fairfax police open the investigation into richard williams after a 16-year-old boy told his parents that williams offered him and his friends money and food to wash cars. williams made sexually suggestive statements. a 56-year-old got sick last month after drinking a toxic tea leaf blend. they're filing a wrongful death lawsuit against the company in chinatown. they're trying to trace the source of the tea leaves that contain the plant based toxin. new at 11:00, abc 7 news has learned work to repair the seismically anderson dam in morgan hill won't start for another three years. >> that has nearby neighbors very concerned. katie march zulle low has the story from morgan hill.

>> under the original plan, to retrofit the dam, construction would have begun in 2018, the dam needs more work, which will take more time. that doesn't sit well with residents who live in harm's way. >> joanne bebe lives in san martine, she got an e-mail from the city of morgan hill, about the safety of anderson dam. >> in the event of a major earthquake, i would have 40 minutes to run for it. the water would be about 15 feet high. >> joanne was one of 200 people that gathered at the morgan hill community center to get an update to retrofit the dam. new studies show more problems with the dam than originally thought. >> we were ready to go, we had the permits and we were ready to go. >> the deputy operating officer says now they need new permits, construction won't begin until 2020. >> it's two more years, we have to realize that the dam has been

this is a look from our camera earlier at the backup it was causing. several other cars were hit, the chp was advising drivers to use 280 south. a 73-year-old woman is recovering tonight after being beaten unconscious on a bart train this morning. >> it happened while the woman was riding the train. as abc 7 news reporter katie udis explains, it's one of two investigations tonight. >> people could hardly believe the details of a beating that left a bart rider unconscious. >> it's shocking somebody was attacked many it's a good thing they caught him right away. >> the attack happened between the san leandro and coliseum stations around 4:30 this morning. >> regardless of whether it's a bart station or a woman walking down the street.
