there, including two janitors, cleaning an empty station. abc7 news reporter matt keller live for us at the warm springs

b.a.r.t. station. >> reporter: good morning. the lights are on and there are actually people home here at the warm springs b.a.r.t. station but no passengers and no trains. we saw a few workers walking around here about a half hour ago. according to "the chronicle," b.a.r.t. has been staffing the warm springs station full-time with eight workers even though no trains will be running for at least two months. the warm springs extension project is a 5.4-mile b.a.r.t. extension. b.a.r.t.'s website says only a small amount of relatively minor work remains to be complete. but why staff it with someone here every weekday from 4:00 a.m. to midnight and a little bit shorter hours on the weekends? "the chronicle" quotes b.a.r.t. officials as saying the union contract allows employees to sign up twice a year in january and august and officials put the warm springs station on the august list thinking it might have opened before now, but it didn't. this is what they're paying their employees here.

the five station agents see more than $73,000 a year and the dispatch supervisor salary is more than $89,000 a year. they have two janitors on their staff here and sometimes they go to other stations to clean up there. b.a.r.t. says more testing needs to be done here before they open. the warm springs b.a.r.t. station. reporting live in fremont, matt keller, abc7 news. san leandro police are asking for the public's help in tracking down the driver who shot and killed another driver. you can see the map. police found the victim in the parking lot of kaiser hospital where his wife had driven him to. she tells detectives that her husband go into an argument with another driver. that person opened fire as both cars traveled down the street. >> the woman who's identifying herself as his wife slid over in the -- up against the driver, the victim himself and actually operated the vehicle. >> she drove the kaiser and staff found her screaming for

i'm tracking a story at the live desk this morning, a deadly crash on 580. and it looks like at this point the victim was walking on the freeway. i was trying to get my video up here for you, but i think it might take a little bit of work there, so i'm going to get back to that story for you in just a moment. there is an investigation underway right now by california highway patrol. happened in pleasanton overnight. send things back to you. one person dead and investigation underway. the freeway, though, in pleasanton, 580, back open. crossing the santa cruz mountains, getting more difficult by the minute now. mudslides have reduced traffic on highway 17 to just one lane in either direction and now there's a new sinkhole has forced the closure of the main alternative to highway 17. it's closed indefinitely.

abc7 news reporter katie marzullo has more on the headache it's causing for commuters. >> it's sinking and it's not a good situation for us right now. >> reporter: this is a new sinkhole caused by a historic landslide. the road is closed but is signs are not enough to stop some drivers. the road is a primary alternative to highway 17. >> it's a major crisis to have that road closed. along with 17 down to two lanes and along with bear creek so we are definitely suffering this year. >> reporter: greg took these photos. public works says geologists have examined the area and it will not be a quick fix. >> we're asking for forgiveness right up front. >> reporter: highway 17 is at the heart of the problem, a mudslide near vine hill road has closed the northbound lanes. repairs are on hold following the death of a worker last week. another big problem in the santa cruz mountains. highway 35 is closed because of a massive washout. drivers are using black road to get around it. so are looky loos trying to see the gaping hole.

people who live there say the road cannot handle it. >> you combine that extra traffic with the roadbed where there's some major cracks and we're very concerned. >> reporter: authorities don't know when these roads will open again. 4:45 now and happening today, a move to prohibit the sale of dogs and cats in san francisco that are not from animal rescue organizations. the san francisco board of supervisors plans to vote on legislation to amend the current health code. proponents say the mills promote large-scale breeding and produce unhealthy pets. the legislation also prohibits the sale of dogs and cats who are under 8 weeks old. this is my favorite story of the day. happening today, a chance for single people to release their frustration about valentine's day. hundreds of lonely hearts once again expected to pack san francisco's justin herman plaza around 6:00 p.m. for a massive pillow fight. do not do what that lady just did. they don't want you to bring pillows that have feathers in

dublin to mission bouleva south, about 14. also until the green at 16 minutes. if you're starting on 205 in tracy, there's a collision. i'll talk about that just before 5:00. san francisco sinking millennium tower is now the target of more lawsuits. the latest come from a group of nine homeowners. the suit goes after millennial partners for allegedly withholding information on the risk of the building sinking. they claim the developer was aware that the structure has sunk and didn't let prospective buyers know that. it acauses the transbay partners authority of making it worse because they're constructing the sales force tower next door. another attempt to demolish a shuttered ice skating rink. shut down nearly four years ago now. san francisco-based spi holdings bought the land with the condition to keep the rink or turn it into a similar spot.

destroyed nine cars in a parking garage. it started late yesterday afternoon. the fire caused about $180,000 in damage to the cars in the structure. seven park employees were treated for smoke inhalation and hundreds of visitors and employees were just stuck outside the parking lot, unable to reach their cars for two hours. investigators still trying to figure out how the fire started. they do not think it was arson. disney, of course, is the parent company of abc7. construction is going on at zuckerberg san francisco general hospital despite the opening of the new medical center. abc7 news was at sf general as mayor ed lee signed an agreement to build a new research medical building. officials say it will attract top doctors who are researching obesity and researching diseases like aids and tuberculosis. >> we've done a lot of work in hiv and aids to transform it from a death sentence to a treatable disease, and we're -- we have efforts now to work on
