clearing homes and allowing more people back in. today the city sent 1300 homes remain restricted and the williams park neighborhood three homes were red tagged because of structural damage. they will need to be fixed or rebuilt. san jose's mayor says he'll ask for a public meeting to discuss the city's response admitting that a clear failure led to the flooding and delay in evacuations. >> we're very focused on recovery this weekend. next week we're going to turn to focus on how we fix this going forward. >> the last two days volunteers have helped clear streets and homes but there's much more work that needs to be done. abc 7 news reporter has more on the damage that remains tonight in san jose. >> reporter: this is the first day many residents in the rock springs neighborhood were able to get into their homes since the flood. >> a big mess. >> reporter: this man and his neighbors are shocked by the

destruction by the coyote creek flood waters. saying they've been told to pull out the water damaged items from inside their homes. but he asked what happened to all of the chemicals they've been warned about that were in the flood waters, and his neighbors are wondering who is going to help pay for everything they lost >> my neighbor's car is all messed up. the city is talking about coming tomorrow. >> i think we should have had some kind of warning, you know, a day before, just to let people know you got to get your stuff. you got to get your family. get out of the house. >> reporter: some residents are lucky they live on the floor. wan phan's apartment escaped the floored. >> we don't know when we're going to come back here until the city turn on the electrical or water or gas, whatever. >> reporter: these residents are trying to absorb the scale of

creek. inside the car, a 67-year-old woman managed to stay above water in the back seat with her dog for eight hours. >> she was relieved and calm. >> reporter: these men are part of a newly trained water rescue team. they used this equipment for the first time in a real-life situation. >> if we were to head to the far side of the creek there was a lot less current and it got shallower and shallower. >> reporter: the car landed on its wheels and the rock kept it from moving. those circumstances worked in the driver's favor. >> she didn't get out of the vehicle which is a major play. the water is moving pretty quick. probably would have swept her away. >> reporter: the woman was suffering from hypothermia. >> we just got done with our training and this happened. it's meant to happen. >> an awesome feeling, definitely. >> makes you feel good.

as congress mom jackie speer held a town hall meeting today. more than 1400 people signed up to attend. they are concerned about what will happen to their health insurance. >> people around the country are speaking up to how to affordable care act has saved their lives. it's not going away. it can be improved and we'll resist efforts by the republicans to try to undermine it. >> this was her sixth town hall in response to the election of donald trump as president. in the north bay, 2,000 people packed into an auditorium to ask questions abts shared concerns about the future of their health care. pat boyle attended and shared this video with us. mike thompson and mike mcgwire hosted the event. congressman thompson said he'll take the stories he heard today back to washington.

>> we looking at a long game. i think everything is going to work out fine. >> abc news, washington. eight students are facing charges after a classmate was killed after what police say was a prank gone wrong. the 19-year-old fell asleep at the braj door of a fire house after a night of drinking. firefighters were responding to a false alarm about a stolen fire extinguisher when their suv ran her over. the two students who stole the fire extinguisher has a prank have been charged along with six other students, all young men, accused of giving the victim alcohol. experts do not believe that anyone will go to jail. >> start sending a message, holding people accountable and recognize when you give someone alcohol it can lead to deadly consequences. >> a witness told police that she showed up to the party with a water bottle filled with wine. her blood alcohol level was more
