police spoke with leslie brinkley. >> and she is there live. police say this started with an argument between a man and a woman? >> reporter: that's exactly right. a heated argument, they said, between a man and a woman in their early 40s. it started in an office building just adjacent to me here. let's take a look at our sky 7 video. from that you can see at 400 penobscot that the man showed up. there's a black pickup truck believed to be involved. the woman apparently had a restraining order against him. as that argument escalated, someone called the police. the man started chasing the woman with a gun in his hand and he fired it once as he ran after her about two blocks through one parking lot, across the street, into another office park parking lot on saginaw. that's where police cornered him. the man was waving a firearm, police told me, pointing it at himself. simultaneously the man fired one shot as the police fired one

shot. police told me just a short while ago they believe he died of a self-inflicted gunshot wound but they're still unsure if he was struck or not by that second bullet fired by the officer. there are two immense crime scenes out here. we're on the east side of 101 towards the bay. more than 15 police cars here, several office buildings on lockdown for a short while. during that time period where the man was chasing the woman and was cornered by the police. no one is in danger now. we're told the woman involved in this incident is okay and was uninjured. the d.a.'s office is here investigating, they're waiting for the coroner's office to show up. many more questions yet to be answered and we are expecting in about ten minutes for the deputy chief to be out here giving us more information and an update on how this all evolved. reporting live, i'm leslie brinkley, abc 7 news. >> all right, thank you. now to the east bay where police are investigating a

bizarre crime. it ended with an arrest at a chase bank at 1st street and mt. diablo boulevard. >> laura anthony has been piecing it altogether. he's live now in lafayette with the story. laura? >> reporter: hi. well, we are awaiting confirmation from contra costa sheriffs, but we have been able to put together at least part of the scenario based on information we have gathered here in lafayette. an apparent kidnapping and attempted extortion here at the chase bank in lafayette. it ended when police surrounded a car here in the parking lot just about 2:00 this afternoon. now, some of the details we're learning are from the website news 24 680, they are reporting that a resident of lafayette was kidnapped from his home on sweet drive, that's about a mile from here, and driven here by the suspect to this bank, chase bank, ordered to go in and withdraw money. at that point with the suspect

still inside the victim's white subaru, outside the police were called. a witness who works at a business next door told us this is what she saw when she went out on her lunch break. >> i was going to my car. it was just a couple of cars, you know, down to my car. there was a guy sitting in there. after i sat in my car, i saw the police car came and he was point the gun at him. >> as for a gun, according to the witness, the police were calling for the suspect to drop a gun or show a gun. at this point we are waiting to hear from contra costa sheriffs about whether that suspect actually had a gun. we understand one might have been stolen from the home in lafayette, but it may have been left behind there. again, the suspect is under arrest. the victim we understand is safe, may have been treated for a cut. and again waiting for more details from local sheriffs.

live in lafayette, laura anthony, abc 7 news. >> all right, laura, thanks very much. a man riding a bicycle died this afternoon after a crash in san jose. sky 7 was above the scene as officers investigated. around 3:00 this afternoon a car collided with the bike at lee avenue and coit drive, not far from dover park. the driver of the car stopped nearby. investigators are now working to determine exactly what led up to this tragic accident. switching gears now to the weather, things are going to get pretty messy in a couple of hours. you couldn't tell looking at this, right? the rain will be a lot stronger than it was when it came down in san francisco's financial district this morning. abc 7 meteorologist sandhya patel is here with more. >> we are tracking a 2 on our storm impact scale. take a look at live doppler 7. as you mentioned, we're sort of in a lull right now. the only place i can find an isolated shower is right around hopland. as we take you into street level radar, mountain house road, you take a look at the rainfall totals the last 24 hours. we got over an inch in san

francisco, san rafael, napa. you will notice san jose, about a third of an inch, same thing with livermore and oakland got 0.68 of an inch. we'll be adding to that. on our storm impact scale, the next one coming through is a 2. moderate to heavy rain expected making for a messy morning commute. thunder and hail not out of the question. the hour-by-hour look, 11:00 tonight the rain begins in the north bay and it spreads during the wee hours of the morning. it will get heavier at times between 4:00 and 5:00 a.m. that's not the only storm i'm tracking. i have another one behind it. i'll be back with a closer look in the accuweather seven-day forecast. dan? >> thanks very much. prosecutors say power and the abuse of power by these three deputies are at the center of a murder investigation. today was the first day of the trial for these guards. they are accused of fatally beating michael tyree, an inmate in the santa clara county jail. vic lee is live at the courthouse tonight with the story.

vic? >> reporter: well, dan, all three defendants have already pleaded not guilty. each on $1.5 million bail. today the prosecution and the defense gave and finished their opening statements. prosecutors open statement, michael tyree was beaten to death. the three sheriff's correctional guards sat impasse i'vely listening. braker said power and abuse of power is what this case is all about. several jurors winced when they showed a photo of the bruised, naked body. he displaced text messages sent by ferris which was disdainful of inmates and said the guards enjoyed watching them suffer. the only lawyer who spoke on camera afterwards called the texts meaningless, bravado, in a macho jail culture.

he echoed what his co-counsel said. >> it is not a homicide case. it's either an accidental case or a suicide. >> reporter: but the prosecutor said that after the autopsy, death was caused by blunt force trauma. the medical examiner ruled it a homicide. the defense told jurors sheriff's investigators did a sloppy job in reviewing tyree's death and the defense would use evidence they gathered to prove he was still alive after the three deputies left his cell that night. listen to the science, attorney judith odbert said, not to the prosecution's happened picked witnesses. many of the prosecutor's witnesses will be inmates who lived in the same cell block. >> witnesses, because they're all convicted felons, some of them have been convicted for murder, some attempted murder. >> reporter: the defense believes this is what caused tyree's death. >> the cause of death happened as a result of him standing on the toilet and falling off and slipping and the skid marks actually on the toilet seat from his feet. >> reporter: defense attorneys

also say tyree was fully dressed when deputies left his cell but naked when they found him dead. vic lee, abc 7 news. a 13-year-old santa rosa boy killed by a sheriff's deputy will have a park named after him. sonoma county supervisors today awarded a $3 million contract for a park to be built in memory of andy lopez. he was carrying an air soft rifle resembling an assault rifle when he was shot seven times in october, 2013. the four-acre park will include a teen zone, skateboarding spot and a community garden. a bizarre incident on a san francisco bus. a man set a woman's hair on fire on the 9 san bruno. it happened last night about 8:00 as the bus was reaching 8th and market street. the woman's friend put the fire out. she's okay. the man was arrested. very strange, obviously. a phony e-mail duped tech employees on the peninsula into giving out personal tax information. someone posing as the company's ceo conned employees at coupa's

breaking news in redwood city. there's a news conference under way. >> this is deputy chief gary kirby. >> when police were initially called around 2:20, it took us about three and a half, four minutes to get here on scene in the 200 block of penobscot. officers made contact with her. they came in with their sirens so she could hear they were responding. because she was mobile, it took a little time to find her. when they did, they secured her. the suspect then took off running away from the police. the police pursued him. knowing the pertinent facts that, one, he had a restraining order against him for domestic violence and, two, that he had weapons registered to him. so with those two facts in mind and the visual presence of the weapon, the on-scene sergeant set up a very extended perimeter, called for a rifleman to take a position of advantage so he could secure the rest of his officers.

they started to talk to him as he stopped for a short period of time, tried to negotiate his surrender. unfortunately, there was an exchange of gunfire. one of our officers fired one round and we believe that he discharged a round at himself into his face. with that, that ended the confrontation. medical was called in. the fire department pronounced him deceased on scene. the coroner will be taking the investigation along with the district attorney of san mateo county. we have an officer-involved shooting protocol that takes the investigation from here away from the agency that's involved in the shooting. and they will be providing additional information from that point. the additional things that we know about this incident that you might not know about initially right now is we have had a decent standing with this individual over the last -- this last month. so, for example, our first contact with the suspect came

around march 9th of a very what we call a low level domestic violence dispute where the individual was taken into custody for a nondomestic violence related incident. on march 10th we had another incident involving the two parties involved in this incident. the wife and her ex-husband, where the ex-husband is believed to have broken into her house and caused a ruckus with her present. that prompted the officers to provide an emergency restraining order for her protection that's good for seven days. at that time the officers confiscated all the weapons in the house that were registered to him and took them in for safe keeping, a normal domestic violence protocol. because it was a violation of a restraining order on march 14th where the suspect again confronted her, she went and sought an extension of that emergency protective restraining order through the courts which were granted on the 15th. her emergency protective restraining order was going to expire on the 17th. >> you're listening to deputy

chief gary kirby of the redwood city police department describing that incident today in which a man ended up shot and killed. it was apparently a domestic dispute and a chase that went down the street. one man left dead in the street as a result of that. we'll continue to follow the story and have more for you at 6:00. meantime, president trump's new travel ban may be on hold, but it's forcing many countries -- many from the countries targeted to rethink their travel plans. >> it's having a big impact on the persian community during what is supposed to be a festive time. >> abc 7 news carolyn tyler reports. >> reporter: this san ramon ice cream company is filling orders for its exotic flavors, desserts that will sweeten the 14-day celebration of the persian new year. >> by itself it means a new day. >> reporter: and this time it's especially meaningful for this

this company. they are celebrating 70 years and big festivities had been planned to honor her late father, the founder of the business. >> unfortunately, he's not with us anymore, but we promise that with or without him we will have a family reunion. >> reporter: but president trump's travel ban has changed all that. iran is one of six nations targeted, and now an older sister and brother are stuck in tehran. they aren't alone and it's not just noruz according to a lawyer with four iranian american groups fighting the travel ban. >> weddings being disrupted, i heard a story of a father that was not able to come to the united states to attend his own son's funeral. i mean how devastating is that. >> reporter: the organizations have filed suit over what they call travel ban 2.0. >> it's discrimination both on status tore grounds and unconstitutional grounds. >> reporter: in the meantime

they will still celebrate the new year, but it won't be as sweet as their ice cream. >> happy noruz. >> reporter: in san ramon, carolyn tyler, abc 7 news. san francisco is making a preemptive move on a proposed muslim registry. this morning mayor ed lee signed an ordinance into law that prohibits the city from participating in any type of registry based on religion or ethnicity. during the campaign president trump vowed to establish a registry for muslims in the united states. none has been created. san francisco is said to be the first city in the nation to enact such an ordinance. abc 7 news was in san francisco's financial district as supervisor hillary ronan introduced a measure that makes companies choose between building the border wall and doing business with the city. the proposal bans companies that bid on the wall from contractoring with san francisco. let's move to consumer news about cars. newer models mean newer features but some are not safe.

>> michael finney is here to tell us about that. >> it's amazing. car shifters used to be intuitive and easy to use, but now many car makers are adding style and design elements to their interiors. they might look better, but consumer reports says these new shifters can be confusing and even potentially dangerous. for decades cars with automatic transmissions had a simple straightforward shifter like this one, but some newer cars have shifters that look or function differently. the new designs can set their model apart or offer a touch of luxury. consumer reports warns those new designs can be complicated and even counterintuitive. >> the problem with these unconventional gear slerkelectos they make it hard to consistently pick the correct gear, especially park. in the worst case that means the car could roll away. >> i'm in a mercedes benz glc.

the shifter, no matter what position you're in, it always returns to the center and makes it hard to see what gear you're in. putting it into park is a small button at the end which is blocked by the steering wheel. >> another problem, since it's not immediately obvious whether the transmissions are in gear, neutral or park, on some models it's possible for the car to roll after the driver gets out. some manufacturers have built-in safeguards. ford, lincoln, acura, honda and gm all automatically return to park if the door opens with the engine on or if the engine is shut off in gear to prevent those rollaways. consumer reports believes so strongly that these confusing shifters can be dangerous, it now deducts points for cars that don't have built-in fail safes that prevent rollaway accidents. now, so far consumer reports ratings, more than 50 cars have had points deducted from their scores due to confusing shifters. models from mercedes benz,

chrysler and lexus, ct200 have dropped their ratings enough to lose their recommendations. now, if you already own a car with one of these shifters, consumer reports recommends you always double check when it's in park and use the emergency brake any time you're going to step out of the car. >> sometimes old fashioned is best, michael. >> there you go. well, cell phones will soon work as atm cards at wells fargo cash machines. the san francisco-based bank says it plans to upgrade all 13,000 of the atms next week. >> customers will get an eight-dijeight eight-digit code from their smartphone app which they enter along with their pin number. atm cards will also continue to work. hi there, everyone. let's check out live doppler 7 right now. we're still tracking a few light showers right around the north bay. this is taking you to street level radar. annapolis road, this is really going to intensify as we head into tomorrow morning's commute. seeing some intense thunderstorms across the central

valley and some thundersnow heading into the sierra nevada where chains are required right now on 50, 4 and 88. so it is snowing but it is raining at lake level in tahoe. winter weather advisory for the higher elevations, about 6500 feet until 6:00 tomorrow night. we're looking at up to a foot along the crest, 4 to 8 inches above 6500 feet. so do expect more chain controls and travel delays. a live look from our lake tahoe camera. a look at those temperatures there in the low to mid-60s just about everywhere. half moon bay, 59 degrees. a few puffy clouds as we look across the bay. 61 in santa rosa, 65 in livermore. a little breezy outside as well, as you notice from our sutro tower camera as you see those cumulus clouds there. brief downpours expected tomorrow morning during the commute. thunder and hail is possible and another moderate storm is coming our way friday. the system for late tonight into tomorrow morning is a 2. it's moderate in strength.

it will bring us heavy rain at times, messy for your morning commute. do expect the potential for smallunderstorms develop. hour-by-hour forecast, 11:00 tonight you see moderate to heavy rain. 3:00 a.m., you might be woken up by the pitter patter of the raindrops because it is going to be coming down and it will be gusty over some of the higher elevations. 5:00 a.m., you're noticing downpours. 6:00 a.m. this continues in the east bay, the south bay. by 8:00 a.m. the rain is easing as you're taking the kids to school or going off to work. 9:00 a.m., this might be better as the rain continues to ease up. scattered showers for your afternoon hours and it winds down pretty quickly. but this isn't the only system. we have another one behind it that is due in on friday. here's a look at the rain totals for this incoming storm. anywhere from 0.2 of an inch for most of you to just over an inch of rain. tomorrow morning when you get going, do not leave home without your rain gear. allow that extra time, that morning commute may be a rough one, especially with heavy rain

this is wild. for the first time nasa has images of a landslide taking place on a comet. it captured the moment in july fwichbt when a 230-foot cliff

collapsed on a comet 67 p orbiting jupiter. it sent a large plume of dust into space. it gave scientists a peek into the subsurface of a comet. they believe seasonal changes on the comet may have triggered this collapse. it's now official, a threatened species of bumblebees is on the endangered species list for the first time in the continental u.s. the u.s. fish and wildlife service declared the rusty patch bumplbee as endangered today. they used to live across 28 states and now it's down to 13. they were supposed to be declared in danger last month but an executive order from president trump on new regulations delayed it and environmental groups sued to end that delay. oh, are you laughing? you're hearing what researchers call an infectious laugh. scientists believe parrots in
